<p>Abstract<br />This article aims to explain the causes of the rejection of child immunization and efforts should be made so that the implementation of the childhood immunization program is well received in the protection of the rights of children in Karanganyar. This type of research is empirical. Form of research is exploratory. The data used are primary data and secondary data collection methods of documentation and interviews. Analysis of data using qualitative analysis. Based on the description of the results of research and discussion in connection with the considered problem with the theory of the legal system and application of the theory of law, it can be concluded that the factors that led to the rejection of immunization is: (a) the legal structure has not been able to implement the rules contained in the law; (b) legal norm or rule can not be implemented fully in society; (c) Most people do not understand the law and legal content community do not know the benefits of the existing law. Efforts should be made so that the implementation of the childhood immunization program is well received by all communities in Karanganyar district are: (a) the legal structure should be addressed; (b) The public policy context with the real conditions in the field or community legal norms or rules that can be applied; (c) promoting positive law and the laws governing the contents of the immunization program to the public so that people understand them. As for the consequences of the legal system are not addressed, then the rejection of child immunization will still occur and may tend to increase. The rights of children to be immunized and the rights of children born to avoid the diseases that threaten the survival and/or cause disability unprotected</p><p>Keywords: Legal Protection; Rights of the Child; Immunization Program.</p><p>Abstrak<br />Artikel ini bertujuan menjelaskan faktor penyebab terjadinya penolakan imunisasi anak dan upaya yang harus dilakukan agar pelaksanaan program imunisasi anak dapat diterima dengan baik dalam <br />upaya perlindungan hak-hak anak di Kabupaten Karanganyar. Jenis penelitian adalah empiris. Bentuk penelitian adalah eksploratif. Data yang digunakan adalah data primer dan data sekunder dengan metode pengumpulan data dokumentasi dan wawancara.  Analisis datanya menggunakan analisis kualitatif. Berdasarkan deskripsi hasil penelitian dan pembahasan sehubungan dengan <br />masalah yang dikaji dengan teori sistem hukum dan teori  penerapan hukum, dapat disimpulkan bahwa faktor yang menyebabkan terjadinya penolakan imunisasi adalah : (a) Struktur hukumnya <br />belum mampu melaksanakan aturan yang ada dalam hukum; (b) Norma atau aturan hukumnya belum dapat diterapkan sepenuhnya di masyarakat; (c) Sebagian masyarakat belum memahami <br />hukum dan isi hukum sehingga masyarakat belum mengetahui manfaat dari hukum yang ada. Upaya yang harus dilakukan agar pelaksanaan program imunisasi anak dapat diterima dengan <br />baik oleh semua masyarakat di Kabupaten Karanganyar adalah : (a) struktur hukumnya harus dibenahi; (b) Adanya kebijakan publik yang lebih kontekstual dengan kondisi riil di lapangan <br />atau masyarakat sehingga norma atau aturan  hukumnya dapat diterapkan; (c) mensosialisasikan hukum positif dan isi hukum yang mengatur tentang program imunisasi kepada masyarakat <br />sehingga masyarakat memahaminya. Adapun konsekuensi apabila sistem hukumnya tidak dibenahi, maka penolakan imunisasi anak akan tetap terjadi dan mungkin cenderung meningkat. <br />Hak anak untuk mendapatkan imunisasi dan hak anak yang lahir terhindar dari penyakit yang mengancam kelangsungan hidup dan/atau menimbulkan kecacatan belum terlindungi.</p><p>Kata kunci: Perlindungan Hukum: Hak Asasi Anak; Program Imunisasi.</p>

The purpose and this study is to know the Legal Protection for Good-Strong Parties in Cancellation of Sale and Purchase Agreement of Land and Banguan (Study of PN Decision No. 29 / Pdt.6 / 2014 / PN.wsb). This research is empirical law research, that is research based on implementation in effort to get primary data preceded by library research to obtain secondary data. The research was conducted at Notary Office / PPAT, and all data obtained were analyzed quantitatively. The chaotic health services due to paramedical doctoroid practices have an impact on legal and humanitarian issues. The existence of violation of the law by paramedic doctoroid actors is inseparable from the weakness of the legal system and structure in the world of medical health. This study aims to uncover paramedics who practice doctoroid practice on independent practice. Using the type of sociological legal research (sociolegal-research) that is descriptive analytical, with a critical study approach. Analysis of the results of the study showed that the practice of paramedic physoids was caused by the legal system starting from the substance of the law, legal structure and pathological legal culture. The types of physician practices carried out by paramedics include the practices of the authority of general practitioners, pediatricians, gynecologists, internists, cardiologists, dermatologists, surgeons and dentists. Doctoroid practice is a sub-standard health service which is actually a form of violation of the law in medical practice. Based on these conditions, then the form of transcendental-based legal protection as a solution. Transcendental-based legal protection is a preventive legal protection aimed at establishing a true legal perspective as a result of the process of internalizing divine revelation which is then objectified in the character of legal actors.Keywords: legal protection, paramedic doctoroid practice, transcendentalABSTRAKCarut marutnya pelayanan kesehatan akibat praktik dokteroid paramedis berdampak kepada persoalan hukum dan kemanusiaan. Adanya pelanggaran hukum oleh pelaku dokteroid paramedis tidak terlepas dari lemahnya sistem dan struktur hukum yang ada di dunia kesehatan medis. Penelitian ini bertujuan untuk mengungkap paramedis yang melakukan praktik dokteroid pada praktik mandiri. Menggunakan jenis penelitian yuridis sosiologis (sociolegal-research) yang bersifat deskriptif analitis, dengan pendekatan studi kritis. Analisis dari hasil penelitian menunjukkan bahwa praktik dokteroid paramedis disebabkan karena sistem hukum mulai dari substansi hukum, struktur hukum dan budaya hukum yang patologis. Jenis praktik dokter yang dilakukan oleh paramedis, berupa praktik kewenangan dokter umum, spesialis anak, ginekologis, internis, cardiologis, dermatologis, spesialis bedah maupun dokter gigi. Praktik dokteroid merupakan pelayanan kesehatan substandar yang sebenarnya adalah bentuk pelanggaran hukum dalam praktik kedokteran. Atas dasar kondisi tersebut, maka bentuk perlindungan hukum berbasis transendental sebagai solusi. Perlindungan hukum berbasis transendental merupakan perlindungan hukum preventif bertujuan terbentuknya perspektif hukum yang benar sebagai hasil proses internalisasi wahyu ilahiah yang kemudian terobjektifikasi dalam karakter para pelaku hukum.Kata Kunci: perlindungan hukum, praktik dokteroid paramedis, transendental

The results of this research, the settlement of wealth’s Yayasan Bhakti Sosial Surakarta is the obstacles the process of Foundation can be classified into three things according the theory of Legal System by Friedman, judging from its legal Structure is Pengadilan Negeri Surakarta Kelas IA Khusus Specifically less scrupulous and clearly in the verdict, then dropped from the substance of the law is the verdict No. 141/G.Pdt/ 2010/PN Ska defective award,the case Bhakti Sosial Surakarta’s Foundation reflects that culture law of the organs the Foundation are not obedientproduct law. Sanctions can be applied to the organs of the Foundation are not doing the settlement of wealth Foundation disbanded is article 70 of Act No. 16 Of 2001 Jo. Act No. 28 of 2004 about the Foundation, in addition to applying criminal sanctions can also apply the tort with petitum UVB and sequestration.</p><p>Keywords: The settlement, Wealth, Foundation, Court</p><p>Abstrak<br />Artikel ini bertujuan untuk mengetahui hambatan proses pemberesan harta kekayaan Yayasan Bhakti Sosial Surakarta dan Sanksi yang dapat diterapkan apabila organ yayasan tidak melakukan pemberesan harta kekayaan yayasan yang telah dibubarkan oleh pengadilan. Penelitian ini merupakan penelitian hukum empiris yang bersifat deskriptif. Lokasi penelitian yaitu di Kantor Advokat Heru S. Notonegoro dan Pengadilan Negeri Surakarta Kelas IA Khusus. Jenis dan sumber data penelitian ini meliputi data primer  dan  data  sekunder. Teknik  pengumpulan  data  melalui wawancara  dan  studi  kepustakaan. Teknik analisis data dilakukan secara kualitatif dengan interaktif model. Berdasarkan hasil penelitian menunjukkan bahwa hambatan proses pemberesan harta kekayaan Yayasan Bhakti Sosial Surakarta dapat digolongkan  menjadi  tiga  hal menurut teori Legal System dari Friedman, Dilihat dari Struktur Hukumnya yaitu Hakim Pengadilan Negeri Surakarta Kelas IA Khusus kurang cermat dan jelas dalam menjatuhkan putusan, kemudian dari Substansi Hukumnya yaitu Putusan No. 141/G Pdt. 2010/ PN Ska yang cacat amar putusannya, kasus Yayasan Bhakti Sosial Surakarta mencerminkan bahwa budaya hukum dari Organ Yayasan tidak taat produk hukum. Sanksi yang dapat diterapkan untuk Organ Yayasan yang tidak melakukan pemberesan harta kekayaan yayasan yang bubar adalah Pasal 70 Undang-Undang No.16 Tahun 2001 Jo.Undang-Undang No. 28 Tahun 2004 tentang Yayasan, selain menerapkan sanksi pidana juga dapat menerapkan perbuatan melawan hukum dengan petitum Putusan Serta Merta dan Sita Jaminan.</p><p>Kata Kunci : Pemberesan, Harta Kekayaan, Yayasan</p>

<p>With a brand, the company that produces the goods will be easily recognized. When the brand is already known by the public, will raise the reputation of the brand of the product so that in the event of violations, such as piracy or imitation famous brand are harmed is the first legitimate brand owners. Based on the permaslaah, then this article will be discussed about the protection of brand owners in the legal system of the first brand in Indonesia. Based on the background of the above can be identified several problems that include (1) the protection of brands based on the works of the law, system theory (2) system registration brand in Indonesia from time to time in accordance with the act of the brand that once existed in the Indonesia, (3) the protection of the law on the registration of the first brand owner brand with constitutive system, (4) a system of registration of the trademark in other countries. To address these problems, the authors use the juridical normative research methods. The system of registration, a brand under law 20/2016 about brands and geographical indications has a first to file. Legal protection of trademark owners first can be divided into two, namely the preventive legal protection that is made through registration of the brand and the repressive nature of legal protection that is done in case of violation of the brand through lawsuits or criminal charges. In addition, the act 20/2016 about brands and geographical indications as well arrange regarding the protection of brand owners first through temporary assignment court to protect its brand in order to prevent a greater harm. System registration brand in Malaysia with the same registration system brand in Indonesia. The two countries adhere to the basic constitutive system with first to file, i.e. the first applicant is a legitimate brand owners and obtained exclusive rights over its brand.</p>

AbstractIn 1998 Ghana harmonised its child care legislation to conform to the Convention on the Rights of the Child by enacting the Children's Act 1998, Act 560. Some stakeholders expressed misgivings at its capacity to ensure child protection, but little literature exists on the views of professionals working within the law. This paper presents an investigation of the views of professionals who are mandated to work within the law to ensure the rights of the child to legal protection in Ghana. The findings suggest that there is a gap between legal intent and practice. It is concluded from these findings that for better child protection, the provision of legal rights for children is only an initial step; the administrative framework including better professional training, adequate resources for social care agencies and the establishment of new structures also needs to be reconsidered.

Foundations, as permanent funds established by a certain legal act, can serve manifold purposes, but often pursue charitable goals. As such, they play an important role for the public good. Therefore, states always had an interest in fostering foundations by providing a pertinent legal framework. In Austria, this topic has not yet been the focus of scholarship. Through this study some light is shed on the implementation of the law on foundations in the Habsburg Monarchy. It focuses on the role of the state and its legal system regarding the regulation and supervision of foundations from 1750 to 1918. This period is characterized by the sovereigns’ endeavor to regulate the position of foundations via extensive legislation. In particular, a system of oversight for foundations was created in order to guarantee the attainment of their charitable goals. In fact, this system prevailed until the end of the 20thcentury.

The report surveys in two parts the development of the law on project-related planning and thus relates in particular to the planning and approval of space-consuming infrastructure projects such as traffic routes and power lines. For this purpose, German administrative law has long provided for the specific instrument of plan approval (Planfeststellung). In this context, the Federal Administrative Court has extensive first-instance jurisdiction and uses this to shape large parts of German approval law, including beyond the actual area of plan approval law, be it in terms of legal protection and procedure, be it with regard to the requirements of substantive environmental law. On the other hand, the revision of the law on environmental protection induced by the decisions of the Aarhus Compliance Committee and the European Court of Justice has been used by the German legislator to extend procedural specifics of the plan approval to other approval decisions of environmental relevance. This firstly indicates the contours of a general law on project approval and, secondly, the nature of the plan approval as an instrument for the implementation of projects in the public interest is more strongly emphasized.

Aware of gender discrimintaion of women and students of women in different countries, so they protest and movement finally manage to do some conference that have produced Convention On The Elimination Of All Form Of Diskrimination Against Women   (CEDAW). Indonesia has ratified CEDAW with Law No. 7, 1984. But until now gender discrimination still occurs in all facets of life and society. One of them is a fimale civil servant in Sumbawa regency. Discrimination that has accurred not given the opportunity to accupy the fimale civil servant echelon-echelon II and III. In connection with the second echelon echelon II or III on Sumbawa Regency :      1) What are the forms of gender discrimination against fimale civil servants. 2) What factors are causing it, and 3) What is the form of legal protection against civil servants are women from gender discrimination. This study includes empirical legal research aims to determine the effectiveness of the law and the legal vacuum in the administration and management of government, particularly in women civil servants in positions echelon II or III. Dates collected were analyzed with descriptive analytic techniques. These form of discrimination against women in Sumbawa civil servants include marginalization and subordination, the factors that cause it was a mistake in the interpretation and implementation   gender equality, influence the understanding and application of Islamic teachings, political and cultural factors shame, geographical factors tough, close relationship with the ruling factor, factor in the civil servants streotif women and a heavier workload factor for women. Moderate forms of legal protection can be seen from the substance of the law, the legal structure and legal culture.

Problem setting. Legal regulation is an integral component of the administrative and legal mechanism for ensuring the functioning of juvenile justice, through which the state regulates relevant social relations through law and the totality of legal means. Recent research and publications analysis. The following Ukrainian scientists tried to conceptually solve these issues: Ya. Kvitka, V. Levchenko, O. Maksimenko, N. Lesko, I. Ishchenko, O. Navrotsky. Paper objective. The purpose of the study is to obtain scientific and applied results on the presentation of options for legislative support of juvenile justice in other countries and to formulate proposals for improving the administrative and legal regulation of juvenile justice in Ukraine. Paper main body. The analysis of the legislation of other countries indicates that there are several conditional models of legal regulation of the peculiarities of ensuring the rights of the child in the exercise of juvenile justice. This division is based on the following criteria, such as the existence of a law in the country that establishes the general principles of the judicial and extrajudicial, administrative and legal protection of children’s rights; the existence of a separate law on juvenile justice, which codifies all the rules of law that determine the peculiarities of criminal proceedings against children; the existence of a separate law on juvenile justice, but which establishes the general principles of the operation of juvenile justice, public administration in this area, prevention of offenses, etc. Conclusions of the research. The expediency of adopting the Law on Juvenile Justice in Ukraine, which, in its content, will mainly be an act of administrative and legal nature, the Law «On Ensuring the Rights of the Child in Ukraine», the Law «On the Ombudsman of Ukraine» is substantiated. An auction is an activity of selling of goods in public by means of a verbal-bid to get the higher price or to get lower prices and the price quote can be done in a closed and written. This is done by the way of collecting the prospective buyers of the auction led by officials of the auction. In this case, the intended auction was the sale of goods that are held publicly. The auction, according to the regulations of security right, is when the debtor made a breach, the holder of the security rights have the right to sell the security rights’ objects over its own power through a public auction as well as taking payment of account receivable from the sale proceeds. An auction is an alternative to the sale of an undertaken asset by way of inviting prospective buyers at a particular time and place in which the last highest bidder in writing or orally is determined as the winner. The author used socio-legal research as his research method. To meet the forth standards set by the law, the auction should be widely announced to the public, either through printed file, electronic or visual. A legal certainty as a basis which concerned with propriety and justice is very closely related to the principle of auction sales in another. As the formulation of the problem of the form of identification of the problem, namely how the legal protection of the auction buyers encountered the obstacles as well as the solution.Keywords: Auction; Legal Protection; Mortgage Right
