Mating agreement has been stipulated in Article 29 of Act No. 1 Of 1974. Married to the present agreement remains in the society. The problems examined in this study is: what are the factors occurrence marriage agreement, how the validity of the agreement to marry, and the legal consequences mating agreement executed after the course of the marriage. The method used is a normative legal research. The result of the first conclusion that the arrangement agreement are married in Indonesia in the Act include the Civil Code, the Marriage Act No. 1 of 1974, KHI and the Constitutional Court Decision No. 69 / PUU-XIII / 2016, and at the conclusion of research results mating agreement made after the course of a legal marriage do not violate the boundaries of the law, religion, and morality.Keywords: Agreement; Mating Agreement; Marriage Law.

The purpose of this study is to find out the position of the Constitutional Court which later? an understanding of the politic of International agreement law adopted by the Republic of Indonesia. This can be reviewed from the legal considerations that underlying the Constitutional Court Decision. It is a legal research that examines the laws and regulation related to Constitutional Court through several stages: elaborate textual studies, completing textual studies, analyzing legal materials and determine conclusions. The study shows that International and legalized agreement that has not been ratified are placed as part of national law and are used as a reference to enrich the reasoning horizon in interpreting the constitution. Law on the ratification of the International Agreement containing norms which are attachments and an inseparable part of the law, which in its existence as a law constitutes the authority of the Constitutional Court to examine its constitutionality. In this context, the constitutional Court embraced the politic law of monism with the primate of national law and the Constitutional Court embraced the politic law of dualism when examining the constitutionality of the law concerning the ratification of the International Agreement-in terms of subject matter. Tujuan dari kajian ini adalah untuk mengetahui sikap Mahkamah Konstitusi yang nantinya akan memberikan pemahaman tentang politik hukum Perjanjian Internasional yang dianut Negara Republik Indonesia. Hal ini dapat ditinjau dari pertimbangan hukum yang mendasari amar Putusan Mahkamah Konstitusi. Artikel ini merupakan suatu penelitian hukum yang mengkaji Peraturan Perundang-undangan dan Putusan Mahkamah Konstitusi yang ada dengan langkah-langkah melakukan studi tekstual, melengkapi studi tekstual serta melakukan analisis terhadap bahan hukum yang terkumpul dan menarik kesimpulan. Hasil penelitian menunjukan bahwa Perjanjian Internasional yang telah disahkan maupun yang belum disahkan ditempatkan sebagai bagian dari hukum nasional dan dijadikan rujukan guna memperkaya cakrawala penalaran dalam menafsirkan Undang-Undang dasar. Undang-Undang tentang pengesahan Perjanjian internasional memuat norma yang merupakan lampiran dan bagian yang tidak terpisahkan dari Undang-Undang bersangkutan, yang dalam keberadaannya sebagai Undang-Undang merupakan kewenangan Mahkamah Konstitusi untuk menguji konstitusionalitasnya. Dalam konteks ini Mahkamah Konstitusi  menganut  politik hukum monisme dengan primat hukum nasional dan Mahkamah Konstitusi menganut politik  hukum dualisme saat menguji konstitusionalitas Undang-Undang tentang pengesahan Perjanjian Internasional dalam hal menyangkut pokok perkaranya.

The Constitutional Court as the guardian of the constitution and the guardian of human rights has the duty to ensure that the Law does not contradict the constitution and does not violate human rights. One of the manifestations of this can be seen in the Constitutional Court Decision Number 1 / PUU-X / 2013, where the Constitutional Court removed the element "Some other deeds or unpleasant treatment/act" in Article 335 paragraph (1) of the Criminal Code. With the removal of the core elements of Article 335 paragraph (1) of the Criminal Code, raises questions related to the existence of the offense whether it still exists or not. Based on this, this study will examine 1) Application of Article 335 of the Criminal Code Before the Decision of the Constitutional Court Number 1 / PUU-X / 2013 and 2.) Application of Article 335 of the Criminal Code After the Decision of the Constitutional Court Number 1 / PUU-X / 2013. This research is a normative legal research with a statute approach, conceptual approach, and case approach. Based on this research, it was found that after the Constitutional Court Decision Number 1 / PUU-X / 2013 that offenses of unpleasant acts had been reconstructed into forced offenses.

In accordance with the Marriage Law Article 43 paragraph (1) and Article 100 Compilation of Islamic Law, that child out of wedlock obtain a civil relationship with her mother and her mother’s family. The provisions of article 43 paragraph (1) that the Court’s decision the Constitution of No. 046/PUU-VIII/2010 amended with the new norm, that “children born out of wedlock have links civil with her mother and her mother’s family as well as with men as a father to proven by science and technology and/ or other evidence under the law have blood relations, including civil relations with his father’s family’’ provisions of the new norm is still debatable and the pros and cons in the community that have not been finalized. Therefore, it is necessary to do research on: How Construction illegitimate child protection today; factors that affect the construction of the legal protection of a child out of wedlock is not justice at this time. This study used a qualitative approach with sosiolegal research. Factors that affect the protection of children out of wedlock is not justice due to several factors: -First; Factors Differing perceptions Ulama’ and Judges of children out of wedlock and protection against him; Factors Court decision is very diverse/ varied against illegitimate child protection issues; Factors diversity of perceptions on Registration of Population Administration in Indonesia. Then the provisions of the Marriage Law Article 43 paragraph (1)which has judicial review by the Constitutional Court Decision No. 046/PUU-VIII/2010 and Article 100 of the Compilation of Islamic Law must be reconstructed with the editor of a new article as follows: “a child born out of wedlock has relations civil with her mother and her mother’s family as well as with men as a father who can be proved by science and technology and/ or other evidence under the law have blood relation to the determination/ instruction judge and the Court’s decision, the Muslim Religious Court andbesides Islam in the District Court, including a civil relationship with his family “and there should be an affirmation form of additional chapters in the Marriage Law Article 43 with the editorial article as follows; “If it turns out according to a court ruling that the children who sought their origin was proven seedlings men and women and was born in/ from the marriage valid, then the child becomes legitimate child and have a relationship of civil full and relationships biological children with both parents and get inheritance rights.

This study aims to determine how the arrangements for the unilateral termination of the contract/agreement and what are the legal consequences arising from the unilateral termination of the contract. The research method used is normative juridical. The approach used in this research is the statute approach and the case approach, and the conceptual approach. The conclusion of the research results is that; contract termination arrangements and legal consequences are regulated in Articles 1266, 1267, 1243 and 1365 of the Civil Code. The conditions for an agreement to be canceled unilaterally are that the agreement must be reciprocal, there is default, and the cancellation must be requested from the judge. Unilateral termination of the agreement due to default without going through the court is an act against the law. The legal consequence of the unilateral termination of the agreement due to default is a claim for compensation from the party who feels aggrieved. The Civil Code does not explicitly regulate the differentiation of compensation as a result of default with compensation as a result of an act against the law. Based on the research results, it is found that compensation as a result of default is compensation in the form of material, while compensation for an illegal act is compensation in the form of material and immaterial. It is hoped that in the future there will be clear regulations regarding compensation as a result of default and compensation as a result of acts against the law.

According to the Marriage Law Article 29 the marriage agreement is made before or at the time of marriage. But in October 2016 the Constitutional Court passed verdict No.69 / PUU-XIII / 2015 as a material test of Article 29 of the Marriage Law which with the ruling of the constitutional court the marriage agreement can be made before, at the time of marriage, even throughout the marriage. However, before the constitutional court issued the verdict, the Tangerang District Court issued a ruling stipulating the marriage agreement throughout the marriage, namely the decision No. 269 / PEN.PDT.P / 2015 / PN.TNG which the parties were mixed marriages couple. The problem discussed is what the judge considers in deciding the marriage agreement when there is no provision that the marriage agreement can be made throughout the marriage. The legal research method used is a normative research method. Based on the research’s result, the judge granted and stipulated the marriage agreement based on the Marriage Law Article 4 which states that the marriage agreement is possible to be changed as long as there is agreement between the two parties and does not harm the third party In conclusion, the judge did not decide in accordance with the law regulating at the time. The suggestion is that it is expected that the judge as a law enforcer can make a decision in accordance with the law regulating at that time. Because ideally the judge's decision must contain justice, legal certainty, and expediency.

Penelitian betujuan mengetahui penegakan hukum persaingan usaha yang dilakukan oleh KPPU di Indonesia. Metode penelitian menggunakan metode penelitian hukum normatif. Hasil Penelitian ini menunjukkan bahwa : (1) Kewenangan Penyelidikan yang dimiliki oleh KPPU adalah atribusi melalui Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat dan telah dikuatkan melalui Putusan Mahkamah Konstitusi Nomor 85/PUU-XIV/2016, yang dalam pelaksanaanya, Komisi memberikan mandat Penyelidikan kepada Investigator Pemeriksaan untuk mendapatkan alat bukti yang cukup, tetapi hambatannya KPPU tidak mempunyai upaya paksa seperti penggeledahan dan penyitaan untuk mendapatkan dokumen/surat yang dapat menjadi alat bukti; (2) Hukum persaingan usaha dapat berjalan dikarenakan telah memuat norma primer yang bersifat larangan dan norma sekunder tentang tata cara penanganan perkara yang dilakukan melalui empat tahapan, yaitu pertama, klarifikasi terhadap laporan atau penelitian inisiatif, kedua, penyelidikan untuk mendapatkan alat bukti yang cukup, ketiga, pemeriksaan Majelis Komisi untuk membuktikan dugaan pelanggaran, dan keempat, penjatuhan Putusan Komisi. The research aims to find out the enforcement of business competition law conducted by KPPU in Indonesia. The research method uses normative legal research methods. The results of this study indicate that: (1) The Investigative Authority possessed by KPPU is attribution through Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition and has been strengthened through the Constitutional Court Decision Number 85 / PUU-XIV / 2016, which in its implementation, the Commission mandates Investigation to Investigate Investigators to obtain sufficient evidence, but the obstacle is that KPPU does not have compelled efforts such as searches and confiscation to obtain documents / letters that can serve as evidence; (2) The law of business competition can run because it contains primary norms that are prohibited and secondary norms concerning the procedures for handling cases which are carried out in four stages, namely first, clarification of reports or research initiatives, second, investigations to obtain sufficient evidence, third, examination of the Commission Council to prove the alleged violation, and fourth, the imposition of the Commission's Decision.

The approach taken was thestatutory and the analytical conceptual approach.The research results indicate that with the withdrawal of leasing object in alease agreement by the creditor according to law (under the provisions of Article 1338of Indonesian Civil Code) can be justified and lawful. The demand for the minimum payment of the minimum wage has an expiration date, which is 2 years. The expiration date has been revoked with the Decision of the Constitutional Court Number 100/PUU-X/2012. In the Decision of the Industrial Relations Court Number 195/Pdt.Sus-PHI/2016/PN.Bdg juncto Decision of the Supreme Court Number 885K/Pdt.Sus-PHI/2017, the judge refused to grant the claim the minimum wage payment. Based on the verdict, what will be discussed in this paper are how the judges basis for filing a claim lacks payment of workers' minimum wages and how the legal consequences from the judge's consideration in filing a claim lack the minimum wage payment in the Industrial Relations Court Decision Number 195/Pdt.Sus-PHI/2016/PN.Bdg juncto Decision of the Supreme Court Number 885K/Pdt.Sus-PHI/2017. The research method used is normative legal research. Based on the research that has been done, the judge mistakenly interpreted the enactment of the Constitutional Court Decision Number 100/PUU-X/2012 so the judge refused to grant the claim for the lack of minimum wage payments submitted by the plaintiffs. The judge's judgment stated that the Constitutional Court Decision Number 100/PUU-X/2012 did not apply retroactively so that the normative rights expiration provisions last took effect on September 18, 2013. Even though the claim should have been partially granted by the judge because the employer proved to pay workers' wages under the minimum wage provisions applicable, namely for payment of wages in 2013. In addition, the plaintiffs also submitted the claim after the issuance of the Constitutional Court Decision Number 100/PUU-X/2012.

Putusan Mahkamah Konstitusi seringkali menimbulkan perdebatan di masyarakat. Salah satunya terkait penundaan keberlakuan putusan Mahkamah Konstitusi yang telah melahirkan doktrin baru mengenai kekuatan hukum mengikatnya putusan MK. Penelitian ini mengangkat permasalahan, pertama: karakter putusan MK yang memuat tenggang waktu konstitusionalitas dan konsep kebersesuaian undang-undang dengan UUD 1945. Kedua, pengaruh putusan tersebut terhadap pembangunan hukum di Indonesia. Jenis penelitian yang digunakan adalah penelitian yuridis normatif. Hasil penelitian menyimpulkan bahwa, pertama, putusan-putusan yang menjadi objek penelitian ditemukan karakteristik yang beragam terkait dengan tenggang waktu konstitusionalitas dan kebersesuaian antara Undang-Undang dan Undang-Undang Dasar 1945, sebagai berikut; (i) Putusan yang menentukan tenggang waktu secara tegas dan perintah untuk penyesuaian dengan UUD 1945, yaitu putusan Nomor 012-016-019/PUU-IV/2006 (UU KPK) dan Putusan Nomor 32/PUU-XI/2013 (UU Asuransi) dan Putusan Nomor 026/PUU-III/2005 dan 026/PUU-IV/2006 (UU APBN); (ii) Putusan yang menentukan tenggang waktu secara tidak tegas (fleksibel) dan perintah untuk penyesuaian dengan UUD 1945, yaitu Putusan Nomor 97/PUU-XI/2013 (UU Pemda dan UU Kekuasaan Kehakiman) dan Putusan Nomor 14/PUU-XI/2013 (UU Pilpres); (iii) Putusan yang tidak menyebutkan tenggang waktu namun hanya perintah untuk penyesuaian dengan UUD 1945 (secara tidak langsung), yaitu Putusan Nomor 28/PUU-XI/2013 (UU Koperasi) dan Putusan Nomor 85/PUUXI/2013 (UU SDA). Kedua, Putusan MK menjadi salah satu faktor determinan dalam fungsi legislasi, dan hal ini dapat dipahami karena inilah bentuk diskresi yang dimiliki oleh MK selaku pelaku kekuasaan kehakiman.The constitutional court often make their headlines or controversy with their ruling. One of them is relative with the postpone enforcement of a decision which has raised a new doctrine about legal force's binding of the Constitutional Court's decision. This study raised the issue, first, about the character of the constitutional court's ruling which contained the limitation of time in constitutionality and the concept of conformity of the law with the 1945 Constitution of the Republic of Indonesia. Second, the influence of the court decision on legal development in Indonesia. This study used normative legal research. The results of the study concluded that, first, it is founded that the various characteristics related to the limitation of time in constitutionality in the court's decision which become the object of this study and also it is founded that the compability between the law and the 1945 Constitution of the Republic of Indonesia as follows : (i) The court's decision that set the limited of time in constitutionality explicitly and orders to adjust to the 1945 Constitution of The Republic of Indonesia, namely decisions number 012-016-019/PUU-IV/2006 (Corruption Eradication Commission Act) and decision number 32/PUU-XI/2013 (Insurance Related Business Act) and decision number 026/PUU-III/2005 and 026/PUU-IV/2006 (State Budget Act); (ii) Court's decision that determine the limited of constitutionality flexibly and orders to adjust to the 1945 Constitution of the Republic of Indonesia namely decision number 97/PUU-XI/2013 (Regional Government Act and Judicial Power Act) and decision number 14/PUU-XI/2013 (Presidential Election Act); (iii) Court's decision that do not mention the limitation of time in constitutionality but only orders to adjust to the 1945 Constitution of The Republic of Indonesia, namely decision number 28/PUU-XI/2013 (Cooperatives Act) and decision number 85/PUU-XI/2013 (Water Resources Act). Secondly, the constitutional court decision is one of the determinant factors in the function of legislation, and this can be understood because this is the form of discretion that the constitutional court has as the perpetrator of judicial power.

Marriage is one of the process of human life as regulated in Article 28B paragraph (1) of the 1945 Constitution of the Republic of Indonesia and also regulated in Article 10 of the Human Rights Law. Marriages conducted by Believers are regulated and protected in the Adminduk Law and the implementing Government Regulations, but not accommodated in Law Number 1 of 1974 on Marriage which is the lex specialist of the regulations governing Marriage in Indonesia. This research uses normative legal research method whose main object is the legal substance of legal protection for Believers on the basis of recognition of belief according to the mandate of the 1945 NRI Constitution, due to incomplete norms and exclusive interpretation of the meaning of the words “God Almighty” and “and trust that”. This research is expected to provide an understanding to stakeholders regarding the validity of marriages conducted by Believers and provide administrative legal protection to Believer. The Constitutional Court Decision Number 97/PUU-XIV/2016 provides legal solutions and protection for Believers for administrative legal arrangements that have not fully protected the existence of believers in the God Almighty. After the issuance of Constitutional Court’s decision, the marriage of Believers was recognized as a legal marriage and brought good legal consequences for their offspring.Keywords: Legal Protection; Believer; Marriage; Law of Administration.Perkawinan adalah salah satu proses kehidupan manusia yang diatur dalam Pasal 28B ayat (1) UUD NRI Tahun 1945 dan diatur pula dalam Pasal 10 UU HAM. Perkawinan yang dilakukan oleh Penghayat Kepercayaan diatur dan dilindungi dalam UU Adminduk dan Peraturan Pemerintah pelaksananya, namun tidak diakomodir dalam UU Nomor 1 Tahun 1974 tentang Perkawinan yang merupakan lex specialis dari peraturan yang mengatur tentang Perkawinan di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif yang obyek utamanya adalah substansi hukum atas perlindungan hukum bagi Penghayat Kepercayaan atas dasar pengakuan Kepercayaan sesuai amanat UUD NRI Tahun 1945, akibat kekuranglengkapan norma dan penafsiran eksklusif makna kata “Ketuhanan Yang Maha Esa” dan “dan kepercayaannya itu”. Penelitian ini diharapkan dapat memberikan pemahaman kepada para stakeholder terkait Keabsahan Perkawinan yang dilakukan oleh Penghayat Kepercayaan dan memberi perlindungan hukum secara administratif kepada Penghayat Kepercayaan. Putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016 hadir memberikan solusi dan perlindungan hukum bagi Penghayat Kepercayaan atas pengaturan hukum administratif yang belum sepenuhnya melindungi dari keberadaan pemeluk Kepercayaan terhadap Tuhan YME. Pasca terbitnya Putusan MK tersebut, perkawinan Penghayat Kepercayaan diakui sebagai perkawinan yang sah dan membawa akibat hukum yang baik bagi anak turunannya. Kata Kunci: Perlindungan Hukum; Penghayat Kepercayaan; Perkawinan; Hukum Administrasi.
