The U.S. Supreme Court’s Atkins v. Virginia decision barred the execution of persons with intellectual disability, but provided minimal specification regarding adjudication. One exception to the lack of instruction was the recommendation that states generally conform to accepted clinical practice and norms, positioning professional associations to take an important role in this discourse. This study uses Chambers and Wedel’s value-critical method of analysis to examine the policy element, standard of proof of intellectual disability, within Georgia’s 1988 statute prohibiting the execution of persons with intellectual disability. Owing to the public outcry that followed Georgia’s controversial execution of Jerome Bowden, who evidenced significant impairments in intellectual and adaptive functioning, the 1988 statute was the first in the nation to bar such executions, and predated the Atkins decision by 14 years. However, due to a drafting error, Georgia was also the only state to invoke the highest standard of proof, beyond a reasonable doubt. When states use a standard of proof of intellectual disability that is higher than the lowest standard, a preponderance of the evidence, capital defendants with intellectual disability are at an increased risk for unlawful execution. We present findings and recommendations across the identified analytical contexts.

Despite being the first state to abolish the capital punishment of defendants with intellectual disability (ID), Georgia is currently the only state to uphold what is considered to be the most stringent standard of proof of ID in the United States: beyond a reasonable doubt. Other states have implemented less stringent standards of proof (i.e., a preponderance of the evidence and clear and convincing evidence). Although the U.S. Supreme Court ruled the execution of persons with ID unconstitutional in the 2002 Atkins decision, states are at this juncture considered to have a great deal of discretion in defining what constitutes ID. In addition to raising concerns about the Eighth Amendment’s protection against cruel and unusual punishment, variation between state-determined definitions of ID raises important questions of equal protection of the law. On January 27, 2015, Mr. Warren Lee Hill was executed by method of lethal injection in the state of Georgia after the U.S. Supreme Court denied Mr. Hill’s claim to have met the state’s legal definition of ID beyond a reasonable doubt. This article provides a historical and legislative background for the case of Warren Lee Hill, while examining the definitions of ID (including adaptive functioning) in the legal and clinical arenas. Last, this article will take a critical stance with regard to the current diagnostic criteria being used in the state of Georgia.

Introduction The global abrupt progression of the COVID-19 pandemic may disrupt critical life-saving services such as routine immunization (RI), thus increasing the susceptibility of countries to outbreaks of vaccine-preventable diseases (VPDs). Being endemic to several infectious diseases, Lebanon might be at increased risk of outbreaks as the utilization of RI services might have deteriorated due to the pandemic and the country’s political unrest following the October 2019 uprising. The aim of this study was to assess the changes in the utilization of RI services in both the public and private sectors following the COVID-19 pandemic. Methods A self-administered cross-sectional survey was completed electronically, in April 2020, by 345 private pediatricians who are registered in professional associations of physicians in Lebanon and provide immunization services at their clinics. Means of the reported percentages of decrease in the utilization of vaccination services by pediatricians were calculated. As for the public sector, an examination of the monthly differences in the number of administered vaccine doses in addition to their respective percentages of change was performed. Adjustment for the distribution of RI services between the sectors was performed to calculate the national decrease rate. Results The utilization of vaccination services at the national level decreased by 31%. In the private sector, immunization services provision diminished by 46.9% mainly between February and April 2020. The highest decrease rates were observed for oral poliovirus vaccine (OPV) and hepatitis A, followed by measles and pneumococcal conjugate vaccines. The number of vaccine doses administered in the public sector decreased by 20%. The most prominent reductions were detected for the OPV and measles vaccines, and during October 2019 and March 2020. Conclusion The substantial decrease in the utilization of RI as a result of the COVID-19 pandemic requires public health interventions to prevent future outbreaks of VPDs.

By means of a specific anti-Streptococcus mutans monoclonal antibodies test we want to identify the diabetic patients which have an increased risk to develop the periodontal disease. The highest percentage, of 88.1% of all patients included in this study represents the subjects with a level greater than 500,000 cfu / mL of streptococcus mutans. The Kruskal-Wallis test reveals a value of p = 0.283 resulted from the status of diabetes in patients and the level of streptococcus mutans in saliva. In conclusion, the status of diabetes in patients seems not to influence the salivary level of mutans streptococci determined with the method used in our study.

This study examined adaptive functioning, strategies used to develop adaptive functioning skills, and areas where additional services could benefit autistic young adults without intellectual disability. Participants were 21 autistic young adults and at least one parent of each young adult. Quantitative analyses replicated previous reports of an adaptive functioning disadvantage relative to intellectual functioning such that adaptive functioning standard scores were significantly lower than intelligence quotient scores. Qualitative analysis utilized grounded theory methodology and yielded a conceptual model describing the nature and development of adaptive functioning in this demographic. Together, findings provide a more nuanced understanding of the gap between intellectual and adaptive functioning in autistic young adults without intellectual disability. Lay abstract Adaptive functioning describes the age-appropriate skills necessary for independent living. Research suggests that autistic children, adolescents, and adults who do not have an intellectual disability demonstrate adaptive functioning challenges relative to their intellectual ability. Thus, even though many of these individuals have the intellectual capacity to excel in mainstream educational and vocational settings, their adaptive functioning challenges may serve as an obstacle to independence. The research on adaptive functioning in autistic adults is focused on statistical analysis of standardized assessments (e.g. parent-report on multiple choice questionnaires). Qualitative research that examines the narratives of young adults and their parents is needed to better understand adaptive functioning in young adults and their resulting service needs. This study combined statistical analysis of standardized assessments with qualitative analysis of interview responses from autistic young adults without intellectual disability and their parents. Findings replicated previous reports of adaptive functioning challenges and identified influences on adaptive functioning development, consequences of independence, and service needs. Taken together, findings indicate the need for interventions and services that facilitate adaptive functioning development in autistic adolescents and young adults and provide insight into potential intervention targets and strategies.

Abstract Intellectual disability (ID) is a developmental disorder characterized by deficits in intellectual functioning and adaptive behavior. The fifth edition of the Diagnostic and statistical manual of mental disorders (DSM-5) defines adaptive functioning as a severity measure of ID. The availability of tests in the international context to assess this construct has increased in recent years. In Brazil, however, non-systematic assessment of adaptive functioning, such as through observation and interviews, still predominates. The Escala de Funcionamento Adaptativo para Deficiência Intelectual EFA-DI [Adaptive Functioning Scale for Intellectual Disabilities] is a new instrument developed in Brazil to assess the adaptive functioning of 7- to 15-year-old children and support the diagnosis of ID. This study’s objectives were to investigate evidence of validity related to the EFA-DI’s internal structure, criterion validity, and reliability. The psychometric analyses involved two statistical modeling types, confirmatory factor analysis (CFA) and item response theory analysis (IRT). These results highlight the EFA-DI scale’s strong psychometric properties and support its use as a parental report measure of young children’s adaptive functioning. Future studies will be conducted to develop norms of interpretation for the EFA-DI. This study is expected to contribute to the fields of psychological assessment and child development in Brazil.
