Regulating Public Fundraising in China: The Charity Law and Its Predecessor

Abstract The promulgation of Chinese Charity Law in March 2016 was expected to break the long-term monopoly of governmental charities in public fundraising in China. However, governments’ regulating practices on fundraising seem to be still quite ambivalent during the post-legislation era, indicating endogenous contradictions of the Charity Law. In order to explore the legislative logic of Chinese Charity Law on public fundraising regulation, this paper, employing an analytical framework of state-society relations, historically examines all relevant laws and policies of China that deal with the fundraising regulation issue since the reform and opening-up. It is revealed that a “control thinking” of the Chinese state towards civic fundraising has been dominating the field all the way, and that the recent loosening of state control was compelled by bottom-up social dynamics. The paper argues that, under the constant influence of state control thinking, the institutional adjustments of Chinese Charity Law on opening spaces for civic fundraising tend to be quite passive and endogenously contradictory, leading to both validity and limitations of the law in practice.

Since the reform and opening up, Chinese economy has developed rapidly. Industrial and civil construction projects have made significant progress. That said, it is of great significance to further strengthen the construction management of industrial and civil construction projects for the long-term development of construction industry in China. In terms of reality, one of the common problems in the current industrial and civil construction is wall cracks, which will have an important impact on the appearance of the building and the overall construction quality. Therefore, it is necessary to analyze the reasons and put forward corresponding measures on it. That is how we can continuously improve the construction quality in civil and industrial construction projects, thereby achieving the enhancement of building safety and stability.

From both theoretical and practical points of view, the contemporary Overseas Chinese policy of the PRC is largely based on the experience gained during the de facto reign of Deng Xiaoping (1977–1992). In the shortest possible time after the end of the "cultural revolution (1966-1976)" Deng was succeeded to carry out restoration work on interaction with the diaspora and include it in the strategic development plan of the PRC for decades ahead. Talking about the PRC's Overseas Chinese policy, the author minds both the foreign policy – towards overseas Chinese (huaqiao-huaren: emigrants and ethnic Chinese with foreign citizenship, and the internal policy – towards re-emigrants and relatives of emigrants in the PRC (guiqiao-qiaojuan), who are directly connected with Overseas Chinese.  The article analyzes the first steps of Deng Xiaoping's team to restore work with the Chinese diaspora before the official announcement of the policy of reform and opening-up: reconstruction of the administrative structure for Overseas Chinese Affairs, planning the main directions of work with diaspora, including it in the strategic development plan of the PRC. The author explains the legal details and examines the main theoretical approaches to the work with the diaspora in the first years of reform and opening-up. The paper deals with the processes of creating the basis for long-term cooperation between the PRC and the Chinese diaspora. It concludes that Deng Xiaoping completely restored external and internal work with the diaspora and created conditions for further comprehensive cooperation with it in the short, medium, and long term.

<p>As an important part of the management system of listed companies, the effective implementation of internal audit can improve the comprehensive level of enterprises and promote the long-term and stable development of enterprises. Since the reform and opening up, China's internal audit in the exploration of continuous progress, gradually standardized, systematic. However, due to historical and realistic reasons, the internal audit independence of listed companies in China is poor, the overall quality of internal audit personnel is not high, the field and scope of internal audit is narrow, it is difficult to effectively deal with the complex and changing market environment, enterprises face financial, operational and other risks. Therefore, the internal audit of listed companies needs to be transformed and upgraded. This paper introduces the current situation of internal audit of listed companies in China, further analyzes their existing problems, and puts forward solutions to these problems.</p>

With the data from 1980 to 2009, this paper gave an empirical analysis on the relation of transport development and economic growth by VAR model. Research shows that since the 30 years’ reform and opening up policy of China, the transportation and economic development have got a long-term positive mutually relationship, and make a positive interactive development state.

Factor input, structural optimization and institutional reform, which determine the fundamentals of China's economic development, will actively prop up long-term, sustained and stable growth of the Chinese economy and keep China's potential economic growth rate stabilized within a reasonable growth range in the long term.Design/methodology/approachThe fundamentals of economic development of a country are the basic situation of economic operation determined by the country's main factors and the long-term trend thereof, and they have such characteristics as stability, internality and persistence.FindingsStability refers to economic operation that remains relatively stable within a reasonable growth range at a certain stage of development, and this does not rule out exceptional economic fluctuations in certain years due to the impact of unexpected short-term factors. For instance, the fundamentals of the Chinese economy during the period after the reform and opening-up are characterized by a sustained high growth rate.Originality/valueInternality refers to the intrinsic quantity and quality of all factors supporting the economic development of a country, especially the quantity and quality of the factors that play a decisive role in the economic development of a country at a specific stage. For instance, demographic dividend and capital formation have bolstered the high-speed growth of the Chinese economy since the reform and opening-up.

We quantitatively analyze the relationship between China’s energy consumption, energy efficiency and economic cycle from the perspective of periodic fluctuations. Through HP filter analysis, the following main conclusions are drawn: First, the relationship between China’s energy consumption and output is nonlinear. Second, before the reform and opening-up, China’s output-energy efficiency changed greatly. After the reform and opening-up, the long-term trend has become relatively stable, while in the short term, the output-energy efficiency is more likely influenced by fluctuation factors. Third, from 2002 to 2005, fluctuations led to the decrease of output-energy efficiency in such industries as agriculture, industry, manufacturing, transportation and warehousing and the wholesale, retailing and lodging; and from 2010 to 2015, the overall output-energy efficiency was improved in such industries as agriculture, industry, manufacturing and the wholesale, retailing and lodging, mainly contributed by the trend factor. Based on these findings, we believe that long-term and short-term factors must be sorted out when preparing policy objectives and means for energy efficiency. From the perspective of sector-based analysis, the loss of energy efficiency is more attributed to short-term fluctuation factors, thus maintaining a stable economy is conducive to improving energy efficiency.

With the continuous development of economic globalization and the overall deepening of China's reform and opening up, energy efficiency has increasingly become a major strategic issue related to national social-economic development, energy security and environmental protection. At present, the general trend of energy efficiency in China is continuously improving, but the development among regions is seriously uneven. There is still a big difference compared with the current and the international advanced level. Therefore, establishing the policy support system and the long-term development mechanism helping to continuously improve energy efficiency will undoubtedly be a strategic topic both for present and future.

This article analyses the evolution of the mother–daughter relationship in China, and describes the mothering characteristics of four generations of women, which in sequence includes “foot-binding mothers”, “mothers after liberation”, “mothers after reform and opening up”, and “mothers who were only daughters”. Referring to Klein’s ideas about the mother–child relationship, especially those in her paper “Some reflections on ‘The Oresteia’ ”, the author tries to understand mothers and their impact on their daughters in these various periods of Chinese history, so as to explore the mutual influence of the mother–daughter relationship in particular, and the Chinese cultural and developmental context in general.
