The laws of The Republic Of Indonesia in 1945 became the highest legal source of lower legal products. The laws of The Republic Of Indonesia in 1945 from 1999 to 2002 have been amended four times. The consequences of the amendement certainly affect the laws that run it including synchronzation of local government law with the result of the amendment of the four constitutions of The Republic Of Indonesia in 1945. In this connection the formulation of this research problem is: a) How is the regulation of local government in the amendnment of the four laws of The Republic of Indonesia in 1945?, b) what the arrangement of local government after the amendnment of the four laws of The Republic of Indonesia in 1945?. Is normative legal research. As is known, normative legal research includes research on legal principles, legal system, legal synchronization level, and legal history research. In accordance with the characteristics and nature of normative law research, in this study will use several methods of approach: The Statue Approach (statutory approach, The analitical and Conseptual Approach)  Based on Article 18 of the 1945 Constitution of the State of the Republic of 1945 found The existence of development policy relation between central government and regional government as regulated in Law Number 23 Year 2014 about Local Government, that is base on: Decentralization, Deconcentration and Co-Administration, assignment from government to region and village and from region to village To perform certain tasks accompanied by financing, facilities and infrastructure and human resources with the obligation to report in its implementation and accountable to the commissioned. Undang-Undang Negara Republik Indonesia Tahun 1945 menjadi sumber hukum tertinggi produk hukum yang lebih rendah. Undang-Undang Negara Republik Indonesia Tahun 1945 dari Tahun 1999 sampai 2002 telah dilakukan amandemen sebanyak empat kali. Konsekwensi dari amandemen tersebut  tentunya berpengaruh terhadap Undang-Undang yang menjalankannya termasuk sinkronisasi Undang-Undang Pemerintahan Daerah dengan hasil Amandemen Keempat Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dalam kaitan itu rumusan masalah penelitian ini adalah: a) Bagaimana pengaturan pemerintahan daerah dalam Amandemen Keempat Undang-Undang Negara Republik Indonesia Tahun 1945?,  b) Bagaimana pengaturan pemerintahan daerah dalam Undang-Undang Pemerintahan Daerah pasca Amandemen Keempat Undang-Undang Negara Republik Indonesia Tahun 1945?. Jenis penelitian ini adalah penelitian hukum normatif. Sebagaimana diketahui penelitian hukum normatif mencakup penelitian terhadap asas-asas hukum, sistematika hukum, taraf sinkronisasi hukum, dan penelitian sejarah hukum. Sesuai dengan karakteristik dan sifat penelitian hukum normatif, maka dalam penelitian ini akan memakai beberapa metode pendekatan: The Statue Approach (pendekatan perundang-undangan), The analitical and Conseptual Approach (pendekatan analisis konsep hukum). Berdasarkan Pasal 18 Undang-Undang Dasar Negara Republik 1945 ditemukan adanya hubungan kebijaksanaan pembangunan antara pemerintah pusat dan pemerintahan daerah sebagaimana diatur dalam Undang-Undang Nomor 23 Tahun 2014 Tentang Pemerintahan Daerah, yaitu dengan dasar-dasar : Desentralisasi, Dekonsentrasi, dan Tugas pembantuan, penugasan dari pemerintah kepada daerah dan desa dan dari daerah ke desa untuk melaksanakan tugas tertentu yang disertai pembiayaan, sarana dan prasarana serta sumber daya manusia dengan kewajiban melaporkan dalam pelaksanaannya dan mempertanggungjawabkan kepada yang menugaskan.

<p><em>In this study, there are two (2) issues that were examined. First, how the Central Government and Local Government gained authority in the land sector. Second, how the meaning of the relationship of authority of the Central Government and Local Government in the area of land according to the 1945 Constitution, This study uses normative legal research. The results of research are: First, the authority of the Central Government in the land sector is the inherent nature of authority, because as the sole power in a unitary state. In the development of central government authority derived from attributive authority and Local Government authorities in the land sector sourced from attributive authority and discretionary. Second, the meaning of the relationship of authority between the central government and the regional government in the land sector as: (a) the relationship of subordination; (B) the relationship of supervision; and (c) the relationship of responsibility in achieving the objectives of the State.</em></p>

Local regulations are local regulations that are established by local specificities recognized by the Constitution of the Republic of Indonesia-1945 as part of their decentralization. Local regulations can not contradict the legislation of higher order not to cause a result of the cancellation. This cancellation is the authority of the central government in relation to the unitary state. Supervision by the central government there are two models of preventive supervision and oversight repesif. Cancellation regulatory oversight repesif area is conducted on local government. Cancellation Provincial Regulation made by the President and the Minister of the Interior gave rise to a dualism. For it will be discussed on How cancellation arrangements are made with the Provincial Regulations and Regulations Presidential Decree of the Minister of the Interior? 2. What is the legal effect of the cancellation of Provincial Regulation by Presidential Decree and the Regulation of the Minister of the Interior? The issues discussed using normative research by using the approach of legislation, the legal concept analysis approach, in order to obtain answers that dualism cancellation provincial regulations stipulated in several laws including Law No. 32 Year 2004 on Regional Government, Law No. 28 year 2009 on Local Taxes and levies, Government Regulation No. 79 Year 2005 on Guidelines Direction and Control of Local Government, Minister of the Interior No. 1 Year 2014 on the Establishment of the Regional law Products stating that the authority of the cancellation of regulations made by the President of the instrument while the Presidential Decree cancellation made by the Minister of the Interior was limited to cancellation Draft Regional Regulation on stage during the evaluation of preventive supervision and legal consequences caused by the dualism cancellation of local regulations are different between cancellation made by the President and minister of Interior. Cancellation is cancellation of its President in the field of executive interim final cancellation made by the Minister of the Interior if the local government to enforce the local regulations canceled Interior Minister will ask the cancellation to the President.

Consequences of the implementation of the Act Number 23 of 2014 on Regional Government spawned extraordinary complexity of the problems in some areas. One of the problems that arise is a rampant discourse of regional expansion that occurs both at the provincial and district/city. In essence, the establishment, merger, and abolition of the area aim to improve public services to be more optimal, shorten the span of control, and accelerate the welfare of society in strengthening the integrity of the Unitary Republic of Indonesia. The purpose of this study was to determine the implications of the establishment of new autonomous regions in the frame of the Republic of Indonesia based on Act Number 23 of 2014 on Regional Government; and to understand the implications of the establishment of new autonomous regions preparation for improving people's welfare by Act Number 23 of 2014 on Regional Government. This type of research is a normative legal research. Methods and techniques of data collection through library studies or studies document. Mechanical analysis of legal material is a descriptive qualitative. Conclusions from this research are that the implications of the establishment of regional preparation of new autonomous within the framework of the Unitary Republic of Indonesia before Act Number 23 of 2014 on Regional Government due to the local communities feel there is an imbalance of equity and fairness between regions with each other in the local government areas. Implications of the establishment of new autonomous regions preparation for improving people's welfare by Act Number 23 of 2014 on Regional Government that in order to establish an area or region of the expansion needed a measure as the basis for the determination. Establishment and expansion of new areas should be based on the divisions that are objective with those aspects of the financing of Human Resources and other support facilities

Abstract Amendments to the laws on local government undnagan impact on local government authority in running the affairs of government. For 10 years Indonesian running the regional autonomy system using Law No. 32 of 2004 on local government, and amendments thereto, for the moment the law declared invalid by the enactment of Law No. 23 Year 2014 on Regional Government, the State Gazette of the Republic of Indonesia Year 2014 No. 244, on October 2, 2014. in the Act governing the affairs of government that must be done by the central government, provincial government and local government district / city. Some affairs are regulated in more detail in the Government Regulation No. 18 Year 2016 concerning the Region, which regulates the scope of authority in dealing with government affairs. PP No. 1/2016 outlining the areas that must be held in an area with indicator, scale of values that can be found local work load. Environmental Management itself in Law number 23/2014 and Government Regulation No. 1/2016 is a category / classified in the Mandatory government affairs unrelated to basic services.Keywords: Local authorities, Environment, government affairs

ABSTRAK�Dalam penelitian ini permasalahan yang akan dibahas yaitu: proses pembentukan peraturan daerah dalam rangka otonomi daerah di Kabupaten Kendal dan penerapan asas keterbukaan dalam proses pembentukan peraturan daerah di Kabupaten Kendal.Pendekatan yang akan digunakan adalah pendekatan yang bersifat Yuridis Empiris. Penelitian yang berbasis pada inventarisasi hukum positif, penemuan azas-azas hukum dan penemuan hukum inconcretto, yang dilengkapi pengamatan operasionalisasi asas-asas hukum secara empiris di masyarakat.Kesimpulan dari penilitian ini adalah belum tersedianya instrumen hukum yang dapat menjadi rule of game pelaksanaan asas keterbukaan, pola pendokumentasian yang belum terintegrasi dan faktor keterbatasan anggaran juga menjadi hambatan bagi diterapkannya asas keterbukaan dalam pembentukan peraturan daerah di Kabupaten Kendal. Eksistensi peraturan hukum daerah dalam pembentukannya oleh pemerintah daerah telah sesuai dengan asas-asas peraturan perundang-undangan yang baik, sebagaimanan tertuang dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan. Asas keterbukaan telah diterapkan dalam pembentukan peraturan daerah oleh pemerintah daerah yang terdapat pada : usulan rancangan peraturan daerah yang berasal dari Pemerintah Daerah maupun Dewan Perwakilan Rakyat Daerah; proses pembuatan peraturan daerah secara terencana, terpadu dan sistematis.Kata Kunci �� : Implementasi, Asas Keterbukaan, Pembentukan Peraturan Daerah, Otonomi Daerah�ABSTRACTIn this research the problems to be discussed are: the process of formulating regional regulations in the context of regional autonomy in Kendal Regency and the application of the principle of openness in the process of formation of local regulations in Kendal Regency.The approach to be used is the Juridical Empirical approach. Research based on the inventory of positive law, the discovery of legal principles and the discovery of inconcretto law, complemented by observations of the operationalization of empirical legal principles in society.The conclusion of this research is the unavailability of legal instrument that can become the rule of game of implementation of the principle of openness, un-integrated documentation pattern and budgetary constraint factor also become obstacle for the application of openness principle in the formation of Regional Regulation in Kendal Regency. The existence of regulation of local law in its formation by the local government has been in accordance with the principles of good legislation, in accordance with the Law of the Republic of Indonesia Number 12 Year 2011 on the Establishment of Laws and Regulations.  AbstrakSejak 2009 hingga saat ini terdapat 30 kasus yang diadili oleh Pengadilan Negeri di Indonesia dengan menggunakan Pasal 27 ayat (3) Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Berbagai kasus tersebut memunculkan opini dari sebagian masyarakat yang menganggap pasal-pasal delik pencemaran nama baik bertentangan dengan semangat reformasi yang menjunjung kebebasan berpendapat dan berekspresi. Jenis penelitian ini adalah penelitian hukum normatif. Tulisan ini berkesimpulan bahwa tindak pidana reputasi pasca Putusan Mahkamah Konstitusi Nomor 50/PUU-VI/2008, Putusan Mahkamah Konstitusi Nomor 2/PUU-VII/2009, Putusan Mahkamah Konstitusi Nomor 5/PUU-VIII/2010,  Putusan Mahkamah Konstitusi Nomor 31/PUU-XIII/2015 dan Putusan Mahkamah Konstitusi Nomor 76/PUU-XV/2017 tentang Pengujian Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 diatur secara terperinci dengan salah satu pointnya yaitu melakukan perubahan dalam Pasal 27 ayat (3) UU ITE dan menurunkan ancaman pidana pada 2 (dua) ketentuan.Kata Kunci: Delik Reputasi, Kepastian Hukum dan Mahkamah Konstitusi.Abstract  Since 2009 until now there have been 30 cases tried by the District Courts in Indonesia using Article 27 paragraph (3) of Law Number 19 Year 2016 concerning Amendments to Law Number 11 Year 2008 concerning Information and Electronic Transactions. These various cases gave rise to opinions from some people who considered the articles of defamation offenses contrary to the spirit of reform which upheld the freedom of opinion and expression. This type of research is normative legal research. Normative legal research prioritizes library research with a focus on studies of legal principles, legal systematics, legal synchronization and legal history, this research is also descriptive. This study concluded that the crime of reputation after the decision of the Constitutional Court Number 50 / PUU-VI / 2008, Decision of the Constitutional Court Number 2 / PUU-VII / 2009, Decision of the Constitutional Court Number 5 / PUU-VIII / 2010, Decision of the Constitutional Court Number 31 / PUU-XIII / 2015 and Constitutional Court Decision Number 76 / PUU-XV / 2017 concerning Testing of Law Number 19 Year 2016 concerning Amendment to Law Number 11 Year 2008 concerning Information and Electronic Transactions of the Constitution of the Republic of Indonesia Year 1945 is regulated in detail with one of the points, namely making changes in Article 27 paragraph (3) of the ITE Law and reducing criminal threats in 2 (two) provisions.Keywords: Reputation Delik, Legal Certainty and the Constitutional Court.

State budget management is tightly related to how the existing state law regulates fiscal relationship between the central government and the regional-local governments.  The authority granted to regional-local government to manage their own budgeting more or less autonomously in practice results in mismanagement, misuse of available financial resources and even corruption.  Unfettered and unchecked financial leakage at the regional government level may and have resulted in failure to realize and implement projects much needed by society.  In light of this situation, a justified need arise for state intervention to monitor-control planning and realization of regional-local government budget. The author proposed the expansion of the Audit Board of the Republic Indonesia’s authority. They should not passively wait for financial reports to be submitted but actively assist regional-local government in planning their own budget, monitor the spending and realization of it and lastly, provide assistance in drafting the final report.

The Regional Representative Council (hereafter called DPD) is one of the top state institutions that is directly elected in the General Election. In general, the members of the Regional Representative Council of the Republic of Indonesia (hereafter called DPD RI) are tasked with bringing up the interests and aspirations of the people in the regions to the central government as well as having the authority to carry out supervision in the regions. Supervision in question is the supervision of the implementation of laws, and the results of DPD supervision are submitted to the House of Representatives (hereafter called DPR) as a material for consideration for follow-up. Based on this background, this research was conducted with the aim of describing how DPD RI's supervisory function mechanism on the implementation of regional autonomy in Bali Province and what obstacles DPD RI faces in supervising regional autonomy in Bali Province. This research was conducted using a normative legal research method with a statutory approach. The results of this study showed that DPD RI oversight function is implemented with three mechanisms, namely the absorption of aspirations in the community, conveying aspirations through the preparation of reports and problem inventory lists, and submission of the results of supervision to DPR. While the obstacles faced by DPD RI in supervising regional autonomy in Bali Province are the weak authority of DPD RI compared to its legitimacy, the cooperation pattern between DPD and related regional government agencies that has not been clearly regulated, and the lack of support and community participation for participate in supervising after the enactment of a law.

Dalam kaitannya dengan penafsiran, dapatkah Mahkamah Konstitusi menafsirkan suatu norma pidana dan dapatkah Mahkamah Konstitusi membuat hukum baru atas norma hukum pidana. Untuk menjawab masalah tersebut, digunakan penelitian hukum normatif, Penelitian hukum normatif atau kepustakaan tersebut mencakup: (1) penelitian terhadap asas-asas hukum, (2) penelitian terhadap sistematika hukum, (3) penelitian terhadap sinkronisasi vertikal dan horizontal, (4) perbandingan hukum, (5) sejarah hukum. Oleh karena itu, maka bahan yang digunakan adalah bahan sekunder yang dilakukan melalui penelitian kepustakaan (library research). Berdasarkan hasil penelitian tersebut, Mahkamah Konstitusi melakukan judicial activism ketika norma tersebut melanggar hak konstitusional warga negara yang dijamin oleh Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, dan Mahkamah Konstitusi melakukan judicial restraint ketika harus menyatakan sesuatu yang semula bukan perbuatan pidana menjadi perbuatan pidana.In relation to interpretation, can the Constitutional Court interpret a criminal norm and can the Constitutional Court make a new law on criminal law norms. To answer this problem, normative legal research is used. Normative legal research includes: (1) research on legal principles, (2) research on legal systematics, (3) research on vertical and horizontal synchronization, (4) comparison law, (5) legal history. Therefore, the materials used are secondary materials which are carried out through library research. Based on the results of the study, first: the Constitutional Court conducted judicial activism when the norm violated the constitutional rights of citizens guaranteed by the 1945 Constitution of the Republic of Indonesia, second: the Constitutional Court conducted a judicial restraint when it had to declare something that was not a criminal act.
