<p>Abstract<br />The aim of this study was to determine the forms of tort committed by foreign direct investment companies which engaged in the field of fisheries in Indonesia. Fisheries in Indonesia has been 100 percent controlled by a foreign direct investor company. Ironically, many those companies committed unlawful act. This study was a normative legal research using legislation approached. The data was secondary one. The collection of those data through the library research, then analyzed qualitatively. An unlawful act committed by foreign direct investment company were: the legal status of companies that do not turn into foreign direct invesment company, a fictitious company, they were not building fish proccessing units, fishing gear that does not fit, transiphment, and violations of fishing ground. Pada Juni 2016, warga Inggris memilih untuk meninggalkan Uni Eropa, fenomena ini dikenal dengan nama Britania Exit yang disingkat dengan Brexit. Tulisan ini bertujuan untuk mengkaji pengaruh Britania Exit (Brexit) terhadap perekonomian Britania Raya, yaitu Gross National Income (GNI) dan Gross National Product (GNP) berdasarkan ekspor-impor, Foreign Direct Investment (FDI) dan ketenagakerjaan. Referendum menunjukkan bahwa lebih dari lima puluh persen warga Inggris memilih keluar dari Uni Eropa. Pasca politik British Exit (Brexit). Referendum Brexit terlihat dari alasan fundamental yaitu regulasi pasar ekonomi Inggris sendiri dan masalah imigrasi. Itu membuat Inggris kehilangan lebih banyak karena akses preferensial yang hilang ke pasar Uni Eropa yang besar. Tulisan ini menganalisis dengan menggunakan teori pertumbuhan ekonomi dan konsep kepentingan nasional. Metode penelitian yang digunakan adalah metode penelitian kualitatif, dengan sumber data sekunder yang didapatkan dari berita online, buku, jurnal, dan sumber-sumber tertulis lainnya. Teknik pengumpulan data yang digunakan adalah studi kepustakaan (library research), dengan teknik analisis data yang dimulai dari reduksi data, penyajian data, hingga penarikan kesimpulan. Adapun hasil dan pembahasan dari tulisan ini adalah kepentingan nasional Inggris yang berupa persoalan kedaulatan menjadi alasan dari Brexit, meskipun hal tersebut berdampak terhadap penurunan pertumbuhan ekonomi yang dialami oleh Inggris.

Indonesia is a development country that requires a large amount of funds to carry out development. To encourage development, Indonesia receives domestic and foreign financing. FDI (Foreign Direct Investment) is one of the alternative sources of funds in increasing development in Indonesia. FDI is a type of foreign investment that makes a significant contribution through asset transfers and management, as well as technology transfers that can boost the Indonesian economy. Investment in Islam is an activity based on this because of the investment, assets will be more productive and useful for others. The objective achieved in this study is to review how FDI in development is viewed from an Islamic economic perspective. In this study using the Library Research method, which is a study that utilizes library sources to obtain research data. This article is result of library research. This research is included in the category of normative legal research. This research discussion aims to explain the legal status of non-Muslim mothers in the context of post-divorce child care. The findings of this study are that according to the ulama' of the four schools of thought, the haānah rights of an apostate mother should not be granted. The argument that is built is that haānah does not only take care of physically but also includes children's religious education. The non-Muslim mother is feared to have a direct or indirect influence on the child. The legal status of an apostate also affects legal action. The apostasy reduces the ability to raise children, so the majority of scholars' abort the haānah rights for apostate mothers. KHI explains child custody/haānah in general as regulated in article 105. Parenting rights of non-Muslim mothers are not regulated by KHI. Penelitian ini masuk dalam kategori penelitian hukum normatif. Diskusi penelitian ini bertujuan menjelaskan status hukum ibu nonmuslim dalam konteks pengasuhan anak pascaperceraian. Temuan penelitian ini adalah bahwa menurut ulama’ empat mazhab, hak haḍānah ibu murtad, tidak boleh diberikan. Argumen yang dibangun adalah haḍānah  tidak  hanya merawat secara jasmani saja akan tetapi haḍānah juga meliputi pendidikan agama anak. Ibu nonmuslim itu dikhawatirkan memberi pengaruh baik langsung maupun tidak langsung kepada anak. Status hukum seorang yang murtad juga mempengaruhi tindakan hukum. Kemurtadan itu mengurangi kecakapan dalam mengasuh anak, sehingga mayoritas ulama’ menggugurkan hak haḍānah bagi ibu murtad. KHI menjelaskan hak asuh anak/haḍānah secara umum saja sebagaimana diatur dalam pasal 105. Hak Pengasuhan ibu non muslim tidak diatur oleh KHI. Being one of the most important tools of the national economy, foreign direct investment provides means for production expansion, creating employment opportunities and jobs, accelerating structural changes, improving the country’s financial standing in foreign relations, increasing its foreign exchange reserves, reducing budget holdbacks, and improving its credit rating. In Russia, foreign investments are primarily made through capital contributions by registered foreign residents. According to official reports, in the total annual capital inflows into the Russian Federation, 10 to 12% are attributable to foreign direct investment, 1 to 2% - to indirect investment, and up to 80% - to other investments. The current state of the world economy is characterized by many challenges: from increased competition and a new round of trade wars between major economic powers to a shift in emphasis in approaches to assessing the effectiveness of economic entities from exclusively financial to mainly non-financial, including environmental and social aspects. The corresponding economic conditions, coupled with significant political and economic pressure from a number of countries, sharply raise the issue of developing new approaches to determining the effectiveness of their own activities. Determining the effectiveness of business entities is necessary in order to ensure timely and adequate assessment of their business model from the perspective of key stakeholders and to develop an effective strategy for long-term sustainable functioning in the new business environment. This issue is particularly relevant for those economic entities that implement their activities, including through foreign representative offices. Determining the effectiveness of business entities ' representative offices abroad and evaluating their strategic performance, in addition to differences in approaches to accounting and public reporting, is also complicated by the specifics of the legal status of representative offices of economic entities, as well as the processes of legal regulation of their activities in different countries.

ABSTRACTOctopus production data show that catch in Banggai Laut waters is decreasing.  In addition, some destructive or illegal fishing gear such as spears, bombs and poisons are still used to catch octopus.  Given this alarming situation,  this study is intended to assess the sustainability status of octopus fishery in Banggai Laut Regency by means of the Ecosystem Approach Fisheries Management (EAFM) indicator.  Octopus catch data incorporating species and amount of catch, number of fishing efforts, mantle size, weight, fishing ground, and the type of protected species are obtained through direct observation on handline fishing and interviews with fishermen. Furthermore, the same method was applied to collect fishing techniques data including fishing efforts, fleet size, crew certification and data on illegal fishing practices.  The result shows that the status of octopus resource and the domain of fishing technique in Banggai Laut Regency is in the medium category with a value of 63.33 and 68.75 respectively. Accordingly, the sustainability level of octopus fisheries is in the moderate category with a value of 66.04.  Fisheries management related to the fishing practice that is targeting undersize octopus and exceeding the annual quota require further investigation in order to maintain the sustainability level of octopus fisheries.Keywords: Banggai Laut Regency, EAFM, octopus, sustainability levelABSTRAKInformasi tentang produksi menunjukkan bahwa hasil tangkapan gurita di perairan Banggai Laut cenderung menurun. Hal ini sangat mengkhawatirkan keberlanjutan sumberdaya gurita.  Penelitian ini bertujuan untuk mengevaluasi status atau tingkat keberlanjutan perikanan gurita di Kabupaten Banggai Laut. Kondisi keberlanjutan perikanan gurita di Kabupaten Banggai Laut dianalisis menggunakan indikator Ecosystem Approach Fisheries Management (EAFM).  Data sumberdaya gurita diperoleh melalui pengamatan langsung dalam kaitannya dengan pancing ulur dan wawancara yang meliputi jenis dan jumlah produksi hasil tangkapan pancing ulur, upaya penangkapan, ukuran panjang mantel gurita, bobot gurita, spot daerah penangkapan gurita dan spesies yang dilindungi. Data teknik penangkapan ikan diperoleh melalui wawancara, survey dan observasi data yang meliputi data upaya penangkapan, jumlah armada penangkapan pancing ulur, sertifikasi awak kapal perikanan dan pelanggaran operasi penangkapan pancing ulur. Domain sumberdaya gurita di Kabupaten Banggai Laut termasuk dalam kategori sedang dengan nilai 63,33. Domain teknik penangkapan termasuk kategori sedang dengan nilai 68,75. Tingkat keberlanjutan perikanan gurita secara keseluruhan termasuk kategori sedang dengan nilai 66,04. Pengelolaan terkait penangkapan gurita yang berukuran tidak layak tangkap dan membatasi hasil tangkapan maksimal yang boleh ditangkap per tahun perlu dilakukan untuk menjaga tingkat keberlanjutan perikanan gurita.Kata kunci:  Kabupaten Binggai Laut, EAFM, gurita, keberlanjutan

Scomberomorus guttatus is a large pelagic fish commodity in Pangandaran Regency. It has the highest amount and production values, therefore it needs to be maximally utilized but remains its sustainability. The purpose of this research is to determine the most selective fishing gear for Scomberomorus guttatus commodities based on the frequency of Scomberomorus guttatus length, the proportion of the main catch and by-catch in Pangandaran Regency for sustainable and environmentally friendly capture fisheries management. The data used in this study are the number of catches, catch weight and length of the Scomberomorus guttatus catches from gillnet, longline, and beach seine. Data used in research collected during November 2018-January 2019 in Pangandaran Regency. Analysis data used in the study is the analysis of the selectivity of the types of catches and the selectivity of the length of the catchable Scomberomorus guttatus from each of fishing gears. The results showed that of the three fishing gears used to catch Scomberomorus guttatus, gillnet is the most selective and productive fishing gear for utilizing Scomberomorus guttatus commodity because it has a 43,2% of main catch, 84,6% of the feasible Scomberomorus guttatus size. Longline is a fishing gear that is only selective to the length size of the Scomberomorus guttatus that has a percentage of decent size catch equal to 86,4%, while beach seine isn't selective fishing gear and unproductive for Scomberomorus guttatus commodities due to it designed to catch a demersal fish.

There have been some concerns over the existence of trade and investment agreements. They have been doubted because of the poverty and inequality issues in some regions across the globe. The rise of the spirit of national interest of their members has also exacerbated the situation. Hence, these two miserable facts may end up with a question whether Indonesia should keep joining trade and investment agreements. This article is aimed to examine if Indonesia should continue its participation in trade and investment agreements. Employing a normative legal research, this article put three parameters, analysing the continuity of Indonesia’s participation, namely the benefits of international trade and foreign direct investment, the rationale of trade and investment agreements, and how trade and investment agreements (that involve Indonesia) have positively affected Indonesia’s development. This article then claims that Indonesia should keep joining trade and investment agreements for realising its targets on economic growth and development.
