The article analyzes the stages of constitutional development of the Philippines, the principles and characteristics of the various constitutional acts adopted in the American colonial period and after the country's legal independence. Particular attention is paid to the principles and the specific characteristics of the current constitution of 1987, as well as the constitution of 1935, which was the first basic law, which laid the foundations of western constitutional model and the basic principles characteristic of the constitutions of democratic countries, including progressive for that time legal status of the individual, based on the "Bill of Rights" and directly borrowed from the American constitutional system. The question of the national state of one of the countries in South-East Asia is also analyzed which is of considerable scientific interest in terms of the perception of the Western model of democracy and attempts at planting on alien for these models of socio-economic and political framework. The author mentions how, after the provision of legal independence from the U.S. in 1946, the Philippines went the way of the serious distortion of the principles of "Western democracy". There was a wide gap between the formal democratic constitutional institutions of the Western model and the actual breaking of on the basis of eastern states with traditionally immature social structure, backward productive forces. The author shows that the U.S. attempts to impose its former colony model of American state and legal institutions that would facilitate the establishment of the South- East Asia "window of Western democracy", and could serve as a role model for the layout of other countries, not only in South-East Asia but also in Africa and Latin America, suffered a fiasco.

Abstract A. muricata is a small evergreen tree up to 9 m tall. It is native to tropical America but is widely planted in home gardens in South-East Asia. In Brazil, several small commercial plantations are in operation (about 2000 hectares are planted) with more planned. It was one of the earliest fruit trees introduced to the old world, brought to the Philippines by the Spanish. It is valued chiefly for its edible fruits, which are large (> 1 kg), heart-shaped and dark green in colour. The flesh is tart, desirable for ice creams and drinks, fruit jellies and sweetcakes. In the Philippines, young fruits with seeds still soft are used as a vegetable.

In 1972, the Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter (London Convention) was negotiated. It is a global treaty, for the first time, to regulate dumping of waste at sea worldwide. Following this global endeavor, the Protocol to the London Convention (London Protocol) was later agreed to further modernize the London Convention so as to reinforce the management of dumping of waste at sea. While in East Asia, only China, Japan, the Republic of Korea (South Korea) and the Philippines have acceded to the Convention and its Protocol, other countries do not show their willingness to sign them. Against this background, this article will address the responses of these East Asian states to the implementation of the London Convention, and analyze and assess their relevant laws and regulations with particular reference to China’s practice. In addition, it will focus on new challenges, such as offshore carbon storage, to the London Convention.

A perennial question in the scholarship of the state asks how states rule and expand their capacity to do so. Scholars have paid special attention to activities that rationalize and build administrative capacity, known as legibility projects. Alongside these projects, state actors also rule through ambiguous and unclear techniques that have been given less scholarly attention. I introduce the concept of institutionalized ambiguity in legal status to extend the study of state rule. I ask what generates ambiguity, what purposes it serves in law and policy, and what consequences it has for the management of populations. I propose an analytic approach that draws attention to equivocation in law as enabling classificatory debates and discretion in the political realm. To illustrate the purchase of institutionalized ambiguity in legal status, I analyze how, during the years of formal imperial rule (1898-1946), U.S. state actors debated the racial fitness and membership of Filipinos in the imagined U.S. nation. I consider the broader implications of this analysis for scholars of modern state formation and suggest that foundational conflicts over national identity can be institutionalized in law, in turn facilitating a range of contradictory, but co-existing, legally defensible policies.


Significance Meanwhile, the Myanmar junta and the military-aligned Thai government are under pressure from opponents, and the Philippines is gearing up for elections. With COVID-19 vaccination rates varying greatly, some countries in the region are better placed than others to revive their pandemic-hit economies.

A new species of the genus Pareumenes de Saussure, 1855, from the Philippine Islands (Mindanao and Samar), P. impunctatus sp. nov., is described. This is the first record of the genus from the Philippines. A key to the species of the genus occurring in insular South-East Asia is provided.


Subject South-east Asian tax bases. Significance Indonesia's tax amnesty programme enters its third phase in 2017. The amnesty will generate short-term revenue, but it is not a solution to a wider problem of limited tax bases found across the ASEAN core economies of Indonesia, Malaysia, the Philippines, Singapore and Thailand. Impacts Bilateral tax treaties may change following OECD reforms, even if South-east Asian states are not party to the initiatives. Compliance costs for country-by-country reporting for multinational companies under the OECD initiatives could be substantial. More efficient tax collection and wider tax bases could benefit ASEAN states' development such as infrastructure.


Subject Online radicalisation. Significance On May 25, the Indonesian parliament unanimously passed stringent anti-terrorism laws allowing the military to be directly involved in counterterrorism operations. The vote followed a string of suicide bombings attributed to local jihadist networks that have pledged allegiance to Islamic State (IS). Jakarta joins other South-east Asian governments -- notably those of Malaysia, the Philippines and Singapore -- in attempting to counter a new push in the region by IS, as it loses territory in Iraq and Syria. Impacts Rising anti-Shia sentiment in the region, a by-product of increased Saudi influence, will likely give IS new issues to exploit. The Rohingya crisis gives IS a regional boost, especially in terms of operations in Myanmar and more likely in Yangon than Rakhine State. Non-ideological, low-wage overseas workers, particularly from the Philippines and Indonesia, are most susceptible to IS.
