تهدف هذه الدراسة إلى بيان الطريقة التي تُطبّق بها منتجات المصارف الإسلامية الماليزيّة، ومعالجة تلك التطبيقات التي أدّت إلى الخلاف بين فقهاء ماليزيا والمشرق الإسلامي. ووضّحت الدراسة محلّ الإختلافات الفقهيّة مُبيّنة أنَّ ما يُثار من مثل هذه الخلافات يتركّز في طريقة تطبيق بعض صور المسائل الإجتهاديّة التي أخذت بها الهيئات الشرعيّة في ماليزيا، وهذه الأساليب في طريقها للترشيد إلى الثواب. وقد اعتمد الباحث على المنهجين الأساسيين وهما: المنهج التحليلي النقدي، والمنهج المقارن بغية الوصول إلى النتائج المرجُوّة. وأخيرًا، قد تحفّظ الباحث على طريقة بعض الأساليب التي تُطبّق بها منتجات المعاملات الماليّة، مُوضّحةً آراء الفقهاء المعاصرين، وحُكم الشرع فيها، مما يلزم النظر فيها ومُراجعة تطبيقها لتنضبط بالضوابط الشرعية. الكلمات المفتاحية: آراء الفقهاء، التورق المنظم، بيع العينة، الدين، المصارف الإسلامية**************************This study aims to describe how Malaysian Islamic banking products are implemented and how some of these implementations lead to disagreement between the Islamic jurists of Malaysia and Islamic East. The study pointed out the areas of juristic differences indicating that these differences are rooted in the process of applying some forms of ijtihÉdÊ issues that are accepted by the Malaysian religious bodies and these methods are in the process of improvement towards accuracy. The researcher maintained reservation on some methods applied in the products of financial transactions; in doing so, the researcher explained the relevant views of contemporary jurists and Share‘ah rulings that require re-consideration and review of their applications in order to modulate them with Share‘ah regulations. The researcher has relied on two primary approaches: critical cum analytical and comparative. Key words: views of jurists, organized Tawarruq, Bay‘ al-‘Aynah, Credit, Islamic banks.

Purpose: To see the customer perception regarding car loans in Islamic and conventional banking. Methodologies: This study is based on primary data. These followed by only Bahawalpur corporate customers are taken as the sample research. Firstly the persons have been identified of the selected banks that are the financial affairs of those banks. When these people show their willingness then questionnaire has been filled by them and the required data has been collected. The statistical technique chi-square had been adapted for analysis the data. Findings: Total 120 questionnaires have been distributed among different banks and out of which 104 were get completed and returned. Peoples prefer conventional banks for car loans as compared to Islamic banks.   Key Words: Islamic Banking, Corporate Customer, Car Financing.

Indonesia has the largest Muslim population in the world. With this amount, of course, it should be a capital for economic strength. However, as of November 2020, data released by the Financial Services Authority put the Islamic banking market share at 6.33%. Efforts to merge the three state-owned Sharia banks into Indonesian Sharia Banks are expected to increase the penetration of the sharia economy in Indonesia, which is still far behind when compared to conventional domestic economic movements and Islamic financial transactions in other countries. This research will describe the extent of the sharia economic conditions in Indonesia after the merger of state-owned sharia banks into BSI. This study uses a qualitative method with a type of literature review research which is obtained from various authentic sources such as books, articles, journals and trusted websites. There was a 2.7% increase in the market share of Islamic banks after the merger. This increase when compared to the existing potential and the market is still very small. However, it is hoped that this impact will continue to increase over time, especially as capital support for various financial sectors and the halal industry in the country.

Purpose This paper aims to investigate the extent to which maṣlaḥah (public interest) is taken into consideration in Islamic banking operations in Malaysia, particularly in bayʿ al-ʿīnah (sale and buyback), taʿwiḍ (compensation) and ibrāʾ (rebate). Design/methodology/approach This study applies deductive and inductive methods to analyze the application of maṣlaḥah in Islamic financial transactions. Three issues in Malaysia are selected as a case study, allowing bayʿ al-ʿīnah, standardizing the rate of taʿwiḍ and stipulating the ibrāʾ clause in financial agreements. As this study is qualitative in nature, all data are analyzed based on the content analysis method. Findings Both the maṣlaḥah of Islamic banks and their customers were found to be considered by the Central Bank of Malaysia in the implementation of contracts and principles of Islamic banking. The first maṣlaḥah represents the viability of Islamic banks, while the second maṣlaḥah promotes fairness and transparency between Islamic banks and their customers. Research limitations/implications This study only focuses on the contracts and principles of Islamic banking operations in Malaysia with regard to three selected issues. Practical implications This paper clarifies the practical application of maṣlaḥah in the Islamic banking industry, particularly with regard to implementing its contracts and principles. Originality/value This paper analyzes the argument of maṣlaḥah on the issues of bayʿ al-ʿīnah , taʿwiḍ and ibrāʾ in Malaysia, which are considered among scholars to be debatable issues. While many discussions focus on the legal aspect of Sharīʿah on those issues, this study emphasizes how the application of maṣlaḥah aims to solve the current problems and harmonize between Sharīʿah and reality.

Critics of Islamic banking argue, that how could Islamic banking work when interest (riba) is prohibited? Those in favour argue that Islamic banks can operate without interest. This is the contention of the paper. Islamic bank is a banking which operates without the norm of interest. However, the Muslim scholars have never seriously discussed the three basic questions. Riba, interest, are riba and interest synonymous. The most common application of riba is on monetary transaction relating to “loans” and “credits”. A unique feature of Islamic banking is its profit-and-loss sharing (PLS) paradigm, which is predominantly based on the mudarabah (profit-sharing) and musharaka (joint venture) concepts of Islamic contracting. However, Islamic banks are also criticized for not applying the principle of mudaraba in an acceptable manner. Where banks are eager to take part in profit-sharing but they have little tolerance for risk. Jaiz bank plc, the first Islamic bank in Nigeria, is a quoted public company owned by over 26,000 shareholders. Based on recommendations from Islamic Development Bank (IDB), which is also a shareholder of the bank, Jaiz Bank PLC had partnered with Islamic Bank of Bangladesh (IBBL). However, the Islamic Banks, generally, seem to attract a fraction of the business of financial transactions in any country where conventional banks operate. The challenge facing Islamic banks is the diversity of opinion among the Sharia scholars. Whether the particular practice or product, is Sharia compliant. The paper therefore, concludes that, by prohibition of riba, Islam wishes to establish an economic system where all forms of exploitation are eliminated. The difficulty to understand the prohibition comes from lack of appreciation of the whole complex of Islamic values.  Thus, the future of Islamic banks depends not only upon investing in new products but also upon the satisfying the faith of the stakeholders.

Abstract: Since the decade of the 1970s Muslims in various countries have been trying to establish Islamic banks. The purpose of establishing these Islamic banks in general is to promote and develop applications of Islamic principles, sharia and their traditions into financial transactions, banking, and other related businesses. Globalization that occurs in various parts of the world, including Indonesia is no longer an issue but the reality that has now happened. Globalization is not a very frightening problem that tends to have a negative side but also has a positive side, namely the expansion of business networks during the challenges can be overcome by hard work and patience. With the globalization of economic competition between countries it is undeniable to become increasingly strict. Automatic in the world of banking will also experience competition between banks. Likewise with the presence of the Islamic system in every economic activity, it will certainly lead to competition between conventional systems with the sharia system. Tujuan pendirian bank-bank syariah ini pada umumnya adalah untuk mempromosikan dan mengembangkan aplikasi dari prinsip-prinsip Islam, syariah dan tradisinya ke dalam transaksi keuangan, perbankan, dan bisnis-bisnis lain yang terkait. Globalisasi yang terjadi diberbagai belahan dunia, termasuk negara Indonesia bukanlah isu lagi tetapi kenyataan riil yang kini telah terjadi. Globalisasi bukanlah persoalan yang sangat menakutkan yang cenderung meimiliki sisi negatif saja melainnkan juga memilki sisi positif yaitu perluasan jaringan bisnis selama tantanganya dapat diatasi dengan kerja keras dan kesabaran. Dengan adanya globalisasi persaingan ekonomipun antar negara tidak dapat dipungkiri semakin ketat.  Otomatis di dunia perbankan pun juga akan mengalami persaingan antara  bank - bank. Begitu juga dengan hadirnya sistem syariah di setiap aktivitas ekonomi  tentunya akan menimbulkan persaingan antara sistem konvensional dengan sistem syariah. Lebih terperinci artikel ini akan membahas mengenai bank syariah di era globalisasi, yang mencakup perkembangan perbankan syariah serta peluang dan kendala yang dihadapi bank syariah di era globalisasi ini.

Produk Pembiayaan Secara Islam telah mula berkembang pesat dalam arus industri perbankan dan kewangan pada masa ini. Keadaan ini antaranya boleh dilihat melalui pertambahan aset perbankan Islam saban tahun di samping penyertaan lebih banyak institusi yang menawarkan produk secara Islam. Produk pembiayaan perumahan Islam contohnya menampilkan pengaplikasian konsep syariah seperti Murabahah, Bay ‘Bithaman Ajil (BBA), BBA komoditi, Ijarah Thumma Bay‘, Istisna’ dan Musharakah Mutanaqisah (MM). BBA paling banyak digunakan dalam menawarkan produk pembiayaan perumahan secara Islam sementara penggunaan konsep lain seperti MM masih lagi dianggap baru. MM adalah kontrak hibrid berasaskan perkongsian dan diakhiri dengan pemilikan tunggal. Konsep ini mula diaplikasi dalam amalan perbankan di Malaysia selepas tahun 2000. Konsep berasaskan ekuiti adalah sangat digalakkan penggunaanya dalam muamalat Islam berbanding konsep berasaskan hutang seperti BBA. Justeru kajian ini akan menganalisis kelebihan yang terdapat dalam produk berasaskan konsep MM dengan tumpuan kepada produk pembiayaan perumahan yang ditawarkan Kuwait Finance House Malaysia Berhad (KFHMB). Kata kunci: Produk pembiayaan perumahan Islam; Musharakah Mutanaqisah Islamic finance products has grown rapidly in the current banking and financial industry. This situation can be seen by the increasing of Islamic banking assets each year in addition to the participation of more institutions offering Islamic products. Islamic home financing products in Islamic banks use the concepts of Murabahah, Bay ‘Bithaman Ajil (BBA), BBA commodities, Ijarah Thumma Bay ‘, Istisna’ and Musharakah Mutanaqisah (MM). BBA concept is the most mode of financing use in Islamic home financing products, while others use the concept of MM. MM is a hybrid contract–based on partnerships. This concept was applied in banking practice in Malaysia since 2000. The concept of equity–based are very much encouraged to be used in the Islamic muamalat than debt–based concepts such as the BBA. Hence, this study will analyze the advantages of the products based on the concept of MM with a focus on home financing products offered by Kuwait Finance House Malaysia Berhad (KFHMB). Abstract The present epoch is witnessing a significant growth in the Islamic banking institutions, which has led to an increase of need of methods of administrative and legal in these institutions in order to achieve the objectives for which they were established and to meet the desire of Muslim and non-Muslim community members who wish to deal with them. Therefore, this study aims to discuss the essence of Islamic governance in Islamic banks and their relationship to the system of these institutions as well as to focus on the principle of fulfilling the promise and to show the extent of its mandatory and its relationship to the principles of governance. Hence, the study highlights the basic role of Islamic law in consolidating the principles of governance. These kind of principles securing the stability of transactions generally and financial transactions particularly, which containing exalted principles. This study used the analytical approach to analyze the statements of jurists on the issues of binding promise, as well as descriptive approach to explain the principles of governance and its relation to the principles of Islamic law. The research included two topics, and it came out, indicating the effect of opening the excuses in the business and banking services in Islamic banks of different forms, especially since the need in our time for these banking services is necessary, so that the masses of the Muslim community are hardly indispensable, which requires looking at them according to the purposes of the Sharia and taking into account the need People, while preserving the principles and principles of Sharia. Then the conclusion came, and it included the most important results of the study.

Abstract: The rapid development of the number of islamic banks should be balanced with the availability of infrastructure to carry out daily operational practices. The operational tools include hardware as like as representative office, computerized system, reliable human resources and software as like as method, culture and financial and islamic banking knowledge. In terms of development of Islamic finance is the paper "Alternative Calculation of Return Shahibul Mal on Mudharabah Scheme on Bank Syariah" was written. During this calculation of return shahibul mal has not been standardized in a formula, thus causing two serious effects. First, in the theoretical level, the formula has not yet created a difficulty. Secondly, in practical level, the formula is not impressive enough to recalculate the complexity of return calculations obtained by shahibul mall, causing laziness of the community using the services of islamic bank. This paper using mathematical and arithmetic equations with the help of modeling made by the author to refine and improve the method of calculation that has been available. The purpose of this paper is to create a standard formula that facilitates the calculation of return earned by a shahibul mal in a mudaraba scheme in a islamic bank.
