<p>Immunization is a mandatory program by government for every child in Indonesia. In 2016, however, the vaccine used for children’s immunization was found under standardized or unqualified. It was mixed with particular substances which might lead the users into some allergies, minor or severe injuries, trauma, and even danger their lives. Parents certainly fully entrusted their children’s immunization to the competent. The crime of producing, distributing, and using non-standard vaccines involved many parties both individuals and corporations, ranging from the task of producing, distributing, and up to injecting the vaccines into children. With the enormous profits of the crime, however, only private parties were sued while the corporations were still free from any accusation and thus, it made them have potential chances to redo such crime, violating medical laws, consumer protection laws, Money laundering legislation, and up to brand and geographical indications.</p><p>This study was a legal research with statute and conceptual approaches. It aimed to investigate the provisions of producing and distributing non-standard vaccines by corporations and to analyze their liability on such crime. The results, conclusions, suggestions, and recommendations for the problem were discussed.</p>

<p>Abstract<br />This legal research examines the weakness of Act No. 20 of 2016 on Marks and Geographical Indications, as until now there is still a knockoff brands that passed trademark registration in Indonesia. This research uses  doctrinal  or  normative  prescriptive  research  methods.  Results  of  this  study  is  the  absence  of the requirements and there are multiple interpretations of the philosophy of the brand famous brand understanding and similarity in principle or in its entirety.</p><p>Keyword: Trademark registration, weakness of Act<br /> <br />Abstrak<br />Penulisan hukum ini mengkaji mengenai kelemahan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis sebagaimana sampai sekarang ini masih terdapat merek-merek tiruan yang lolos pendaftaran merek di Indonesia. Penulisan ini menggunakan metode penelitian doktrinal atau normatif yang bersifat preskriptif. <p>Abstract</p><p>This article aims to study the bank’s responsibility towards fraud against customer with a case study of Bank Mega Fraud against PT. Elnusadeposito funds. This research is a normative legal research using constitutional and case study approach. The result of this research show that Bank Mega liquefyPT. Elnusadeposito funds carelessly without PT.Elnusa consent is an act against the law. Bank Mega hasfailed to fulfil it’s responsibility towardsthe customer as regulated Article 37 B paragraph (1) UndangUndang Nomor 10 Tahun 1998 concerning banking service that stipulate every bank must guarantee the public funds deposited in the bank concerned The action of Bank Mega has caused losses both material and immaterial loss so that Bank Mega has to give responsibility and compensation for damage and consumer loss according to Article 19 paragraph (2) Undang-Undang Nomor 8 Tahun 1999 regarding consumer protection.</p><p>Keywords: Responsibility; prudential principles; banks; and customers.</p><p>Abstrak</p><p>Artikelini bertujuan mengkaji tanggung jawab perbankan terhadap pembobolan dana nasabah dengan</p><p>studi kasus terhadap Bank Mega dalam kasus pembobolan dana deposito PT.Elnusa, Penelitian ini merupakan penelitian hukum normatif dengan melakukan pendekatan undang-undang dan pendekatan kasus.Berdasarkan hasil dari penelitian dapat disimpulkan bahwa tindakan Bank Mega mencairkan dana deposito milik PT.Elnusa secara tidak hati-hati dan tanpa sepengetahuan PT. Elnusa merupakan tindakan yang melanggar hukum. Bank Mega telah tidak memenuhi kewajibannya terhadap nasabah sebagaimana diatur dalam Pasal 37 B ayat (1) Undang-Undang Nomor 10 Tahun 1998 tentang Perbankan yang menyebutkan bahwa setiap bank wajib menjamin dana masyarakat yang disimpan pada bank yang bersangkutan. Tindakan Bank Mega telah menimbulkan kerugian baik materiil maupun immateriil sehingga Bank Mega selaku pelaku usaha berdasarkan Pasal 19 ayat (2) Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen bertanggung jawab untuk memberikan ganti rugi atas kerusakan, pencemaran, dan/atau kerugian konsumen akibat mengkonsumsi barang dan/atau jasa yang dihasilkan.</p><p>Kata Kunci: Tanggung jawab; prinsip kehati-hatian; bank; dan nasabah.</p>

The realization of the principle of justice in proving the settlement of consumer disputes through arbitration in Indonesia is equally important. Undeniable, there is a weakness of the consumer protection law, both substantial norms and formal law. This article is normative legal research that refers to norms and legal principles in the legislation or court decisions. The results show that the proof is one of the trials that plays an important role. In general, the verification system is distinguished based on civil law and common law understandings influenced by various proof system theories such as the presumption of liability principle adopted in the Indonesian consumer protection law. The principle of justice in the consumer arbitration system is different from the arbitration verification system that is universally applicable in Indonesia. The ultimate goal of choosing consumer arbitration is to get substantial justice that is more dignified and not just obtaining formal justice.

There is a tug of authority in resolving insurance disputes outside the court between the Consumer Dispute Settlement Agency (BPSK) based on Law Nomor 8 of 1999 concerning Consumer Protection with Alternative Dispute Resolution Institutions (LAPS) based on Financial Services Authority Regulation Number 1/POJK.07/2014. This encourages the author to conduct legal research in order to determine the authority of BPSK in resolving insurance disputes as well as the legal consequences of the decision after the issuance of the Financial Services Authority Regulation Number 1/POJK.07/2014 using the statutory approach. This legal research results in the finding that BPSK is still authorized to settle insurance disputes following the issuance of the Financial Services Authority Regulation Number 1/POJK.07/2014, this is based on the provisions of the Lex superior derogat legi inferiori principle. Then there is no legal effect on the BPSK decision after the issuance of the Financial Services Authority Regulation. This is because BPSK's decision has been based on Law Number 8 of 1999 concerning Consumer Protection, whose position is higher than the Regulation of the Financial Services Authority. So there is no need for BPSK to follow the provisions of the regulations whose hierarchy of legislation is lower than the Consumer Protection Act. Therefore BPSK's decision is "final and binding" as explained in Article 54 paragraph 3 of the Consumer Protection Act.

Abstrak   Efektivitas penegakan hukum terhadap produsen makanan berbahaya menuju Indonesia Sehat 2025 tersebut didasarkan apabila pelaku usaha memproduksi dan memperdagangkan produk makanan yang mengandung bahan kimia serta membahayakan kesehatan dan keselamatan konsumen, maka pelaku usaha/produsen melanggar Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan, Undang-Undang Nomor 18 Tahun 2012 tentang Pangan, Undang-Undang Nomor 8 Tahun 1999 tentang perlindungan Konsumen.  Penelitian ini merupakan penelitian hukum normative yang bertujuan untuk mengetahui Faktor yang mempengaruhi terhadap efektivitas penegakan hukum terhadap produsen makanan berbahaya menuju Indonesia Sehat 2025. Faktor hukumnya, yaitu lemahnya sanksi terhadap pelanggarnya, proses penanganan masalah berbelit-belit, kurang profesionalnya para aparatur penegak hukum dan kurangnya koordinasi antar penegak hukum. Tanggung jawab pidana produsen terhadap kerugian yang diderita konsumen akibat makanan berbahaya yang diproduksi, dipasarkan, ditawarkan dan diperdagangkannya, secara yuridis, dalam konsepsi Undang-Undang Perlindungan Konsumen dan peraturan perundang-undangan terkait lainnya.   THE EFFECTIVENESS OF LAW ENFORCEMENT ON FOOD MANUFACTURERS IN INDONESIA   Abstract   The effectiveness of law enforcement against dangerous food producers towards Healthy Indonesia 2025 is based on if business actors produce and trade food products that contain chemicals and endanger the health and safety of consumers, then the business actor/producer violates Law Number 36 of 2009 concerning Health, Law No. Law Number 18 of 2012 concerning Food, Law Number 8 of 1999 concerning Consumer Protection. This research is a normative legal research that aims to determine the factors that influence the effectiveness of law enforcement against producers of dangerous food towards Healthy Indonesia 2025. The legal factors are the weakness of sanctions against violators, the process of handling problems is complicated, the lack of professionalism of law enforcement officials and the lack of coordination between law enforcement. The producer's criminal responsibility for the loss suffered by the consumer due to the dangerous food produced, marketed, offered and traded, legally, in the conception of the Consumer Protection Act and other relevant laws and regulations.   Keywords: Effectiveness, Law Enforcement, Food Producers

Adanya ketidakseimbangan dalam penggunaan perjanjian baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan di Kota Banda Aceh memberi perlindungan hak kepada penjual daripada pembeli, sehingga lebih banyak risiko kerugian yang harus dipikul oleh pembeli. Pokok permasalahan dalam artikel ini adalah apakah klausula baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan melanggar ketentuan peraturan perundang-undangan tentang perlindungan konsumen. Jenis metode penelitian yang digunakan dalam artikel ini adalah jenis metode penelitian hukum normatif. Pendekatan penelitian hukum yang digunakan dalam artikel ini terdiri dari, pendekatan peraturan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa perjanjian baku pada perusahaan pembiayaan PT ADMF bertentangan dengan ketentuan KUH Perdata, khususnya dalam Pasal 1266, Pasal 1267, Pasal 1337, Pasal 1338 ayat (1), ayat (2), dan ayat (3), Pasal 1339 KUH Perdata, dan juga bertentangan dengan ketentuan UUPK, khususnya dalam Pasal 4, Pasal 7, Pasal 18 ayat (1), dan ayat (2) UUPK. Oleh karena itu, penggunaan perjanjian baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan harus ditinjau dan disesuaikan agar tidak bertentangan dengan ketentuan undang-undang.  Standard Agreement in The Hir-Purchase Agreement for the Motor Vehicles in a Finance Company in Banda Aceh  The existence of an imbalance in the use of standard agreement in the hire-purchase agreement for motor vehicles in a finance company in Banda Aceh gives protection to the seller rather than the buyer, thus more risk of loss to be borne by the buyer. The main issue in this article is whether the standard clause in the hire purchase agreement of motor vehicles in the finance company violates the provisions of legislation on consumer protection. The research method used in this article was the normative legal research method. The legal research approaches used in this article consist of, statutory approach, case approach and conceptual approach. The results showed that the standard agreements used by PT ADMF was contradictory to the provisions of the Civil Code, particularly in Article 1266, Article 1267, Article 1337, Article 1338 Paragraph (1), Paragraph (2), and Paragraph (3), Article 1339 Civil Code, and also contrary to the provisions of UUPK, particularly in Article 4, Article 7, and Article 18 paragraph (1) and paragraph (2) UUPK. Therefore, the standard agreements in the hire-purchase agreement of motor vehicles in the finance company should be reviewed and adjusted so as not violates the provisions of legislation.

Legal protection for a mark of a place or origin of MSMEs can be done by first registering the mark to obtain legal force. In this case the Office/Agency/Community Organization assists by facilitating MSMEs in terms of socialization and assistance for trademark registration. Law Number 20 of 2016 concerning Marks and Geographical Indications provides improvements to previous laws, especially regarding preventive protection measures, namely registration procedures and registration fees. Brands produced by Indonesian MSMEs can help increase competitiveness in the development of new products. This research is normative or library research method, namely legal research carried out by reviewing and researching library materials in the form of primary legal materials and secondary legal materials. This study concludes: First, the problems in the protection of intellectual property rights in the field of branding for MSME products are due to the understanding of MSME actors on brand rights is still low/shallow so that MSME actors do not register the brand of MSME products. Second, efforts to provide brand protection to the MSME industry are by registering MSME brands and the government makes it easy for MSME industry players to register trademarks.

From the statement, there are 2 problems, namely How to set the law of telecommunicationservice users in the field of advertising and How to protectthe lawfor consumers with the existence ofpersonaldata breaches through SMS Broadcast.The method to be used is a method of normative legal research. The conclusion outlines that Article I of the Consumer Protection Law Serves as the legal basis for the protection of telecommunication service users, while in Article 26 of the /TE Law is used as the legal basis for the use of personal data, which in this case is SMS Broadcast

Public interest in shoes is a special need, shoes are in great demand by millennials because they are useful for protecting feet. The habit of collecting these shoes arises from the desire of humans to keep their goods so they don't get damaged quickly and stay clean for a Long time. However, there are still cases of damage to shoes that cause Losses to consumers and there is no responsibility from the shoe washing service. The research method used is the type of empirical Law, empirical legal research aims to find facts, and conduct interviews. There are internal and external factors that cause damage to consumer shoes by business actors. So that responsibility for losses cannot be carried out unilaterally between business actors and consumers because there are Legal remedies that can be taken if they are harmed. Lack of knowledge and understanding fromconsumers, makes the position of consumers lower than business actors. So with the existence of Law Number 8 of 1999 concerning Consumer Protection, both parties need to know so that their rights and obligations are not violated.

This study aims to analyze the burden of proof reversal system in handling cases of money laundering. This type of research is normative juridical legal research. The results of this study indicate that in the reversal system of the burden of proof of criminal acts of money laundering, each party has a burden of proof, the public prosecutor is burdened to prove that these assets are the property of the defendant and has a relationship with the original criminal act charged, while the defendant burdened to prove the origin of the assets claimed and if the defendant is unable to prove the origin of the assets, the assets can be strongly suspected to originate from criminal offenses. There are still obstacles in law enforcement both from the substance of the law (norms), legal structure (law enforcement agencies) and the culture of law (the culture of community law).
