POSSIBILITIES OF USING WORLD EXPERIENCE IN ORGANIZING EXCHANGE TRADING IN AQUATIC BIORESOURCES IN THE RUSSIAN FEDERATION

The subject of this article is the study of world experience in organizing exchange trading in aquatic biological resources and assessing the prospects for creating exchange trading in aquatic biological resources in the Russian Federation. Objectives of the work: study of Russia's plans to organize exchange trade in aquatic biological resources; assessment of the Russian market for trade in aquatic biological resources; analysis of the functioning of international trading exchanges of aquatic biological resources (fish) on the example of the International Wholesale Seafood Market in Busan (South Korea) and the Norwegian Fish Exchange Fish Pool; assessment of prospects and the formation of recommendations for organizing exchange trading in aquatic biological resources (fish) in the Russian Federation. The study used methods of comparison, analogy and scientific generalization. The main result of the study is the conclusion that the creation of a trading platform for organized trading in aquatic biological resources (fish) in Russia is a promising project according to the analysis of the internal and external market for trade in aquatic biological resources (fish) in Russia. At present, this issue is only at the initial stage of study and development. At the same time, the idea of creating an organized market for aquatic biological resources (fish) is actively supported at the state level. The creation of an organized market for aquatic biological resources (fish) in Russia is possible with the use of world experience, subject to significant infrastructural transformations and attracting more players.

An attempt is made in this work to reveal the content of the subject of the crime under art. 258¹ of the Criminal code of the Russian Federation “Illegal extraction and circulation of especially valuable wild animals and aquatic biological resources belonging to the species included in the Red Book of the Russian Federation and (or) protected by international treaties of the Russian Federation”. The necessity of division of art. 258¹ of the Criminal code of the Russian Federation into two articles, separately providing for liability for illegal production and trafficking of especially valuable wild animals and illegal extraction of especially valuable aquatic biological resources. The differences in the subject of the crime under art. 256 of the Criminal code of the Russian Federation, from the subject of the crime under art. 258¹ of the Criminal code of the Russian Federation. The necessity of a substantial expansion of the List of especially valuable especially valuable wild animals and aquatic biological resources belonging to the species included in the Red Book of the Russian Federation and (or) protected by international treaties of the Russian Federation for the purposes of articles 2261 and 258¹ of the Criminal code of the Russian Federation due to inclusion in him of all representatives of the Red Book of the Russian Federation.

The paper is a contribution to the in-depth research on the Russian local selfgovernment. The Author describes the process of formation and constitutional position of local self-government in the Russian Federation. He emphasizes that the process, at its initial stage at present, is related to the ongoing administrative reforms of the country and the creation of a single and effectively enforced nationwide legal area. He indicates the dilemmas both in the area of the material basis of existence of local self-government and its competences. The Author determines stages of self-government formation. Basing on normative solutions, he presents tasks of the Russian local self-government, its structure and authorities. He pays particular attention to the forms of citizens' direct participation in the management of local affairs.

В настоящее время происходит процесс активного реформирования уголовно-исполнительной системы, кроме того, параллельно проводится работа по изменению уголовно-исполнительного законодательства. Количество осужденных, содержащихся в местах лишения свободы, неизменно снижается, причем прослеживается определенная тенденция, когда исправительные учреждения одного вида режима переполнены, другие заполнены не в полном объеме, в связи с чем их количество уменьшается, в частности, на всей территории Российской Федерации имеется только 22 колонии для несовершеннолетних. В уголовно-исполнительном законодательстве РФ содержится норма, предусматривающая отбывание наказания в исправительном учреждении, расположенном в пределах территории субъекта Российской Федерации, в котором осужденный проживал или был осужден. Однако в настоящее время соблюдение данного принципа достаточно проблематично, и выходом из сложившейся ситуации может быть создание комплексных (мультирежимных) исправительных учреждений. Данное положение не противоречит и положениям международных стандартов исполнения наказаний, подобные положения имеются и в Минимальных стандартных правилах в отношении обращения с заключенными 2015 г., и в Европейских пенитенциарных правилах. Все это обосновывает актуальность изучаемой темы. Currently, there is a process of active reform of the penal system, in addition, work is being carried out in parallel to change the penal legislation. The number of convicts held in places of deprivation of liberty is constantly decreasing, and there is a certain trend when correctional institutions of one type of regime are overcrowded, while others are not filled in full, which is why their number is decreasing, in particular, there are only 22 juvenile colonies throughout the Russian Federation. Among the principles of deprivation of liberty, the penal legislation of the Russian Federation singles out the principle of serving a sentence in a correctional institution located within the territory of the subject of the Russian Federation where the convicted person lived or was convicted. However, at present, compliance with this principle is quite problematic, so the solution to this situation may be the creation of complex (multi-mode) correctional institutions. This provision does not contradict the provisions of international standards for the execution of sentences, such provisions are found in the standard Minimum rules for the treatment of prisoners of 2015, and in the European prison rules. All this justifies the relevance of the topic under study.

We investigate the issue of concessionaire rights protection. We analyze the system of grounds for the early agreement termination and compensation provided to the concessionaire, as well as the mechanisms of concession agreement. We identify mandatory and optional terms of concession agreement. We highlight the cases of early termination of concession agreement, in which either the Russian Federation, or the subject of the Russian Federation, or the municipal formation is a concession grantor. We establish that upon termination of the concession agreement, the concessionaire has the right to demand from the concession grantor the reimbursement of expenses incurred by him in the creation and (or) reconstruction of the object (minus the expenses of concession grantor). We consider the cases of contract termination upon mutual agreement of the parties or by decision of the authority if concessionaire’s failure to fulfill its obligations has led to the infliction or threat of harm to people’s lives and health. We determine the procedure for reimbursement of the parties’ expenses in case of early termination of concession agreement. We investigate the protection of rights guarantees of concessionaire, namely, the establishment of the minimum payment in case of early termination of the concession agreement - investment expenses for creation (reconstruction) of the object. We highlight the obstacles for compensation of the concessionaire’s expenses for the project documentation development. We use practice materials as examples. We submit the proposals for amendments to the current legislation of the Russian Federation.

The paper focuses on the definition of the legal status of the cryptocurrency in the framework of the current Russian legislation. The subject of the research is the principal scientific and practical approaches to determining the object of civil rights and the object of acquisitive crimes in terms of their adaptability to cryptocurrencies. The purposes of the work were the search for a universal algorithm for resolving civil disputes related to the turnover of the crypto currency, and the qualification of the virtual currency theft (fraud). By using historical, comparative legal and dialectical methods as well as the content analysis method parallels between cryptocurrencies and individual objects of civil rights (a thing, property rights, other property) were drawn, and a number of options for qualifying the actions related to the non-repayable withdrawal of the cryptocurrency were proposed. Finally, the paper analyzes the draft laws prepared by the RF Ministry of Finance and the Central Bank of the Russian Federation and presents the author’s vision of the prospects for legalizing the cryptocurrency as an object of civil rights.
