In this scientific article, the author discloses the definition of insolvency as a substantive legal basis for opening bankruptcy proceedings. It is emphasized that the grounds for initiating bankruptcy proceedings enshrined in the Bankruptcy Procedure Code are not consistent with the concept of insolvency of the debtor, which is enshrined in part one of Article 1 of this Code, as their combined application does not require establishing the debtor's ability to meet its monetary obligations. to creditors after the due date solely through the application of bankruptcy proceedings. It is established that the courts do not establish the facts of the debtor's signs of insolvency, taking into account the concept of insolvency, which is enshrined in law. It is alleged that the postponement of the moment of proving insolvency to the stage of disposition of the debtor's property is the cause of cases of unreasonable application to the debtor of the consequences of bankruptcy proceedings, namely, a moratorium on creditors' claims, restriction of the debtor to decide on his property. It is emphasized that the existing legal position of the Supreme Court on the moment of establishing the solvency of the debtor is unconstructive, as it allows the opening of bankruptcy proceedings against debtors who have no signs of insolvency, but simply perform their obligations in bad faith. It is noted that insolvency is an economic category, requires knowledge of the balance sheet of the enterprise, the economic component of its assets and liabilities, and so on. In order to establish the facts of bankruptcy, fictitious bankruptcy or hidden bankruptcy, it is proposed to conduct a mandatory economic examination of the debtor before initiating bankruptcy proceedings.

This article is devoted to the study of the image of Executive authorities in modern Russia. The relevance of the chosen topic of the scientific article is emphasized for the present time, when society and the state are developing methods of countering the coronavirus pandemic – not only in the medical, but, no less important, in the socio-psychological aspect. In this perspective, the consolidating potential of a positive image of government bodies and civil servants is noted. Attention is focused on the terminological apparatus of the problem. Based on the analysis of relevant scientific works, the article provides the author's definition of the image of public authorities. The author notes the peculiarity of the image of Executive authorities, which consists in the presence of two inextricably linked equivalent components – the image of the authority and the image of a civil servant. Image formation of government bodies is considered as a multi-factor interaction of three main subjects: government bodies, the population, and the mass media. The main method of implementation is still the mass communication media, which provide a permanent presence of Executive authorities in the information and communication space. It is noted that the basis for the formation of a positive image of the Executive authority and bureaucracy is their effective functioning. At the same time, the perception of citizens, their attitude to the activities of Executive authorities, the level of trust in them is considered as the main indicator of the modality of the image. Based on the analysis of data from sociological studies, the conclusion about a positive trend in the perception of public authorities and officials by Russians is substantiated. However, there is a negative impact on their image of the lack of these changes and, in General, a low level of openness of public authorities.

For any business organizations, it is of great importance to handle customer complaints effectively. This is particularly vital in the service industry as complaining customers are found not very collaborative and tend to be emotional in the process of complaining [1] and sometimes the exchanges between agents and complaining customers become interpersonally sensitive. Following Orthaber and Reiter’s [2] definition of “interpersonally sensitive exchange”, this study addresses two research questions: (1) what pragmatic strategies are employed by call center agents in interpersonally sensitive interactions in complaint responses? 2) and what are the effects of these strategies on interpersonal relationship in complaint responses? Based on a corpus of 42 outbound calls (approximately 7.5 hours) made by the agents in the Complaint Centre of one Chinese airline, four conventional and two unconventional complaint response strategies are found to be employed by the agents. These strategies produce positive outcomes in some cases while lead to opposite effects in others. An effective strategy can either enhance the rapport between the agent and the complaining customer, or benefit the progressivity of complaint handling. Conversely, it deteriorates the originally sensitive rapport and sometimes even leads to upgraded complaint.

The scientific article examines the modern mechanism of protection of intellectual property rights in Ukraine. Attention is paid to the historically first using of the concept of intellectual property rights in international law and the shortcomings of this definition. The legal definition of this concept contained in the Civil Code of Ukraine is analyzed. It is concluded that the legislative enshrinement of intellectual property rights is evidence of its recognition by the state, and such a right applies to special objects, the list of which is enshrined at both national and international levels. The question of the relationship between the concepts of "protection" and "defense" of civil rights is covered. The main groups of approaches of scientists to the solution of this problem are indicated. An approach that defines "protection" as a general concept for "defense" is supported, where "protection" is a broader concept that covers the term "defense". Emphasis is placed on the fact that although these legal categories are related, they cannot be identified. The main features that distinguish these concepts are listed, and the features of "defense" as an independent concept are highlighted. There are given examples of definition of the concept of protection of intellectual property rights given by scientists. Based on these definitions, the main features of this term are summarized. The issue of forms of protection (jurisdictional and non-jurisdictional) has been studied. The general and special order within the jurisdictional form is distinguished. It is noted about the peculiarities of self-defense as a non-jurisdictional form. The focus is on the judicial (general) procedure for protection of intellectual property rights as the main one. Possible ways of protection (civil, administrative, criminal, and criminal) are analyzed. The problems and shortcomings of the current system of legal protection and protection of intellectual property rights in Ukraine are analyzed. Both reports from international partners and research by Ukrainian scientists were used. The authors outline ways to solve existing problems. Owned business management inevitably implies the availability of tools for its implementation. The set of tools for such management is effective, when it can be integrated into the overall system of business processes. The problem lies in the selection of those managerial business processes, where the participation of the owner is necessary. Justification of the definition of such business processes is possible on the basis of systematization and identification of the risks, that must be assumed by the business owner. In theory and practice of management, the focus is on the management of the organization, which is implemented by hired specialists-managers. The role of business owners is rarely seen as an independent activity. Meanwhile, the goals and the role of business owners are far from adequate to the goals and roles of managers. This circumstance makes the problem of ownership business management urgent. Currently, the terms “owner contro”l and “ownership management” are used in literary sources. These terms do not coincide in their meaning. Ownership management includes ownership control and occurs when the owner solves the problems of strategic development. If strategic development goals are not set for any reason, the owner remains to develop a system of ownership control over the current state of the business. Ownership business management should be built on the development and control of the organization's business processes. The owner can not physically control all business processes, and this is not necessary. There is a need to highlight those business processes, that he must control necessarily. In our opinion, the solution of this problem can be built on the basis of an appropriate classification of entrepreneurial risks.

In the presented scientific article, an attempt was made to study the origins of the origin of the Yedinoverie Church in the Dnipro Ukraine, the main stages of its development in the 19th and early 20th centuries and the definition of a place of common faith in the structure of the Russian Orthodox Church. Historical conditions and peculiarities of the emergence of uniformity are analyzed as a form of compromise between the Old Believers and the official Orthodox Church. The role of the Slavonic and Kherson Archbishop Nikifor (Feotoki) in the origin of the common religion and the reaction of the Holy Synod to its actions is examined. The process of creating Yedinoverie Church and the dynamics of its development in different regions of the Dnipro Ukraine is studied. In the context of the topic under consideration, scientific and interest documents are published and archived, which give an opportunity to consider certain aspects of the activities of the clergymen of the faith Edinoverie Church. The attitude of soviet power and the official Orthodox Church to the unity of faith at various stages of the period under investigation is considered. The main criteria of pressure on the Old Believers to join them in the Yedinoverie Church are clarified. It is noted that the activities of the Russian government did not bring the desired results and the number of co-religionists did not increase significantly. The reasons were the unwillingness of the Old Believers to change their spiritual priorities and the disappointment in the activities of the Russian Orthodox Church. With time, already in the first half of the XX century, the Yedinoverie Church, fulfilling its mission of associating schismatics with official Orthodoxy, became an integral part of the Russian Orthodox Church. Its church temples and monasteries gradually changed their status to Orthodox.
