scholarly journals Legal Aspects of Formation of Information Jurisdiction of Future Jurists: The Practice of Creating a Web Portfolio

The article states that total and radical changes are taking place in society in all spheres, and legislative provision of the sphere of providing educational services in the field of higher legal education is gradually emerging; noted that the conceptual vision of the problem as a whole has not yet emerged; it is stated that human rights are on the surface of all social transformations, and the right among others belongs to the right to information, therefore the aspect of implementation and protection of personal data on the Internet, scientific substantiation, legal regulation of these rights and consolidation of their respective status are relevant; it was also noted that in the conditions of post-industrial society the issues of informatization of the Ukrainian educational space are very topical; it is a question that their decision should be made not only by dynamic methods of development of information educational environment, but also by search of new means, forms and ways of interaction of socio-cultural institutions (media and education), as well as support and evaluation of the effectiveness of the educational process in the conditions of information society; noted that today these tasks are intended to be solved by media education; formation of media competence directly concerns future jurists, since they are responsible for the transfer of knowledge and experience in practice, that is, consulting activities in the context of universal informatization; the issue of media competence of the future jurist is also being updated because the society is experiencing a discrepancy in the experience of interaction with the media in the older generation and young people; it is noted that, because of media creation, a teacher in higher education institution will be able to expand the students' view of future jurisprudence, about the media, to reveal the intellectual potential of modern information technologies and "media culture as a means for further continuous self-education"; it was stated that for a long time the portfolio was used only as an authentic evaluation of the results of the students' educational and professional achievements, but its possibilities are obviously much wider; "Web Portfolio" is a web-based resource that reflects the growth of the owner's educational or professional achievements; the value of such a web-portfolio is also evident in the issue of potential employment and in the self-presentation of oneself as a competent specialist, ready to live and work in the conditions of the information society; it was noted that the web portfolio should be put into operation of the institutions of higher education; indicated that there are also so-called "false portfolios", representing a specialist with no work experience, but with the available skills; stated that the issue of creating a web-portfolio is relevant for the higher education of future jurists; also noted that there is a danger of being "hostage" to the network and, in general, it is difficult to resist, counter, prevent and combat threatening challenges on the network.

Introduction. Working conditions of the teaching staff of higher education institutions are not static, as they reflect the changes taking place in the outside world. The increase in the role of informatization, the acceleration of the information flow, the changing of the information field, the introduction of scientometric indicators, the recognition of the impact of stress in the workplace on the health of an employee – all this accompanies the work of the teaching staff. The analysis of these phenomena makes it possible to single out three large groups of working conditions for the teaching staff of higher education institution, which today are undergoing changes, to identify the prerequisites for their occurrence and to formulate their consequences for the entire educational process. The purpose of the study was to conduct a comprehensive analysis of the working conditions of higher education teachers, which are currently undergoing changes. Methods and methodology. The work used the methodology of a comprehensive study, including methods of document analysis, comparative analysis, secondary use of sociological, economic and medical data. The results of the study show that the digitalization of vocational education, including higher education, is carried out in different conditions than the digitalization of schools, which leads to the emergence of a new paradigm of interaction between higher education teachers and students. As a result of research, the absence of a centralized acquisition of skills in the use of digital technologies by teachers was confirmed: 45% of respondents carry out advanced training on their own, 41% – using online platforms, 31% – ask for help from colleagues in their educational institution, 30% – exchange experience with colleagues from others vocational institutions. In the absence of legislative regulation of the issue of mastering new digital competencies by the teaching staff of higher education institutions, the ways of solving this issue are proposed. The results of the research revealed that meeting the scientific productivity requirements for the teaching staff is one of the main sources of stress in the workplace (40% of respondents). It is concluded that in order to achieve quality indicators in the field of scientific activity, in order to prevent opportunistic behavior of the teaching staff, higher education institutions need to develop tools of internal motivation. The authors believe that an integrated approach to regulating the emotional burnout of teachers could also be applied in relation to minimizing the risks of professional burnout, that is, to adopt acts of legal regulation at the federal and local levels in order to prevent professional burnout.

Актуальность темы научной статьи обусловлена тем, что каждый гражданин Российской Федерации независимо от его социального статуса обладает правом на образование. Однако отдельные категории граждан, в частности, осужденные лица, не могут воспользоваться данным правом по причине наличия у них особого юридического статуса. Беспрепятственный доступ осужденных к образовательному процессу оказывает положительное влияние на социальную безопасность и защищенность каждого отдельного гражданина, так как от уровня их образованности напрямую зависит степень их исправления. В данный момент на территории нашей страны наблюдается большая вовлеченность всех слоев населения (включая осужденных) в сферу образовательных услуг как на возмездной, так и на безвозмездной основах. Профессиональное образование и профессиональное обучение как очень важный и необходимый элемент в отечественной пенитенциарной системе регулируется различными источниками права, относящимися и к системе уголовно-исполнительного законодательства, и к системе образовательного законодательства РФ. Целями правового регулирования отношений в сфере образования являются установление государственных гарантий, механизмов реализации прав и свобод человека в указанной сфере, а также защита прав и интересов участников отношений в сфере образования. Problem statement of the scientific article is due to the fact that every citizen of the Russian Federation, regardless of his social status has the right to education. However, some categories of citizens cannot exercise this right due to their special legal status, in particular, we will talk about convicted persons. Unimpeded access of this category of citizens to the educational process has a positive impact on the social safety and security of each individual, since the level of education of convicted persons directly affects the degree of their correction. At the moment on the territory of our country there is a great involvement of all segments of the population (including convicts) to the sphere of educational services free or for a fee. Vocational education and training as a very important and necessary element in the domestic penitentiary system is regulated by various sources of law relating to both the system of penal legislation and the system of educational legislation of the Russian Federation. The objectives of legal regulation of relations in the field of education are the establishment of state guarantees, mechanisms for the implementation of human rights and freedoms in education, as well as the protection of the rights and interests of participants of relations in the educational field.

The article describes the prerequisites for the creation and implementation of an inclusive educational environment in higher education settings in Ukraine. Contradictions have been identified between the legal framework governing higher education for students with special educational needs and the lack of appropriate physical and psychological conditions for the realization of the right to education, and the contradiction between the existence of a tendency to integrate the educational process and the need to individualize the educational process. It is determined that the state of development of inclusive education in Ukraine is characterized by insufficient development of both social and acmeological mechanisms of interaction of key figures of the educational process. The types of inclusive education implemented by higher education institutions are described. The experience of implementation of inclusive educational policy at Lviv Polytechnic National University and the University "Ukraine" is considered. The author's development of the model of acmeological interaction of participants of the inclusive process in the inclusive educational environment is presented, and the criteria and indicators of evaluation of the interaction of the participants of the inclusive process in the inclusive educational environment are explained. It was found that a serious obstacle to the introduction of inclusive higher education in Ukraine is the lack of financial capacity of universities: there is no equipped environment, there are no special programs aimed at such education. Conclusions are made regarding the importance of acmeological interaction of participants in the inclusive process in an inclusive educational environment, which is not only to improve the situation of students with special educational needs but also to create positive aspects of social development in general.

The article examines the process of regulating employment through the introduction of digital technologies in the organizational and legal sphere. The authors considered the features of the manifestation of organizational and legal aspects of employment regulation during the transition to a post-industrial society. The attention is focused on the most problematic areas of employment regulation. The research is based on the position of continuity of socio-economic development and continuity of its stages. The study made it possible to identify quantitative, structural, and qualitative transformations in the field of employment in the Russian Federation, related to information and digital technologies. These changes require the solution of a set of tasks to improve the system of organizational and legal regulation of employment: limiting the negative impact of digital technologies in the process of regulating employment; regulation of organizational and legal regulation of all types of “agency labor” and its adjustment, considering the spread of its non-standard forms in terms of expanding the scope of digital technologies; ensuring cooperation between all parties of social and labor relations on issues related to the use of non-standard forms of employment in the context of the introduction of digital technologies; reduction of “digital illiteracy” among jobseekers; positioning of electronic self-employment as a promising form of employment regulation. Based on the results of the study, the authors determined the vector for solving these problems, considering the large-scale use of digital technologies.

Objective of the study. To analyze the modern literature on the legal regulation of the determination of the sex of newborns with disturbances of sexual development in Russia and abroad, as well as the right of these children for self-determination of their sex upon coming of age. Material and methods. The review is based on the domestic and foreign literature published overthe past 7 years, including in Pubmed. Results. There were revealed the modern problems of the legal regulation of determining the sex of newborns with developmental disorders in the territory of the Russian Federation. Conclusion. The right to the sex self-determination of  the children born with impaired sexual development upon coming of  age requires careful analysis by medical experts, as from a legal point of view it contributes to a more complete implementation of the constitutional principle of equality regardless of gender and ensures human rights in accordance with their perception and attitude.

The article is devoted to the analysis of administrative and legal regulation of practical training of applicants for higher education in higher education institutions with specific training conditions that train police officers. Today, practical training is an integral part of the educational process, which allows to ensure the acquisition of competencies and program learning outcomes provided by educational and professional programs. Based on the analysis of the Regulations on practical training of students and cadets of higher educational institutions of the Ministry of Internal Affairs of Ukraine, the authors have identified problematic issues of organization and conduct of various types of practical training. It is concluded that the existing mechanism of practical training of this category of persons and its normative expression needs to be improved, as it does not meet the needs of today, contains provisions that contradict other regulations, outdated terminology, does not take into account the organization of the educational process at the present stage of development. departmental education, etc. In addition, the draft Regulation on the practical training of applicants for higher education in higher education institutions with specific training conditions for the training of specialists for the Ministry of Internal Affairs of Ukraine and the National Police of Ukraine is being studied and is currently being discussed. The authors conclude that its provisions are unconditionally progressive, but make specific proposals to improve the proposed organizational and legal framework. In particular, it is proposed to specify the purpose of practical training, the mechanism of its organization for applicants for higher education by correspondence, persons studying under the program “2 years cadet - 1 year student», the order and grounds for involvement in public safety and order, clear determined their status, given the lack of specification of the rights and responsibilities of this category of persons in such activities.

The article is based on the results of research work of the Financial University under the Government of the Russian Federation “Improving the regulation of labor and the organization of new approaches to the organization of labour processes and the remuneration of certain categories of employees in higher education”, fi nanced by budget funds for State job in 2014. The article analyzes the legal regulation of improving remuneration of support staff , including from the standpoint of personnel management system, assessment of the role and importance of this category of workers working in the educational process; discusses possible approaches to remuneration of support staff to meet the requirements of the legislation of the Russian Federation, including the policy objectives for improving the system of remuneration in the budgetary organizations, as set out in the Order of the Government of the Russian Federation of 26.11.2012, № 2190«On Approval of the gradual improvement of the system wages in the state (municipal) institutions for 2012–2018». The article also provides an analysis of the main problems in the existing institutions of higher education in pay systems, off ers a practical solution for the formation conditions of remuneration of support staff and the positioning of functional processes, which employ this category of personnel in connection with the performance of tasks to ensure the increase the quality of the educational process in the organization of higher education.

The article is devoted to the regulation of communication privacy, which is not only a guarantee of the individual right to confidentiality and privacy, but also a necessary condition for the collective freedom of speech, trust in communication services, which is essential for formation of the information society. The right to communication privacy with the advent of new communication technologies is being transformed and expanded, which requires updating and harmonization of the legal framework. In this regard, the purpose of the research is to reveal problems and contradictions in updating legal regulation of communication privacy, including by analyzing legislation and existent scientific approaches to the content of communication privacy, description of mechanisms for both ensuring and limiting communication privacy, as well as interaction of legal entities regarding communication privacy. The relationship between Russian and European legislation, which regulate communication privacy (ePrivacy) have been considered in this paper. The research methodology is represented by such methods as dialectical, analysis, analogies, formal-legal, comparative methods of research activity. The work demonstrates different approaches to determining the content of the right to communication privacy, expanding the range of professional subjects of communication privacy, and loosening the mechanisms for limiting this right in the direction of its expansion in the context of interrelations between subjects of legal relations concerning communication privacy.
