This article is devoted to the legal problems associated with the provision of patent protection for the results of scientific activities created by artificial intelligence systems. The authors explore the approaches formulated by doctrine and practice in relation to objects created by robotic systems, computer technology and AI. The problem of the relationship between patent protection of the results of scientific (scientific and technical) activities and artificial intelligence systems is becoming more and more urgent. Modern AI systems are quite capable of creating inventions that are the result of the application (use) of the cognitive (thinking) abilities of a person, that is, such inventions can be patentable. There is no doubt that the increasingly active introduction of AI systems will force national legislators to reconsider the definition of the term “inventor.” In Russian legislation, the issue of patent protection of inventions created by AI is currently not resolved. The review of the state of legal regulation of patent protection of the results of scientific activity (first of all, inventions) created by AI systems, presented in the article, indicates the absence of clear rules both in Russian and foreign law (using the example of individual jurisdictions) regarding the determination of the legal status of this kind. objects and the person who has exclusive rights in relation to them. The use of already existing legal constructions by analogy, as well as the borrowing of foreign experience, can only temporarily solve the issue of patent protection of the results of scientific activity created with the help of AI.

If harm to others occurred due to the mistakes of the developer, then he bears responsibility and costs. If the damage to others occurred due to the fault of the owner due to non-compliance with the terms of use, then he bears responsibility and costs. Ethical standard and legal regulation help intellectual agents with intelligent artificial intelligence become professional members of society. Ensembles of intelligent agents ith smart artificial intelligence will be able to safely work with society as professional images with skills, knowledge and competencies, implemented in the form of retrained digital twins and cognitive robots that interact through language, behavioral and active ethical communications. Cognitive robots and digital doubles through self-developing ensembles of intelligent agents with synergistic interaction and intelligent artificial intelligence can master various high-tech professions and competencies. Their use in the industry increases labor productivity and economic efficiency of production. Their application in the social sphere improves the quality of life of a person and society. Their widespread application requires compliance with an ethical standard so that their use does not cause harm. The introduction and use of an ethical standard for the use of cognitive robots and digital doubles with smart artificial intelligence increases the safety of their use. Ethical relationships between individuals and intellectual agents will also be governed by an ethical standard.

Introduction: digitalization is an interdisciplinary problem, but the degree of its mediation by specialists in different fields varies significantly. The modern legal studies of digitalization are often haphazard and superficial. Lawyers are clearly lagging behind modern trends, which can create a number of serious problems in terms of the legal regulation and loss of humanitarian and legal values accumulated by humanity. This situation really creates a number of serious threats to the legal regulation, because technologies are developing, the number of rules associated with their use is increasing, and these rules are written by the experts in the field of digital economy and IT-technologies. The purpose of the study: to summarize the main theoretical and legal problems arising from the widespread introduction of digital technologies in the legal regulation and legal activity. Research objectives: to define the concept of digitalization; to consider the main trends of scientific research on issues related to the largescale spread of digitalization and artificial intelligence technologies; to identify and formulate the main problems of doctrinal and theoretical plan discussed by the legal community in the context of digitalization; to determine the limits of the real impact of new technologies on the social regulation. Methods: the system, structural and functional ones, the methods of analysis and synthesis, expert evaluation. Results: the paper systematizes the main problems of digitalization that concern modern lawyers. The problems of digitalization are divided into general social ones, concerning threats to the development of society as a whole, and special legal ones, concerning the actual change of the legal regulation and law in the era of digitalization. Conclusions: it is not technologies that need the legal regulation, but the relations with the use of technologies do. As for the “horror stories” about AI and total digitalization, most of the problems lie in the sphere of natural intelligence, not artificial one, in the sense that it is necessary to regulate the actions of natural intelligence carriers in the design of artificial intelligence.

The article deals with some directions of the research and educational policy development. The article considers the problem of application of artificial intelligence in the law of Ukraine in general and in the notarial and civil process in particular. The legal consequences of the legal regime of temporary occupation of some territories of Ukraine are indicated and the ways to eliminate obstacles in the protection and defense of the rights of citizens of Ukraine in these territories are determined. The legal construction of «artificial intelligence» is studied and its types are offered. The conclusion about the expediency of using intelligent computer programs, intelligent information technologies as types of artificial intelligence in notarial and executive processes is substantiated. It is proposed to consider the use of artificial intelligence in notarial and civil proceedings for citizens of Ukraine living in the Autonomous Republic of Crimea or in the occupied territories of Donetsk and Luhansk regions, within the limits, in the manner and in the manner prescribed by law of Ukraine. It is proved that the introduction of artificial intelligence through the mechanism of protection and defense of human and civil rights and freedoms in the civil process must be adapted to social relations that arise and exist, not violate the constitutional rights and freedoms of man and citizen in Ukraine and have a legal basis. Based on the scientific and practical analysis of the Civil Procedure Code of Ukraine, it is proposed for citizens of Ukraine living in the Autonomous Republic of Crimea or in the occupied territories of Donetsk and Luhansk regions to establish that lawsuits, separate and injunctive proceedings are entirely online. The procedure (procedure) and features of such proceedings with the use of various types of artificial intelligence (such as chatbots and other information intelligence technologies) should be defined in the Civil Procedure Code of Ukraine. It is noted that the introduction of the above mechanism to protect and defend the rights of citizens living in the Autonomous Republic of Crimea or in the occupied territories of Donetsk and Luhansk regions through intelligent computer programs will require proper maintenance and support of such programs to prevent leakage of information, leakage of personal data, etc. The conclusion is substantiated that e-litigation and remote notarial proceedings will increase the effectiveness of notarial and judicial forms of protection and protection of rights and make these state forms of protection more flexible, able to anticipate the peculiarities of procedural actions involving residents of the temporarily occupied territories.

Problem setting. Artificial intelligence is rapidly affecting the financial sector with countless potential benefits in terms of improving financial services and compliance. In the financial sector, artificial intelligence algorithms are already trusted to account for transactions, detect fraudulent schemes, assess customer creditworthiness, resource planning and reporting. But the introduction of such technologies entails new risks. Analysis of resent researches and publications. The following scientists were engaged in research of the specified question: D.W. Arner, J. Barberis, R.P. Buckley, Jon Truby, Rafael Brown, Andrew Dahdal, O. A. Baranov, O. V. Vinnyk, I. V. Yakovyuk, A. P. Voloshin, A. O. Shovkun, N.B. Patsuriia. Target of research. The aim of the article is to identify key strategic issues in developing mechanisms to ensure the effective implementation and use of artificial intelligence in the financial services market. Article’s main body. The paper investigates an important scientific and practical problem of legal regulation of artificial intelligence used by financial services market participants. The legal risks associated with the use of artificial intelligence programs in a particular area are considered. The most pressing risks to address targeted AI regulation are fundamental rights, data confidentiality, security and effective performance, and accountability. This article argues that the best way to encourage a sustainable future in AI innovation in the financial sector is to support a proactive regulatory approach prior to any financial harm occurring. This article argues that it would be optimal for policymakers to intervene early with targeted, proactive but balanced regulatory approaches to AI technology in the financial sector that are consistent with emerging internationally accepted principles on AI governance. Conclusions and prospects for the development. The adoption of rational regulations that encourage innovation whilst ensuring adherence to international principles will significantly reduce the likelihood that AI-related risks will develop into systemic problems. Leaving the financial sector only with voluntary codes of practice may encourage experimentation that in turn may result in innovative benefits – but it will definitely render customers vulnerable, institutions exposed and the entire financial system weakened.
