Fake investment is becoming a phenomenon that has been occurring a lot lately in Indonesia, especially the online kind. Investment is a commitment to invest some fund to one or more asset(s) in some period of time. This article is written with a goal to do research on law enforcement of Indonesian investment law. The method of research that is used is normative law research. It’s found that: Investment in Indonesia is regulated by the Law of The Republic of Indonesia number 25 of 2007 on Capital Investments. System of investing in Indonesia is protected by Law of The Republic of Indonesia number 10 of 1998. The presence of fake investment is bringing negative influence to Indonesian investment scene. Act of fraud or embezzlement in the form of investments can be prosecuted criminally and sentenced up to 4 years of imprisonment according to the Indonesian criminal code article 372 and 378. It is to be expected that public can differentiate which is a legal and which is a fake investment. That could be realized if the public is educated on economics and law. It is a joint responsibility of the government, investment organizers, and academics. Investasi bodong menjadi sebuah fenomena yang sering terjadi belakangan ini sangat marak terjadi di Indonesia, khususnya investasi online. Investasi merupakan komitmen menanamkan sejumlah dana pada satu atau lebih aset selama beberapa periode. Artikel ini dibuat dengan tujuan untuk meneliti penegakkan hukum tentang investasi di Indonesia. Metode yang digunakan adalah penelitian hukum normatif. Dan ditemukan bahwa: Investasi di Indonesia diatur dalam Undang-Undang No. 25 Tahun 2007 Tentang Penanaman Modal. Sistem investasi di Indonesia dilindungi oleh UU No. 10 tahun 1998 tentang Perubahan Undang-undang Nomor 7 Tahun 1992 tentang Perbankan. Kehadiran investasi bodong membawa pengaruh negatif bagi iklim investasi Indonesia. Tindakan penipuan dan penggelapan uang yang berkedok investasi dapat dijerat pidana penjara paling lama empat tahun sesuai Pasal 372 dan 378 UU KUHP. Diharapkan kedepannya masyarakat dapat membedakan mana investasi yang legal dan yang bodong. Hal itu dapat terjadi bila masyarakat teredukasi soal ekonomi dan hukum. Ini menjadi tanggung jawab bersama pemerintah, penyelenggara investasi, dan akademisi.

Secreted as an action or decision that can be used by the state civil service (ASN) under certain conditions, in carrying out the law enforcement duties of civil servants especially the police the authority to use discretion can be applied according to the conditions needed in the context of law enforcement, but after the enactment of Law Number 30 of 2014 concerning Government Administration requires clarity regarding the position of discretion in law enforcement. The method used is a normative approach using secondary and primary data that is analyzed qualitatively. The results showed (1) That the enactment of the Law on Government Administration is an effort to provide a legal position for discretion within the State Civil Apparatus. Discretion is regulated more clearly, from the definition, the limit according to the law, the limit is issued by the authorized official, the purpose, scope, conditions, use of discretion and approval procedures, and the consequences of discretionary law. (2) POLRI in its position as a law enforcement apparatus has the function of enforcing law in the judicial field both preventive and repressive. So with the discretionary authority in the judicial field as stipulated in Law No. 2 of 2002 in Article 18 paragraph (1) that "In the public interest of the Republic of Indonesia National Police officials in carrying out their duties and authorities can act according to their own judgment". (3) that in the relationship between the implementation of discretion according to the Government Administrative Law and the Police Law of the Republic of Indonesia there is an expansion of the purpose of police discretion in law enforcement, which is not only to create and maintain security and order, but also to launch and overcome obstacles in the process of law enforcement.Keywords : Discretion, State Civil Apparatus, Law Enforcement.

<p>Pregnancy is a very happy situation for every partner who has been legitimate. In connection with this we still often encounter couples who do not value pregnancy so take the decision to do inhumane actions, one of which is abortion. Abortion is a form of criminality that is still very difficult to be handled by the public or the government, this is because there are still gaps for the perpetrators to carry out these actions and the deterrent effect is still lacking for abortion. This study aims to determine the legal arrangements and accountability for abortionists. This study uses normative juridical research methods, to address abortion problems that occur without looking at it from one perspective, but comprehensively. The results showed that the legal arrangements for the crime of abortion have been regulated in the law adjustment for abortion has been regulated ib article 194 law number 36 year 2009, about a midwife who help those who committed abortion is included in criminal code article 349</p>

The freedom in social media communication have not been responded wisely by the citizen of the net (netizen). Sometimes while expressing themselves in the social media, netizens used the taboo words which potentially break the law. The problems chosen in this research is a type of taboo words used by the netizen and also whether these expressed words have a potential to violate the law. The method to collect the data is “Simak bebas libat cakap“(SBLC), it is a method where there is no active communication between interviewer and interviewee but it is only taken the data from internet, then to transcribe the taken data. The following step is analyzing data which used referential equivalent method, then the results of the analysis were presented informally. The findings showed that taboo words used in social media consisted of: (1) obscene words, (2) vulgar language, and (3) nick name and insult. These taboo words potentially violate the government regulation of the Republic Indonesia number 11 of 2008 concerning electronic information and transactions article 27 paragraph (3) and article 45 paragraph (1) as well as article 310 section (1) and article 311 section (1) of the Indonesian Criminal Code concerning defamation. Studying of issues regarding criminal infractions – whether intended or imprudent – plays quite a significant role. Fundamental changes taking part in world economy and politics, globalization processes, as well as internal dynamics of country development, undoubtedly, have impact on national legal framework, including criminal law. Therefore, the main goal of the present paper is the analysis of legislation of the Republic of Kazakhstan regarding criminal infractions and the law enforcement practice. To reach this goal authors have used methods of comparison, analysis and data systematization. As a result it has been found that in Kazakhstan there are at average 4,3 registered criminal infractions per a convict. The term of criminal infraction has appeared in the Criminal Code in 2014 to cover offences of small gravity and administrative violations that cannot be referred to the sphere of state administration. Authors have revealed the punishment in the present day Kazakhstan is not a main form of criminal responsibility realization. In the majority of cases linked to criminal infractions the persons committed them are relieved from criminal responsibility at the stage of prejudicial inquiry.

Penyertaan pada dasarnya diatur dalam pasal 55 dan 56 KUHP yang berarti bahwa ada dua orang atau lebih yang melakukan suatu tindak pidana atau dengan perkataan ada dua orangatau lebih mengambil bahagian untuk mewujudkan suatu tindak pidana. Penyertaan di dalam Undang-Undang Pemberantasan Tindak Pidana Korupsi yaitu Undang-Undang Nomor 31 Tahun 1999 jo Undang-Undang Nomor 20 tahun 2001 disebut sebagai pembantuan.Dalam putusan Kasasi Mahkamah Agung Nomor : 1769 K/PID.SUS/2015 menyatakan bahwa Terdakwa I Indra Gunawan Bin Alm. Saleh tersebut tidak terbukti secara sah dan menyakinkan bersalah melakukan perbuatan sebagaimana yang didakwakan dalam semua dakwaan Penuntut Umum dan Menyatakan Terdakwa II Irfan Bin Husen telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana “Turut Serta Melakukan Korupsi”. Majelis Hakim Judex Factie Pengadilan Tinggi/Tipikor Banda Aceh dalam memeriksa dan mengadili perkara Aquo telah salah dalam menerapkan hukum atau suatu peraturan hukum tidak diterapkan atau diterapkan tidak sebagaimana mestinya, yaitu mengenai penerapan hukum pembuktian sehingga harus dibatalkan oleh Mahkamah Agung Republik Indonesia.The participation is basically regulated in articles 55 and 56 of the Criminal Code, which means that there are two or more people who commit a crime or say that there are two or more people taking part to realize a crime. But in reality, in the observations of the authors of the vehicles that we encountered, both four-wheeled and two-wheeled, almost every evening until evening, vehicles were found parked on the Flyover on the Sudirman street, Tuanku Tambusai, Sukarno Hatta and HR Subrantas. While the government has clearly provided a symbol of prohibition to stop on the bridge and in the traffic law it clearly states that everyone driving a motorized vehicle on the road is obliged to comply with the stopping and parking requirements. This is dangerous because the flyover is built only for passing vehicles and the vehicle is prohibited from parking or stopping along the body of the flyover because the flyover is not prepared not for stopping vehicles. This type of research is research conducted by identifying the law on how the effectiveness of the law applies in society. The conclusion is that the implementation of the prohibition on parking for motorized vehicle riders in Pekanbaru City flyovers based on Law Number 22 of 2009 concerning Road Traffic and Transportation which results in disruption of road functions based on Law Number 22 of 2009 is less effective and maximal. This is because there are still many people who do not know about these regulations, Lack of Socialization of Law Number 22 Year 2009 from Law Enforcement Officials, Lack of firm law enforcement officials in implementing criminal sanctions, and Lack of Legal Awareness of the Community itself. Obstacles Faced in the Implementation of the Parking Prohibition for Motorized Vehicle Riders on Flyover in Pekanbaru City Based on Law Number 22 of 2009 concerning Road Traffic and Transportation are the Legal Substance, Legal Structure, Legal Culture and Facilities or Facilities and the limited facilities and infrastructure. Efforts made to overcome obstacles in the Implementation of the Parking Prohibition for Motorized Vehicle Riders at Pekanbaru City Flyovers Based on Law Number 22 of 2009 concerning Road Traffic and Transportation are that peace and traffic order is by fostering mutual assistance and assistance among the enforcement officers and the public, the public workers' office of transportation without neglecting their respective interests in the framework of increasing obedience and compliance, thus the Government's hope of improving services in traffic order in a peaceful and orderly condition in the regions can be realized. Apart from that, the implementation of traffic control, tranquility and orderliness can also be carried out by utilizing public facilities and facilities, increasing legal awareness, increasing the number of police personnel in the traffic sphere and repressive actions. Keywords: Implementation, No Parking, Flyover  Namun pada kenyataannya dalam pengamatan penulis kendaraan yang kami jumpai baik roda empat maupun roda dua, hampir setiap sore hingga malam hari ditemukan kendaraan yang parkir di Flyover yang ada dijalan Sudirman, Tuanku Tambusai, Sukarno Hatta dan HR Subrantas. Sementara pemerintah sudah dengan jelas memberikan simbol larangan untuk berhenti dijembatan tersebut serta didalam undang-undang lalu lintas tersebut dengan tegas mengatakan setiap orang yang mengemudikan kendaraan bermotor di jalan wajib mematuhi ketentuan berhenti dan parkir akan diberikan sanksi. Hal ini berbahaya karena Flyover tersebut dibangun hanya untuk kendaraan yang melintas dan kendaraan dilarang parkir atau berhenti di sepanjang badan jalan Flyover karena Flyover itu tidak disiapkan bukan untuk kendaraan yang berhenti. Jenis penelitian ini adalah penelitian yang dilakukan dengan cara mengadakan identifikasi hukum bagaimana efektivitas hukum itu berlaku dalam masyarakat. Kesimpulan adalah Implementasi Larangan Parkir Bagi Pengendara Kendaraan Bermotor Di Flyover Kota Pekanbaru Berdasarkan Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas Dan Angkutan Jalan yang mengakibatkan terganggunya fungsi jalan berdasarkan Undang-Undang Nomor 22 Tahun 2009 kurang efektif dan maksimal. Hal ini dikarenakan masih banyaknya masyarakat yang tidak mengetahui peraturan tersebut, Kurangnya Sosialisasi Undang-Undang Nomor 22 Tahun 2009 dari Aparat Penegak Hukum, Kurang tegasnya Aparat penegak Hukum dalam menerapkan Sanksi Pidana, Serta Kurangnya Kesadaran Hukum Masyarakat itu sendiri. Hambatan Yang Dihadapi Dalam Implementasi Larangan Parkir Bagi Pengendara Kendaraan Bermotor Di Flyover Kota Pekanbaru Berdasarkan Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas Dan Angkutan Jalan adalah Substansi Hukum, Struktur Hukum, Budaya Hukum dan Sarana atau Fasilitas dan masih terbatasnya sarana dan prasarana. Upaya yang dilakukan untuk mengatasi hambatan dalam Implementasi Larangan Parkir Bagi Pengendara Kendaraan Bermotor Di Flyover Kota Pekanbaru Berdasarkan Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas Dan Angkutan Jalan adalah bahwa ketentraman dan ketertiban lalu lintas adalah dengan membina saling membantu dan menolong diantara aparat penertiban dan masyarakat, dinas perhubungan dinas pekerja umum tanpa mengabaikan kepentingan masing-masing dalam rangka peningkatan ketaatan dan kepatuhan, dengan demikian harapan Pemerintah untuk meningkatkan pelayanan dalam ketertiban lalu lintas dalam keadaan tenteram dan tertib di daerah dapat terwujud. Selain itu pelaksanaan penertiban, ketentraman dan ketertiban lalu lintas juga dapat dilakukan dengan memanfaatkan sarana dan fasilitas umum, meningkatkan kesadaran hukum, Menambah Jumlah Personil Kepolisian di lingkup lalu lintas serta Tindakan represif.

This research uses a normative approach, which is carried out by examining laws and theories. Also, this study uses a case approach, namely the 2017 village fund corruption case in Pekon Sukaratu. The main problem in this res­earch is what is the authority of the prosecutor in conducting investigations into criminal acts of corruption after the passage of Law Number 30 of 2014 concerning Government Administration and whether the investigation carried out by the prosecutor at the Pringsewu District Prosecutor's Office in coordination with the Government Internal Supervisory Apparatus or Aparatur Pengawas Internal Pemerintah (APIP) against the allegations a criminal act of corruption in the management of village funds in 2017 in Pekon Sukaratu whose losses to the state have been returned have met the principle of legal certainty. The research results show that the prosecutor has the authority to carry out the law enforcement process, namely the investigation of suspected corruption crimes as stipulated in Article 30 paragraph (1) letter d of the law on the Prosecutor's Office of the Republic of Indonesia. Based on the results of the research that has been done, it is better if changes in laws and regulations related to the elements of corruption in Law No. 31 of 1999 concerning Eradication of Corruption Crime because there is a product of the Constitutional Court with the decision No. 25/PUU-XIV/2016. Besides, there is a need for socialization for prosecutors regarding their authority in TPK investigations and related to coordination patterns with the authority of APIP in carrying out investigations and calculating state financial losses.

The problems of the anti-corruption strategy, issues of elimination of criminal factors, improvement of legislation and the activities of law enforcement agencies are analyzed. Anti-corruption problems should be solved systematically in a set of integrative measures of state-political, socio-economic, national-cultural, informational, criminological, legal and moral. The priorities of the implementation of such a course are the urgent implementation of such strategic principles as DE monopolization, DE offshorization, requisition of energy security facilities, demarcation of business and power, and ensuring effective tax and customs policy. The effective mechanism against corruption is the disengagement of power and business, the elimination of factors of political corruption. It is proposed in the Law on the Prevention of Corruption, as well as in the laws regulating the status of civil servants, to enshrine the requirement of impeccable business reputation and integrity. A system of new legislation should be developed and adopted: the Code of Evidence, the Code of Law Enforcement, the Investigator Status Function Act, the Detective Status Act, the Jury and World Court Act, and the Crime Detection, Prevention and Prevention Act. It is proposed to state the disposition of the law of the Criminal Code of Ukraine on illegal enrichment in accordance with Article 20 of the UN Convention against Corruption of 31.10.2003. In particular, it is proposed to consolidate the responsibility of officials for a significant increase in assets that exceed the total assets of zero declaration and legal wages in the public service. The mechanisms of the state government should provide for the function of prosecutorial supervision over the enforcement of anti-corruption legislation in the activities of enterprises, executive authorities and local government. Systemic proposals are being made for the formation of a strategy and a comprehensive anti-corruption programed.

The objective of the Socialization of the Prevention of Non-Procedural Indonesian Migrant Workers (PMI-NP) is a preventive effort in the law enforcement process carried out by the Immigration agency through the activities of the Immigration Polytechnic cadets to reduce the number of Indonesian Non-procedural Migrant Workers in Indonesia. Preventive efforts are carried out in coordination with the Manpower Office in Pati District.The socialization of the prevention of Non-Procedural Indonesian Migrant Workers is carried out at the Indonesian Educational and Professional Development Institutions. The results of the implementation of these activities are expected that the public will have legal awareness of the process of becoming PMI procedurally, know the impact of the dangers of becoming PMI - NP, and provide legal certainty for PMI candidates so that they can become procedural PMIs so that it is safe to do work outside the territory of the Republic of Indonesia.
