Abstract:The purpose of this research is to know if omnibus law is needed today in Indonesia, and how it is likely to impact the Omnibus Law on copyright employment. The benefits of this research are theoretically expected to provide a rationale that is cognitive beneficial to develop legal sciences, especially omnibus law from the perspective of human rights in relation to sustainable development. We know after the inclusion of the Omnibuslaw draft Act, wave demonstration of labor to refuse to occur almost across the country. There are chapters that are expected to be increasingly afflicted workers and give advantage to entrepreneurs because the reason of investment is seen as a form of regulation that is not party to the people, suppress domestic labor and provide opportunities for foreign workers. The research uses the of approach and Conceptual Approach. This research uses the source of primary legal material that is legislation and the source of secondary legal material in the form of books and texts of legal. The results of this study demonstrate omnibus law is a fundamental step and simplify the various rules into a single large rule that overcomes all matters so that it does not overlap in its settings. Applying the omnibus law is a heavy choice so that the interests of the people must get adequate place.   Keywords: Omnibus Law, Labor, constitutional rights   Abstrak: Tujuan dari penelitian ini adalah untuk mengetahui apakah omnibus law dibutuhkan di Indonesia saat ini, dan bagaimana dampaknya terhadap hak pekerja. Manfaat dari penelitian ini secara teoritis diharapkan dapat memberikan pemahaman rasional berupa manfaat kognitif untuk pengembangan ilmu hukum, khususnya omnibus law dari perspektif HAM dalam hubungannya dengan pembangunan berkelanjutan. Kita semua tahu RUU Ombinus Law menyebabkan gelombang demonstrasi buruh menolak RUU tersebut hampir di seluruh pelosok negeri. Terdapat beberapa bab yang diharapkan menambah penderitaan pekerja dan memberika keuntungan kepada pengusaha sebab investasi menjadi satu alasan yang terlihat dalam regulasi tersebut yang tidak berpihak pada masyarakat, menekan pekerja domestic dan memberikan kesempatan kepada pekerja asing. Penelitian ini menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Penelitian ini menggunakan sumber bahan hukum primer dan sekunder. Hasil dari kajian ini menunjukkan bahwa omnibus law merupakan langkah yang fundamental dan langkah yang dimaksudkan untuk menyederhanakan kompleksitas peraturan perundang-undangan yang mampu mengatasi segala permasalahan yang timbul mencegah tumpang tindih regulasi. Penerapan omnibus law adalah pilihan berat untuk dapat menjamin kepentingan masyarakat secara adil.  Keywords: Omnibus Law, Buruh, Hak Konstitusional

Departing from the increasingly widespread problem of People Smuggling, both in the form of organized and unorganized crime networks, both inter-state and domestic as a whole is a threat to the norms of life based on human rights. In this case the role of the immigration officer as the gatekeeper in the country's traffic in the case of people entering / leaving Indonesian territory, as in 2015, the People Smuggling case was successfully revealed by the Immigration Officer within the Soekarno-Hatta Airport Airport I, where immigration officers found three people women wearing fake passports who were about to leave for Kuala Lumpur with perpetrators Laila Yunita and Jamal Al Khatib. This writing aims to analyze the causes and effects of human smuggling, as well as examine the serious efforts made by PPNS in eradicating People Smuggling, especially in the case of People Smuggling committed by Laila Yunita and Jamal Al Khatib. The research uses a statutory approach, a conceptual approach and a case approach. So that with the case, it will be understood how important the value of legal human resources is in the scope of immigration in the context of national law development, as a breakthrough in competency development strategies

ABSTRACTAs a concept of sustainable development it is seen to support the development of human rights, especially Ekososb rights where the fulfillment of human rights no longer focuses only on the current generation but also focuses on fulfilling human rights for future generations. This research was conducted with the aim of analyzing and understanding about Indonesia's commitment after signing the International Sustainable Development Goals Commitment in 2015. This research use normative juridical methods that will analyze the concept of sustainable development in Indonesian legislation and the relation of the concept of sustainable development to the fulfillment of human rights for the people of Indonesia. Human Rights and the State could not be separated from one another. Both are interconnected in terms of how to ensure internal stability in a country. With the existence of human rights, it is hoped that state is not arbitrary to treat its people and is obliged to protect everyone in its territory including in this case Stateless persons mentioned in Article 7 paragraph 1 of the Convention relating Status of Stateless Persons in 1954. This study aims to analyze the obligations the State must take in relation to the protection of persons with stateless persons status, and to recognize the legal consequences and responsibilities of States in the event of omitting acts of human rights violations against people with stateless persons status. This paper using normative research methods with statute approach and conceptual approach. The study shows that in relation to the obligation of the state that each State shall be obliged to provide protection to persons with stateless persons status as stipulated in the 1954 Convention and the provisions of the International Human Rights Law, the obligations of state protection include the protection of the right to life, the right to employment and even the right to obtain citizenship status. The international legal consequences accepted by the state are listed in Article 39, Article 41, and 42 of the UN Charter. Then for state responsibility are listed under Article 35, Article 36, and Article 37 of UNGA 56/83 of 2001.   Hak Asasi Manusia dan Negara tidak bisa dipisahkan satu sama lain. Keduanya saling terkait dalam hal bagaimana menjamin stabilitas internal di suatu negara. Dengan adanya hak asasi manusia, diharapkan negara tidak sewenang-wenang memperlakukan rakyatnya dan berkewajiban melindungi semua orang di wilayahnya termasuk dalam hal ini para warga negara yang disebutkan dalam Pasal 7 ayat 1 Konvensi terkait Status Orang Tanpa Negara di tahun 1954. Tulisan ini bertujuan untuk menganalisis kewajiban yang harus diambil Negara sehubungan dengan perlindungan orang-orang dengan status orang tanpa kewarganegaraan, dan untuk mengakui konsekuensi hukum serta tanggung jawab negara dalam hal melakukan  tindakan pelanggaran hak asasi manusia terhadap orang-orang dengan status  tanpa kewarganegaraan. Tulisan ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil studi menunjukkan bahwa sehubungan dengan kewajiban negara bahwa setiap Negara wajib memberikan perlindungan kepada orang-orang dengan status orang tanpa kewarganegaraan sebagaimana diatur dalam Konvensi 1954 dan ketentuan-ketentuan Hukum Hak Asasi Manusia Internasional, kewajiban perlindungan negara termasuk perlindungan hak untuk hidup, hak untuk bekerja dan bahkan hak untuk mendapatkan status kewarganegaraan. Konsekuensi hukum internasional yang diterima oleh negara tercantum dalam Pasal 39, Pasal 41, dan 42 Piagam PBB. Kemudian untuk tanggung jawab negara tercantum di bawah Pasal 35, Pasal 36, dan Pasal 37 UNGA 56/83 tahun 2001.

This study aims to analyze the dichotomy of the implementation of privatization of water resources by the private sector that occurs in Indonesia and the responsibility for managing water resources by the state in terms of human rights principles. In accordance with the mandate of the constitution which is affirmed in Article 33 paragraph (3) that "Earth and water and natural resources contained therein are controlled by the state and used for the greatest prosperity of the people." This research uses normative legal research methods, while the approach used in this study is a statutory approach and library research methods as well as a conceptual approach that will be harmonized with statutory provisions. The results of this study indicate that the state has the responsibility in managing water resources in accordance with the mandate of the constitution to guarantee, protect and fulfill human rights to water. Water management by the private sector (water privatization) which is monopolistic, exclusive and materialistic is not in accordance with the spirit of the constitution and the basis of the Indonesian state. Moreover, based on the decision of the Constitutional Court which annulled the Water Resources Law, it obliges that the management of water resources be carried out by the state in order to realize social welfare.

Upaya mencegah dan menghapus praktik penyiksaan di Indonesia bukanlah persoalan yang mudah. Meski sudah meratifikasi Konvensi Menentang Penyiksaan dan mengakui hak untuk bebas dari penyiksaan sebagai HAM dan hak konstitusional, namun praktik penyiksaan di Indonesia masih juga berlangsung secara massif. Permasalahan dalam penelitian ini, pertama, faktor-faktor apa saja yang menyebabkan praktik penyiksaan masih terjadi di Indonesia? Kedua, upaya apa yang harus dilakukan untuk mencegah dan menghapus praktik penyiksaan dalam memperkuat perlindungan HAM dan hak konstitusional untuk bebas dari penyiksaan di Indonesia? Pendekatan yang digunakan dalam kajian ini adalah pendekatan perundang-undangan, pendekatan kasus dan pendekatan konseptual. Hasil kajian memperlihatkan bahwa, pertama, sejumlah faktor yang menyebabkan masih terjadinya praktik penyiksaan di Indonesia: (1) tidak adanya aturan hukum yang tegas dan memberikan sanksi yang berat kepada pelaku penyiksaan; (2) terinstitusionalisasinya praktik kekerasan dan penyiksaan di jajaran penegak hukum serta permisifnya masyarakat terhadap praktik tersebut; (3) mekanisme perlindungan dan pemberian kompensasi terhadap korban penyiksaan masih belum memadai. Kedua, perbaikan yang harus dilakukan mencakup: (1) adanya komitmen yang kuat dari pemerintah dengan membuat kebijakan penghapusan tindakan penyiksaan, seperti membuat Undang-Undang khusus menentang penyiksaan; (2) penataan institusi Kepolisian, Kejaksaan, TNI, Lembaga Pemasyarakatan serta lembaga-lembaga lainnya dengan meningkatkan pengawasan, memberikan sanksi yang tegas dan dilakukannya proses hukum jika masih terdapat praktik penyiksaan yang dilakukan. Selain itu perlu diberikan pendidikan HAM bagi personil institusi-institusi tersebut; (3) meningkatkan partisipasi masyarakat agar memiliki kesadaran untuk melawan setiap praktik kekerasan dan penyiksaan; (4) mengoptimalkan peranan lembaga seperti Komnas HAM dan LPSK untuk memberikan perlindungan dan pendampingan terhadap korban. (5) harus adanya pemenuhan terhadap hak-hak korban yang menjadi korban dari praktik penyiksaan.Efforts to prevent and eliminate the practice of torture in Indonesia are not easy. Although it has ratified the Convention Against Torture and recognizes the right for freedom from torture as human rights and constitutional rights, the practice of torture in Indonesia is still massive. The problem is, what factors cause the practice of torture to still occur in Indonesia? Then what efforts should be made to prevent and eliminate the practice of torture in strengthening human rights protection and constitutional rights for freedom from torture in Indonesia? The approach used in this study is the statute approach, case approach and conceptual approach. The results of the study show a number of factors that leads to the practice of torture in Indonesia: (1) the absence of strict legal rules and severe sanctions for perpetrators of torture; (2) institutionalization of the practice of violence and torture in the ranks of law enforcement as well as the permissiveness of the community towards the practice; (3) the mechanism for protecting and providing compensation to victims of torture is still inadequate. The improvements that must be made include: (1) a strong commitment from the government by making a policy of abolishing acts of torture, such as making a special law against torture; (2) structuring of the Police, Prosecutor's Office, TNI, Correctional Institutions and other institutions by increasing supervision, providing strict sanctions and carrying out legal proceedings if there are still practices of torture carried out. In addition, it needs education of human rights for personnel of these institutions; (3) increasing community participation in order to have awareness to fight every practice of violence and torture; (4) optimizing the role of institutions such as Komnas HAM and LPSK to provide protection and assistance to victims. (5) there must be rights fulfillment to the victims who become the victims of the practice of torture.

Election or local election is a way of channeling the rights of every principle community, which means that the right to vote and vote is contained in his constitutional rights as citizens. In article 28 letter D of the Republic of Indonesia Republic of 1945 which reads that "every citizen has the right to have the same opportunity in government". The sound contained in the article contains the understanding that the State guarantees each of its citizens to obtain the rights to sit in government either as People's Representatives, regents, Mayors, Governors, or even become a President. The method used in this study is normative juridical legal research which uses a statutory approach. The issue raised by the author is How the Human Rights Perspective of Legislative Candidates in Organizing Elections and How Comparative Legal Arrangements for Former Legislative Candidates Examined From Law Number 7 of 2017 Concerning General Elections With Regulation of the Election Commission Number 20 of 2018 Regarding Nominating Members Regional Representative Council, Provincial Regional Representative Council, Regency / City Representative Council. In terms of the implementation of elections need to be held honestly, fairly and democratically based on the spirit of Democracy that has been carried out so far so as to create leaders and representatives of the people who side with their people. Speaking of Human Rights, everyone has the same rights before the State and applies to former corruption convicts who have or have the same political rights as other citizens guaranteed by the constitution.

Laws are the norms that govern all human actions that can be done and should not be carried out both written and unwritten and have sanctions, so that the entry into force of these rules can be forced or coercive and binding for all the people of Indonesia. The most obvious form of manifestation of legal sanctions appear in criminal law. In criminal law there are various forms of crimes and violations, one of the crimes listed in the criminal law, namely the crime of Human Trafficking is often perpetrated against women and children. Human Trafficking is any act of trafficking offenders that contains one or more acts, the recruitment, transportation between regions and countries, alienation, departure, reception. With the threat of the use of verbal and physical abuse, abduction, fraud, deception, abuse of a position of vulnerability, example when a person has no other choice, isolated, drug dependence, forest traps, and others, giving or receiving of payments or benefits women and children used for the purpose of prostitution and sexual exploitation. These crimes often involving women and children into slavery. Trafficking in persons is a modern form of human slavery and is one of the worst forms of violation of human dignity (Public Company Act No. 21 of 2007, on the Eradication of Trafficking in Persons). Crime human trafficking crime has been agreed by the international community as a form of human rights violation.

That National Human Rights Institutions (NHRIs) play an important role in the protection and promotion of human rights is a well-known fact. This has been widely acknowledged by the United Nations (UN). Also well-known is the fact that several African countries have enacted new constitutions during the last two to three decades. One of the most salient features of those new constitutions is that they establish NHRIs, among other things. Given their unique role and mandate, these NHRIs can and do play an important role in the realisation of the sustainable development goals contained in the UN 2030 Agenda for Sustainable Development. Adopting a case study approach, this article explores the role NHRIs have played in the promotion and protection of human rights in selected African countries and implications for sustainable development in those countries. The main argument is that there are several lessons African countries can learn from each other on how their NHRIs can more meaningfully play that role. Accordingly, best practice and comparative lessons are identified and it is recommended that NHRIs can contribute to sustainable development more meaningfully if they can make themselves more relevant, credible, legitimate, efficient and effective.
