The development and progress of electronic transactions has resulted in changes in the activities of human life in various fields which have directly given rise to new forms of legal action that require Indonesia to form arrangements regarding electronic transaction management. The purpose of this study is to find out the background of the birth of criminal law policies regarding electronic transactions and to find out the formulation of criminal acts regarding electronic transactions in Law Number 19 of 2019 concerning Information and Electronic Transactions. The results of this study indicate that the background of the birth of the criminal law policy in the field of electronic transactions is the development of crime through electronic systems in society. Although crime through an electronic system is virtual, it can be categorized as a real legal act or action. Juridically, legal actions in this cyber space are regulated in the ITE Law. This ITE Law is an absolute legal approach to safeguard security in cyberspace and produce legal certainty on technology utilization issues.

Transaksi elektronik adalah  suatu transaksi perdagangan atau perniagaan baik berupa penyebaran, pembelian, penjualan, pemasaran barang dan jasa dengan menggunakan media elektronik yang terhubung melalui internet. Dengan adanya transaksi elektronik sangat menguntungkan bagi pihak konsumen dalam memilih berbagai jenis barang namun pelanggaran hak-hak konsumen sangat memungkinkan terjadi  mengingat transaksi elektronik mempunyai karakteristik yang berbeda dengan transaksi konvensional. Untuk itu diperlukannya perlingan hukum terhapa konsumen dalam jual beli barang yang mengandung unsure penyalahgunaan keadaan yang dihubungkan dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK). Penyalahgunaan keadaan yang sering dilakukan oleh pihak pelaku usaha adalah melanggar Pasal 4 UUPK tentang hak-hak konsumen. Penyalahgunaan keadaan juga dapat dilakukan oleh pihak pelaku usaha dengan mencantumkan klausula baku tidak sesuai dengan Pasal 18 UUPK tentang larangan pencantuman klausula baku.  Akibat dari penyalahgunaan keadaan dari pihak pelaku usaha mengakibatkan pihak konsumen mengalami kerugian dan mengakibatkan terjadinya wanprestasi. Selain UUPK dalam transaksi elektronik mengenai perlindungan terhadap konsumen juga diatur dalam Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UUITE). UUITE menjelaskan tentang tanggung jawab pelaku usaha terhadap konsumen yang terdapat dalam Pasal 9 UUITE yang menyatakan bahwa,” Pelaku usaha yang menawarkan produk melalui sistem elektronik harus menyediakan informasi yang lengkap dan benar berkaitan dengan syarat kontrak, produsen, dan produk yang ditawarkan”. Pasal ini menjelaskan tanggung jawab pelaku usaha dalam memberikan informasi yang sebenarnya mengenai toko online miliknya dan informasi terkait pencantuman klausula baku untuk menghindari terjadinya wanprestasi antara pihak konsumen dan pelaku usaha. Dalam kondisi seperti ini sepatutnya negara hadir terutama dalam wujud hukum yang mengatur dan memberi perlindungan kepada konsumen, seperti yang dijelaskan dalam Pasal 1 angka 1  UUPK menyebutkan bahwa Perlindungan Konsumen adalah segala upaya yang menjamin adanya kepastian hukum untuk memberi perlindungan kepada konsumen.Electronic transaction is a trading or commercial transaction in the form of distributing, purchasing, selling, marketing of goods and services by using electronic media connected via internet. With the electronic transaction is very beneficial for the consumer in choosing various types of goods but violations of consumer rights is possible because electronic transactions have characteristics different from conventional transactions. Therefore, the need for legal relief on consumers in buying and selling of goods containing elements of misuse of the circumstances associated with the Act Number 8, 1999 concerning Customer Protection (UUPK). Abuse of the state that is often done by the business actor is violating Article 4 UUPK concerning consumer rights. Abuse of the situation can also be done by the business actor by stating the standard clause does not comply with Article 18 UUPK about the ban on the inclusion of the standard clause. As a result of misuse of the circumstances of the business actors resulted in the consumer losses and resulted in a default. In addition to UUPK in electronic transactions concerning consumer protection is also regulated in the Information and Electronic Transaction Act (UUITE). UUITE explains the business actors' responsibility to consumers contained in Article 9 UUITE states that, "Business actors offering products through electronic systems must provide complete and correct information relating to the terms of contracts, producers and offered products". This Article describes the responsibility of business actors in providing actual information about their online store and information related to the inclusion of standard clauses to avoid the occurrence of wanprestasi between the consumer and business actor. Under these circumstances, the state should be present primarily in the form of laws that regulate and provide protection to consumers, as described in Article 1 point 1 UUPK mention that Consumer Protection is any effort that ensures legal certainty to provide protection to consumers.

The article describes a new method/idea about taxing the income towards the digital in Indonesia during the COVID-19 Pandemic. Since social and physical distancing has fertilized the trend to conduct trading activities through the electronic system and provide a level playing field, then the policies for direct tax (income tax) in the trading activities utilizing electronic systems were issued in Law Number 2 of 2020. To obtain data and information in this study, the authors used qualitative research methods. Considering that direct tax has been regulated in Indonesian legislation, this study uses a normative juridical approach without neglecting empirical facts in developing the digital economy. The application of this regulation is assessed based on the Tax Law in Indonesia by focusing on several aspects such as legal certainty and tax jurisdiction. Based on the tax philosophy in Indonesia, Law Number 2 of 2020 is considered as lacking in providing legal certainty and policies regarding the income tax for the trading activities utilizing the electronic system. It is considered a unilateral measure. This study on income tax is relatively new in facing the rapid development of the digital economy, especially regarding a permanent physical establishment that is considered irrelevant.

The focus of this research study aims to reaffirm the contents of article 45 paragraph (5) of the ITE Law related to complain offenses which are considered confusing in providing clear definitions and obscurity of legal certainty which can hinder the law enforcement process for justice seekers if there is a dispute in cyberspace. This type of research is normative legal research, descriptive using deductive reasoning. From the results of the discussion, this study shows that the complaint offense listed in the ITE Law which is abstract in nature is blurred if the complaint does not have a more concrete explanation of the meaning of the complaint. So that the Judicial Review needs to review the contents of the article. Policy formulation UU ITE No. 11 of 2008 concerning Information and Electronic Transactions which was last amended by Act No. 19 of 2016 specifically with the interaction of social change and changes in law today address alignments on the one hand in the interests of a group. Fokus dalam studi penelitian ini bertujuan untuk menegaskan kembali isi pasal 45 ayat (5) UU ITE terkait dengan delik aduan yang dirasa membingungkan dalam memberikan definisi yang jelas serta terkaburnya sebuah kepastian hukum yang dapat menghambat proses penegakkan keadilan hokum bagi pencari keadilan apabila ada sengketa di ruang cyber space. Tipe Penelitian ini adalah penelitian hukum normatif, deskriptif dengan mengunakan penalaran deduktif. Dari hasil pembahasan penelitian ini menunjukkan bahwa delik aduan yang tercantum dalam UU ITE yang bersifat abstrak menjadi kabur apabila delik aduan ini tidak mempunyai penjelasan yang lebih konkrit dari arti delik aduan tersebut. Sehingga dirasa perlu Judicial Review mengkaji lagi muatan pasal tersebut. Formulasi kebijakan UU ITE No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik yang terakhir diubah dengan Undang-Undang Nomor 19 Tahun 2016 khususnya dengan interaksi perubahan sosial dan perubahan hukum dewasa ini menujukan keberpihakan pada satu sisi dalam kepentingan suatu golongan.

The Research  on Buyer Legal Protection in the sale and purchase agreement through an electronic system aims to find out how the validity of the sale agreement through an electronic system and how the form of legal protection of buyers for losses due to damage to goods purchased through an electronic. By the agreement between the seller and the buyer in the sale and purchase agreement, they have the rights and obligations. This research method use Library Research Method and the research carried out in the library, where data is obtained from availeble data by reading, studying books, laws and relations, magazines, scientific paper, legal dictionaries and so on. Based on the method used, the results of this study indicate that the validity of the sale and purchaseagreement through an electronic system still considers the validity of the agreement as Article 1230 KUHP of the Civil Code, namely agreement of both parties, where both parties are capable in doing legal action and cause-effect which is lawfull. Buyer’s legal protection for losses due to damage to goods purchased through electronic systems is preventive protection and repressive protection, the buyerwho suffered the loss ca sue for loss or claim the replacement of the damaged goods with goods of the same brand.

Penatalaksanaan penyelenggaraan pemerintahan dan pengujian terhadap keputusan tata usaha negara dilakukan agar menjadi jelas dan memberi kepastian hukum. Dengan keluarnya UU No 30 Tahun 2014 tentang administrasi pemerintahan maka diperlukan penyelarasan dan penyesuaian atas peraturan peradilan tata usaha negara. Penelitian ini menggunakan pendekatan undang-undang (statute approach) dan penelitian hukum doctrinal. Hasil penelitian ini menunjukkan bahwa batas antara Pengadilan Umum dengan Pengadilan Tata Usaha Negara dalam memutus sengketa dibidang hokum dibedakan atas jenis perkaranya. Pengadilan umum memutus perkara dibidang perdata dan hokum pidana. Seangkan PTUN memutus perkara gugatan terhadapa perbuatan hokum pemerintah. Adapun penerapan prinsip-prinsip good governance dan AAUPB memiliki persamaan dan perbedaan, yang antara keduanya saling memiliki hubungan untuk mewujudkan pemerintahan yang baik dan sesuai hukum.<br /><br /><br /><em>Management of the administration and testing of state administrative decisions made in order to become clear and provide legal certainty. With the issuance of Law No. 30 of 2014 on government administration will require alignment and adjustment to regulatory administrative courts. Abstract: This article discusses about the legal reasoning used by the judges to sanction a criminal law hacking in the website of President of the Republic of Indonesia in State Court of Jember No. 253/Pid.B/2013/PN.JR. The results of the study explained that in Islamic criminal law, there is an element of the crime of access to computer hacking and/or electronic systems belonging to others without permission. This is regulated in article 30 paragraph (1) of act 11 year 2008 on information and electronic transactions which can be analogized as like entering someone else’s home without permission, the act is prohibited by Islam because there are some similarities in its legal argumentation. It is because there is no provision in the text about this criminal act. The criminal act of accessing a computer/electronic systems owned by others without permission in the Islamic Criminal Law (Fiqh Jinayah) can be categorized as jarimah ta'zir submitted to ulil amri, in this case is the government.Keywords: Legal sanctions, crime, hacking website.

Service at the “Kelurahan” is a very important part in determining the success of development, especially in public service. The problem faced is the lack of skill level of the “Kelurahan” apparatus with the more dynamic demands of the community and the archive management system is still conventional and manual that is writing the identity of the archive into the book agenda, expedition, control card, and borrowed archive card, so it takes a more practical electronic system, effective and efficient so required to develop themselves in order to improve public services. Conventional administration and archive management must be transformed into cloud-based computing (digital), for which archiving managers should always be responsive and follow these developments and wherever possible in order to utilize for archival activities, with greater access expected archives are evidence at once able to talk about historical facts and events and be able to give meaning and benefit to human life, so archives that were only visible and readable at archival centers can now be accessed online, and even their services have led to automated service systems. Using Microsoft Access which its main function is to handle the process of data manipulation and manufacture of a system, this system is built so that the bias runs on Cloud which means Cloud itself is a paradigm in which information is permanently stored on servers on the internet and stored. The purpose of this program is the implementation of administrative management that has been based cloud computing (digital) and is expected to be a solution in managing the archive so that if it has been designed and programmed, it can be stored in the computer and benefi- cial to the “Kelurahan” apparatus and add in the field of management archives in the form of improving the quality of service to the community, can facilitate and scientific publications.

Problem setting. According to Art. 27 of the Constitution of Ukraine, everyone has an inalienable right to life, no one can be arbitrarily deprived of life, and the state, in turn, is obliged to protect human life. Protection of a person’s life, as a duty of the state, is manifested in the establishment of criminal liability, enshrined in Section II “Criminal offenses against life and health of a person” of the Criminal Code of Ukraine, who commit socially dangerous acts. whether there are criminal offenses and what punishments they should be committed. The distinction between crimes such as premeditated murder and negligent deprivation of another’s life is important, as criminal law theory still does not have sufficient information on this issue and does not have a complete list of features of the above crimes, but we tried to identify them in our article. Target of research. Deepening their knowledge on the caution of a person’s life due to inconsistency and drawing the line between possible offenses and conditional authority, clarifying the special characteristics of the perpetrator and the victim, outlining the essential features of the perpetrator and the victim, and researching the regulation of negligent proposal of a new version of the Criminal Code of Ukraine. Analysis of resent researches and publications. The theoretical basis for the study of the problem of murder through negligence are the works of legal scholars, in particular, M. Bazhanov, V. Borisov, S. Borodin, V. Glushkov, O. Gorokhovskaya, I. Zinchenko , V. Tyutyugin, O. Us, E. Kisilyuk, V. Kuts, M. Yefimov, S. Likhova, V. Stashis, V. Shablisty and others. Article’s main body. According to Art. 3 of the Constitution of Ukraine, man, his life and health, honor and dignity, inviolability and security are recognized in Ukraine as the highest social value. Given this constitutional provision, the legislator should pay special attention to the criminal law protection of human life and health as the most important public relations. So it is no coincidence that considering such encroachments as one of the most dangerous in the criminal law dimension, the legislator established criminal liability for their commission in Section II “Criminal offenses against life and health” of the Special Part of the Criminal Code of Ukraine. Due to the high public danger and the high prevalence of criminal offenses against human life and health, criminal law theory and law enforcement practice are under increasing scrutiny. Thus, the analysis of judicial practice in recent years shows that, for example, among all murders (Articles 117-119 of the Criminal Code of Ukraine) the number of persons convicted of deprivation of life due to negligence is about 15 percent annually. In our opinion, it is also advisable to analyze the concept of “murder” by comparing the common and distinctive features of the offenses referred to in Art. Art. 115 and 119 of the Criminal Code of Ukraine. According to scientific results, we can conclude that these offenses have many common features. It is possible to understand the common features and preconditions for the spread of these types of offenses. Conclusions and prospects for the development. A study of issues related to the criminal law analysis of murder through negligence and its difference from other types of murder, shows that these acts encroach on the identical object, which is “human life as a set of social relations.” Unfortunately, nowadays the dynamics of offenses committed in Art. Art. 115 and 119 is intensifying, so consideration of their delimitation and characterization of their features is very important. The study examines the main features of these types of crimes, as well as analyzes some provisions of national law and proposes some adjustments to them.

The article considers topical issues of definition and qualification of crimes against human life in Ukraine and abroad. It is proved that the problematic issue of criminal law protection of human life is a significant differentiation of approaches to determining the moment of its onset, which reflects the medical and social criteria for the formation of an individual who has the right to life. It is shown that Ukrainian criminal law gives a person the right to life from birth, while the correct approach is to recognize the beginning of human life and appropriate criminal protection from the moment of onset 10 days after conception, which is consistent with European experience (in particular, France) and sufficiently reflects the medical features of the period of formation of a full-fledged embryo. The article also addresses the issue of the fact that Section II of the Special Part of the Criminal Code of Ukraine combines encroachment on two different generic objects - public relations for the protection of life and public relations for the protection of personal health. This provision of the criminal law of Ukraine does not correspond to the international practice on this issue. In addition, it is reasonable to believe that the two relevant categories of the object of criminal encroachment cannot be considered similar, as such an approach in certain cases can significantly complicate the classification of a criminal offense. It is emphasized that, given the exceptional importance of criminal law protection of human life, it is necessary to formulate a separate section of the Special Part of the Criminal Code of Ukraine, which covers only crimes against life as the main object of criminal encroachment.

Progressive law puts forward the sociology of law rather than legal certainty which is the focus of legal positivism. In Indonesia, this law was coined by Satjipto Rahardjo. This study aims to determine the formulation of progressive law in future criminal law, and to determine the actualization of the concept of progressive law in regulating corruption in Indonesia. The research method used is a normative legal research method with statute and conceptual approaches. The technique of collecting legal materials in this study is a descriptive method that aims to obtain the meaning of reality related to the problems to be discussed and solved in this study. The results show that in the current Criminal Code Bill, progressive law has been regulated, to be precise in Article 2 paragraph (1) and (2). Progressive law is also regulated in Law no. 48 of 2009 concerning Judicial Power. Then, the actualization of progressive law in regulating corruption in Indonesia is a judge with the powers that take into account the sociological context of society in making decisions. Judges, prosecutors and lawyers can certainly discuss together in eradicating corruption. Efforts are also being made to reconstruct and redefine the power of law enforcement. This arrangement can also encourage the KPK to be more progressive in eradicating corruption, as well as building law enforcers who have morality so that they can become role models and increase public participation, for example by forming NGOs in preventing or fighting corruption in various agencies.
