Management Rights Title is the right to control over the land from the state authority delegated to the holder partial implementation. Land with Management Rights Title may be granted to another party one through Building Rights Title. The whole provisions governing Building Rights Title generally applies to Building Rights Title on the land Management Right Title. No Regulation Legislation that specifically regulates the building standing on the Management Rights raises the issue of how if Building Rights Title will serve as collateral and then how protection for creditors at the time of going to execute if the party becomes the debtor defaults.

This study aims to identify the key points of the FELDA land inheritance issues and their possible solutions. Land (Group Settlement Areas) Act 1960 was analyzed as it is the main act that regulates FELDA land management. This study discovered that Section 14 limits the land holding to not more than two holders while Section 15 prohibits subdividing or partitioning over FELDA land holding. An administrator is appointed to manage the land on behalf of other heirs and this practice poses risk as the administrator may fail to execute the trust. Hence, inter vivos gift is proposed to address this problem. It was also found that status of FELDA land holding is considered as ‘Conditional Holding’ since it limits the number of registered holders and authorisation to inherit the FELDA land to the second FELDA settlers generation This study concluded that inter vivos gift is legal and this is evidenced from the Section 215, National Land Code 1965 which demonstrates that FELDA land holding can be transferred to the second generation via ‘Form 14A’ at the land offices with the consent from the State Authority and FELDA management as specified in the Land (Group Settlement Areas) Act 1960.

As a legal concept jurisdiction may be considered the right to exercise state authority. Story says that it may be “laid down as a general proposition that all persons and property within the territorial jurisdiction of a sovereign are amenable to the jurisdiction of himself or his courts; and that the exceptions to this rule are such only as by common usage and public policy have been allowed, in order to preserve the peace and harmony of nations, and to regulate their intercourse in a manner best suited to their dignity and rights.” (Santissima Trinidad 7 Wheat. 354) It is fully recognized that all land and the marginal sea, to a distance of a marine league at least, is subject to territorial jurisdiction and that the open sea is not within the jurisdiction of any state though vessels sailing upon such seas are within the jurisdiction of the state whose flag they rightfully fly. As Story says exceptions to this rule of exclusive jurisdiction are such “as by common usage and public policy have been allowed, in order to preserve the peace and harmony of nations, and to regulate their intercourse, in a manner best suited to their dignity and rights.”

This article focuses on the State's accountability as an owner representative in the process of land management in Vietnam. Based on the requirements of building a socialist rule of law state and the people’s land ownership, the article points out the gaps in law and barriers in the process of exercising accountability in the field of land management. On that basis, the article proposes solutions to improve the law to ensure the accountability of the State, through the relevant agencies, that are assigned the right to represent the land owner in Vietnam

AbstractLand is part of the surface of the earth that plays an important role in the life of the people whose control is in the state, one of the forms of state control over land is the management rights. Batam Island is a sucessful example of management rights on land. However, with the presence of the local governemnt, many new issues about the management of law are feared to emerge. The Management Rights on Batam’s land is obtained directly by the President who delegated to the Board of Mastery, so that the status of Batam land is divided into three namely: (1) the land above the management right by  Enterprise (in Indonesian we called it Badan Pengusahaan); (2) land above the management of Batam City Local Government; (3) land managed by the state. Dualism of authority to manage Batam’s Land caused problems as follows: Establishment of Kampung Tua, Status quo on land in Rempang Galang area, mismatch of land condition in Batam City with letter of decision by Ministry of Forestry, and the complexity of permit process, which hampered the development of Batam City. So by understanding how the implementation of Management Rights on Land will be enlightment to find a solution to the problem of dualism of land management authority and formulate the right policy in the framework of determining Batam as a Special Economic Zone.Keywords : Batam, Management Rights, Agrarian, Special Economic Zone,  Abstrak            Tanah merupakan bagian permukaan bumi yang memegang peranan penting dalam kehidupan masyarakat yang penguasaannya diatur oleh negara, salah satu wujud penguasaan negara atas tanah adalah Hak Pengelolaan. Pulau Batam adalah salah satu contoh HPL “sukses”. Namun, dengan hadirnya pemerintah kotamadya Batam, dikhawtirkan banyak persoalan baru di bidang pertanahan yang muncul. Hak Pengelolaan Batam diperoleh langsung oleh Presiden yang dilimpahkan kepada Badan Penguasaan, sehingga status tanah Batam terbagi atas tiga yaitu : (1) tanah diatas Hak Pengelolaan Badan Pengusahaan; (2) tanah diatas pengelolaan Pemerintah Daerah Kota Batam; (3) tanah pengelolaan negara. Dualisme kewenangan pengelolaan lahan terjadi di Kota Batam dan menimbulkan permasalahan sebagai berikut : penetapan Kampung Tua, Status quo pada tanah dikawasan Rempang Galang, ketidakcocokan kondisi pertanahan di Kota batam dengan SK KEMENHUT, serta kerumitan proses perizinan, yangmana menghambat perkembangan Kota Batam. Maka dengan memahami bagaimana penyelenggaran Hak Pengelolaan dapat menemukan penyelesaian permasalahan dualisme kewenangan pengelolaan lahan dan merumuskan kebijakan yang tepat dalam rangka penetapan Batam sebagai Kawasan Ekonomi Khusus.Kata Kunci : Batam, Hak Pengelolaan, Tanah, Agraria, Kawasan Ekonomi Khusus.

The basic principle mentioned about the right over land by state is very basic according Article 33 Paragraph (3) of the 1945 Constitution which states "" earth and air and natural resources contained within it controlled by the state and used for the stock of people's prosperity." This research is intended to seek and understand whether the meaning of rights by the state can be interpreted also as the right of the state (eigenaar) to the land in Indonesia. This research uses research methods with the approach of legislation and conceptual road. Based materials from books law and research journals are the main legal ingredients. The results show that state copyright is interpreted as a state authority, judicial, air and space rules and regulations.

In the discipline of Islamic law research, strong proofing and clear Istinbat method are key pillars in the construction of Islamic law based on the application of the science of usul al-fiqh and maqasid al-shari'ah. However, what happens at the state of Johor’s fatwa institution is the opposite. The fatwa research methods applied by the Fatwa Committee of Johor in resolving current fatwa issues is not based on the right and true discipline of Islamic law research. In fact, current inputs related to fatwa issues are not explicitly stated in the method of determining the law either in the form of reality or scientifically verified. Therefore, this paper will discuss the fatwa procedures undertaken by the Fatwa Committee of Johor based on the methods applied in resolving current issues. The research methodology adopted is library and interview methods. This study shows that fatwa management and production in the state of Johor is placed under the jurisdiction of the Mufti of Johor’s Department. The methods adopted by the Fatwa Committee of Johor covers two methods, namely: internal research methods including literature review through the application of original source and proofs based on syarak. Second: field research method that includes an external review or going to the location of study such as conducting observation, questionnaires and interviews including referrals to specialists of different fields. Maslahah and mafsdah consideration are also implemented by the Fatwa Committee in every fatwa decision based on the standard that meets the interests of maqasid al-shari'ah. Namun begitu, apa yang berlaku di institusi fatwa negeri Johor adalah sebaliknya. Kaedah penyelidikan fatwa yang diaplikasi oleh Jawatankuasa Fatwa Negeri Johor dalam menyelesaikan isu fatwa semasa tidak berasaskan kepada disiplin penyelidikan hukum Islam yang tepat dan sebenar. Malahan input-input semasa yang berkaitan dengan isu fatwa juga tidak dinyatakan secara jelas dalam kaedah penentuan hukum sama ada dalam bentuk realiti yang berlaku atau pembuktian secara saintifik. Justeru, kertas kerja ini akan membincangkan prosedur fatwa Jawatankuasa Fatwa Negeri Johor berdasarkan metode-metode yang diaplikasi dalam menyelesaikan isu-isu yang bersifat semasa. Metodologi kajian yang digunakan dalam kajian ini adalah melalui metode perpustakaan dan metode lapangan. Hasil kajian menunjukkan bahawa pengurusan dan pengeluaran fatwa di negeri Johor hanya terletak di bawah bidang kuasa Jabatan Mufti Johor. Metode fatwa yang diamalkan oleh Jawatankuasa Fatwa Negeri Johor merangkumi dua metode iaitu pertama, kaedah penyelidikan dalaman yang merangkumi kajian kepustakaan menerusi pengaplikasian dari sumber asas dan dalil-dalil syarak. Kedua, kaedah penyelidikan lapangan yang meliputi kajian luaran atau turun ke lokasi kajian seperti observasi, soal selidik dan temubual dan rujukan kepada pakar dalam bidang yang berlainan. Pertimbangan maslahah dan mafsdah juga dimplementasikan oleh Jawatankuasa Fatwa dalam setiap keputusan fatwanya berasaskan standard yang menepati kepentingan maqasid al-shari’ah. How should a liberal democracy respond to hate groups and others that oppose the ideal of free and equal citizenship? The democratic state faces the hard choice of either protecting the rights of hate groups and allowing their views to spread, or banning their views and violating citizens' rights to freedoms of expression, association, and religion. Avoiding the familiar yet problematic responses to these issues, this book proposes a new approach called value democracy. The theory of value democracy argues that the state should protect the right to express illiberal beliefs, but the state should also engage in democratic persuasion when it speaks through its various expressive capacities: publicly criticizing, and giving reasons to reject, hate-based or other discriminatory viewpoints. Distinguishing between two kinds of state action—expressive and coercive—the book contends that public criticism of viewpoints advocating discrimination based on race, gender, or sexual orientation should be pursued through the state's expressive capacities as speaker, educator, and spender. When the state uses its expressive capacities to promote the values of free and equal citizenship, it engages in democratic persuasion. By using democratic persuasion, the state can both respect rights and counter hateful or discriminatory viewpoints. The book extends this analysis from freedom of expression to the freedoms of religion and association, and shows that value democracy can uphold the protection of these freedoms while promoting equality for all citizens.

The right to adequate housing is a constitutional imperative which is contained in section 26 of the Constitution. The state is tasked with the progressive realisation of this right. The allocation of housing has been plagued with challenges which impact negatively on the allocation process. This note analyses Ekurhuleni Metropolitan Municipality v Various Occupiers, Eden Park Extension 51 which dealt with a situation where one of the main reasons provided by the Supreme Court of Appeal for refusing the eviction order was because the appellants subjected the unlawful occupiers to defective waiting lists and failed to engage with the community regarding the compilation of the lists and the criteria used to identify beneficiaries. This case brings to the fore the importance of a coherent (reasonable) waiting list in eviction proceedings. This note further analyses the impact of the waiting list system in eviction proceedings and makes recommendations regarding what would constitute a coherent (reasonable) waiting list for the purpose of section 26(2) of the Constitution.

Despite the recent enactment of the Zimbabwean Constitution which provides for the right to basic education, complaints, reminiscent of a failed basic education system, have marred the education system in Zimbabwe. Notwithstanding glaring violations of the right to basic education by the government, no person has taken the government to court for failure to comply with its section 75(1)(a) constitutional obligations, and neither has the government conceded any failures or wrongdoings. Two ultimate questions arise: Does the state know what compliance with section 75(1)(a) entails? And do the citizens know the scope and content of their rights as provided for by section 75(1)(a) of the Constitution of Zimbabwe? Whilst it is progressive that the Education Act of Zimbabwe as amended in 2020 has addressed some aspects relating to section 75(1)(a) of the Constitution, it has still not provided an international law compliant scope and content of the right to basic education neither have any clarifications been provided by the courts. Using an international law approach, this article suggests what the scope and content of section 75(1)(a) might be.

In order to fulfill this mandate, he has set nine priority programs known as the concept of Nawa Cipta. This program calls for concrete steps so as not merely a wish list. The most fundamental thing in economics field is how the constitutional mandate that the right to dominate the state can be realized in the management of economic activities, including in dealing with foreign economic domination in IndonesiaKeywords: implementation, the right to dominate the state, foreign economic domination.  AbstrakPresiden Jokowi telah mendapatkan mandat dari rakyat untuk mewujudkan Indonesia yang lebih adil dan sejahtera. Dalam rangka memenuhi mandat tersebut, telah ditetapkan sembilan program prioritas       yang dikenal dengan konsep Nawa Cipta. Program ini tentunya memerlukan langkah-langkah kongkret sehingga tidak sekedar menjadi daftar keinginan. Hal yang paling mendasar dalam bidang ekonomi adalah bagaimana amanat konstitusi yakni hak menguasai negara dapat diwujudkan dalam pengelolaan kegiatan perekonomian, termasuk dalam mengatasi dominasi perekonomian asing di Indonesia.  Kata kunci: implementasi, hak menguasai negara, dominasi perekonomian asing
