he appearance in the legal system of military disciplinary regulations introducing the category of the so-called a contact act (i.e. an act that is a military disciplinary offense that simulta-neously fulfills the features of a prohibited act, penalized in another act, e.g. in the Act of June 6, 1997, the Penal Code) triggered a number of questions about the mutual relationship between the repressive nature of criminal and quasi-repressive military disciplinary liability. The category of a contact act expressis verbis refers to the provision of Art. 17 sec. 1 and art. 17 sec. 2 points 2-3 of the Act of 09/10/2009 on Military Discipline. Committing a military disciplinary offense by a mil-itary soldier, which at the same time carries the features of an offense penalized in the Criminal Code, gives the possibility of double (i.e. criminal and disciplinary) punishment of a soldier for the same act in fact. Therefore, it is necessary to consider whether such practice makes ne bis in idem (prohibiting repeated punishment of a person for the same act) quite a constitutional principle; or, on the contrary, this practice violates constitutional standards? The analysis made in this article is an attempt to answer this question. The considerations are dogmatic and historical in nature, using the method of systemic and linguistic interpretation.

RESUMO Objetivo: O presente artigo tem por objetivo demonstrar a importância das circunstâncias do art. 59 do Código Penal (culpabilidade, antecedentes, conduta social, personalidade, motivos, circunstâncias e consequências do crime, comportamento da vítima) para a efetividade do princípio constitucional da individualização da pena, expressamente previsto no artigo 5º., inciso XLVI da Constituição de 1988. Procura-se demonstrar que a relativa indeterminação na cominação das penas, ao conferir certa margem de atuação ao magistrado, contribui para a individualização da pena, mas esta somente estará legitimada a partir da motivação das decisões judiciais. Metodologia: O estudo adota o método de abordagem da revisão bibliográfica, mediante a leitura de livros, artigos científicos e a legislação. Resultados: Concluiu-se que na individualização e na aplicação da pena, os critérios previstos no art. 59 do Código Penal são a todo momento revisitados pelo magistrado, como uma forma de adequar a sanção ao fato praticado e particularizar sua aplicação ao agente infrator e ao caso concreto. Contribuições: O estudo traz como contribuição a importância do Princípio da Individualização, calcado na liberdade, que tem sua amplitude na medida em que o sistema adota relativa indeterminação na cominação das penas, na proporção em que concede ao juiz certa margem de atuação. Todavia, a razoabilidade contida nesta indeterminação é imprescindível para evitar arbitrariedades. Palavras-chave: Individualização; Pena; circunstâncias judiciais; fundamentação judicial. ABSTRACT Objective: To demonstrate the importance of the circumstances of Article 59 of the Criminal Code (culpability, background, social conduct, personality, motives, circumstances and consequences of the crime, victim's behavior) for the effectiveness of the constitutional principle of individualization of the penalty, expressly foreseen in Article 5, XLVI of the Constitution. Based on the foundations of the theory of crime, it is sought to demonstrate that the relative indeterminacy in the combination of penalties, by conferring a certain scope of action to the magistrate, it contributes to the individualization of the penalty, but it will only be legitimated based on the motivation of judicial decisions. Methodology: The study adopts the method of approaching the bibliographic review, by reading books, scientific articles and legislation. Results: The individualization and application of the penalty, the criteria foreseen in article 59 of the Penal Code are at all times revisited by the magistrate, as a way of adapting the sanction to the practiced fact and particularizing its application to the offending agent and to the case concrete.Contributions: The importance of the Principle of Individualization, based on freedom, which has its amplitude as the system adopts relative indeterminacy in the combination of penalties, in the proportion in which it grants the judge a certain margin of performance. However, the reasonableness contained in this indeterminacy is essential to avoid arbitrariness. keywords: Individualization; penalty; judicial circumstances; judicial rationale.

AbstractThe article analyses how the Swiss Confederation regulates its multilingualism and the role the official languages play in the legislative and judicial processes of this country. It is proved here that the legislation in Switzerland is not made in all four official languages, hence it depends on translation. Considering that only German and French text versions of Swiss laws are aligned to each other, the article further examines whether the differences existing between the language versions of these legal texts lead to pragmatic divergences. Against this backdrop, the article considers whether the legal system of the multilingual Switzerland can be called multilingual.

AbstractIn the 20 years that have passed since the Karen Quinlan case exposed a simmering clinical issue to the light of day — more precisely, to the press and to judicial process — a consensus has developed in American law about how end-of-life decisionmaking should occur. To be sure, there are dissenting voices from this consensus, but they are often (though not always) about minor issues. By illustrating how this consensus has evolved, this paper explores how law is made in the American legal system and the roles that different legal and extra-legal institutions play in lawmaking.

Indonesian Criminal Code Bill proposal, suddenly became a hot issue after Indonesia commemorate their 74th Independence Day. The executive and legislative accelerated completion of Indonesian Criminal Code Bill (ICCB) at Fairmont Hotel, Jakarta. Many parties have been urging the government to revise some outdated articles since the penal code was a product of Dutch colonialism in the past. Three crucial topics were discussed and added to the draft regarding blasphemy to president, crimes against morality and decency, as well as specific intent crime. Apparently, some parties were unsatisfied with the draft. Waves of uproar sprang up between mid-September and early October 2019. the demonstrators considered that there are ten controversial articles in the ICCB that have vague enforcement parameters. To reduce the public tension, the government agreed to delay the ICCB ratification that, according to public includes multiple problematic articles. President Joko Widodo stated that more input would be conducted before disseminate the latest ICCB information to public. The postponement would be evoked after the new set of parliaments is inaugurated. Albeit being postponed, Tourism practitioner in Bali experiencing significant loss of tourists visit due to the issues. It is expected in future; the government would involve tourism practitioner in group discussion before setting new regulations that may affect the vital industry of Indonesia.

An attempt is made in this work to reveal the content of the subject of the crime under art. 258¹ of the Criminal code of the Russian Federation “Illegal extraction and circulation of especially valuable wild animals and aquatic biological resources belonging to the species included in the Red Book of the Russian Federation and (or) protected by international treaties of the Russian Federation”. The necessity of division of art. 258¹ of the Criminal code of the Russian Federation into two articles, separately providing for liability for illegal production and trafficking of especially valuable wild animals and illegal extraction of especially valuable aquatic biological resources. The differences in the subject of the crime under art. 256 of the Criminal code of the Russian Federation, from the subject of the crime under art. 258¹ of the Criminal code of the Russian Federation. The necessity of a substantial expansion of the List of especially valuable especially valuable wild animals and aquatic biological resources belonging to the species included in the Red Book of the Russian Federation and (or) protected by international treaties of the Russian Federation for the purposes of articles 2261 and 258¹ of the Criminal code of the Russian Federation due to inclusion in him of all representatives of the Red Book of the Russian Federation.

The New Testament apocryphon Didascalia Domini is one of the least known. Its original was written in Greek, according to François Nau, at the end of the 7th century. Relatively early it was translated into Old Church Slavonic. At present five copies of this translation are known, stretching from the 13th to the 15th century. Three of them belong to the Serbian redaction, one each to the Russian (East Slavic) and to the Middle Bulgarian redaction. According to Michail Nestorovič Speranskij the translation originated in Bulgaria. The Greek copies, the oldest of which stems from the 11th century, have divergent final chapters. Moreover, the Slavic translation has yet another ending not corresponding to any of the Greek texts. The textological analysis of the five Slavic copies makes it possible to get an idea of their mutual relationship. On the basis of the linguistic archaisms of the text one can surmise that the translation has been made in Eastern Bulgaria during the 11th century. At the end of the paper there is a critical edition of the Slavic text.

In this present time, the debate about abortion in Indonesia is increasingly crowded. Abortion is also carried out by women - victims of rape to reduce the burden they suffered. The regulation on abortion in Indonesia has been regulated in the statutory regulations, namely the Criminal Code, especially in Article 346, Article 347, Article 348, and Article 349. In the RKUHP (Draft of Criminal Code), abortion regulation is regulated in two chapters namely, Chapter XIV Article 501 and Chapter XIX Articles 589, 590, 591, 592. In addition, the government has also issued several regulations governing abortion such as Government Regulation No. 61 of 2014 concerning Reproductive Health and also Law No. 36 of 2009 concerning health. However, the various regulations that exist between the Criminal Code, RKUHP, PP and the Act actually contradict to each other. There is no synchronization between the regulations regarding abortion by women rape victims. The KUHP and RKUHP clearly do not allow abortion in Indonesia and do not legalize it without any exception, including abortion carried out by women victims of rape. Whereas in Law Number 36 of 2009 concerning health, abortion can be carried out on an indication of medical emergencies and pregnancy due to rape that causes psychological trauma, so abortionists cannot be prosecuted as criminal.

Kitab Undang-undang Hukum Pidana atau biasa disebut dengan KUHP adalah warisan kolonial Belanda yang diberlakukan di Indonesia melalui asas konkordasi dan disahkan melalui UU Nomor 1 Tahun 1946 serta diberlakukan untuk umum melalui UU Nomor 73 Tahun 1958. Artinya, KUHP yang sedang berlaku bukan terbentuk sesuai dengan karakteristik masyarakat Indonesia meskipun ada penyesuaian, itu dianggap tidak cukup. Karena itu, pembaruan KUHP secara universal juga perlu dilaksanakan agar kontras dengan bangsa Indonesia. Pengajuan permohonan uji materiil terhadap pasal dalam KUHP dengan Nomor Perkara 46/PUU-XIV/2016 merupakan gambaran bahwa pembaruan KUHP juga dikehendaki oleh masyarakat banyak. Artikel ini dibuat bertujuan untuk menggambarkan betapa lapuknya KUHP dan memberikan pengetahuan kepada pihak yang berkepentingan untuk menyegerakan pembaruan. Metode pengumpulan data dalam penelitian ini melalui tiga tahap. Pertama, wawancara dengan ahli yaitu peneliti-peneliti MK RI. Kedua, studi kepustakaan untuk memperkuat jarum analisis betapa urgennya suatu pembaruan. Ketiga, obserasi yang dilakukan selama proses persidangan perkara. Salah satu kewenangan Mahkamah konstitusi adalah menguji Undang-Undang terhadap Undang-undang Dasar. Dalam permohonan tersebut, Pasal 284 ayat (1), (2), (3), (4), (5), Pasal 285, dan Pasal 292 KUHP menggambarkan bahwa betapa pentingnya pembaruan KUHP karena keidaksesuaian ruh yang ada didalamnya. Pasal-pasal tersebut dipandang sudah sangat urgen untuk diubah. Pembaruan KUHP secara universal sangat urgen untuk disegerakan karena ini dapat menjadi faktor kriminogen bagi masyarakat dan dapat mencederai rasa keadilan. Harapannya Mahkamah Konstitusi dapat menjawab kebutuhan masyarakat tentang suatu hukum yang benar-benar hidup dalam masyarakat.The Penal Code or commonly called KUHP is the Dutch colonial legacy that prevailed in Indonesia through the principle of concordance and legalized with The Constitusion No. 1 of 1946 and enacted for the public through The Constitution No. 73 of 1958. Its means, Criminal Code that are applicable not formed by the characteristics of Indonesian society although there was an adjustment, it was not enough. Therefore, the universally Criminal Code reform should be carried out to contrast with the nation of Indonesia. The submission of judicial review of the clause of the Criminal Code with Case No. 46 / PUU-XIV / 2016 is a representation that reformation of Criminal Code is also desired by many people. This report aims to describe how old the Criminal Code is and provide the knowledge to interested parties to hasten the reform.The method of collecting data in this report through three stages. First, interviews with experts that researchers in The Constitutional Court of Indonesia. Second, the study of literature to strengthen a needle analysis of how the urgency of reform. Third, observation that committed during court proceedings.The one of authority of the Constitutional Court is reviewing the Constitution. In the petition, Article 284 paragraph (1), (2), (3), (4), (5), Article 285 and Article 292 illustrates how important reform the Penal Code because there is unsuittable spirit inside. Such articles deemed to have been very urgent to be changed. Reformation Penal Code universally is very urgent to be expedited because this can be a kriminogen factors for society and can injure the sense of justice. Hopefully the Constitutional Court can answer the necessary of community on a law that actually live in the community.

Freedom of political expression has not been fully guaranteed in the Indonesian legal system. One of the most prominent in the legal debate is the matter of treason (makar) charges against political expressions of self-determination. In the case of Papua, many Papuans have been detained, criminalised, and even killed because of their political expression. Interestingly, the Constitutional Court, through its decision Number 7/PUU-XV/2017, provided guidance in its ‘ratio decidendi’ argument, specifically the interpretation of treason phrases in the Criminal Code. Interpretation is given by the Constitutional Court after seeing the reality that law enforcement has been arbitrarily abused by the application of the treason article. This is contrary to the freedom of association, opinion and expression, as guaranteed in the 1945 Constitution of the Republic of Indonesia. This article discusses how the application of the phrase treason in law enforcement, especially in connection with the conviction of many Papuans after the Surabaya anti-racism rallies in September 2019. A number of district court decisions on dozens of convicted Papuans show that the legal system that guarantees freedom of political expression has not changed much and law enforcement in fact emphasises the position of racial discrimination and is far below the standard of human rights law. Abstrak Kebebasan ekspresi politik belum sepenuhnya dijamin dalam sistem hukum Indonesia. Salah satu yang paling mengemuka dalam perdebatan hukum adalah soal tuduhan makar terhadap ekspresi politik menentukan nasib sendiri. Dalam kasus Papua, tidak sedikit jumlah warga Papua yang ditahan, dikriminalkan, hingga tewas terbunuh karena soal ekspresi politiknya. Menariknya, Mahkamah Konstitusi melalui putusannya Nomor 7/PUU-XV/2017 memberikan panduan dalam argumen ratio decidendinya, khusus interpretasi frasa makar dalam Kitab-Undang-Undang Hukum Pidana. Penafsiran diberikan oleh Mahkamah Konstitusi setelah melihat realitas penegakan hukum telah banyak disalahgunakan penerapan pasal makar. Hal demikian bertentangan dengan kebebasan berkumpul, berpendapat dan berekspresi, sebagaimana dijamin dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Artikel ini membahas bagaimana penerapan frasa makar dalam penegakan hukumnya, khususnya berkaitan dengan dipidananya banyak warga Papua setelah aksi anti rasisme Surabaya pada September 2019. Sejumlah putusan pengadilan negeri atas puluhan warga Papua yang dipidana tersebut memperlihatkan sistem hukum yang menjamin kebebasan ekspresi politik tidak banyak berubah dan penegakan hukum justru menegaskan posisi diskriminasi rasial serta jauh dari standar hukum hak asasi manusia.
