The Corona Virus Disease (COVID-19) pandemic that has plagued the world has changed the mindset, how to behave and how to act, not only in social interaction but also has influenced the law enforcement system. Development in Information Technology (IT) has found a teleconference system as a means of conducting virtual courts as a reaction to social or physical distancing movements which is one way to prevent the spread of COVID-19. Although in practice the use of a virtual court in a trial is considered capable of preventing the spread of viruses, the use of a virtual court must keep be based on applicable laws and regulations. This paper is a normative legal research with legislation approach, case approach, comparative legal approach, and conceptual approach to legal material collected through literature study and then analyzed using grammatical, systematic, and extensive interpretation methods. Based on the results of the study, several countries such as the United Kingdom, China, Australia (New South Wales) and America (New York) and Indonesia (although limited to the examination of witnesses) have applied virtual courts in the justice system. Implementation of the trial using the virtual court method by teleconference did not violate the provisions of the trial set out in the Criminal Procedure Code (KUHAP). According to the Draft Law KUHAP has accommodated the trial using the virtual court method as an embodiment of legal principles in the judiciary that is carried out quickly, simply, and at a low cost. The use of virtual court is not the first or primary choice in examining criminal cases in Indonesia, in abnormal emergency conditions due to the COVID-19 pandemic as it is today, an examination by the virtual court method is a solution so that the criminal justice system continues to run without reducing the efforts to prevent the spread of the virus. Trials using virtual court facilities continue to accommodate the human rights of victims, witnesses and defendants through their virtual presence so that a fair trial continues in the courtroom.

The constitutional protections toward crime witnesses in Indonesia are indisputably inevitable. As an effort to uphold justice, Indonesia relies on the formal mechanism of criminal law known as the criminal justice system. The system starts from reports by the police, prosecution by the prosecutor, to the stage of a trial in a court, and execution in a prison. Throughout its development, the criminal justice system seemed to focus more on protecting criminal offenses (criminal oriented) rather than paying attention to the rights of witnesses and victims (witness and victim-oriented). Therefore, the studies that concern the rights of witnesses and victims are highly needed in order to figure out ways to balance the treatment between the suspects/defendants and the witnesses and victims. Through the use of the statue approach and conceptual approach, the positions and the rights of legal protection for witnesses and victims are thoroughly captured and described in this current research. Besides, the factors causing uneven attention and unfair treatment toward crime victims are also specifically identified.

The Covid 19 pandemic so far has made a huge impact in various lines of life, especially for the Indonesian. This pandemic has not only caused a crisis in the health sector, but has created a domino effect that has also caused crises in other fields such as economic, social and religious life. From an economic standpoint, the outbreak of the Covid 19 virus has forced many business actors to go out of business or if someone survives they are forced to cut the number of employees so that the flow of layoffs increases during this time. Business actors who are trying to survive on this crisis are required to find the best solutions to keep producing and selling products, of course with more innovative things. The following article is a literature study on how accelerated adaption to the industrial revolution 4.0 in the Corona Virus Desease 19 pandemic as an opportunity to increrase the economic and business sectors through digitization of business strategies. The method used is to examine several research results that have been published in journals that explain the Covid 19 pandemic and solutions for business people to survive at this time. The findings of this study inform that one of the solutions that can be applied during this pandemic to survive in running a business for business actors is digitization of business strategies in each business run in order to reach wider consumers and increase profitability. This digitization of business strategies has proven to be able to help businesses survive a pandemic by adjusting the sales method that was previously conventional to digital.Keyword: Corona virus disease-19; industrial revolution 4.0; digitization; business strategy Pandemi Covid 19 sejauh ini telah mengakibatkan dampak yang begitu besar dalam berbagai lini kehidupan khususnya bagi bangsa Indonesia. Pandemi ini tidak hanya menyebabkan krisi dalam bidang kesehatan saja, namun menimbulkan efek domino sehingga juga menimbulkan krisis di bidang-bidang lain seperti ekonomi, sosial dan kehidupan beragama. Dari sisi ekonomi, mewabahnya virus Covid 19 memaksa banyak para pelaku usaha untuk gulung tikar atau pun jika ada yang bertahan terpaksa memangkas jumlah karyawan sehingga arus gelombang PHK meningkat selama masa ini. Para pelaku usaha yang berusaha bertahan dalam krisis ini, dituntut untuk menemukan solusi terbaik untuk dapat tetap berproduksi dan menjual produk, tentunya dengan hal-hal yang lebih inovatif. Tulisan berikut ini adalah studi literatur tentang bagaimana akselerasi adaptasi revolusi industri 4.0 di tengah pandemi covid-19 sebagai peluang peningkatan sektor ekonomi dan bisnis melalui digitalisasi strategi bisnis. Metode yang digunakan adalah mengkaji beberapa hasil penelitian yang pernah dimuat pada jurnal-jurnal yang menjelaskan seputar pandemic Covid 19 dan solusi bagi pelaku bisnis bertahan di masa ini. Temuan penelitian ini menginformasikan bahwa salah satu solusi yang dapat diterapkan di masa pandemi ini untuk tetap bertahan menjalankan usaha bagi para pelaku usaha adalah dengan digitalisasi strategi bisnis pada tiap-tiap usaha yang dijalankan agar dapat menjangkau konsumen lebih luas dan dapat meningkatkan profitabilitas. digitalisasi strategi bisnis ini terbukti mampu membantu para pelaku usaha untuk bertahan di masa pandemi dengan jalan menyesuaikan metode penjualan yang semula konvensional diubah kea rah digital.Kata kunci: Covid 19; akselerasi digital;  revolusi industri 4.0; digitalisasi; strategi bisnis

This article draws upon research undertaken in South Wales to understand children’s views concerning what it means to be a ‘victim’ of crime and their experiences, in that context, of engaging with the criminal justice system. Significantly, and moving beyond traditional policy and service provision concerns, child participants argued passionately that not only did adults fail to provide them with appropriate advice and support, but that their understandings of victimhood were inaccurate. Rather, children articulated an almost zemiological understanding of ‘harm’ which was the basis for an alternative way of understanding what it was to be a ‘victim’. Furthermore, children suggested that they were not taken seriously by an adult-led criminal justice system and that the operation of that system did not address their needs. Reflections are offered in this article concerning children’s views, and the profound implications that their alternative discourse pose for criminal justice policymakers and practitioners.

This study examines the impact of drugs on the criminal justice system of the greater Rochester (New York) metropolitan area. Although discussed widely, there has been little investigation of the effects of the “war on drugs” at the local level. This research considers patterns of arrest and case processing and includes an examination of drug treatment. Increases in arrests, particularly for possession of drugs, have occurred in the city but not the suburbs and have had a disproportionate effect on African-Americans. Many cases are processed as misdemeanors and result in minor sanctions. The implications for traditional order maintenance concerns in a metropolitan community are discussed.

New Orleans in 2011 finds itself facing many of the same problems New York City faced in 1961 when the founders of the Vera Institute of Justice launched the Manhattan Bail Project: Too many people are held in pretrial detention who could be released without risk to public safety; the reliance on bail results in disparate outcomes based on financial ability; and the unnecessary detention of thousands of defendants each year imposes excessive costs on the city government and taxpayers, as well as on those needlessly detained. Vera is now working with New Orleans stakeholders to develop a comprehensive pretrial services system. Following in the footsteps of the Manhattan Bail Project, the work will create a carefully conceived and locally sensitive pretrial services system, one that will result in a fairer and more efficient criminal justice system and a safer community.

AbstractIn Indonesia, currently the number of victims infected with Corona Virus Disease 2019 (COVID-19) is increasing, causing death. The impact of Covid-19 on the labor sector, namely company closures, delays in mobilization and decreased productivity. The research was conducted using a statutory and conceptual approach. The results showed that the Covid-19 virus was a disease caused by biological exposure factors. What employers can give workers / laborers in the work environment during the Covid-19 pandemic is the right to Occupational Safety and Health (K3). K3 is a protection that must be received by workers in order to prevent accidents in the work environment. In accordance with the mandate of the Work Safety Law and the Labor Law, workers infected with the Covid-19 virus can recover to their original state if they are given adequate health insurance by the state. However, until now there has been no latest legal regulation regarding the protection of workers who work amid Covid-19. Dampak Covid-19 pada sektor ketenagakerjaan yakni penutupan perusahaan, keterlambatan mobilisasi dan menurunnya produktivitas. Penelitian dilakukan dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa virus Covid-19 termasuk ke dalam penyakit akibat faktor pajanan biologi. Hal yang dapat diberikan pengusaha kepada pekerja/buruh di lingkungan kerja selama pandemi Covid-19 adalah hak atas Keselamatan dan Kesehatan Kerja (K3). K3 merupakan perlindungan yang wajib diterima oleh pekerja guna mencegah terjadinya kecelakaan di lingkungan kerja. Sesuai dengan amanat UU Keselamatan Kerja dan UU Ketenagakerjaan, pekerja yang terinfeksi virus Covid-19, dapat pulih seperti keadaan semula apabila diberikan jaminan kesehatan yang memadai oleh negara. Namun, sampai saat ini belum ada peraturan hukum terbaru terkait perlindungan pekerja yang bekerja ditengah Covid-19. The principles of international law mandate diversion as a model for solving juvenile cases. The diversion model as a resolution model in Indonesia, Philippines, and Thailand is rooted in the traditional culture and local wisdom of the people. Diversion agreement can take form of restitution. This study discusses three issues: (1) diversion in juvenile criminal justice system, (2) restitution in diversion, and (3) comparison of restitution in the Philippines and Thailand. This study employs normative legal approach, which examines the ambiguity of norms of restitution forms. Currently, restitution is interpreted merely as reimbursement for victim. This study collected primary and secondary legal materials collected through literature study. This study employed statutory, legal concept, and comparative law approaches. The focus was on the Philippines and Thailand contexts. The analysis was conducted qualitatively. Diversion is a specialty in the juvenile criminal justice system in which criminal cases committed by children are resolved by deliberation. The result of the diversion agreement can be in the form of restitution as agreed in the deliberation. The Law Number 11 of 2012 on the Juvenile Criminal Justice System recognizes form of restitution. The form is money. It is different from the Philippines and Thailand that formulating a form of restitution in the form of services provided by the perpetrator and/or his family to the victim and/or his family. This form of restitution is based on social realities in which the economic condition of the perpetrator’s family makes it impossible to pay restitution in the form of money. The restitution of work services can be a material for reformulation in the dimension of ius constituendum in Indonesia.

Perkembangan pandemi Covid-19 saat ini sangat mengkhawatirkan dimana terjadinya suatupeningkatan kasus corona khusus di Indonesia. Penelitian ini bertujuan untuk mengetahuidan menganalisis kebijakan yang diambil pemerintah dalam penanganan pandemi Covid-19serta langkah-langkah yang diambil pemerintah untuk menganggulangi dampak-dampak, terutama dampak dari segi ekonomi dan sosial akibat pandemi Covid-19. Metode penelitianhukum yang digunakan yakni metode penelitian hukum normatif. Adapun pendekatan yangdigunakan dalam penelitian ini adalah pendekatan perundang-undangan dan pendekatankonseptual. Penelitian ini berlandaskan pengaturan perundang-undangan yang mengaturmengenai penanganan dan penganggulangan pandemi Covid-19 serta analisis atas konseppenetapan peraturan perundang-undangan tersebut. Hasil dari penelitian ini adalah dalamrangka penanganan Covid-19, berawal dari pemerintah tmengeluarkan kebijakan tentangPembatasan Sosial Berskala Besar yang merujuk pada Undang-Undang Nomor 6 Tahun2018 tentang Kekarantinaan Kesehatan. Peraturan pelaksanaannya yaitu PeraturanPemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar, sertaKeputusan Presiden tentang Kedaruratan Kesehatan sampai dengan saat ini pemerintah telahmengeluarkan kebijakan PPKM yang dimana dilakukan secara berkala. This study aims to identify and analyze thepolicies taken by the government in handling the Covid-19 pandemic and the steps taken bythe government to mitigate the impacts, especially the economic and social impacts of theCovid-19 pandemic. The legal research method used is the normative legal research method. The approach used in this research is a statutory approach and a conceptual approach. Thisresearch is based on the legislation governing the handling and handling of the Covid-19pandemic as well as an analysis of the concept of establishing these laws and regulations. The results of this study are in the context of handling Covid-19, starting with thegovernment issuing a policy on Large-Scale Social Restrictions which refers to Law Number6 of 2018 concerning Health Quarantine. The implementing regulations are GovernmentRegulation Number 21 of 2020 concerning Large-Scale Social Restrictions, as well as thePresidential Decree on Health Emergencies. Until now, the government has issued a PPKMpolicy which is carried out regularly.
