‘Municipal indigents’ are a category of poor citizens who qualify to receive certain municipal services for free in South Africa. Having registered as municipal indigents, the poor not only gain access to free basic services but also embark upon a voyage into a bureaucratic underworld where policies are changed and eligibility criteria and sanctions are unevenly applied. Various preconditions and limits on services, as well as social surveillance of indigent households, has turned indigency programmes into a ‘regime’. The policy has swung from hard cost recovery (mass disconnections) during the period 1994–2000 to ‘free’ basic services and, more recently, to social-shaming and criminalisation. This paper provides a thematic account of recent municipal indigent processes in order to explore the ‘moving boundary’ between benevolence and control regarding this crucial citizen–state interface. Based on recent interviews with government officials, a review of relevant government documents, and describing the administrative complexities, the paper reveals aspects of what the poor confront in day-to-day experiences of the state. It is argued that there are lessons for all municipalities seeking a more sustainable and democratic path to citizenship rather than an ongoing low-level war with poor citizens.

Abstract Since the emergence of the crisis of capitalist globalization in 2008, the deconstruction of the Fordist wage relationship and the rising unemployment in various countries have stimulated the growth of labour informality, distancing workers from labour protection, intensifying turnover and stimulating intermittent employment. Collective bargaining has become increasingly rare and decentralized, and jobs increasingly precarious and individualized, undermining the protective capacity of the ‘moral economy of the poor’ and transforming direct action - that is, popular action without the mediation of unions and traditional political parties - into perhaps the only credible alternative for ‘precarious workers’ to express their demands in a world marked by the commodification of labour, basic services and housing. A return to the era of the ‘class struggle without class’? This is the conjecture that this article sets out to evaluate, comparing the class experience of poor and precarious workers in three countries from the so-called Global South: Portugal, South Africa and Brasil.

The Republic of South Africa formulated numerous progressive laws, regulations and strategies from 1994 to 2008 to support the provision of free basic sanitation access to the poor by 2014. The State has yet to achieve this objective in urban areas – ostensibly due to the poor municipal execution of national policy. This paper challenges this viewpoint, as it ignores policy weaknesses and overlooks the influence of non-municipal actors in service delivery. An assessment of national policy and implementation in South Africa’s second largest city (Cape Town) indicated that irreconcilable differences between municipal officials, residents and advocates’ interpretations of broadly-framed national policy, as well as policy gaps specific to servicing informal settlements and providing shared sanitation, contributed to the municipality’s failure to achieve policy objectives. The actors’ differences and policy shortcomings necessitated municipal policy reformulation according to the ‘lived’ and ‘practical’ realities of servicing informal settlements. The findings suggest a disproportionate focus on turning national policy into practice – for this viewpoint misses how local actors’ perspectives and current practices can shape policy. Understanding, accepting and addressing the interplay between policymaking and implementation can contribute to more constructive means of effectively delivering sanitation in South Africa.

Poverty reduction is necessary for the attainment of sustainable tourism development. Ironically, in many mountain regions, tourism destinations are concomitant with extreme poverty. Route tourism is regarded as one of the few poverty reduction options available to mountain communities. This study used the worldviews theory to compare the perceptions of the three distinct groups, namely local communities, tourism business operators and local government officials, regarding the contribution of route tourism to poverty reduction along the Maluti Route, in the Drakensberg Mountain Region of South Africa. A survey was carried out among 80 tourism business operators and 250 community members, and complimented with in-depth interviews held with local government officials and observations that were made in tourism business organisations. The results indicate diametrically opposed viewpoints between tourism business operators and local communities. While business organisations believe that they are significantly contributing to poverty reduction in the region, local communities acknowledge only a limited number of benefits from tourism. The study concludes that tourism can work for the poor if they are adequately equipped with skills to contribute in tourism investment and if the tourism cake is deliberately ‘tilted’ towards them. We conclude by highlighting the need for communication among stakeholders about current efforts and options available to reduce poverty through tourism, including the training of locals in tourism related skills, as well as improving linkages among industry, government and tourism industry as a measure for enhancing the role of tourism in poverty reduction.

Invasive species, those that are nonnative and cause economic damage, are one of the main threats to ecosystems around the world. Ambrosia beetles are some of the most common invasive insects. Currently, severe economic impacts have been increasingly reported for all the invasive shot hole borers in South Africa, California, Israel, and throughout Asia. This study was conceptualised in order to assess the strategies used to incorporate the homeland of KaNgwane into Mpumalanga province after the cessation of apartheid in 1994. The specific objective of the study was to investigate the compliance of records and archives with the National Archives and Records Service of South Africa Act (Act No 43 of 1996), during the incorporation of the homeland of KaNgwane into Mpumalanga. The study adopted a qualitative methodology through document analysis, interviews and observations. The key findings revealed that the archives of the former homeland of Kangwane were not aligned with the requirements of the National Archives and Records Service of South Africa Act (Act No.43 of 1996.) Institutions seem to lack experience when it comes to the challenges of storing records and implementing arrangement and control systems. The frequent lack of a records management policy and few to no staff with record-keeping and archival backgrounds was also a concern. A shortage of space to store records safely was also one of the major issues that the study uncovered. There appears to be no concerted effort to retain important historical records. Many records are stored in several different locations in government buildings.  I conclude that archives play an essential role to the nation as the institutional memory.

Diskresi sebagai wewenang bebas, keberadaannya rentan akan disalahgunakan. Penyalahgunaan diskresi yang berimplikasi merugikan keuangan negara dapat dituntutkan pertanggungjawabannya secara hukum administrasi maupun hukum pidana. Mengingat selama ini peraturan perundang-undangan tentang pemberantasan tindak pidana korupsi tidak merumuskan secara rinci yang dimaksudkan unsur menyalahgunakan kewenangan maka para hakim menggunakan konsep penyalahgunaan wewenang dari hukum administrasi. Problema muncul saat diberlakukannya Undang-Undang Nomor 30 Tahun 2014 dimana telah memicu persinggungan dalam hal kewenangan mengadili penyalahgunaan wewenang (termasuk diskresi) antara Pengadilan Tata Usaha Negara dengan Pengadilan Tindak Pidana Korupsi. Pada perkembangannya, persinggungan kewenangan mengadili tersebut ditegaskan oleh Peraturan Mahkamah Agung Nomor 4 Tahun 2015 bahwa PTUN berwenang menerima, memeriksa, dan memutus permohonan penilaian ada atau tidak ada penyalahgunaan wewenang (termasuk diskresi) dalam Keputusan dan/atau Tindakan Pejabat Pemerintahan sebelum adanya proses pidana. Sehubungan tidak dijelaskan tentang definisi dan batasan proses pidana yang dimaksud, maka timbul penafsiran yang berbeda. Perlu diadakan kesepakatan bersama dan dituangkan dalam regulasi tentang tapal batas persinggungan yang jelas tanpa meniadakan kewenangan pengujian penyalahgunaan wewenang diskresi pada Pengadilan TUN.Discretion as free authority is vulnerable to being misused. The abuse of discretion implicating the state finance may be prosecuted by both administrative and criminal law. In view of the fact that the law on corruption eradication does not formulate in detail the intended element of authority abuse, the judges use the concept of authority abuse from administrative law. Problems arise when the enactment of Law No. 30 of 2014 triggered an interception in terms of justice/ adjudicate authority on authority abuse (including discretion) between the Administrative Court and Corruption Court. In its development, the interception of justice authority is affirmed by Regulation of the Supreme Court Number 4 of 2015 that the Administrative Court has the authority to receive, examine and decide upon the appeal there is or there is no misuse of authority in the Decision and / or Action of Government Officials prior to the criminal process. That is, shortly before the commencement of the criminal process then that's when the authority of PTUN decides to judge the misuse of authority over the case. In this context, Perma No. 4 of 2015 has imposed restrictions on the authority of the TUN Court in prosecuting the abuse of discretionary authority.

Rivers are the lifeline of Bangladesh economy and serve as the source of water supply, fisheries, irrigation for agriculture, low-cost transport, generate electricity and conserve biodiversity. The Ichamati River situated in Pabna, Bangladesh is also a blessing for the city. However, recently, due to the irregular and unplanned activities adjacent to the riverside, the life, flow and water quality of the river is in a vulnerable condition. This study aims to identify the present status of the Ichamati River and provide an effective design approach and policy measures in restoring the river flow and control water pollution. The data was collected from the questioner surveys, key informant interviews and focus group discussions. Results suggest that several factors such as the construction of an illegal settlement, unplanned waste dumping, disposal of fiscal sludge through sewerage connection, lack of awareness among people regarding the importance of river biodiversity and absence of riverfront development and conservation plan are responsible for water pollution, inconsistent water flow and damaging the life cycle of Ichamati river. The design approach and policy measures were developed based on the perceptions of local community people, experts and government officials. The suggested policy measures will help to restore the flow of the river and reduce the water pollution, and the design approach will ensure the economic benefit of the riverfront development in future.

Background:Poor medical waste management has been implicated in an increase in the number of epidemics and waste-related diseases in the past years. South Africa is resource-constrained in the management of medical waste.Objectives:A review of studies regarding medical waste management in South Africa in the past decade was undertaken to explore the practices of medical waste management and the challenges being faced by stakeholders.Method:Published articles, South African government documents, reports of hospital surveys, unpublished theses and dissertations were consulted, analysed and synthesised. The studies employed quantitative, qualitative and mixed research methods and documented comparable results from all provinces.Results:The absence of a national policy to guide the medical waste management practice in the provinces was identified as the principal problem. Poor practices were reported across the country from the point of medical waste generation to disposal, as well as non-enforcement of guidelines in the provinces where they exit. The authorized disposal sites nationally are currently unable to cope with the enormous amount of the medical waste being generated and illegal dumping of the waste in unapproved sites have been reported. The challenges range from lack of adequate facilities for temporary storage of waste to final disposal.Conclusion:These challenges must be addressed and the practices corrected to forestall the adverse effects of poorly managed medical waste on the country. There is a need to develop a medical waste policy to assist in the management of such waste.

The Arthur Crawford Scandal explores how nineteenth century Bombay tried a British official for corruption. The presidency government persuaded Indians, government officials, to testify against the very person who controlled their career by offering immunity from legal action and career punishment. A criminal conviction of Crawford’s henchman established the modus operandi of a bribery network. Subsequent efforts to intimidate Indian witnesses led to litigation at the high court level, resulting in a political pressure campaign in London based on biased press reports from India. These reports evoked questions in the House of Commons; questions became demands that Indians witnesses against Crawford be fired from government service. The secretary of state for India and the Bombay government negotiated about the fate of the Indian witnesses. At first, the secretary of state accepted the Bombay government’s proposals. But the press campaign against the Indian witnesses eventually led him to order the Government of India, in consultation with the Government of Bombay, to pass a law ordering those officials who paid Crawford willingly, to be fired. Those whom the Bombay government determined to be extorted were not to be fired. Both groups retained immunity from further actions at law. Thus, Bombay won a victory that almost saved its original guarantee of immunity: those who were fired were to receive their salary (along with periodic step increases) until they reached retirement age, at which time they would receive a pension. However, this ‘solution’ did little to overcome the stigma and suffering of the fired officials.

Abstract Background Health workers are crucial to the successful implementation of infection prevention and control strategies to limit the transmission of SARS-CoV-2 at healthcare facilities. The aim of our study was to determine SARS-CoV-2 infection prevention and control knowledge and attitudes of frontline health workers in four provinces of South Africa as well as explore some elements of health worker and health facility infection prevention and control practices. Methods A cross-sectional study design was utilised. The study population comprised both clinical and non-clinical staff working in casualty departments, outpatient departments, and entrance points of health facilities. A structured self-administered questionnaire was developed using the World Health Organization guidance as the basis for the knowledge questions. COVID-19 protocols were observed during data collection. Results A total of 286 health workers from 47 health facilities at different levels of care participated in the survey. The mean score on the 10 knowledge items was 6.3 (SD = 1.6). Approximately two-thirds of participants (67.4%) answered six or more questions correctly while less than a quarter of all participants (24.1%) managed to score eight or more. A knowledge score of 8 or more was significantly associated with occupational category (being either a medical doctor or nurse), age (< 40 years) and level of hospital (tertiary level). Only half of participants (50.7%) felt adequately prepared to deal with patients with COVD-19 at the time of the survey. The health workers displaying attitudes that would put themselves or others at risk were in the minority. Only 55.6% of participants had received infection prevention and control training. Some participants indicated they did not have access to medical masks (11.8%) and gloves (9.9%) in their departments. Conclusions The attitudes of participants reflected a willingness to engage in appropriate SARS-CoV-2 infection prevention and control practices as well as a commitment to be involved in COVID-19 patient care. Ensuring adequate infection prevention and control training for all staff and universal access to appropriate PPE were identified as key areas that needed to be addressed. Interim and final reports which identified key shortcomings that needed to be addressed were provided to the relevant provincial departments of health.
