Indonesian geographical, geological and hydrological regions are disaster-prone areas. Disaster-prone is the geological, biological, hydrological, climatological, geographical, social, cultural, political, economic and technological conditions or characteristics of a region for a certain period of time that reduce the ability in preventing, reducing, achieving readiness, and reduce the ability to respond to adverse impacts of certain hazards. People's behavior that damages the environment also tends to increase the number of disasters. Seeing such conditions, the government has compiled a policy to allocate budgets for pre-disaster, during emergency response, and post-disaster development. This government policy is also supported by the contributions of community in providing disaster relief. A bad disaster management system can be a gap to commit criminal acts against funds and disaster relief. In this study, two issues will be discussed, namely legal politics in funding and managing disaster relief and the legal consequences of criminal acts in funding and management of disaster relief. The legal politics in disaster relief funding and management are outlined in The Act Number 24 of 2007 concerning Disaster Management and Republic of Indonesia Government Regulation Number 22 of 2008 concerning Funding and Management of Disaster Assistance. The legal consequences of criminal acts of funding and management of disaster assistance are criminal penalties ranging from imprisonment, fines, or capital punishment

Pasal 18B ayat (1) UUD Tahun 1945 memberikan legitimasi terhadap Qanun Aceh No. 3 Tahun 2013 tentang Bendera dan Lambang Aceh yang merupakan hasil kesepakatan Pemerintah Indonesia dengan GAM. Hal ini kemudian dituangkan ke dalam Undang-Undang No. 11 Tahun 2006 tentang Pemerintahan Aceh. Permasalahannya adalah materi qanun tersebut dianggap bertentangan dengan Peraturan Pemerintah No. 77 Tahun 2007. Pemerintah Pusat menghendaki perbaiki terhadap beberapa materi qanun, namun pihak Pemerintah Aceh dianggap menyalahi MoU Helsinki. Rumusan masalah kajian ini sebagai berikut: Pertama, apakah landasan pemikiran lahirnya Qanun Aceh No. 3 Tahun 2013 tentang Bendera dan Lambang Aceh? Kedua, apakah akibat hukum dari adanya Pasal 246 ayat (2), dan ayat (4) serta Pasal 247 Undang-Undang No. 11 Tahun 2006 tentang Pemerintahan Aceh? Ketiga, apakah akibat hukum adanya Qanun Aceh No. 3 Tahun 2013 tentang Bendera dan Lambang Aceh? Hasil penelitian sebagai berikut: Pertama, menemukan landasan pemikiran lahirnya Qanun Aceh No. 3 Tahun 2013 tentang Bendera dan Lambang Aceh terdiri dari Pasal 18B UUD Tahun 1945 serta perumusan Pasal 246 dan Pasal 247 Undang-Undang No. 11 Tahun 2006. Kedua, bahwa akibat hukum dari adanya Pasal 246 dan Pasal 247 berlaku dan sah untuk diterapkan melalui pembentukannya Qanun Aceh. Ketiga, konsekuensi yuridis adanya Qanun Aceh No. 3 Tahun 2013 berlaku secara yuridis dan dapat ditindaklanjuti oleh Pemerintah Aceh karena sudah diundangkan dalam lembaran daerah. Tentu sudah berlaku secara otomatis karena pada saat disahkan oleh Gubernur Aceh selaku Kepala Pemerintah Aceh dan DPRA secara serta merta diundangkan dalam lembaran daerah Pemerintah Provinsi Aceh. Legal Certainty of Qanun Aceh Number 3 Year 2013 On Flag and Symbol of Aceh  The 1945 Constitution Article 18B paragraph (1) gives legitimacy to the Aceh Qanun Number 3 of 2013 on the Flag and the Symbol of Aceh which is the result of the Government of Indonesia's agreement with GAM. This is then poured into Law Number 11 Year 2006 regarding Aceh Government. The problem is that the Qanun material is considered to be contradictory to Government Regulation Number 77 of 2007. The central government wants to improve on some of the Qanun material, but the Government of Aceh is considered to have violated the Helsinki MoU. The formulation of the problem as follows: First, what is the basis of thinking the formulation of Aceh Qanun Number 3 of 2013 on the flag and the symbol of Aceh? Second, what are the legal consequences of the existence of Article 246 paragraph (2), and paragraph (4) and Article 247, Law Number 11 Year 2006 regarding Aceh Government? Thirdly, what are the legal consequences of Aceh Qanun Number 3 of 2013 on the Flag and the Symbol of Aceh? The results of the research are as follows: First, find the foundation of the thought of the birth of Aceh Qanun Number 3 of 2013 on the Flag and the Symbol of Aceh consists of Article 18B of the 1945 Constitution and the formulation of Article 246 and Article 247 of Law Number 11 Year 2006. Second, the existence of Article 246 and Article 247 is valid and valid to be implemented through the establishment of Aceh Qanun. Thirdly, the juridical consequences of the Aceh Qanun Number 3 of 2013 are valid in juridical manner and can be acted upon by the Government of Aceh as already enacted in the regional slabs. Of course already valid automatically because at the time passed by the Governor of Aceh as Head of the Government of Aceh and DPRA is immediately promulgated in the sheet area of Aceh Provincial Government.

AbstractThe state requires mothers through Article 128 of Law Number 36, 2009 concerning Health to fulfill children's human rights in the form of exclusive breast milk for 6 months. Furthermore Government Regulation Number 33 of 2012 concerning Exclusive Breastfeeding allows substitution of breast milk in the form of formula milk and donor breast milk. Pumping is one of the ways to obtain donor breast milk. Article 11 Paragraph (2)e of the Government Regulation on Exclusive Breastfeeding asserts breast milk is not traded. The result of this article is the legal actions of buying and selling breast milk, especially regarding the fulfillment of the legal requirements of the agreement, the nature of Pumped Breastmilk as object in law and the legal consequences of its actions. The type of research used is doctrinal research, which uses statutory approach and conceptual approach.Keywords: Pumped Breastmilk; Objects; Sale and Purchase; Legal Terms of Agreement.AbstrakNegara mensyaratkan ibu melalui Pasal 128 Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan untuk memenuhi hak asasi anak berupa Air Susu Ibu (ASI) Eksklusif selama 6 bulan. Selanjutnya mengenai diatur dalam Peraturan Pemerintah Nomor 33 Tahun 2012 tentang Pemberian ASI Eksklusif bahwa apabila ibu tidak bisa memenuhi kebutuhan ASI anak maka bisa diberikan pengganti susu formula dan ASI donor. ASI donor dapat diperoleh salah satunya melalui metode pumping yang dinamakan ASIP. Pada pengaturan syarat donor ASI dalam Pasal 11 Ayat (2) PP Pemberian ASI Eksklusif, yang pada huruf e menyebutkan bahwa ASI tidak diperjualbelikan. Hasil artikel ini ialah perbuatan hukum jual beli ASI yang digali lebih jauh terutama mengenai pemenuhan syarat sah perjanjiannya, hakikat ASIP sebagai benda dalam hukum dan akibat hukum perbuatannya. Tipe penelitian yang digunakan yaitu doctrinal research, yang menggunakan pendekatan perundang-undangan serta pendekatan konseptual.Kata Kunci: Air Susu Ibu Perah; Benda; Jual Beli; Syarat Sah Perjanjian.

Organization of Prov. Regional Disaster Management Agency North Sulawesi Moves in the Field of Disaster Management Operations Centers which need to implement Government Regulation No. 71 of 2010 on accrual bases to provide information from financial records and facilitate more effective performance. In accounting there are two records of the first cash basis and accrual basis. Accrual Basis is the basis for facilitating performance measurement, in regulating clearer and more understandable. This study uses descriptive research methods that aim to explain the circumstances, events or everything related to programs that can be explained in words or numbers. The application of Government Regulation No. 71 of 2010 concerning accrual basis is certainly in accordance with what has been implemented by the Law that has been implemented by the government, Government Accounting Standards, Financial Accounting Standards. Accrual basis application needs financial statements, so that problems can be found or what things are not in accordance with the activities of either budgeting or calculation of budgeting.Keywords: Accrual Basis, Government Accounting, Government Accounting Standards, Financial Accounting Standards, Descriptive Methods.

Every year Bangladesh faces enormous damages due to flooding. Facing these damages the Government adopts various recovery approaches. However, the psychological dimension of any disaster is generally overlooked in disaster management. Researchers have found that the spatial distribution of post-disaster mental health can help the authorities to apply recovery procedures where they are most needed. For this research, Posttraumatic Stress Checklist (PCL-5), Patient Health Questionnaire (PHQ-9) and Generalized Anxiety Disorder-7 (GAD-7) were used to estimate posttraumatic stress, major depressive disorder and anxiety following three episodes of severe floods in 2017 that affected at least 8 million people. To better understand the spatial pattern of psychological vulnerability and reach a comprehensive scenario of post-disaster mental health, Moran’s I was applied for spatial autocorrelation and Pearson’s correlation and regression analysis for a study of the relationship between the psychological aspects. It was found that psychological vulnerability showed a spatial clustering pattern and that there was a strong positive linear relationship among psychological aspects in the study area. This research might help to adopt disaster management policies that consider the psychological dimension and spatial distribution of various psychological aspects to identify areas characterized by high vulnerability and risk so that they can be reached without delay.

The Central Disaster Management Council of the Cabinet Office predicts that an earthquake of magnitude 7 will occur in Metropolitan Tokyo and the Tokai area within 30 years. In preparation for such large-scale earthquakes, the government is considering various measures. In this study, we focus on the ‘Umi no eki (Sea Station)’ system developed by the Maritime Bureau of the Ministry of Land, Infrastructure and Transport, and propose a manual for ‘relief goods transportation’ and ‘stranded-commuter transportation’ using pleasure boats. Since it is important to determine whether pleasure boat owners are willing to voluntarily participate in relief activities at the Umi no eki, we also conducted a survey among pleasure boat owners concerning their awareness of disaster management. As a result, we found that pleasure boat owners are highly willing to participate. This study clarified the restrictions on volunteer activities carried out by pleasure boat owners, and a disaster management manual for pleasure boats was prepared with the objective of constructing a rescue system using pleasure boats in Tokyo Bay.

Purpose This paper aims to examine tweet posts regarding Typhoon Washi to contend the usefulness of social media and big data as an aid of post-disaster management. Through topic modelling and content analysis, this study examines the priorities of the victims expressed in Twitter and how the priorities changed over a year. Design/methodology/approach Social media, particularly Twitter, was where the data gathered. Using big data technology, the gathered data were processed and analysed according to the objectives of the study. Topic modelling was used in clustering words from different topics. Clustered words were then used for content analysis in determining the needs of the victims. Word frequency count was also used in determining what words were repeatedly used during the course period. To validate the gathered data online, government documents were requested and concerned government agencies were also interviewed. Finding Findings of this study argue that housing and relief goods have been the top priorities of the victims. Victims are seeking relief goods, especially when they are in evacuation centres. Also, the lack of legal basis hinders government officials from integrating social media information unto policymaking. Research limitation This study only reports Twitter posts containing keywords either, Sendong, SendongPH, Washi or TyphoonWashi. The keywords were determined based on the words that trended after Typhoon Washi struck. Practical implication For social media and big data to be adoptable and efficacious, supporting and facilitating conditions are necessary. Structural, technical and financial support, as well as legal framework, should be in place. Maintaining and sustaining positive attitude towards it should be taken care of. Originality/value Although many studies have been conducted on the usefulness of social media in times of disaster, many of these focused on the use of social media as medium that can efficiently spread information, and little has been done on how the government can use both social media and big data in collecting and analysing the needs of the victims. This study fills those gaps in social big data literature.

Flood and landslide that occurred at the end of 2017 in Pacitan Regency induced huge losses. However, with good cooperation from all levels of The Pacitan's society, the impact of the disasters could resolve in 4 months. This study aims to determine the steps taken by the government of Pacitan Regency to achieve effectiveness in realizing the original regional income of Pacitan Regency, especially for post-disaster recovery. The research method used is descriptive qualitative, through interviews with the Head of the Disaster Management Section of Pacitan Regency. The results obtained indicate The government of Pacitan Regency has policies that can secure their Original Regional Income. The Regional Original Income is always achieved well before disasters, during disasters, and after disasters. Apart from implementing policies, the effectiveness of regional income in the time of disaster recovery process in Pacitan Regency is also encouraged by the assistance funds obtained from the central government, regional governments, and the private sector. Meanwhile, involving the community with an attitude of good cooperation that is one of a characteristic of the Indonesian society could quickly restore the condition of the Pacitan Regency.

Flooding has long been a recurrent problem in the Argentinian city of Santa Fe, mainly affecting the poverty-stricken suburban outskirts. In 2003 one of the worst floods ever occurred, which also affected residents in the middle income sectors who had never been flooded before and who reacted with an extraordinary process of commemoration and protest against the government for its lax disaster management. Paradoxically, most other past disastrous floods in the city’s history seem to dwell in the shadows of social oblivion. Drawing on ethnographic fieldwork in the years 2004–2011, this article analyzes how local flood memories are made through daily life practices and places in the suburban outskirts, more than through public commemorations, which has implications for vulnerability and risk.
