Forest destructions has been escalating worldwide, including in Indonesia. Therefore, the Government issued Law Number 18 / 2013 on the Prevention and Eradiction of Deforestation (P3H) which was expected to guarantee legal certainty with emphasis on eradication of organized forest destruction. The problem to be discussed in this paper is about law enforcement and application of Law Number 18 / 2013 which frequently used to criminalize the indigenous people in Indonesia. The indigenous people have been criminalized on the ground of unlawful forest products utilization, while they merely foraging to fulfill their basic necessities. The criminalization of indigenous people is a conclusive evidence, which proof that Indonesian Goverment has been neglecting the indigenous people’s right. This paper use normative approach. The conclusion of this paper analyze that the problem of the criminalization happens in implementation level, which caused by the ignorance of law enforcement apparatus and vested interest.

Law enforcement without direction and not based on the three pillars of the justice of law, legal certainty and the benefits to society can break the law anyway even violate human rights. As one of the policies of the government that are not considered mencerminakan the values of justice and disturbing for the people, the government policy that acts of omission or delay in the application of the death penalty. This research is a normative legal normative juridical approach. The data collected is secondary data were analyzed using qualitative methods juridical analysis. Based on these results it can be concluded that in the application of the death penalty there are serious legal issues, this is due to government policies that commit omission or delay in the execution of the death penalty is a violation of human rights as stipulated in Article 28 of the 1945 Constitution. This study aims to analyze the indicators that affect the effectiveness of the handling of Cyber Crime by the Directorate of Crimes at the North Maluku Police. As well as to reveal the process of handling Cyber Crime by the Directorate of Crime and Crime of North Maluku Police. Currently there are technical obstacles that result in the lack of legal certainty related to the problem of Cyber Crime, including the lack of structural and channeled coordination, as well as an understanding of the application of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 About Information and Electronic Transactions. Thus, the indicators of success that can affect the effectiveness of handling Cyber Crime by the Directorate of Crimes at the North Maluku Police are the Legal Mastery of the Directorate of Crimes in North Maluku regarding the ITE Law, Appropriate Law Enforcement, Community Participation, and Adequate Facilities and Infrastructure. Efforts to Handle Cyber Crime by the Crimean Directorate of North Maluku Police are the control of investigators in the field of Technology by equipping and facilitating officers with special training related to Cyber Crime, as well as providing modern facilities in investigations/investigations. In addition, in dealing with cybercrimes, it is necessary to introduce the paradigm and construction of investigator thinking from formalistic to imaginative, progressive and prioritizes the benefit of the community.

The misuse of social media that causes defamation Decision: No 574 K / pid.sus / MA / 2018, is one of the many legal problems that have been ensnared due to the misuse of social media. The author uses three types of data sources, namely primary data sources of data obtained from laws and Supreme Court decisions. And secondary data data obtained from law books, law magazines and legal writings. And the last is tertiary legal material is complementary legal material obtained from dictionaries and the internet. and data analysis using qualitative data which is data in the form of words that talk about statutory regulations. The results of the research show that in the application of law enforcement of the ITE Law article 27 paragraph 1 in conjunction with article 45 paragraph 1 there is still a sense of injustice for the community, factors that must also be considered in imposing sanctions on victims of Baiq Nuril. and sociology of law and a strong conscience against actions or decisions in law enforcement. In this case, the government should have strict supervision of the use of information technology. This is aimed at preventing and overcoming efficiently and effectively the act of defamation through social media.

<p class="WalrevAbstrak"><span lang="NL">Law enforcement to transnational fugitives especially those perpetrators of money laundering with international dimension in Indonesia, in particular related to incoming extradition is needed to reconstruct. This is because hitherto, the decision to extradite is the decision of the executive branch as stipulated in Act No.1 of 1979 on Extradition. Hence, the consideration for the government to extradite is more on political concern rather than judicial. This practice is deemed neglecting the protection of human rights and creating legal uncertainty, especially in relation to detention period that could exceed beyond admissible time as stipulated in KUHAP because of the grace period on the issuance of the Presidential Decision. This research is doctrinal and field study. Based on findings in the field, incoming extradition request must be based on the court’s decision, or judicial order in the future to ensure protection of human rights and legal certainty of the person who is subject of the extradition and to the requested country.</span></p><p class="WalrevAbstrak"> </p><p class="IABSSS">Penegakan hukum terhadap buronan transnasional, terutama para pelaku pencucian uang di Indonesia, perlu sebuah rekontruksi khususnya terkait dengan ekstradisi. Ini karena sampai sekarang, keputusan untuk mengekstradisi adalah keputusan cabang eksekutif sebagaimana diatur dalam Undang-Undang No.1 tahun 1979 tentang Ekstradisi. Oleh karena itu, pertimbangan bagi pemerintah untuk mengekstradisi lebih pada masalah politik daripada peradilan. Praktik ini dianggap mengabaikan perlindungan hak asasi manusia dan menciptakan ketidakpastian hukum, terutama dalam kaitannya dengan masa penahanan yang dapat melebihi melampaui waktu yang dapat diterima sebagaimana diatur dalam KUHAP karena masa tenggang pada penerbitan Keputusan Presiden. Penelitian ini bersifat doktrinal dan studi lapangan. Berdasarkan temuan di lapangan, permintaan ekstradisi yang masuk harus didasarkan pada keputusan pengadilan, atau perintah pengadilan di masa depan untuk memastikan perlindungan hak asasi manusia dan kepastian hukum dari orang yang menjadi sasaran ekstradisi dan ke negara yang diminta.</p>

This research uses a normative approach, which is carried out by examining laws and theories. Also, this study uses a case approach, namely the 2017 village fund corruption case in Pekon Sukaratu. The main problem in this res­earch is what is the authority of the prosecutor in conducting investigations into criminal acts of corruption after the passage of Law Number 30 of 2014 concerning Government Administration and whether the investigation carried out by the prosecutor at the Pringsewu District Prosecutor's Office in coordination with the Government Internal Supervisory Apparatus or Aparatur Pengawas Internal Pemerintah (APIP) against the allegations a criminal act of corruption in the management of village funds in 2017 in Pekon Sukaratu whose losses to the state have been returned have met the principle of legal certainty. The research results show that the prosecutor has the authority to carry out the law enforcement process, namely the investigation of suspected corruption crimes as stipulated in Article 30 paragraph (1) letter d of the law on the Prosecutor's Office of the Republic of Indonesia. Based on the results of the research that has been done, it is better if changes in laws and regulations related to the elements of corruption in Law No. 31 of 1999 concerning Eradication of Corruption Crime because there is a product of the Constitutional Court with the decision No. 25/PUU-XIV/2016. Besides, there is a need for socialization for prosecutors regarding their authority in TPK investigations and related to coordination patterns with the authority of APIP in carrying out investigations and calculating state financial losses.

One of the biggest problems faced by the Unitary State of the Republic of Indonesia is the handling of the problem of corruption which seems to never end, both in terms of eradicating or implementing laws regarding corruption. In Indonesia, an independent institution specifically dealing with corruption issues has been established, namely the Corruption Eradication Commission (KPK) since 2002. However, the fact is that until 2020 it has not really been able to effectively address the problem of corruption in Indonesia with various arrests made by the Corruption Eradication Commission (KPK). proves that the problem of corruption that occurs inthis country and the government in Indonesia needs serious attention from various parties who play an important role in dealing with the problem. This writing aims to determine the extent to which legal certainty applies in the process of eradicating corruption in Indonesia, the researchmethod used is the normative research method. Based on the results of the research conducted, it can be concluded that the laws governing and law enforcement officials inovercoming the problem of corruption in Indonesia have not been fully effective in providing legal certainty to corrupt actors and the application of existing laws has not been able to fully guarantee the disappearance or no more corruption. will happen in the future, and there is a need for prevention that can give birth to new corruptors in the future by further increasing anti-corruption learning programs and carrying out various socialization or prevention of acts of corruption from an early age which is felt to help overcome the problem of corruptors in this country.

Kebijakan terkait dengan masyarakat adat yang paling banyak di sorot selama ini adalah di bidang tanah dan sumberdaya alam. Dengan adanya keputusan Mahkamah Konstitus atas Perkara nomor 35/PUU-X/2012 Pengujian terhadap UU No. 41 Tahun 1999 Tentang Kehutanan yang menyatakan hutan adat bukan hutan negara, belum menjadi kebaikan bagi masyaraka tadat. Adapaun permasalahan yang akan diteliti adalah: Bagaimana Penegakan Hukum Konflik-konflik Agraria yang terkait dengan hak-hak masyarakat adat Pasca Putusan Mahkamah Konstitusi No.35/PUU-X/2012, Apa hambatan-hambatan dan Kebijakan apa yang dilakukan Pemerintah untuk menyelesaikan Konflik Agraria yang terkait dengan hak-hak masyarakat adat. Metode Penelitian ini menggunakan pendekatan yuridis sosiologi dilengkapi penggalian informasi dengan stakeholder terkait dalam rangka mempertajam kajian dan analisis Penyelesaian yang menyeluruh sebagai implementasi norma konstitusi yang ditegaskan oleh Putusan MK 35/PUU-X/2012 tidak membuat jalan lain tertutup. Antara lain Peraturan Perundang-undangan yang bersebaran dan perlu sinkronisasi, Penerapan penegakan hukum secara sungguh-sunguh dari berbagai stikholder terkait termasuk hasil Inkuiri Nasional Masyarakat Adat yang diselenggarakan oleh Komnas HAM untuk memberi pilihan-pilihan kepada masyarakat. Upaya yang serius dan koordinasi antar kementerian atau lembaga terkait dalam rangk menegakkan konflik-konflik agraria yang terkait dengan hak-hak masyarakat adat tanpa ada ego sektoral. Rekomendasi penelitian ini adalah koordinasi antar institusi atau lembaga terkait seperti Kementerian BPN dan Tata Ruang, Kementerian Lingkungan Hidup dan Kehutanan, Polri dan tokoh-tokoh masyarakat adat, Komnas HAM, serta Kemendagri agar mendorong Pemda segera mendata, melakukan penelitian dan mengukuhan keberadaan Masyarakat Hukum Adat beserta wilayah adatnya. AbstractPolicies related to indigenous peoples most in highlight during this time is in the field of land and natural resources. Methods This study used juridical sociology include extracting information with relevant stakeholders in order to sharpen the research and thorough analysis of the Settlement as the implementation of the constitutional norm which is confirmed by the Constitutional Court Decision 35 / PUU-X / 2012 did not make another road closed. Among other legislation that needs to be spread and synchronization, Application of law enforcement were full of a variety of related stikholder including the results of the National Inquiry Indigenous Peoples organized by the Commission for giving choices to the public. Serious effort and coordination among relevant ministries or agencies in enforcing circuit has agrarian conflicts related to the rights of indigenous peoples without any sectoral ego. Recommendations of this study is coordination between institutions or agencies such as the Ministry of BPN and Spatial Planning, Ministry of Environment and Forestry, the National Police and leaders of indigenous peoples, the Commission, as well as the Ministry of Home Affairs in order to encourage the provincial government immediately assess, conduct research and confirm existence of Indigenous People and their customary territory.

This paper is entitled "The Neglected Dream" (Implementation of the Purpose of Law and Criminal Law in Indonesia). Law and the purpose of law have interrelated and inseparable links. The law always plays an important role in a country even the law has a multifunction with the aim of the public good in order to achieve justice, legal certainty, order, expediency, and others. However, this is far from the fire. That is, the public is only given the wind of heaven and dreams that wash away while the state authorities use the law as a tool to suppress society, so that society can be positioned in accordance with the desires of the state authorities. The implementation of the law and the purpose of the law in force in Indonesia is clearly visible, so through a number of legal theories set forth in this paper will be a little stomping for anyone who understands it when compensating for the facts that occur in the midst of society. In fact, for people who want to get legal justice but in reality are entangled in the law. The government should be serious in responding to this because the people have given full mandate to manage this country, including in dealing with legal issues, both in terms of legal structure, legal substance and legal culture played by law enforcement.
