Tribal Land Rights: A Situational Analysis in the Context of West Bengal

Tribal communities in India are most deprived. Socio-economically, they are poor and marginalised. The root cause of socio-economic marginalisation can be attributed to alienation of tribal people from their land, territory and resources. The overall situation of the tribal population of West Bengal is not better than the national average, even more deprived than the tribal population of other states. Despite progressive land reform laws and political commitment to implement such laws, issues of tribal land rights have not been addressed adequately. There is no such exclusive study to understand the situation of tribal land rights in the state of West Bengal. This article analyses the status of tribal land rights in the state context and makes some suggestions for improving the situation. It is found that despite distribution of land titles, a large section of the tribal population remains landless. A sizable portion has not received received record-of-rights. Claims of many tribal people for forest patta remain pending or stand rejected. Tribal land alienation continues to be a matter of concern. The state has not taken any concrete steps for the restoration of unlawfully alienated tribal lands. A large section of the tribal sharecroppers in the state remain unrecorded.

Abstract In addition to challenges facing South Africa’s overall post-apartheid land reform, group rural land claims have particularly proven difficult to resolve. This paper explores the role that the state plays in shaping the outcomes of rural group land claims. It analyzes policy statements, including from policy documents, guidelines and speeches made by politicians during ceremonies to hand over land rights to rural claimants; seeking to understand the possible motives, factual correctness, as well as impact, of these statements on the trajectory of the settled land claims. The paper concludes that land reform as practiced in South Africa is functionally and discursively disembedded from socio-political histories of dispossession, because land has come to be treated more as a commodity, rather than as something that represents multiple meanings for different segments of society. Like many processes leading up to a resolution of a rural claim, subsequent statements by government concerning particular ‘successful’ land claims convey an assumption that local claimants have received just redress; that there was local consensus on what form of land claim redress people wanted, and that the state’s lead role in suggesting commercial farming or tourism as land use options for the new land rights holders is welcome. The paper shows that previous in-depth research on rural land claims proves that the state’s role in the success or failure of rural land claims is controversial at best.

This paper uses the case of South Africa’s latest land redistribution strategy known as the Proactive Land Acquisition Strategy, to explore whether, and how, research can have direct and positive impacts on beneficiaries of land reform. The study is situated within the practice of action research: to explore how it can generate knowledge that can be shared back and forth between stakeholders, as well as how it may ignite changes that the participants desire. The findings are that Proactive Land Acquisition Strategy is not meeting the overall goals land reform. But action research has allowed the beneficiaries to emerge from the process with new knowledge about their rights, as well as what options they have to move forward in their fight for secure land rights and decent livelihoods. We introduce a concept of a ‘learning and action space’ to explain our practice of action research. The paper concludes that action research is a desirable approach for land reform, but while it succeeded in educating beneficiaries, it is only one ingredient in ongoing struggles to challenge power relations among citizens and between citizens and the state.

Abstract Abstract 5114 BACKGROUND Thalassemia syndromes are a heterogeneous anemia caused by mutation affecting globin chains of the hemoglobin molecule. It is estimated that the average life span of Rabhas (tribal population of North Bengal, Jalpaiguri) range from 42 – 45 years. This raised a concern that they are perishing due to some genetic disease. Hence Screening Camps were conducted to identify the reason. Rabha is a little known Scheduled Tribe community of West Bengal. Assam now renamed to Asom is a North-East India state of India with its capital at Dispur. The Rabha people are mainly found in the jungles of Jalpaiguri. West Bengal is a States and territories of India in eastern India. With Bangladesh, which lies on its eastern border the state forms the ethno-linguistic region of Bengal. Jalpaiguri is the largest district of North Bengal, covering an area 6,245 sq.km. It is situated between 26 16' and 27 0' North latitudes and 88 4' and 89 53' East longitudes and Cooch Behar district. Cooch Behar is a district of the state of West Bengal, India, as well as the name of the town which gives its name to the district. The whole area of Eastern and Western Dooars, may be termed as the cradle land of the Rabhas. The Rabhas belong to Indo-Mongoloid group of people and have similarities with other members of Bodo. Bodo may stand for: *Bod A city in Norway* An ethnic community in India: the Bodo people*The Bodo language spoken by them. group such as Garo (tribe). The Garos are a tribe in Meghalaya, India, and Mymensingh District, Bangladesh, who call themselves Achik. Kachari. The Kacharis are the most widely spread tribe in northeast India. They are said to be the earliest inhabitants of the Brahmaputra Valley. Mech (tribe), Koch. Our objectives were- Awareness among the tribal population through talks and documentaries and discussions with community leaders with demonstrations at village level. The goal of thalassemia screening is to identify the carrier status among Rabha populations, to control the birth of affected children thus eradicating thalassemia among them & to save one of the oldest tribe from being extinct. MATERIAL & METHODS At first an Awareness Programme was held among the Rabhas & then with the written consent peripheral blood was collected for thalassemia screening test. The screening age lies between 10 – 35 years. Firstly, NESTROFT (Naked Eye Single Tube Red Cell Osmotic fragility Test) was performed for spot detection. This was followed by CBC (Complete Blood Count) & HPLC (High performance Liquid Chromatography) for confirmation. Molecular Analysis of every sample was done using ARMS PCR. All together 277 individuals were screened. Of which 119 (43%) were HbE carrier & 110 (40%) were HbE homozygous. Rest of them was normal. The carrier & homozygous status was confirmed by performing ARMS PCR. The sensitivity of NESTROFT in this case was 95 %. CONCLUSION Thus the percentage of HbE carrier & HbE homozygous is very high among the Rabhas. But one thing is to be noted that their % of haemoglobin is very high. This might be one of the reasons that they do not require blood transfusion during their life span. It is spreading like a rapid fire due to consanguineous marriage among them. This is one of the reasons for the early mortality. In our project of Department of Biotechnology, Govt. of India we'll complete carrier status detection of total Rabha population (11,000) within 3 years. This article explores the contradictory and contested but closely inter- locking efforts of NGOs and the state in planning for land reform in South Africa. As government policy has come increasingly to favor the better-off who are potential commercial farmers, so NGO efforts have been directed, correspondingly, to safeguarding the interests of those conceptualized as poor and dispossessed. The article explores the claim that planned “tenure reform” is the best way to provide secure land rights, especially for laborers residing on white farms; illustrates the complex disputes over this claim arising between state and NGO sectors; and argues that we need to go beyond the concept of “neoliberal governmentality” to understand the relationship between these sectors.

This study raises the issue of agrarian reform draft under the reign of President Joko Widodo. Agrarian reform became a priority program in the RPJMN of 2015-2019. Based on this matter, the writer analyzes the concept of agrarian reform during the reign of Joko Widodo terms of BAL. The nature of the study was a normative research with statute approach, which was done in four ways, namely descriptive, comparative, evaluative and argumentative. The results showed that the agrarian reform draft during the reign of Joko Widodo is a concept of land stewardship and land reform. The economic system leads to a form of capitalism. It is necessary to conduct refinement of content and material of BAL implementation in order to achieve the justice and the welfare of the nation and the State. The agrarian reform program should be carried out in stages in order to obtain the desired results. It requires the will, ability and active involvement of all elements of the state.

This paper examines the development of modern vaccination programme of Cooch Behar state, a district of West Bengal of India during the nineteenth century. The study has critically analysed the modern vaccination system, which was the only preventive method against various diseases like small pox, cholera but due to neglect, superstation and religious obstacles the people of Cooch Behar state were not interested about modern vaccination. It also examines the sex wise and castes wise vaccinators of the state during the study period. The study will help us to growing conciseness about modern vaccination among the peoples of Cooch Behar district.

<p align="center"> </p><p><em>As happened to the Notary Eli SatriaPilo, S.H, Mkn, who was appointed as the Notary who made the Deed of Relinquishment of Land Rights in the Land Acquisition activities for the Construction of Campus III of the State Islamic Institute (IAIN) of Padang which was located in Sungai Bangek District, Padang</em><em> </em><em>in 2010. The method used was descriptive, in which describing the applicable legislation associated with legal theory in the facts and realities about the Notary’s Responsibility in Making Deed of Land Acquisition for the construction of Campus III of IAIN Padang in Sungai</em><em> </em><em>Bangek. This study used a Normative Juridical approach, in which researching by using and processing secondary data or literature related to the</em><em> </em><em>study. The data collected were in the form of primary data obtained from the District Court of Padang, secondary data obtained from secondary legal materials and primary legal materials. Based on the study, it was found that the role of Notary Eli</em><em> </em><em>Satria</em><em> </em><em>Pilo, in the land acquisition of campus III IAIN was proven to have misused the authority resulting in violation of the Notary Ethics Code and was responsible for accepting termination disrespectfully. Furthermore, he was also shown to be committing a Criminal Corruption made based on the Deed of Relinquishment of Land Rights in the land acquisition for the construction of Campus III of IAIN Padang, so that the State incurred losses of Rp. 1</em><em>.</em><em>946</em><em>.</em><em>701</em><em>.</em><em>050 (one billion nine hundred forty-six million seven hundred one thousand and fifty rupiahs). And he was responsible for receiving and carrying out the sentence that had been handed down by the District Court of Padang, a prison sentence of 4 (four) years, and paying a fine of Rp. 200</em><em>.</em><em>000</em><em>.</em><em>000 (two hundred million rupiahs)</em><em>.</em></p><p> </p>

This chapter explores the role of the political settlement in shaping outcomes of land investments by analysing struggles in key sectors of the economy. Land reform during the socialist period had far-reaching implications for the political settlement. Reforms to land rights under liberalization involved strengthening land markets; however, the state continued to play a significant role. Corruption within formal land management systems became prevalent during the period of high growth. Vietnam experienced a rapid growth in export agriculture but, in contrast with stable property rights for smallholders, Tanzania’s efforts to encourage large land investments were less successful. Industrialization in both countries generated new forms of land struggles that were influenced by the different distributions of power between the state, existing landowners, and investors.

The reflections in this article were instigated by the repeated and brutal clashes since 2007 between peasants and the state government’s militias—both official and unofficial—over the issue of industrialization. A communist government engaging peasants violently in order to acquire and transfer their lands to big business houses to set up capitalist enterprises seemed dramatically ironic. De- spite the presence of many immediate causes for the conflict, subtle long-term change to the nature of communist politics in the state was also responsible for the present situation. This article identifies two trends that, though significant, are by themselves not enough to explain what is happening in West Bengal today. First, the growth of a culture of governance where the Communist Party actively seeks to manage rather than politicize social conflicts; second, the recasting of radical political subjectivity as a matter of identity rather than an instigation for critical self-reflection and self-transformation.
