Industrial Revolution 4.0 has influenced the development of technology and information. The presence of financial technology (fintech) especially fintech peer to peer lending in Indonesia is proof that the Industrial Revolution 4.0 has had an influence on economic aspects as a fundamental aspect of the country. The implementation of fintech peer to peer lending in providing alternative financing to consumers is currently faced with several problems, especially issues related to consumer protection. This study uses a normative legal research method with a statutory approach. This research shows that the state has tried to provide preventive protection to consumers through several regulations, namely Bank Indonesia Regulation Number 19/12/PBI/2017 concerning the Implementation of Financial Technology that regulates the procedures for implementing fintech in Indonesia and also the OJK Regulation Number 77/POJK.01/2016 on Information Technology-Based Lending and Borrowing Services that regulates OJK's supervisory function in implementing fintech peer to peer lending in Indonesia. This protects consumers through the regulation of digital-based savings and loan providers which must be officially registered to guarantee the legality of the organizer, electronic documents by statutory provisions, and dispute resolution mechanisms in the event of a dispute related to fintech peer to peer lending business activities.

The Financial Services Authority (itself is an institution that is independent and free from interference from other parties, which has the functions, duties and authority of regulation, supervision, inspection and investigation. Consumers themselves are one of the unimportant in running their business. From the government, they act really how to support customers with challenges faced by consumers, in terms of consumer financial services protection, the Financial Services Authority (OJK) and the government's extension of the peer to peer lending. The method used in this research is qualitative by using normative juridical. Data collection techniques were carried out using the triangulation method with observation, interviews and documentation. The efforts of the financial authorities related to consumer protection are already good with SATGAS Investment Alert, fintech emergency numbers, but it is still has not been maximized and needs to be increased again. The community itself still believes that applications with four or more stars and good reviews are official applications.

AbstractThe growth of information technology or commonly referred to as Industrial Revolution 4.0 has given birth to a new idea namely Money Lending and Borrowing Services based on Information Technology. Peer to Peer Lending (P2P) Lending is a service that is much in demand by the public. The majority of P2P Lending financial technology providers do not require collateral. With this condition, OJK has issued a special regulation, namely POJK No. 77 / POJK.01 / 2016 concerning Money Lending and Borrowing Services based on Information Technology. Article 21 POJK No.77 / POJK.01/2016 states that the Operator is required to manage credit risk and operational risk. One risk management undertaken by the Provider is to use Credit Scoring to classify Debtors into certain risk grades. However, because the majority of P2P Lending does not require a material guarantee, the Credit Scoring factor other than collateral becomes very important. In practice, the Operator is often less selective about the classification of Debtors in Credit Scoring, resulting in many defaults.Keywords: Peer to Peer Lending; Financial Technology; Credit Scoring; Risk Grade.AbstrakPerkembangan teknologi informasi informasi atau yang biasa disebut dengan Revolusi Industri 4.0 telah melahirkan gagasan baru yaitu Layanan Meminjam Uang Berbasis Teknologi Informasi. Peer to Peer Lending (P2P) Lending menjadi layanan yang banyak diminati oleh masyarakat. Dari beragam Penyelenggara teknologi finansial P2P Lending mayoritas tidak mensyaratkan adanya jaminan kebendaan. Dengan adanya kondisi tersebut OJK telah mengeluarkan aturan khusus yaitu POJK No. 77/POJK.01/2016 tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi. Pasal 21 POJK No.77/POJK.01/2016 menyatakan Penyelenggara wajib melakukan manajemen risiko kredit dan risiko operasional. Salah satu manajemen risiko yang dilakukan Penyelenggara adalah menggunakan Credit Scoring untuk mengklasifikasi Debitor ke dalam risk grade tertentu. Meskipun demikian karena mayoritas P2P Lending tidak mensyaratkan adanya jaminan kebendaan, maka faktor Credit Scoring selain jaminan menjadi sangat penting. Pada prakteknya Penyelenggara seringkali kurang selektif terhadap klasifikasi Debitor dalam Credit Scoring sehingga banyak terjadi wanprestasi. The purpose of this study is to analyze the legal basis for consumer protection and forms of consumer protection for the inclusion of exoneration clauses in financial technology peer to peer lending. This paper uses normative juridical methods for reviewing and analyzing the application of rules, regulations, and positive legal norms contained in the legislation. The analysis technique uses analytical prescriptive. The results of the study show that there are currently three regulations relating to consumer protection of Financial Technology Peer to Peer Lending in Indonesia, i.e. the Consumer Protection Act, Financial Services Authority Regulation Number 77/ POJK.01/2016 concerning Financial Technology Peer to Peer Lending, and the Law Number 11 of 2008 concerning Information and Electronic Transactions. The form of consumer protection for consumers over financial technology peer to peer lending with addition of clause exoneration is to impose sanctions on the organizer in the form of warning letters, fines, restrictions on business activities, and revocation of licenses granted by the Financial Services Authority. If through giving sanctions the consumer still feels disadvantaged, the consumer can resolve the problem through the District Court or outside the court by the Consumer Dispute Resolution Board.

Abstrak Peranan internet dalam teknologi informasi telah digunakan untuk mengembangkan industri keuangan  (financial industry)  melalui modifikasi dan efisiensi layanan jasa keuangan yaitu dikenal dengan istilah Financial Technology atau Fintech. Fintech jenis pinjam-miminjam uang berbasis teknologi atau peer to peer lending (P2P-lending) merupakan jenis Fintech yang tumbuh pesat di Indonesia, kelebihan pinjam meminjam uang melalui layanan P2P-lending lainnya adalah syarat yang sangat mudah dan proses yang cepat dibandingkan meminjam uang melalui Lembaga Bank. Namun kemudahan transaksi yang ditawarkan oleh layanan P2P- lending justru memperlemah posisi dari konsumen. Permasalahan Bagaimanakah Penerapan Konsep Utilitarianisme Untuk Mewujudkan Perlindungan Konsumen Fintech. (Financial Technology) Yang Berkeadilan, Tujuan  untuk mengetahui bagaimanakah penerapan konsep utilitarianisme untuk mewujudkan perlindungan kosnumen fintech ( finansial technology yang berkeadilan . Kata kunci : utilitarianisme, perlindungan konsumen, berkeadilan Abstrak The role of the internet in information technology has been used to develop the financial industry through the modification and efficiency of financial services, known as Financial Technology or Fintech. Fintech borrows money based on technology or peer to peer lending (P2P-lending) is a fast-growing type of Fintech in Indonesia, the advantages of lending and borrowing via other P2P-lending services are very easy conditions and a fast process compared to borrowing money through Bank Institution. Research This study aims to review and analyze the legal protection of loan recipients in the implementation of financial technology. Changes in the financial sector today are fintech (financial technology), one of which is peer to peer lending. The proliferation of peer-to-peer lending-based fintech in Indonesia is often a problem, although on the other hand it is also an answer for people who need funding quickly and easily. Whereas against the rise of online lending (peer to peer lending), the government in this case is the OJK (Financial Services Authority) has taken various ways to protect the community and foster a good business climate, but the problems faced by the community still occur. The problem in this research is what form of legal protection is obtained by recipients of fintech peer to peer lending-based money based on the provisions of applicable laws and regulations? and how to increase the government's role in the implementation and development of fintech-based peer to peer lending services. The research method used in this research is normative juridical. The implementation of financial technology based on peer-to-peer lending has not gone well.

Perkembangan teknologi informasi sangat pesat, adanya kolaborasi antara teknologi informasi dengan berbagai bidang kehidupan melahirkan berbagai macam inovasi yang membuat kehidupan masyarakat semakin mudah. Inovasi di bidang teknologi informasi melahirkan model bisnis baru yang pada gilirannya mampu menghasilkan efisiensi bagi masyarakat. Revolusi teknologi informasi tersebut terus berkembang dan sekarang memasuki bidang keuangan yang regulasinya ketat. Kolaborasi antara teknologi informasi dengan bidang keuangan melahirkan Teknologi Finansial atau Financial Technology (Fintech), salah satunya pinjam-meminjam uang berbasis teknologi informasi (Peer to Peer Lending/P2P Lending). Masyarakat menjadi lebih mudah mengakses kebutuhan keuangannya melalui P2P Lending. Di sisi lain, muncul tantangan dalam P2P Lending mengenai perlindungan data (data pribadi, data transaksi dan data keuangan). Dalam penelitian ini yang akan dibahas hanya data pribadi Penerima Pinjaman, dimana data pribadi tersebut perlu dilindungi agar tidak terjadi penyalahgunaan yang menimbulkan permasalahan hukum

Adanya ketidakseimbangan dalam penggunaan perjanjian baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan di Kota Banda Aceh memberi perlindungan hak kepada penjual daripada pembeli, sehingga lebih banyak risiko kerugian yang harus dipikul oleh pembeli. Pokok permasalahan dalam artikel ini adalah apakah klausula baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan melanggar ketentuan peraturan perundang-undangan tentang perlindungan konsumen. Jenis metode penelitian yang digunakan dalam artikel ini adalah jenis metode penelitian hukum normatif. Pendekatan penelitian hukum yang digunakan dalam artikel ini terdiri dari, pendekatan peraturan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa perjanjian baku pada perusahaan pembiayaan PT ADMF bertentangan dengan ketentuan KUH Perdata, khususnya dalam Pasal 1266, Pasal 1267, Pasal 1337, Pasal 1338 ayat (1), ayat (2), dan ayat (3), Pasal 1339 KUH Perdata, dan juga bertentangan dengan ketentuan UUPK, khususnya dalam Pasal 4, Pasal 7, Pasal 18 ayat (1), dan ayat (2) UUPK. Oleh karena itu, penggunaan perjanjian baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan harus ditinjau dan disesuaikan agar tidak bertentangan dengan ketentuan undang-undang.  Standard Agreement in The Hir-Purchase Agreement for the Motor Vehicles in a Finance Company in Banda Aceh  The existence of an imbalance in the use of standard agreement in the hire-purchase agreement for motor vehicles in a finance company in Banda Aceh gives protection to the seller rather than the buyer, thus more risk of loss to be borne by the buyer. The main issue in this article is whether the standard clause in the hire purchase agreement of motor vehicles in the finance company violates the provisions of legislation on consumer protection. The research method used in this article was the normative legal research method. The legal research approaches used in this article consist of, statutory approach, case approach and conceptual approach. The results showed that the standard agreements used by PT ADMF was contradictory to the provisions of the Civil Code, particularly in Article 1266, Article 1267, Article 1337, Article 1338 Paragraph (1), Paragraph (2), and Paragraph (3), Article 1339 Civil Code, and also contrary to the provisions of UUPK, particularly in Article 4, Article 7, and Article 18 paragraph (1) and paragraph (2) UUPK. Therefore, the standard agreements in the hire-purchase agreement of motor vehicles in the finance company should be reviewed and adjusted so as not violates the provisions of legislation.

Public interest in shoes is a special need, shoes are in great demand by millennials because they are useful for protecting feet. The habit of collecting these shoes arises from the desire of humans to keep their goods so they don't get damaged quickly and stay clean for a Long time. However, there are still cases of damage to shoes that cause Losses to consumers and there is no responsibility from the shoe washing service. The research method used is the type of empirical Law, empirical legal research aims to find facts, and conduct interviews. There are internal and external factors that cause damage to consumer shoes by business actors. So that responsibility for losses cannot be carried out unilaterally between business actors and consumers because there are Legal remedies that can be taken if they are harmed. Lack of knowledge and understanding fromconsumers, makes the position of consumers lower than business actors. So with the existence of Law Number 8 of 1999 concerning Consumer Protection, both parties need to know so that their rights and obligations are not violated.
