In this study, the author considers 3 (three) reasons that are considered important such as philosophical aspects, aspects of criminal law theory, and political aspects of national criminal procedural law after describing 5 (five) previous legal scientific studies related to the implementation of supervisory judges and observers in the criminal justice system. This study aims to reflect on the legal principles of the kimwasmat institution and build models and patterns of implementing the kimwasmat institution. This research intends to answer 2 (two) legal issues: firstly, what are the legal principles contained in Article 280 of the KUHAP. Secondly, what is the model and pattern of implementation of the supervisory and observer judge institutions based on Article 280 of the KUHAP. This legal research uses the socio-legal research method, the materials of which are the results of interviews of judges in deliberate district courts, study of court official documents, relevant laws and regulations to legal issues, legal theory and social science theories. This study found, firstly, the function of kimsmat based on the principle of legal certainty and the principle of benefit which seeks to be married into the principle of certainty which is useful based on Pancasila. Finally, the classical bureaucratic model and the institutional model as well as the aspects of state administration to explain the management and control functions of the authority of the kimwasmat become the basis for the court to carry out criminal objectives.

This study aims to explain the mechanism for electing governors and deputy governors, regents and deputy regents as well as mayors and deputy mayors who are directly elected by the people, through what we are familiar with direct regional head elections and to find out the authority of the general election commission (KPU ) in conducting the procure- ment, distribution and installation of campaign props (APK.) The method used in this research is legal research which is to find the rule of law, legal principles, and legal doc- trines in order to answer the legal issues encountered. AbstractPhishing is an act to commit fraud by tricking the target with the intention of stealing the target's account, by spreading broadcasts which are often carried out through fake emails with fake information that directs the target to a fake page to trap the target so that the perpetrator gets access to the victim's account. Phishing still has some obscurity, especially in the modus operandi of the perpetrator. Therefore, this research aims to analyze and explain the modus operandi of the criminal act of phishing according to the ITE Law. This research is a normative legal research. Because the writing of this research in seeking the truth in order to answer legal issues raised by the author uses secondary data to find legal rules, legal principles, and legal doctrines, and tends to image law as a perspective discipline, which means that only see the law from the point of view of the norms only, which of course is prescriptive. Oleh karena itulah penelitian ini bertujuan untuk menganalisis dan menjelaskan terkait modus operandi Tindak pidana Phising menurut UU ITE. Penelitian ini merupakan penelitian hukum normatif. Karena penelitian ini dalam mencari kebenaran guna menjawab isu hukum yang diangkat penulis menggunakan data sekunder untuk menemukan suatu aturan-aturan hukum, prinsip-prinsip hukum, maupun doktrin-doktrin hukum, dan cenderung mencitrakan hukum sebagai disiplin prespektif, yang berarti hanya melihat hukum dari sudut pandang norma-normanya saja, yang tentunya bersifat preskriptif. Pendekatan ini menggunakan pendekatan undang-undang (statute approach), pendekatan konseptual (conceptual approach) dan pendekatan kasus (case approach). Arrangements regarding legal remedies that can be submitted by investigators against the judge's decision regarding investigative actions in the form of terminating the investigation with the issuance of an Investigation Termination Order (SP3) in pretrial cases. Law No. 8/1981 on the Criminal Procedure Code was not expressly enforced. This article aims to identify legal remedies against pretrial decisions regarding the invalidity of the Termination of Investigation Order (SP3) in the future. This paper is normative legal research, namely the process of finding legal rules, legal principles, and legal doctrines to address legal issues at hand. The result of this study is the arrangements regarding extraordinary legal remedies in the form of a judicial review of criminal decisions that have permanent legal force and are not acquitted or released from all previous legal claims before the entry into force of the Criminal Procedure Code that have been regulated can also be submitted by interested parties. Necessary to reconstruct the regulation of legal remedies against pretrial decisions, especially extraordinary legal remedies in the form of reconsideration, especially by investigators as parties who are very interested in the action.

This article is used to distinguish a deepest understanding between normative and empirical legal research. The jurisprudence is characteristically sui generis or ‘be on one’s own’, it contents norms and its scope, namely legal dogmatic, legal theory, and philosophy of law, is used to solve legal issues or problems.Otherwise the empirical science armed with its methodology,especially in connection with the sociology of law and called with the socio-legal research, describes merely the legal phenomena. Therefore, this article chiefly criticize the failing of the sociology of law to solve legal issues or problems for legal practice or legal scholarship. Artikel ini digunakan untuk membedakan sebuah pemahaman yang mendalam diantara penelitian hukum normatif dan empiris. Ilmu hukum bersifat sui generis atau hanya untuk jenisnya sendiri. Ilmu hukum mengandung  norma  dan  ruang  lingkupnya,  yaitu  dogmatik  hukum,  teori  hukum,  dan  filsafat  hukum, digunakan untuk memecahkan isu atau masalah hukum. Sebaliknya ilmu sosial, terkait dengan sosiologi hukum dan disebut dengan penelitian socio-legalhanya menggambarkan gejala-gejala hukum. Oleh karena itu, secara tegas artikel ini mengkritisi kegagalan sosiologi hukum untuk memecahkan isu atau masalah hukum baik untuk kebutuhan praktik maupun akademisi.

Abstract This study aims to know the design of asymmetric decentralization in the state administration system of the Republic of Indonesia. The research method used in the research is legal research that uses a conceptual approach. The results show that asymmetric decentralization in Indonesia is a historical continuity that has been started from the colonial period and confirmed to date in the 1945 Constitution of the Republic of Indonesia. As a reality of the practice of regional government, the constitutional juridical legitimacy of asymmetric decentralization can be referred to in Article 18A paragraph ( 1), and Article 18B paragraph (1) of the Constitution of the Republic of Indonesia as the supreme law of the land. Asymmetric decentralization concerns fundamental matters related to the pattern of relations between the center and the regions regarding different authority, institutional, financial and control designs. Keywords: Asymmetric Decentralization, State Administration System, Indonesian Government Abstrak Penelitian ini bertujuan utnuk menegtahui desain Desentralisasi Asimetris Dalam Sistem Ketatanegaraan Republik Indonesia. Metode penelitian yang digunakan dalam penelitian adalah penelitian hukung yang menggunakan pendekatan kosnep (conceptual approac). Hasil penelitian menujukan bahwa Desentralisasi asimetris di Indonesia merupakan sebuah keberlanjutan sejarah yang telah dimulai dari masa kolonial dan ditegaskan hingga saat ini dalam UUD NRI Tahun 1945. Sebagai sebuah realitas praktik pemerintahan daerah, legitimasi yuridis konstitusional dari desentralisasi asimetris tersebut dapat dirujuk dalam Pasal 18A ayat (1), dan Pasal 18B ayat (1) Konstitusi Republik Indonesia sebagai hukum tertinggi negara (the supreme law of the land). AbstractThe title of this research is “Elektonic State Administration Dispute Settlement Arrangements” provides an explanation of the legal issues discussed by the author about 1) Comparison of procedural law ini State Administrative Courts which is carried out coventionally and electronically; and 2) Constraints to the application of Electronic Court in the State Administrative Court. Rapid technological advances make it easy for humans in all area, one of which is in the law. Legal breakthroughs carried out by the Supreme Court can be seen in the existence of Electronic Court. The State Administrative Court, which is an institution under the Supreme Court, implements electronic court. The purpose of this legal research is to analyze the relevance of the discretion of government officials during the COVID-19 pandemic with the concepts and legislation related to legal issues; as well as analyzing the existence of a Circular to legitimize the handling of COVID-19 with statutory regulations. This legal research is carried out by making an inventory of various primary and secondary legal materials, so as to obtain relevant and critical studies of the legal issues discussed. The results of this legal research are that the discretion made by government officials can be justified legally if it is relevant to several provisions contained in legislation for the realization of good emergency governance; and the existence of a circular letter is legally valid if it is in accordance with the laws and regulations and the General Principles of Good Governance, by understanding that a circular is not a product of rules that are in the order of national legislation. Thus, a circular does not have strong and binding legal legitimacy. Therefore, the researcher recommends the criteria and classification of the parameters of discretion in the form of a circular as outlined in the form of a Supreme Court Regulation. This should be done so that there is no abuse of authority in implementing discretionary power by government officials and general legal principles.

The discussion in the writing of this thesis is a problem related to forced efforts as regulated in article 116 where in this article forced efforts (Dwangsom) are regulated. The purpose of implementing compulsory measures so that the decisions issued are carried out by those concerned. This study aims to determine the mechanism of forced attempts to officials who do not carry out the TUN Judicial Decision and to find out the obstacles to forced attempts against the TUN Judicial Decision. Normative legal research is used as a research method, which is a stage to find legal regulations, legal principles in order to answer the contents of the law in this thesis with a statutory approach, legal theory and a conceptual approach. Primary and secondary sources of legal materials are then analyzed to obtain conclusions and suggestions. The results showed that the efforts to force the decision, namely Dwangsom and administrative sanctions at the PTUN which had been incracht could not be implemented optimally. The obstacle in forced efforts related to the execution of the PTUN Decision is that there is no special agency tasked with implementing the decision, therefore the government has revised the PTUN Law and provisions relating to Forced Efforts issued by the Supreme Court so that it can be applied by the PTUN judge so that it can be applied and implemented optimally.
