AbstractThe purpose of this paper is to observe, predict and assess the existence of Islamic banking in Indonesia in the development of facing and maintaining public confidence in the issue of banking crime that are currently, have been and will come. Sharia Bank As an institution in the form of a business / service industry, so in the future, commercial/state banks such as state-owned enterprise banks that manage Sharia Banks will be merged as separate National Sharia Banks. Space and opportunities for criminal acts in Islamic banking have the same space and opportunities as other banks (conventional banking). However, what distinguishes if a criminal act is suspected, it must involve institutions formed from the provisions in sharia banking law (national sharia board, sharia supervisory board) accompanied by the Police and financial service authority institutions, but in investigative work. The police apparatus or financial services authority first asks for instructions from the national sharia board and sharia supervisory board.Keywords: Crime, Conventional Banking, Sharia Banking. AbstrakTujuan penulisan ini, untuk mengamati, memprediksi dan menilai keberadaan perbankan syariah di Indonesia dalam perkembangan menghadapi dan menjaga kepercayaan masyarakat dari persoalan tindak pidana perbankan atau kejahatan perbankan yang saat ini, pernah dan atau akan datang.  Bank (Syariah) Sebagai suatu institusi/lembaga dalam bentuk usaha/industri jasa (BUMN), begitu pun ke depan (wacana 2020) Bank-bank umum/negeri (BNI, BRI & Mandiri) yang mengelola Bank Syariah akan dimerger sebagai Bank Syariah Nasional tersendiri. Ruang dan peluang terjadinya tindak pada perbankan syariah memiliki ruang dan peluang yang sama dengan perbankan lainnya (konvensional). Namun yang membedakan bila diduga terjadi tindak pidana di dalamnya, haruslah melibatkan lembaga-lembaga yang terbentuk dari ketentuan dalam hukum/perundang-undangan perbankan syariah (DSN, DPS) disertai institusi Kepolisian dan lembaga OJK, namun dalam kerja penyidikan aparat Polri atau OJK terlebih dahulu meminta petunjuk DSN dan DPS.Kata Kunci : Perbankan Konvensional, Perbankan Syariah, Tindak Pidana.

This study aims to find out how the form of legal protection carried out by the Financial Service Authority towards consumers who experience disputes with insurance companies in Indonesia. This research is a normative legal research that is the prescriptive approach. The data are taken from secondary data types that consist of primary and secondary legal materials. Data collection techniques used are library studies, and the analytical techniques used are deductive by syllogism method. The result of the study shows that a form of repressive protections is carried out by the Financial Service Authority after a dispute between consumers and insurance services and a legal defense that contains many weaknesses. Settlement of disputes between consumers and Insurance Companies can be done through litigation/ court and non-litigation/ out of court settlement. In the litigation process through the Commercial Court. The non-litigation process that will carried out with the institution/ internal dispute resolution step, limited facilities through mediation that facilitated by Financial Services Authority and finally through the external dispute resolution or the arbitration institution.


Significance E-payment transaction volumes have risen dramatically as more people shop online and embrace non-cash payments. Moreover, fintechs are expanding into new segments of the financial services market such as crowdfunding and insurance. The future growth and resilience of this ecosystem depend on updating the regulatory and data protections framework, which is underway. Impacts Legislation on cross-institution and cross-border data sharing would be crucial to boost public confidence in fintechs. Continued growth of fintechs will increase the demand for cybersecurity services. Tier 2 cities will become increasingly important digital markets.

Islamic finance has experienced rapid growth globally, surpassing the USD 2 trillion mark in 2017. As a result, the literature related to Islamic finance and banking is rather rich. Despite the richness of the literature, our knowledge of the marketing issues related to Islamic finance is modest and somewhat ambiguous. Therefore, we review several decades of research about the Islamic finance in various parts of the world. We identify and discuss three main research themes that draw on different conceptualization and theoretical lenses. After synthesizing their respective findings, we propose several avenues for future research that integrate these three research themes with the goal of developing a more nuanced understanding of Islamic finance and its marketing. While we believe that our review will mainly serve as a crucial reinvigoration and launch point for future research on Islamic finance marketing, it is also of great practical benefit for policymakers of various countries and especially managers of financial service firms interested in marketing Islamic banking and financial services to their customers.

Objective - The FSA Act the establishment of which is mandated by Article 34 of Law No. 23 of 1999 concerning the Bank of Indonesia, was enacted on 22 November 2011. This Act, together with Law No. 3 of 2004, regulates and supervises Indonesia's integrated financial services sector. This article reveals the existence of inconsistencies between the legal terms underlying the establishment of the FSA one the one hand, and the provisions contained in the Financial Service Authority itself, on the other. These inconsistencies also become evident in the light of the 1945 Constitution which facilitated the establishment of the Bank of Indonesia Law. The purpose of this article is to ascertain a method of resolving these inconsistencies associated with the genesis of the Financial Service Authority. Methodology/Technique - The research method used in this article is doctrinal in nature that uses secondary data and information sources as material to analyse the relevant problems. Findings - The research has revealed that the most appropriate method of settling these inconsistencies requires a consideration of the express wording of the FSA. <p>Abstract<br />This article aims to describe and analyze the legal aspects of Peer to Peer Lending related to legal issues and settlement mechanism. This type of research is prescriptive normative legal research. This type of research is normative legal research that is prescriptive. The research approach used is vertical and horizontal synchronization level approach. The type of data used in this study is secondary data covering primary, secondary and tertiary legal materials. Data collection techniques used are by study of documents or library materials. Furthermore, the analysis technique used legal material analysis with teleological interpretation methods. Based on this research, the results show that the implementation of Peer to Peer Lending founds several problems including the risk of high interest so that many borrowers fail to pay and improper billing methods. Basically Financial Services Authority has regulated the preventation the risk of Peer to Peer Lending in several rules in Financial Service Authority Regulations Number 77/POJK.07/2016 and Financial Service Authority Regulations Number 18/POJK.07/2018 as guidelines for consumers regarding the complaints service mechanism and its resolution.<br />Keywords: peer to peer lending; risk; consumer complaints service</p><p>Abstrak<br />Artikel ini bertujuan untuk mendeskripsikan dan menganalisis mengenai aspek hukum dalam Peer to Peer Lending berkaitan dengan permasalahan hukum yang timbul serta mekanisme penyelesaiannya. Jenis penelitian ini adalah penelitian hukum normatif yang bersifat preskriptif. Pendekatan penelitian yang digunakan adalah pendekatan taraf sinkronisasi vertikal dan horizontal. Jenis data yang digunakan dalam penelitian ini merupakan data sekunder meliputi bahan hukum primer dan sekunder. Teknik pengumpulan data yang digunakan adalah dengan studi dokumen atau bahan pustaka. Selanjutnya teknik yang digunakan dalam penelitian ini adalah dengan menggunakan analisis bahan hukum dengan metode penafsiran teleologis. Berdasarkan penelitian ini diperoleh hasil bahwa dalam pelaksanaannya Peer to Peer Lending menemukan beberapa permasalahan, diantaranya risiko tarif bunga yang tinggi  sehingga banyak Penerima Pinjaman yang gagal bayar dan cara-cara penagihan yang tidak patut. Pada  dasarnya OJK sudah mengatur mengenai pencegahan risiko P2P Lending dalam beberapa ketentuan yang terdapat dalam POJK Nomor 77/POJK.07/2016 dan POJK Nomor 18/POJK.07/2018 sebagai pedoman bagi konsumen mengenai mekanisme layanan pengaduan konsumen dan penyelesaiannya.<br />Kata Kunci: peer to peer lending; risiko; layanan pengaduan konsumen</p>

Digital finance is a type of financial service that employs digital products like personal computers, the internet, mobile phones, cards linked to a digital payment system. Innovations in the digital world cannot be divorced from Nigerian financial services most notably the banking sector. Therefore, it means that banking industry cannot but embrace digital innovations in their services delivery. Hence, there is a need to review the impact of digital finance in the Nigerian banking sector. Desk research method was used to examine how innovations in the digital world could impact the future financial service delivery in the Nigerian banking sector. From the review, it was that the digital world is quickly changing and this impacts banking in all ramification. It is recommended that the banking industry should try to keep pace with the digital innovations, for them to be able to meet up the demands of their digitally-savvy customers.

This article aims to describe and examine the problems of how the Financial Services Authority’s assignments and functions in disputes related to legal protection for consumers. This research is a normative legal research that is prescriptive. Secondary data types include primary and secondary legal materials.The primary datas is collected from many regulations about financial, financial service authority, consummen and banking. Data collection techniques used are library studies and cyber media, and the analytical techniques are deductive by syllogism methods. The research result shows that the Financial Services Authority in carrying out its duties and functions of consumers protection was carried out with three forms of action, namely, loss prevention measures, consumers complaints services, and legal defense actions. The three tasks and functions must be carried out maximally by applying the basic principles of the implementation of the OJK’s duties so that it can accommodate the protection of consumers and society.

This chapter focuses on integrated personal financial services (IPFS) — the integration of services such as banking, insurance, and investing for the end consumer — in this new, networked economy. It identifies three different business models for the delivery of IPFS. It explores the concept of an infocracy, a form of organization in which information provides the underpinning of structure and the basis of individual power, and addresses its implications for the management and success of the alternative IPFS business models.

The introduction of FinTech into Africa's digital financial services environment has provoked a controversy as to whether the innovative technology should be assimilated by banks and other financial service providers or not, thus creating uncertainty about the future of FinTech on the continent. This chapter, therefore, examines the issues, controversy, and problems surrounding the debut of FinTech and suggest ways to make the technology acceptable in order to harness its potentials for the overall benefit of the African society.
