Parodying the celebrated expression of Harvey, viz., Omne animal ex ovo, it has been attempted to formularise the law of development by the expression omnis cellula e cellula, and to maintain “that we must not transfer the seat of real action to any point beyond the cell.” In the attempts which have been made to support this exclusive doctrine, and to give all the tissues and all vital properties a cell origin, the great importance of the molecular element, it seemed to the author, had been strangely overlooked. It becomes important, therefore, to show that real action, both physical and vital, may be seated in minute particles, or molecules much smaller than cells, and that we must obtain a knowledge of such action in these molecules if we desire to comprehend the laws of organization. To this end the author directed attention: 1st, To a description of the nature and mode of origin of organic molecules; 2d To a demonstration of the fact that these molecules possess inherent powers or forces, and are present in all those tissues which manifest vital force; and 3d, To a law which governs the combination, arrangement, and behaviour of these molecules during the development of organised tissue.

The acts, practices and behaviors of the Public Power in the exercise of legitimation, can generate, in several situations, expectations in individuals. The Estate, in use of its prerogatives, can breach expectations, generating a negative economic response, lack of confidence and instability in its relations. Thus, the principle of protection defends the preservations of these state acts, which effects extend in time, giving the individual an expectation of continuity, even if they are illegal or unconstitutional. Delimiting the emphasis of the present work on the administrative function of the State, it was intended to understand the principle of the protection of trust as an instrument to protect the legitimate expectation of the individual, for imposing limits to the Public Administration in the annulment of administrative acts. In this situation, it was seen that this principle may conflict with legality and self-assessment, being the case of seeking a weighing judgment, which will result in the maintenance of the act or its annulment, this being possible with the temporal modulation of the effects for a certain future moment.

The three orationes Caesarianae, i.e., Pro Marcello and Pro Ligario given in 46 and Pro rege Deiotaro delivered in 45 are connected by the fact that the addressee of all of them is Caesar. The speech made in defence of King Deiotarus is the fruit (if possible) of both a legally and rhetorically critical situation: the judge of the case is identical with the injured party of the act brought as a charge: Caesar. Thus, the proceedings, conducted in the absence of the accused, in which eventually no judgment was passed, should be considered a manifestation of Caesar’s arrogance, who made mockery of the lawsuit, rather than a real action-at-law. This speech has outstanding significance both in terms of the lawyer’s/orator’s handling of the facts of the case under circumstances far from usual, and in the development of the relation between Cicero and Caesar. We can also observe some thoughts on the theory of the state framed by Cicero, the fight against Caesar’s dictatorship gaining ground, for the sake of saving the order of the state of the Republic.
