Boilerplate—the fine-print terms and conditions that we become subject to when we click “I agree” online, rent an apartment, or enter an employment contract, for example—pervades all aspects of our modern lives. On a daily basis, most of us accept boilerplate provisions without realizing that should a dispute arise about a purchased good or service, the nonnegotiable boilerplate terms can deprive us of our right to jury trial and relieve providers of responsibility for harm. Boilerplate is the first comprehensive treatment of the problems posed by the increasing use of these terms, demonstrating how their use has degraded traditional notions of consent, agreement, and contract, and sacrificed core rights whose loss threatens the democratic order. This book examines attempts to justify the use of boilerplate provisions by claiming either that recipients freely consent to them or that economic efficiency demands them, and it finds these justifications wanting. It argues that our courts, legislatures, and regulatory agencies have fallen short in their evaluation and oversight of the use of boilerplate clauses. To improve legal evaluation of boilerplate, the book offers a new analytical framework, one that takes into account the nature of the rights affected, the quality of the recipient's consent, and the extent of the use of these terms. It goes on to offer possibilities for new methods of boilerplate evaluation and control, and concludes by discussing positive steps that NGOs, legislators, regulators, courts, and scholars could take to bring about better practices.

The company group of the PJSC “ROSSETI” pays great attention to reducing occupational hazard at the facilities of the power grid complex. The analysis of the accidents in the branch of PJSC “IGDC of the Center”– “Orelenergo” revealed that transformer housings installed at the mast-type transformer substations 6-10 / 0.4 kV can’t fully provide the required safety level as they can be slightly raised even without using a special tool, and therefore one can stick his hands or some objects to the current-carrying parts of the transformer substation. According to the statistics of the damages at the mast-type transformer substations 6-10 / 0.4 kV various small animals and birds can enter the electrical installation through small slits between the housing and the transformer, which will lead to different emergency situations. To prevent the aforementioned negative consequences, a universal transformer housing was developed for a mast-type unit transformer substation (UTS) 6-10 / 0.4 kV. The offered design of the housing is universal, since it can be used for the transformers of various capacities; for its manufacture tools and materials with different characteristics can be used. At the same time, the installation of the developed housing will allow power grid companies to reduce occupational hazard, reduce the undersupply of electricity and increase the reliability of power supply to the agricultural consumers. The technical solution presented in the article can be applied for the mast-type UTS 6-10 / 0.4 kV in the post-Soviet countries.

The increasing demand for a flexible Naval response to a broad spectrum of military situations imposes a demand to carry out missions in increasingly higher sea states. Launching and retrieving buoyant objects or loading cargo into boats responding to the ocean-air interface requires improved technology for successful operations in high sea states. There is an urgent need for handling systems that provide the degree of control necessary for those Navy missions subjected to an increasing all-weather response. Advances in the state of the art or the development of new techniques are needed to support these operational requirements. This paper will discuss present handling systems and proposed new methods.

The article offers new selection principles of camping sites. Camping-parking for transit car-tourists and camping for tourists have different selection processes, preparation and organization of the site for them. It is important to take into account the maximum combination of attractions in the camping that is created. Geographical location of a site also assumes high level of security of car tourists in a camping. The authors consider requirements for the organization and following of fire safety instructions as the basic rules of security. Complying with the rules adopted for the European campgrounds is important in ensuring fire safety. They take into account a rational organization of the parking accommodation for vehicles (autocampers), tents or small houses, space for barbecue, administrative and other buildings. The authors develop a mathematical model of searching of rational placement camping for tourists, and make proposal for drawing up regulatory instruments that will reduce the threat of fire in camping. The economic efficiency of the proposed organizational and regulatory solutions is provided by reducing of costs and attractiveness increasing of these places of accommodation both for domestic and foreign car tourists.

3D FE (finite element) simulations of the deformation and damage evolution of particle reinforced composites are carried out for different microstructures of the composites. Several new methods and programs for the automatic reconstruction of 3D microstructures of composites on the basis of the geometrical description of microstructures as well as on the basis of the voxel array data have been developed and tested. Different methods of reconstruction and generation of finite element models of 3D microstructures of composite materials (geometry-based and voxel array based) are discussed and compared. It was shown that FE analyses of the elasto-plastic deformation and damage of composite materials using the microstructural models of materials generated with these methods yield very close results. Numerical testing of composites with random, regular, clustered and gradient arrangements of spherical particles is carried out. The fraction of failed particles and the tensile stress-strain curves were determined numerically for each of the microstructures. It was found that the rate of damage growth as well as the critical applied strain, at which the damage growth in particles begins, depend on the particle arrangement, and increase in the following order: gradient < random < regular < clustered microstructure.
