<p>Kriteria pengelolaan perikanan dalam kerangka pembangunan nasional, yaitu pro-growth, pro-poor, pro-job dan pro-environment, mengarahkan pengelolaan perikanan udang di Laut Arafura untuk mengoptimumkan produksi lestari dan keuntungan perikanan, serta meningkatkan keuntungan per kapal dan peluang kerja sebagai nelayan. Masing-masing tujuan tersebut perlu ditetapkan angka acuan sasarannya yang diharapkan dicapai dalam pengelolaan perikanan. Mengingat tujuan tersebut saling bertentangan, sehingga tidak dapat dicapai bersamaan, perlu ditentukan tingkat kompromi optimal diantara tujuan tersebut dan angka acuan sasarannya. Tulisan ini menyajikan model pemrograman matematika untuk optimisasi dengan empat tujuan pengelolaan, serta menggunakannya untuk mengestimasi angka acuan sasaran dan jumlah optimal kapal penangkap. Hasil optimisasi dengan pemberian bobot prioritas yang sama terhadap empat tujuan pengelolaan perikanan dalam kerangka pembangunan nasional menunjukkan bahwa angka acuan sasaran pada tingkat kompromi optimal dicapai dengan pengendalian upaya penangkapan pada tingkat yang setara dengan daya tangkap 512 kapal pukat udang 130 GT. Angka acuan sasaran yang sama dihasilkan dari optimisasi dengan pemberian bobot prioritas yang lebih tinggi terhadap dua tujuan pengelolaan perikanan sesuai dengan Pasal 6 Undang Undang Perikanan tahun 2004.</p><p>The criteria of fisheries management undertaken in a framework of national development, particularly pro-growth, pro-poor, pro-job and pro-environment, guide the management of shrimp fishery in the Arafura Sea to optimising shrimp production and fishery profit, and increasing per vessel profit and job opportunity as fishers. As those objectives were conflicting that could not be achieved simultaneously, it is necessary to seek an optimal compromise amongst several conflicting objectives and to estimate their target reference points. This paper presents a mathematical programming model accommodating four objectives of fisheries management, and the utilisation of this for estimating the target reference points and the optimal number of fishing vessels. The result of optimisation shows that target reference points at the optimal compromise levels for the four conflicting objectives, with equal priority, of fisheries management supporting the national development could be achieved by controlling fishing effort at the level equal to fishing power of 512 shrimp trawlers of 130 GT. The same target reference points resulted from the analysis providing higher priority to the objectives of fisheries management stated in Article 6 of Fisheries Act of 2004.</p>

Sementara itu, visi dan misi Kementerian Kelautan dan Perikanan memberikan prioritas yang lebih tinggi kepada optimisasi produksi dan total keuntungan perikanan. Tujuan-tujuan pengelolaan perikanan tersebut saling bertentangan sehingga tidak dapat dicapai secara bersamaan. Oleh karena itu perlu ditentukan tingkat kompromi optimal di antara tujuan-tujuan tersebut dan sasarannya. Tulisan ini menyajikan model pemrograman matematika untuk optimisasi dengan tujuan beragam yang mengakomodasikan empat sasaran pengelolaan perikanan serta menggunakannya untuk mengestimasi tingkat kompromi optimal dari empat sasaran tersebut dan jumlah optimal kapal penangkap udang. Hasil analisis dengan memberikan bobot prioritas yang sama terhadap empat tujuan pengelolaan perikanan dalam kerangka pembangunan nasional menunjukkan bahwa tingkat kompromi optimal dicapai dengan pengendalian upaya penangkapan pada tingkat yang setara dengan 511 kapal pukat udang berukuran 130 GT. Tingkat kompromi optimal yang sama dihasilkan dari analisis dengan memberikan bobot prioritas yang lebih tinggi terhadap dua tujuan pengelolaan perikanan untuk mendukung upaya pencapaian visi dan misi Kementerian Kelautan dan Perikanan. Meanwhile, the vision and the mission of the Ministry of Marine Affairs and Fisheries provided higher priorities to optimising shrimp production and total profit of fishery. However, those objectives were conflicting that couldnot be achieved simultaneously. Therefore, it is necessary to seek an optimal compromise amongst several conflicting objectives or to achieve satisficing levels of goals. This paper presents a mathematical programming model accommodating four goals of fishery management, and the utilisation of this for estimating the optimal compromise solution to the goals and the optimal number of fishing vessels. The result of analysis shows that the optimal compromise levels for the four conflicting objectives of fishery management supporting the national development could be achieved by controlling fishing effort at the level equal to 511 shrimp trawlers of 130 GT. The same optimal compromise levels resulted from the analysis providing higher priority to the objectives to achieve the vision and the mission of the Ministry of Marine Affairs and Fisheries. This indicates that the fishery management strategy to achieve the vision and the mission of the Ministry of Marine Affairs and Fisheries was not different from the strategy to support the national development.

Illegal fishing carried out by foreign fishing vessels (Kapal Ikan Asing, KIA) and Indonesian fishing vessels (Kapal Ikan Indonesia, KII) in Indonesian waters also causes other crimes such as the entry of illegal immigrants to Indonesia. This writing aims to assess the relationship between illegal fishing and the entry of illegal immigrants as a form of transnational crime. The research method used is normative legal research. The sources of legal material used are primary, secondary and tertiary legal materials related to writing. The technique of collecting data through library studies and analyzed qualitatively. The results of the study show that Indonesia as the largest archipelagic country in the world with 17,504 large and small islands and a length of coastline of 81,700 km 2 makes Indonesia a country with abundant marine resource potential. For this reason, many foreign naval fleets have made Indonesian waters as the main destination for their capture fisheries. This capture fishery company has more foreign ownership, the exploitation of marine resources that we own both legally and illegally. Likewise, this also happened in the Moluccas territory. As a province of the archipelago with an ocean area of ​​658,295 km 2 with a coastline length of 11,000 km 2, the Maluku Sea holds abundant potential for marine wealth. Arafura Sea is one of the fisheries management areas which is often the main destination for foreign-owned fishing vessels. These fresh fish from the Moluccas are stolen and taken away in fresh condition directly to the area of ​​origin of the perpetrators. Illegal fishing activities not only make Indonesia economically disadvantaged, but there is another problem, namely the existence of other crimes that usually follow the illegal fishing activities. One of them is the entry of illegal immigrants into Indonesian territory.

The maximum sustainable yield and the optimum fishing effort are estimated.

For law enforcement in the IEEZ in the context of Indonesia's national interest in the marine sector, the Indonesian Navy, the Maritime Security Agency (Bakamla), and the Ministry of Maritime Affairs and Fisheries (KKP) have carried out the execution of the sinking of foreign fishing vessels caught carrying out illegal fishing practices in the territorial waters Indonesia. This policy is intended as a stern warning to the perpetrators of illegal fishing as well as a form of Indonesia's commitment in monitoring and enforcing the law in Indonesian marine areas, which will continue to be carried out in order to have a deterrent effect on the perpetrators. However, the act of catching foreign fishing vessels is carried out, still based on the applicable rules and regulations, as well as the fulfillment of sufficient initial evidence.  Sufficient preliminary evidence to arrest a foreign-flagged fishing vessel is evidence that suspects a criminal act in the field of fisheries by a foreign-flagged fishing vessel.

The shrimp fishery off the Mexican Pacific coast is the country's most important fishery from the economic standpoint. However, it faces serious problems, including the fleet’s overcapitalization and age, in addition to the environmental variability that affects the size of catches. Thus, this activity depends on a variety of factors that add uncertainty to the profitability of fishing vessels. This study aims to estimate the probability of success and economic risk of "type vessels" under two different environmental variability scenarios in the Gulf of California. The results from the economic simulation pointed to the vessel type used in Guaymas (Sonora) as the most efficient one under a neutral climate change scenario, showing a homogeneous behaviour in physical characteristics and mode of operation. By contrast, under a scenario of a monotonic rise in sea surface temperature, the shrimp fishery faces a greater risk of incurring economic losses. The simulated climate behaviour scenarios revealed that the activity involves a moderate economic profitability under the neutral scenario; however, under the warming scenario, profitability may be low or even nil due to the risks and uncertainty resulting from the influence of environmental phenomena.

Amendment to the United Nations Convention on the Law of the Sea of 1982 with Law No. 17 the Year 1985 makes Indonesia have the right to utilize, conservation, and manage fish resources in Indonesia's exclusive economic zone and the high seas. Such rights are exercised under applicable international terms or standards. Therefore, legislation was made related to the sinking of illegal fishing vessels in Indonesian territorial waters through Law No. 45 of 2009 on Fisheries. Indonesia's high wealth of marine resources does not run following all layers' expectations after illegal fishing. However, the juridical consequences of applying the law have several impacts, namely the impact of sinking foreign vessels on relations with foreign countries and negative-positive effects in the marine environment due to the sinking of foreign vessels illegal fishing actors.

Dumanquillas Bay is a body of saltwater and the major source of food located in the Southern Mindanao. It has been observed that marine resources and fish catch in the area are declining. This study assumed that fishing practices affect the decline of marine and fish catch in the bay. A study on the documentation of fishing practices in the area is reported here. Key informant interview (KII), focus group discussion, direct observation and document archival were used. Twenty-three (23) fishing practices were observed in the area. Based on R.A. 10654 or the Philippine Fisheries Code, five (5) fishing practices were identified in the bay which are illegal. These are “pahulbot sa lalum”, “pahulbot sa mabaw”, “panubli”, “panguryente” and “troll” that destroys sea grasses, coral reefs and the sea beds. The illegal fishing practices identified poses a threat to the marine resources. It implies weak implementation of fishing policies among the LGU’s and other concerned government institutions and NGA’s. Capacity building, CEPA campaign and committed implementation of the Philippine Fisheries Code (R.A. 10654) should be implemented by the PAMB and stakeholders in the community to manage the remaining coastal marine resources thereby uplifting the socio-economic status of the coastal community and achieve sustainability.

Abstract The EU Landing Obligation (LO) is designed to reduce bycatch (i.e. unwanted catch) through more selective fishing practices, such as avoidance behaviours which consist in allocating fishing effort to other species, fishing grounds or seasons. Incentives for fishers to change their behaviours depend on their economic performances as well as their ability to avoid bycatch. Changes in economic performances under the LO are evaluated based on cost and revenue equations. The nested grid method is then used to explore the spatial and temporal distribution of landings and discards, and to suggest alternative effort allocation to avoid bycatch. This article is focussed specifically on the French otter trawl fishery in the eastern English Channel and southern North Sea. Results suggest that under the LO the choke species problem will curtail fishing activities earlier in the year, leading to significant economic losses. In the absence of significant quota top-ups (at least 75%), a change in fishing practices consisting in reducing overall bycatch by 30% is insufficient to reduce losses. With a particular attention to choke species, more economically efficient avoidance strategies can be found thanks to the nested grid method.
