This article discusses a comprehensive theoretical and legal study of the place of case law in the system of sources of law of the Russian Federation. The major focus is devoted to the analysis of various theoretical approaches and court acts that allow to determine the role of case law in the Russian legal system. The conclusion is made that it is necessary to define legally the role of case law and determine its place in the Russian legal system

t+t clustering in He isotopes is investigated by using two theoretical approaches. A role of the t+t cluster component in the ground state is examined with AMD triple-S, allowing the wider configuration space containing simultaneously the "t+t+valence neutrons" structure and "4 He +valence neutrons" structure. We understand the importance of the t + t component even for the ground state. Further, t + t resonances are investigated with RGM type approach. We obtained many t + t states as resonances near to t + t threshold.

The authors propose that there are secrets in all families and discuss the link effects they produce as they are either transmitted transgenerationally or withheld from members of the family they actually concern. Secrets have determinant influences on the link configuration of families, on its dynamics, and, even, on its symptomatic formations. Often, an intentional or accidental revelation of secrets that were previously kept buried produce an explosive commotion within a family. Unmourned memories shape our destinies in disguised manners, and manifest themselves not as revelations of such secrets but as important psychological symptoms that pervade across generations. Different theoretical approaches are discussed and two clinical vignettes exemplify the text.

Актуальность исследования для экономики усиливается такими явлениями, как влияние мирового финансового кризиса, усложнение отраслевой и территориальной структуры производства, усиление интеграции всех сфер общественной жизни, возрастание значения экологических, социальных и политических факторов развития общества, повышение трансакционных издержек принятия решений в сфере управления. Изучение литературы о территориях дает основание определить понятие региональной системы России как элемент, подсистему некоторой иерархической системы, в роли которой выступает национальная экономика. Процессы глобализации коренным образом изменяют роль регионов в национальной экономике. Регион постепенно становится не только отдельным экономическим агентом, но также вступает в мировые конкурентные процессы. Положение территориально-организованных систем оказывается зависимым не только от макроэкономических условий или возможностей самих регионов, но также от расстановки конкурентных сил, механизмов взаимодействия регионов с другими субъектами. В этой связи возникает необходимость системных исследований с целью выработки комплекса мер, которые будут способствовать повышению конкурентоспособности экономики в целом, ее регионов в частности. Существующий инструментарий региональной экономики является уже недостаточным для анализа такого рода проблем, а традиционный конкурентный анализ не рассматривает регионы в качестве субъектов конкуренции. Требуется расширение и применение новых теоретических подходов к анализу региональных экономических систем и эффективности их развития, формированию целостной концепции развития территориальной организации хозяйства, что обусловило актуальность данного исследования. The relevance of the study for the economy is enhanced by such phenomena as the impact of the global financial crisis, the complication of the sectoral and territorial structure of production, the strengthening of integration of all spheres of public life, the increasing importance of environmental, social and political factors in the development of society, the increase in transaction costs of decision-making in the field of management. The study of the literature on territories gives grounds to define the concept of the regional system of Russia as an element, a subsystem of some hierarchical system, in the role of which the national economy acts. The processes of globalization are fundamentally changing the role of regions in the national economy. The region is gradually becoming not only a separate economic agent, but also enters into global competitive processes. The position of geographically organized systems turns out to depend not only on the macroeconomic conditions or the capabilities of the regions themselves, but also on the alignment of competitive forces, the mechanisms of interaction of regions with other entities. In this regard, there is a need for systematic research in order to develop a set of measures that will contribute to improving the competitiveness of the economy as a whole, its regions in particular. The existing tools of the regional economy are no longer sufficient to analyze such problems, and traditional competitive analysis does not consider regions as subjects of competition. It requires the expansion and application of new theoretical approaches to the analysis of regional economic systems and the effectiveness of their development, the formation of an integral concept of the development of the territorial organization of the economy, which determined the relevance of this study.

PurposeThe individual levels involved in real estate management are thoroughly discussed in the literature. This paper provides a structured meta-analysis of the different theoretical approaches in German-speaking countries. It also investigates the integration of transaction management and technical due diligence into the concepts of organisation theory. In this process, the interfaces are analysed and optimised models are developed for transferring the technical due diligence findings to the operational level.Design/methodology/approachInterviews with transaction management experts were conducted based on a narrative literature review. These interviews shed light on how the components of transaction management and due diligence are integrated into the transaction process, with a particular focus on technical due diligence. They also provide insights into how the related results are taken into account in relation to the transaction, and how they are transferred into the operational phase.FindingsIt becomes apparent that the role of transaction management is not clearly defined and delimited in the structural model of the real estate industry. Technical due diligence findings are usually transferred to the operation of the property via several, manual interfaces with corresponding losses of knowledge. The related models derived and developed for the purpose of operational optimisation define the role of transaction management against a technical background and identify the interfaces to be considered.Practical implicationsThe significance of transaction management for subsequent operations is discussed and elaborated on. More specifically, transferring safety-relevant, high-priority findings from the technical due diligence exercise plays a crucial role for the modelling stage. On the implementation level, the derived models serve as a basis for customising the internal organisational structure.Originality/valueIn Germany, there has hardly been any research into the involvement of technical experts in the real estate transaction process to date. This paper provides initial approaches to optimising organisational structures and sustainably integrating technical due diligence findings into real estate operations.

The purpose of the study is to analyze theoretical approaches to the mechanism for resolving legal conflicts, as well as to analyze its components, identify implementation problems and proposals for their elimination. The aim of the study is to improve the effectiveness of conflict prevention in draft laws, laws and other regulations. There is insufficient research on the procedure for adopting regional laws, organizing the work of regional parliaments, and public participation in the legislative process. We hope, if not to reveal, then at least to identify problematic issues that will find worthy researchers and solutions in the future. The paper notes the role of the constitutional Court of the Russian Federation as a subject of conflict-of-laws relations. It is concluded that the legislative process is directly related to the level of legal consciousness of the relevant subjects, moral attitudes, and awareness of their mission as creators of legislation. The practical significance of the research results provides a real opportunity for the competent authorities to take concrete measures aimed at removing corruption-related provisions from the regulatory legal framework.

The present paper aims to explain crime by investigating various theoretical approaches and to show that from the classic era to the recent postmodern theories, a slow but steady cycle of discourse concerning crime has been occurring. In the classic times, the criminal is assumed to be a sane person with sound will who commits crime with an individualistic choice and due to incorrect decisions; In the positivism approach, the theorists' concern is directed at recognizing criminals and clarifying more fundamental biological aspects and psychological performance and they seek to explain the phenomenon of crime by dividing the people of the society into normal and abnormal people; In the modern theories the social factors causing the appearance of crime are at the focal point while critical theories greatly emphasize on the role of the society in the criminal phenomenon and its definition, finally postmodern theories consider crime totally as constructed by mindset, language and power and question its existential reality.

В статье представлена работа В.А. Фаворского над киргизским героическим эпосом Манас. В серии созданных художником рисунков нашли проявление его художественные и теоретические подходы к искусству графики и иллюстрирования книг. Для более глубокого проникновения в суть эпического произведения художник отправляется в Киргизию. Созданные им рисунки имеют не только эстетическую и этнографическую ценности. В них проявилась его теория графики, когда белый фон бумаги воспринимается в качестве белого пространства, а карандаш художника становится сродни резцу скульптора. Пространство белого повисает на штрихах рисунка. Эпический характер повествования привел к монументальности образов и композиций иллюстраций. В статье приводятся теоретические мысли художника о соединении разновременных состояний в произведении искусства, роли контура и пятна. The work of V.A. Favorsky on the Kirghiz heroic epos is presented in this article. There is a demonstration of his artistic and theoretical approaches to the graphic arts and books illustration in the series of these drawings. The artist goes to Kyrgyzstan for the deep insight into the essence of the epic work. His drawings have not only aesthetic and ethnographic value. His theory of graphic appeared there, when a white field of paper is taken as a white space, and the artists pencil became similar to a cutter of a sculpture. The space of the white paper hangs on the drawings strokes. The epic nature of the narrative led to the monumentality of the images and compositions of the illustrations. There are artists theoretical thoughts about the connection of the multitemporal conditions in the works of art, the role of contour and spot.

ABSTRACT A combination of experimental and theoretical approaches was used to investigate the role of nutrient starvation as a potential trigger for biofilm detachment. Experimental observations of detachment in a variety of biofilm systems were made with pure cultures of Pseudomonas aeruginosa. These observations indicated that biofilms grown under continuous-flow conditions detached after flow was stopped, that hollow cell clusters were sometimes observed in biofilms grown in flow cells, and that lysed cells were apparent in the internal strata of colony biofilms. When biofilms were nutrient starved under continuous-flow conditions, detachment still occurred, suggesting that starvation and not the accumulation of a metabolic product was responsible for triggering detachment in this particular system. A cellular automata computer model of biofilm dynamics was used to explore the starvation-dependent detachment mechanism. The model predicted biofilm structures and dynamics that were qualitatively similar to those observed experimentally. The predicted features included centrally located voids appearing in sufficiently large cell clusters, gradients in growth rate within these clusters, and the release of most of the biofilm with simulated stopped-flow conditions. The model was also able to predict biofilm sloughing resulting solely from this detachment mechanism. These results support the conjecture that nutrient starvation is an environmental cue for the release of microbes from a biofilm.

Over the last several years there has been increased interest in and reliance on the role of phonetics in explaining various aspects of phonology. Such notions as ‘natural rule’ and ‘phonetically explainable’ are commonly equated and are incorporated into arguments over the appropriateness of some given rule formulation or over the range of analyses permitted under alternative theoretical approaches. Those who have made the strongest, most explicit appeal to phonetics in this regard include Stampe (1969, 1973), Ohala (1971, 1972, 1974a, 1974b, 1975, 1978), Schane (1972), Harms (1973), and Hooper (1976). The common thread in these various appeals is the claim that some or all defensible phonological rules are phonetically explainable.
