The article discusses in detail the relationship between insurance and medical law. On the basis of the analysis of normative-legal acts, as well as law enforcement practice, the conclusion is made about the significant role of territorial funds of medical insurance and insurance medical organizations in the protection of the citizen's right to its provision in the system of compulsory medical insurance.

ABSTRACT Understanding policy process involves many distinctive approaches. The most common are institutional, groups or networks, exogenous factors, rational actors, and idea-based approach. This paper discussed the idea-based approach to explain policy process, in this case policy change. It aims to analyse how ideas could assist people to understand policy change. What role do they play and why are they considered as fundamental element? It considers that ideas are belong to every policy actor, whether it is individual or institution. In order to answer these questions, this paper adopts Kingdon’s multi streams approach to analyse academic literatures. Through this approach, the relationship between ideas and policy change can be seen clearer. Ideas only can affect in policy change if it is agreed and accepted by policy makers. Therefore the receptivity of ideas plays significant role and it emerges policy entrepreneurs. They promote ideas (through problem framing, timing, and narrative construction) and manipulate in order to ensure the receptivity of ideas. Although policy entrepreneurs play significant role, political aspects remains the most important element in the policy process. The aim of this paper is to establish and clarify the relationship between corruption level and development among European Union countries. Out of the estimated model in this paper one can conclude that the level of corruption can explain capital abundance differences among European Union countries. Also, explanatory power of corruption is higher in explaining economic development than in explaining capital abundance, meaning stronger relationship between corruption level and economic development than between corruption level and capital abundance. There is no doubt that reducing corruption would be beneficial for all countries. Since corruption is a wrongdoing, the rule of law enforcement is of utmost importance. However, root causes of corruption, namely the institutional and social environment: recruiting civil servants on a merit basis, salaries in public sector competitive to the ones in private sector, the role of international institutions in the fight against corruption, and some other corruption characteristics are very important to analyze in order to find effective ways to fight corruption. Further research should go into this direction.

The aim of this study is to explore the importance of Qira’at Mutawatirah as a discipline particularly in the field of fiqh (jurisprudence). As a field of study, Qiraat (Quranic reading) plays a significant role in Islamic Fiqh by way of shaping the opinions and views of the fuqaha’ (jurists). Nevertheless, some fuqaha’ are less familiar with Qiraat as a study which has thus led to some confusion and ambiguity on the matter. It was even suggested that the differences of fiqh found within the madzhabs (sects) are based on the fuqaha’s own Qiraat. Thus this paper is a discussion on the differences of wajh Qiraat within the farsh letters as found among the Qiraat scholars. This paper also analyses the relationship and influence of the Qiraat readings among the fuqaha when it comes to deriving a hukm (principle), particularly on fiqh ibadah (the laws of worship). As such, this significant study sheds light into the approach used by the fuqaha’ when it comes to extracting and deriving laws and principles based on the different Qiraat readings. The objectives of this study are to investigate the extent and role of Qiraat, to analyse and observe the relationship between Qiraat readings of the fuqaha and its relationship to the hukm. This study is based entirely on library research. Overall, the findings show that Qiraat is undoubtedly important; the differences in Qiraat have a major impact in the way that the various Islamic Fiqh were derived from the Qur’anic verses. Nevertheless, the chosen Qiraat readings by Fuqaha, on the other hand, do not play a major role in determining the fiqh within the various sects; instead the wajh Qiraat plays a major role within their respective sects. However, in some circumstances, the chosen Qiraat readings do sometimes become a source which a hukm is decided within their sects, and vice versa. It is hoped that this study becomes a pioneer for other researchers to conduct a more in-depth study on the sciences of Qiraat by exploring it critically within the various perspectives of the Islamic discipline. It is hoped that it can be analysed, studied, understood and implemented in the field of teaching and learning, in line with its importance within the other branches of Islamic discipline. It is hoped that as a study, it can be further expanded and remain significant to the Islamic scholars and the community at large. Keyword: Qiraat Mutawatirah, Fiqh, Qiraat, fuqaha‘   Penulisan ini bertujuan merungkai hubungan rapat Qiraat dalam disiplin ilmu Islam terutamanya ilmu Fiqh. Qiraat menjadi salah satu faktor yang dominan terutamanya dalam mencorakkan perbezaan hukum Fiqh Islami dalam kalangan Fuqaha’. Namun masih terdapat kalangan yang kurang mengetahui dan memahami hakikat kewujudan ilmu Qiraat sehingga menimbulkan kekeliruan dan kesamaran mengenainya bahkan wujudnya pendapat menyatakan bahawa hukum fiqh yang diinstibatkan dalam mazhab adalah berdasarkan daripada Qiraat yang dibaca oleh kalangan fuqaha itu sendiri. Justeru kajian ini akan menyentuh dan membincangkan perbezaan wajh qiraat yang terdapat pada farsh huruf dalam kalangan ulama Qiraat. Dalam masa yang sama, kajian ini juga akan menyingkap dan menganalisis perkaitan dan pengaruhnya terhadap pengeluaran hukum oleh kalangan Fuqaha’ terutama ayat-ayat al-Quran yang melibatkan fiqh ibadat. Kajian ini penting demi memahami keadaan sebenar bagaimana kalangan Fuqaha mengeluarkan hukum fiqh berdasarkan perbezaan Qiraat. Objektif kajian ialah mengkaji sejauhmana perkaitan dan peranan Qiraat pada hukum fiqh, menganalisis dan menilai sejauh mana pertalian bacaan Qiraat yang dibaca Fuqaha’ dengan hukum yang diinstibatkan oleh Fuqaha.’ Secara keseluruhannya, kajian ini dijalankan berdasarkan kajian ke perpustakaan sepenuhnya. Ternyata dapatan hasil kajian ini merumuskan bahawa perbezaan Qiraat pula memberi impak yang besar dalam mencorakkan hukum fiqh dalam ayat al-Quran. Bacaan ‘Qiraat PilihanFuqaha‘ pula tidaklah menjadi faktor utama mempengaruhi hukum fiqh mazhab yang diasaskan oleh mereka bahkan fuqaha hanya menjadikan wajh Qiraat itu sebagai platform utama dalam menentukan hukum fiqh dalam mazhab yang diasaskan mereka. Namun tidak dinafikan juga, bacaan ‘Qiraat Pilihan Fuqaha‘ itu kekadang menjadi sebab penentuan hukum bagi mazhab mereka dan kekadangnya sebaliknya. Kajian ini diharap menjadi perintis kepada pengkaji yang lain untuk lebih prolifik mengenai ilmu Qiraat dalam membahaskannya dari pelbagai sudut disiplin ilmu Islam secara lebih kritis supaya ia dapat ditelaah, dikaji, difahami, diperkasai dan diimplimentasikan dalam aspek pengajaran dan pembelajaran sejajar dengan kepentingannya terhadap cabangan ilmu-ilmu Islam yang lain agar terus berkembang dan bertapak pada kaca mata Ilmuan Islam secara khusus dan masyarakat sejagat secara umumnya.   Kata Kunci: Qiraat Mutawatirah, Fiqh, Qiraat, fuqaha‘.

The nature of armed conflict has changed dramatically in recent decades. In particular, it is increasingly the case that hostilities now occur alongside ‘everyday’ situations. This has led to a pressing need to determine when a ‘conduct of hostilities’ model (governed by international humanitarian law – IHL) applies and when a ‘law enforcement’ model (governed by international human rights law – IHRL) applies. This, in turn, raises the question of whether these two legal regimes are incompatible or whether they might be applied in parallel. It is on this question that the current article focuses, examining it at the level of principle. Whilst most accounts of the principles underlying these two areas of law focus on humanitarian considerations, few have compared the role played by necessity in each. This article seeks to address this omission. It demonstrates that considerations of necessity play a prominent role in both IHL and IHRL, albeit with differing consequences. It then applies this necessity-based analysis to suggest a principled basis for rationalising the relationship between IHL and IHRL, demonstrating how this approach would operate in practice. It is shown that, by emphasising the role of necessity in IHL and IHRL, an approach can be adopted that reconciles the two in a manner that is sympathetic to their object and purpose.

The significant role of mitochondria within cells is becoming increasingly clear. This letter uses the NKCS model of coupled fitness landscapes to explore aspects of organelle-nucleus coevolution. The phenomenon of mitochondrial diversity is allowed to emerge under a simple intracellular evolutionary process, including varying the relative rate of evolution by the organelle. It is shown how the conditions for the maintenance of more than one genetic variant of mitochondria are similar to those previously suggested as needed for the original symbiotic origins of the relationship using the NKCS model.

The subject. The article considers the role of the Plenum of Russian Supreme in forming judicial practice on the example of giving qualification to the crimes committed against sexual freedom and inviolability, as well as against property and public health.The objective of the article is to conduct a complex analysis of the function of the decisions, taken by the Plenum of Russian Supreme Court, in the formation of a unified vector of judicial practice. The authors dare to refute the hypothesis hat judicial practice can be recognized as a source of law.The methodological basis of the research is the dialectical theory of development and interrelation of phenomena. Historical, formal-logical, systematic methods of knowledge have been identified as relevant to the topic of the study.The main results, scope of application. The authors draw attention to the problem of evaluative features used in the process of law enforcement when interpreting the norms of the Special Part of the Criminal Code of the Russian Federation. A norm with such signs acquires an unformalized essence from the point of view of the boundaries of criminalization of a particular phenomenon. On the other hand, the nature of crimes is so diverse that without the flexibility of criminal law regulation (allowing the use of evaluative features), the application of the norm taking into account specific circumstances in a particular case may not be possible. The authors also consider issues related to the characteristics of the objective side, the end time of these crimes, the application of the formula of a single ongoing crime and its separation from related compounds. The process of law enforcement is based on such guidelines as the norms of law, judicial discretion, established judicial practice, the position of the Plenum of Russian Supreme Court. Attributing an explanatory role to the decisions of the Plenum of Russian Supreme Court does not completely eliminate the shortcomings inherent in legal technology. Correcting the current situation with the help of judicial discretion is not always justified, since this is possible only if there is a legitimate alternative. Assigning the status of a precedent to a judicial decision may lead to the substitution of the law by decisions taken in a particular case.Conclusions. The judicial practice concerning these issues is completely different. Despite the existence of similar situations, courts, as a rule, qualify an offense using various norms of the law, which negatively affects compliance with the principle of legality. The issue related to the function of the decisions of the Plenum of Russian Supreme Court in the formation of a single vector of judicial practice has been and remains debatable. The continued addition of new articles to criminal legislation, on the one hand, indicates the desire of the legislator to bring it to perfection, but, on the other hand, forms a mechanism for clarifying the rules of its application, which sometimes leads to their contradictory interpretation. At the same time, crime and punishment should be determined only by legislation.

<p>This paper examines the role of judicial jurisdiction in law-making process in statute countries. The analysis focused on the reformed Japanese Civil Code, which entered into force on 1 April 2020, and more specifically on the conflict between the reformed Civil Code and the precedents of previous legal status. The purpose of the paper was to emphasize that it is extremely important to consider the relationship between new rules and previous precedents. By using the reformed rules of “contract for work” in the Japanese Civil Code reform, this article analyzes and explains the meaning of precedent in law-making process.</p>

In a comparative study of Eradicating Corruption in Indonesia and Japan appears that law culture plays a significant role. Indonesia has special institution that deals with corruption while Japan does not have it. Nevertheless, cases of corruption in Indonesia are higher than in Japan. This is due to the Indonesian culture of ewuh pakewuh, reluctant, and has two different views in dealing with corruption. On the one hand, Indonesia rejects corruption, but on the other hand, it commits actions that support corruption. Meanwhile, Japan has a strong culture of shame for committing law violations both at the community level and law enforcement officers.

<p>M. Umer Chapra discusses various concepts that related to the Islamic economic system and compare with the conventional economic  system,  directions  and  challenges  facing  the  Islamic  economy in the future as well as, as the central theme of his book, he picked up the concept of  Ibn  Khaldun's economic  development.  Interestingly,  he  managed  to  formulate  the  concept  into  a  cycle  that  is  easy  to  understand.</p><p>He not only succeeded in formulating the concept of Ibn Khaldun into the cycle of increase progress and decrease cycles, but also he was able to further define the relationship between one component of development linkages with other components. Ibn  Khaldun  explains the important for  the development of Sharia  (S),  the development  community  (W),  law  enforcement  and  other  Development  (j &amp; g),  as well as the role of  Government (G).   Umer  Chapra  formulate  these  components  in  the  cycle,  the   cycle   advances  toward  him:  SNW-j &amp;  g-GS  and  other  cycle: j &amp; g-WNSG-j &amp; g. In this article, he discusses about some of the thinking of classical Islamic scholars who provide the base  foundation  in  the concept of Islamic  economics  in  particular  Ibn  Khaldun  in  his several works such as the Muqaddimah, which tried to  determine  factors  affecting  quality  by  analyzing  factors  such as the role  of interconnected moral factors, psychological, political, economic, social, demographic, and historical phenomena of the rise and fall of dynasties  and  civilizations.</p><p><strong>Key</strong><strong></strong><strong>words:</strong><strong> </strong><strong>Capra</strong><strong>,</strong><strong> </strong><strong>Systems</strong><strong>, Economics, Islam.</strong></p>
