Legal aid in Indonesia, particularly in terms of access to justice, legal aid provided by the state for people is still pivoted on positive law. Laws regulating legal aid in Indonesia remain revolving around the number of cases and budget absorption targets given to legal aid institutions that have been verified and accredited by the state for people/groups in need. Verification and Accreditation from the state with parameters written in the law inhibit those who need legal assistance if they are not categorized as the poor. The requirement of the poor to access legal aid implies that access to legal aid for everyone in conflict is far from justice. Access to legal aid is essential since the purpose of the law is justice. Besides, legal aid aims to provide justice for those who do not have law knowledge, in other words, blind to the law. Justice for all is the vein of legal aid which is inseparable from the right of legal aid for those in need. Legal aid can be administered by social institutions/legal aid agencies which should provide access to those who need legal assistance and those who are in dispute, be it poor or rich so that justice for all can be achieved. This research discusses the transcendental dimension of legal aid. This study used a descriptive research method intending to analyze legal aid from legal aid institutions viewed from the study of legal philosophy and legal aid with transcendental dimensions.

Legal aid in Indonesia, especially in terms of access to justice, legal aid provided by the state to the people still relies on positive law. The law governing legal aid in Indonesia still revolves around the number of cases and the budget absorption target given to legal aid institutions that have been verified and accredited by the state for people/groups in need. In addition, legal aid aims to provide justice for those who do not have legal knowledge, in other words, are blind to the law. Justice for all is the pulse of legal aid that cannot be separated from the right to legal aid for those in need. Legal aid can be managed by the community, legal aid institutions/institutions that should provide access to those who need legal assistance and those in dispute, both poor and rich, so that justice for all is achieved. This study discusses the transcendental dimensions of legal aid. This study uses a descriptive research method that aims to analyze legal aid from aid agencies seen from the study of legal philosophy and legal aid with a transcendental dimension.

This research is a normative research. One of the fulfillment of human rights is justice in equalizing the position of every citizen before the law, as stated in Article 27 paragraph (1) of the 1945 Constitution of the Republic of Indonesia. The right to equality before the law or what is commonly referred to as equality before the law is a principle that provides recognition and protection of human rights for every individual regardless of one's background. Therefore, it is true that Law Number 16 of 2011 concerning Legal Aid for People Who Are Less Capable to Guarantee Constitutional Rights of Citizens for Justice and Equality before the Law emerged. Legal aid is a legal service provided by advocates to the community seeking justice In the realm of criminal cases, the provision of legal assistance is described in Article 54 of the Criminal Procedure Code which explains that in the interests of defense, a suspect or defendant has the right to receive legal assistance from one or more legal advisers during the time and at each level of examination. The provision of legal assistance must be based on the principle of equality before the law as stated in the explanation of Law Number 8 of 1981 concerning Criminal Procedure Law. From the various analyzes that have been carried out, in the perspective of Islamic criminal law it can be concluded that the principle of equality before the law as described in Article 54 of the Criminal Procedure Code is equivalent to an order to provide legal aid which in Islamic criminal law is spelled out in Surah Al-Maidah verse 2 which states that as a fellow humans are ordered to help each other as a form of horizontal worship to fellow humans (habl minan-nas). In addition there are many more both in the Al Qur'an and the hadith of the prophet regarding the application of the principle of equality before the law.

Indonesia as a state of the law has guaranteed the constitutional rights of each of its citizens without exception as a form of protection of human rights contained in Article 1 paragraph (3) of the 1945 Constitution. Providing legal assistance to citizens who are unable as constitutional rights of every citizen and the State is obliged to protect the constitutional rights regarding obtaining guarantees, protections, and certainty of law that is fair and equal treatment before the law. Legal aid legally in Law Number 16 of 2011 is a legal service free of charge to legal aid recipients. The thing that becomes the basis for the provision of legal assistance by the State is because the State is responsible for providing legal assistance to disadvantaged citizens as a form of access to justice and equality before the law. The state has a role in terms of establishing regulations as the legal basis for implementing legal assistance for disadvantaged citizens. But in reality, in the development of legal aid, there are several problems between legal aid providers (advocates) and the State as a guarantor of the constitutional right to the realization of justice and equality before the law for every Indonesian citizen, including the poor.

Legal Aid is organized to help resolve legal issues faced by Legal Aid Recipients. The birth of Law No. 16 of 2011 concerning Legal Aid provides new hope for the poor to gain access to justice and equality before the law. This writing aims to determine the implementation of the provision of legal aid and the obstacles that influence it in its implementation because sometimes the implementation of Law Number 16 of 2011 concerning Legal Aid in Indonesian Courts is not optimal. This research focuses on the application of legal aid to the poor, the challenges and problems they face. The method used in this research is empirical research. This study found that in the application of legal aid in several regions in Indonesia, the main problem faced in addition to the lack of availability of accredited legal aid institutions, was also the issue of the budget provided by the state. In addition, in terms of the legal culture of the community, the implementation of legal aid is not optimal due to the understanding of the community not to have anything to do with the law so that many cases that should receive legal assistance cannot be accompanied.

The implementation of legal aid is a manifestation of Indonesia as a legal state that guarantees the human rights of citizens to equality before the law which is guaranteed in the 1945 Constitution. Within the framework of implementing this citizen's human rights, the provision of free legal aid is, among other things, obligated to advocates based on Article 22 Law on advocates and their implementing regulations. From this, two problem formulations were made as follows: What is the juridical review of the provision of pro bono legal aid? And what is the role of advocates in providing pro bono legal aid? This research is based on normative legal research, which is a research conducted by reviewing and analyzing legal materials and legal issues related to the problems studied. The results of the author's discussion found that free legal aid is the right of the poor to obtain the same justice as other communities, so that the protection of their rights is well fulfilled and the principle of equality before the law. Advocates are obliged to provide free legal aid to justice seekers, and to obtain free legal assistance, justice seekers must submit a written application to an advocate organization or legal aid institution.

Providing legal assistance to the poor continues by the government to realize legal access and justice for all levels of society. Several regulations regarding legal aid have been issued by the state through the law and implementing regulations, but the fact is that the provision of legal aid is not yet effective. This causes a lack of access to law and justice for the poor. The effectiveness of providing legal aid by the government needs to be assessed to see how effective the legal aid program provided by the government is to realize legal access and justice for the poor. Therefore, criticism and advice should be given to the government in order to optimize legal assistance in order to achieve legal access and justice for all levels of society.

<p>Lahirnya Kalandra Law Office sesuai dengan SK. Menkumham No. AHU-0051440.A.H.01.07 Tahun 2016 diharapkan dapat memberikan akses terhadap keadilan (<em>access to justice)</em> dan kebersamaan dihadapan hukum <em>(equality before the law)</em>. Bantuan hukum merupakan suatu jawaban terhadap adanya kebutuhan masyarakat atas adagium “hukum tajam kebawah, hukum tumpul kebawah” ini didukung dengan lahirnya Undang-Undang  No.16 Tahun 2016 tentang Bantuan Hukum. Penelitian ini bermaksud untuk mengetahui peran <em>Kalandra Law Office</em> dalam memberikan bantuan hukum di kota semarang serta hambatan-hambatan yang mempengaruhi dalam peranannya. Metode yang digunakan dalam penelitian ini adalah normatif-empiris yang mengkaji peraturan tertulis Undang-Undang No. 16 Tahun 2011 Tentang bantuan hukum dalam <em>access to justice.</em> Kalandra <em>Law Office </em>diharapakan menjadi asa baru ditengah keputusasaan masyarakat awan dalam memperjuangkan hak-haknya dimata hukum. Oleh karena itulah Kalandra <em>Law Office</em> memiliki andil yang besar dalam <em>access to justice.</em> Sehingga dapat menumbuhkan harapan baru di dalam dunia peradilan tetapi juga menjadi bukti nyata akan keadilan yang sama bagi siapapun dimuka hukum</p><p>The birth of Kalandra Law Office in accordance with SK. The method used in this research is normative-empirical study of written regulations of Law No. 16 of 2011 concerning legal assistance in access to justice. Kalandra Law Office is expected to become a new hope amid the desperation of the cloud community in fighting for their rights in the eyes of the law. That's why Kalandra Law Office has a big contribution in access to justice. So that it can foster new hope in the world of justice but also be tangible evidence of equal justice for anyone before the law.</p>

В статье рассматриваются правовые и правоприменительные проблемы посещения адвокатами подозреваемых и обвиняемых, содержащихся под стражей. Проанализирована правоприменительная практика нарушений права подозреваемых и обвиняемых на получение своевременной квалифицированной юридической помощи. Обоснована необходимость наличия отлаженного государственного механизма реализации предусмотренных законом прав подозреваемых и обвиняемых. Перечислены проблемы, связанные с предоставлением свиданий адвокату с подозреваемыми и обвиняемыми, находящимися в следственных изоляторах уголовно-исполнительной системы. Проанализированы основания предоставления свиданий адвокату с подозреваемыми и обвиняемыми, содержащимися под стражей, в соответствии с действующим законодательством и нормативными актами ФСИН России. Исследован порядок посещения адвокатами подзащитных, содержащихся в следственных изоляторах уголовно-исполнительной системы, регламентированный как ведомственными нормативными актами ФСИН России, так и решениями адвокатских образований. Приведен механизм работы центра субсидируемой юридической помощи по вопросу организации посещений адвокатами подзащитных, содержащихся в следственных изоляторах. Раскрыт положительный опыт ФСИН России организации дистанционных свиданий адвокатов с подзащитными с использованием систем видеоконференц-связи. На основе рассмотренных проблемных вопросов сформулированы выводы и предложения по совершенствованию правоприменительной деятельности органов и учреждений уголовно-исполнительной системы. The article examines the legal and law enforcement problems of visits by lawyers to suspects and accused in custody. The law enforcement practice of violations of the right of suspects and accused to receive timely qualified legal assistance is analyzed. The need for a well-functioning state mechanism for the implementation of the rights of suspects and accused provided by law is substantiated. The problems associated with granting visits to a lawyer with suspects and accused persons who are in pre-trial detention centers of the penal system are listed. The author analyzes the grounds for granting visits to a lawyer with suspects and defendants in custody, in accordance with the current legislation and regulations of the Federal Penitentiary Service of Russia. The procedure for visiting by lawyers of clients held in pre-trial detention centers of the penal system, regulated by both departmental regulations of the Federal Penitentiary Service of Russia and decisions of lawyers' associations, has been investigated. The mechanism of work of the center for subsidized legal aid on the issue of organizing visits by lawyers to clients held in pre-trial detention centers is presented. The positive experience of the Federal Penitentiary Service of Russia in organizing remote meetings between lawyers and clients using videoconferencing systems is disclosed. On the basis of the considered problematic issues, conclusions and proposals were formulated to improve the law enforcement activities of the bodies and institutions of the penal system.

<p>Lembaga Bantuan Hukum Perguruan Tinggi Negeri (LBH PTN) selama beberapa dekade turut mewarnai proses penegakan hukum di Indonesia. Sejak diundangkannya Undang-Undang (UU) Advokat, mewajibkan pemberi bantuan hukum memiliki lisensi kepengacaraan, sehingga LBH PTN tidak bisa lagi leluasa bergerak, meski kemudian terdapat putusan Mahkamah Konstitusi (MK) yang membatalkan pasal pemidanaan dalam UU Advokat tersebut. Secara praktis, posisi LBH PTN harus dipahami sebagai bagian upaya dari para civitas akademika dalam melakukan pengabdian masyarakat dan pengembangan keilmuan hukum. Lahirnya UU No. 16 Tahun 2012 tentang Bantuan Hukum, memberikan angin segar dalam mereposisi LBH PTN dalam melakukan pemberian bantuan hukum yang menjamin akses keadilan. Dengan menggunakan pendekatan sosio legal ditemukan bahwa UU Bantuan Hukum mereposisi peran pengabdian masyarakat LBH PTN setelah vacuum akibat tidak adanya aturan yang jelas dan tegas yang mengakomodir peran mereka selama puluhan tahun bergerak di bidang bantuan hukum pro masyarakat miskin . UU Bantuan Hukum memperluas de fi nisi Pemberi Bantuan Hukum, sehingga memberikan peluang bagi para dosen PTN, paralegal dan mahasiswa hukum yang tergabung dalam LBH untuk melakukan pengabdian masyarakat sekaligus pengembangan keilmuan hukum. Implementasi jaminan access to justice yang dilakukan LBH PTN dapat dilakukan secara lebih optimal pasca diberlakukannya UU Bantuan Hukum. Proses pemberian pelayanan bantuan hukum dapat dilakukan dengan cara melakukan pendampingan secara litigasi maupun non litigasi, dengan bantuan pendanaan dari negara.</p><p>Access to Jus tice Abstract Legal Aid Institution of State Universities (LBH PTN) in fl uence process of law enforcement in Indonesia for several decade. Since the enactment of law on advocate which requires advocate license for legal aid provider, so that LBH PTN could not more move freely, even then there is the Constitutional Court (MK) decision who cancel article punishment in the Advocates ActIn practically, posi Ɵ on of LBH PTN should be understood as part of academic community e ff ort to perform community service and legal science development. The enactment of law number 16 year 2012 on legal assistance has given a fresh breeze in repositioning LBH-PTN to do some legal assistance that guaranteed access to justice. By using socio legal approach founded that law on legal assistance has been repositioning the role of community service in LBH-PTN aer vacuum caused by the lack of obvious and assertive rules that accommodates their roles for decades to legal assistance which is pro poor society. The expansion of definition legal aid provider in the law on legal aid have been giving an opportunity for state university, paralegals and students who are members of legal aid institution to perform community service together with development of legal science. Implementation of guaranteed access to justice is doing by LBH-PTN could be made optimally post enactment the law on legal aid.Awarding process of legal assistance could be done by accompaniment litigation and non-litigation, dissemination, legal consultation, and other program which related to the implementation of legal assistance with the help of state funds.</p>
