Majorities for Minorities: Participatory Constitution Making and the Protection of Minority Rights

Does the process of making a constitution affect the expansiveness of rights protections in the constitution? In particular, is more participation in constitution-making processes better for minority rights protections? While the process of constitution making and its impact on various outcomes have received significant attention, little is known about the impact public participation or deliberation in this process has on the scope and content of minority rights. Using a wide variety of data to empirically assess the relationship between constitution-making processes and the protection of rights for minorities, we find a positive relationship between participatory drafting processes and the inclusion of minority protections in constitutions under some conditions. The article’s findings have important implications for understanding political representation and lend support to core arguments about the role of the public in constitutional design.

The nature of the relationship between the public administration and politics and the subsequent role of the administration appear to be incompatible with the emergence of an administrative elite. After analysing the reasons for this incompatibility, the article explores the impact of the measures taken in the wake of the economic crisis on the civil service and its reform, and also the prospects for the development of a senior civil service. The key, and also the challenge, to any change in this direction remains the rebalancing of the relationship between the public administration and politics. Points for practitioners What might interest practitioners is the issue of the conditions of effectiveness of civil service reform in times of economic crisis and significant pressure.

In popular culture the relationship between science and religion has often been portrayed as one of conflict. The impact of the conflict thesis can be observed in church leaders’ hesitancy in talking about science and religion in the public domain. It was this finding that led Revd Professor David Wilkinson (cosmologist and theologian) and Professor Tom McLeish (physicist and Anglican lay reader) to form the project ‘Equipping Christian Leadership in an Age of Science’ funded by The Templeton World Charity Foundation. The data presented in this article (collected during 2015-2018) is derived from two discreet pieces of research. The first consisting of a survey of over 1,000 church leaders and interviews with 20 senior church leaders and, the second, with a strategic focus on ministerial training comprised of 12 interviews with church educationalists. This paper reflects on the findings from both pieces of research – covering topics such as church leaders’ enthusiasm towards science, how church leaders view the relationship between science and religion and the role of compartmentalisation in ministerial training. The article is unique in providing sociological analysis on the relevant data and including a personal reflection by David Wilkinson – the project’s director – on the implications of the research for ministerial training and science.

This chapter reviews the relationship between the media and the Umbrella Movement. The mainstream media, aided by digital media outlets and platforms, play the important role of the public monitor in times of major social conflicts, even though the Hong Kong media do so in an environment where partial censorship exists. The impact of digital media in largescale protest movements is similarly multifaceted and contradictory. Digital media empower social protests by promoting oppositional discourses, facilitating mobilization, and contributing to the emergence of connective action. However, they also introduce and exacerbate forces of decentralization that present challenges to movement leaders. Meanwhile, during and after the Umbrella Movement, one can also see how the state has become more proactive in online political communication, thus trying to undermine the oppositional character of the Internet in Hong Kong.

Abstract Fiscal stability of the local self-government units is the condition for stable public finances of the Republic of Srpska (hereinafter: RS) as a whole. Stable public finances of local self-government units have a positive impact on the economic growth of the RS. Therefore, it is necessary to pay a significant attention to the fiscal problems of local self-government units (hereinafter: LGUs). Although the public finances of the LGUs make up 15% of the total public finances of the Republic of Srpska, it is important to emphasize that the life of the RS citizens takes place in the local self-government. In this regard, LGUs have the important role in providing public goods and services, as well as creating the environment for the life of citizens on the basis of legally defined competencies. Having in mind the importance and role of local self-government units in the RS, it is necessary to ensure the efficient management and stability of their public finances. One of the preconditions for the successful exercise of the competencies of LGUs is the rational and efficient use of available resources. The aim of this paper is to examine the impact of the key fiscal factors of local self-government units on their fiscal stability. The results of this analysis will provide answers to the question of how rational and efficient local self-government units are in the execution of their competencies and how it is reflected on their revenues and expenditures, i.e. in total public finances of RS.

The research aims to determine the modified role of Educational Competiotion  to enhance the impact of electronic management in intelligent organizations. The research started from several questions to know the interactive role of Educational Competiotion in enhancing electronic management and its impact on activating intelligent organizations. The research aimed to reach the essence of theoretical philosophy and the intellectual basis of these variables as one of the important issues in modern administrative thought. And its relationship and its direct and indirect effects were diagnosed through the modified role. The research sample consisted of a number of employees in Asia-Cell Company in the city of Karbala. Their number reached (129), and the questionnaire was used to collect data and a number of statistical methods were used to prove the validity of the hypotheses. The results were identical to the main hypothesis. On this basis, a number of conclusions were drawn, the most important of which was that Educational Competiotion modifies the positive relationship between electronic management and intelligent organizations. There should also be awareness-raising sessions on the importance of Educational Competiotion  to take advantage of opportunities and explore new opportunities.

Purpose: This study is carried out to study the relationship between FDI and economic growth of developing countries. Approach/ Methodology/ Design: The study used data from 2000 to 2019 for 113 developing and transition countries. The study used Hausman fixed effect and instrumental variables two stage least square region to trace the results. Findings: The result of the study found a positive relationship between FDI and economic growth. An increase in FDI inflow will result and upsurge in economic growth of developing country. The relationship between unemployment and economic growth is found negative. The overall results show that FDI and economic growth has a positive relationship in developing countries. Practical Implication: This study used annual data of pre pandemic. It is concluded in the study that future studies have to check the impact in post pandemic scenario. Originality/Value: Though the relationship between FDI and economic growth is studied widely in different studies. As mentioned that COVID-19 pandemic changed the world economic situation there is much more aspects of FDI and economic growth is remaining to study. The issue of FDI and economic growth for a cluster of 113 countries is addressed in this study.

This paper evaluates the scope of the powers of the Minister of Finance upon a request from the Minister of Trade and Industry to amend Schedule 1 to the Customs and Excise Act 91 of 1964 (hereafter, CEA) in respect of imported goods as provided by section 48(1)(b) of the CEA. This assessment entails a case analysis of the High Court decisions in South Africa Sugar Association v the Minister of Trade and Industry 2017 4 All SA 555 (GP) and Pioneer Foods (Pty) Ltd v Minister of Finance 2017 ZAWCHC 110 (29 September 2017). These two cases offer for the first time, clarification on the nature of the power conferred on the Minister of Finance by section 48(1)(b) of the CEA. The High Court in these two cases rejected the argument that the role of the Minister of Finance in respect of the power conferred upon him/her by section 48(1)(b) is that of a "registrar" who merely 'rubberstamps' the decision of the Minister of Trade and Industry. Consequently, the High Court in both matters held that a veto power is conferred on the Minister of Finance which permits him/her to either accept or decline the request of the Minister of Trade and Industry to amend Schedule 1 of the CEA.To the contrary, this paper argues that if the Minister of Finance declines the request of the Minister of Trade and Industry, s/he is not 'giving effect' to the request of the Minister of Trade and Industry as required by section 48(1)(b) of the CEA and is thus acting ultra vires because s/he is assuming powers which never conferred on him/her by the legislature. This paper also argues that the High Court in both matters, misconstrued the relationship between section 48(1)(b) and the "public interest" provisions in section 48 and thus unjustifiably stripped the Minister of Trade and Industry of his/her power to implement an amendment to Schedule 1. In the final analysis, this paper explores the impact of the Customs Duty Act 30 of 2014 on the Minister of Finance's powers in this regard.

The objective of the study was to investigate the effect of the intermediate role of the organizational structure in the relation of the abilities of the senior leadership and the effectiveness of the decision. The analytical descriptive method was used, where a questionnaire was designed to collect data from the study community, and 50 questionnaires were distributed, 41 of which were valid for analysis (82%). There is a positive relationship between senior leadership abilities and decision-making. There is a positive relationship between senior leadership and organizational structure. There is a positive relationship between decision making and organizational structure. The organizational structure mediates the relationship between senior leadership abilities and decision-making. A number of statistical methods were used in the study such as arithmetic mean, standard deviation, alpha kernobakh coefficient, global analysis, Pearson correlation coefficient and regression analysis. The study reached a number of results, including: - (1) the abilities of senior leadership have a positive impact on the effectiveness of the decision. (2) The effectiveness of decisions is influenced by the characteristics of the organizational structure. (3) The organizational structure mediates the relationship between senior leadership capacity and decision effectiveness in organizations. The study recommended the possibility of conducting further research related to measuring the impact of the senior management style on management functions and introducing more variables to construct the model of the proposed studies in addition to applying the study in other sectors of business organizations.

Whitsleblowing is one of the positive practices in organizations that are able to raise the level of integrity among the members of an organization. However, the roles of whistleblowing also inevitably invites a response, especially among members of the organization itself. This is because such practices are viewed as one factor that may be detrimental to the organization in addition to revealing the reporter (whistleblower) to some external threats and intimidation of discrimination within the organization. This paper is an attempt to examine the relationship between perceptions of members of the Royal Malaysian Police (RMP) Contingent of Perak through the role of whistleblowing practices to increase the perception of the integrity of the members. Next, identify the purpose of the whistleblowing and its effect on the integrity of the members of the organization. This study used a descriptive quantitative analysis to identify patterns of relationship that exists between the perception of whistleblowing practices with perceptions of increased integrity based on three basic variables of demographic factors, response to whistleblowing and the impact of making the report. The results showed that members of the Perak’s police have a positive perception of whistleblowing practices which are seen to be done in improving the integrity of the members.Keywords: whistleblowing, perception, RMP members, culture, integrity, organization, influence. ABSTRAK: Whitsleblowing merupakan salah satu amalan positif dalam organisasi yang mampu untuk meningkatkan tahap integriti ahli-ahli dalam sesebuah organisasi. Namun begitu, amalan whistleblowing juga turut tidak dapat mengelak daripada mengundang pelbagai respon khususnya dalam kalangan ahli organisasi itu sendiri. Amalan sebegini turut dilihat sebagai salah satu faktor yang boleh memudaratkan organisasi di samping mendedahkan pelapor (whistleblower) kepada beberapa bentuk ancaman ugutan dari luar dan diskriminasi dalam organisasi. Kertas ini merupakan satu upaya untuk melihat perkaitan antara persepsi anggota Polis Diraja Malaysia (PDRM) Kontinjen Perak melalui peranan amalan whistleblowing terhadap persepsi peningkatan integriti anggota. Seterusnya, mengenalpasti maksud whistleblowing dan pengaruhnya terhadap tahap integriti anggota dalam organisasi. Kajian ini menggunakan analisis kuantitatif berbentuk deskriptif bagi mengenalpasti corak hubungan yang wujud antara persepsi terhadap amalan whistleblowing dengan persepsi terhadap peningkatan integriti berdasarkan tiga pembolehubah asas iaitu faktor demografi, tanggapan terhadap whistleblowing dan kesan daripada tindakan membuat laporan. Dapatan kajian menunjukkan bahawa anggota PDRM Perak mempunyai persepsi yang positif terhadap whistleblowing yang mana ianya dilihat perlu dilaksanakan dalam meningkatkan integriti anggota.Kata kunci: whistleblowing, persepsi, amalan, anggota PDRM, budaya, integriti, organisasi, pengaruh.

Nowadays, according to decentralization and current legislation (Land Code of Ukraine, Resolution of the Cabinet of Ministers of Ukraine and the Law of Ukraine «On Self-Governance»), the public lands have been transferred to the CTCs since 1 February 2018. In 2018/2019, 788 CTCs received communal ownership of 1.68 ha of public lands. According to the Draft Law «On Amendments to Several Legal Documents of Ukraine on Agricultural Lands Turnover», the consolidated territorial communities become the legal entities and can acquire property rights to agricultural land plots. Therefore, transferring the lands to be used by the newly created CTCs is currently an urgent issue that requires extended scientific and practical research. The paper aims to research the role of land reform in Ukraine and its impact on increase of CTCs’ budget revenues. The stages of land reform and the development of the land reform in Ukraine as well as its implementation strategy are outlined. The disparities of the integrated satellite map and the data of the Land Cadaster of Ukraine in terms of unregistered lands are defined. The amount of a CTC budget’s increased revenues due to the reform is estimated. Statistical data on small, medium, and large farmers and their interest in the land reform are analyzed. The terms of selling the land to foreign investors and conditions of participation in land auctions are examined. The mechanisms of land purchase, selling, and lease in line with the land reform are suggested. Generalizing the presented aspects of the land reform in Ukraine and their impact on economic activity of the newly created CTCs, it can be argued that the process is quite positive and necessary for both communities and businesses in order to get additional budget revenues for CTCs. The land reform improves the living standards of Ukrainian people through the disclosure of the country’s agricultural capacity.
