Today, Ukraine is in dire need of changes and reforms that would lead to the optimization and effective management of society and the state. One of such important reforms is the transition from state to public management, and further improvement of the foundations and principles of public management. In the management of the state, where complex processes of transition to public management are taking place, there have always been advanced trends of deepening and expanding publicity in the activities of government institutions. This is the path taken by the "old" countries of Western democracy, as well as the countries of the post-socialist camp, the Baltic republics, which today have successfully joined the EU. Ukraine must follow this path if it tries to become a civilized part of the world. Hence, the system of state management should change dramatically, when the most appropriate in the management structure is an organic combination and effective interaction of public government and local self-government. Even more, the efficiency of civil society itself in the management of public affairs and state structures of power is growing. Socio-economic development and social-power relations at the present stage are already experiencing more and more new changes, both positive and negative. They are becoming very important for the state and society. Being complex and ambiguous, such developments and relations require introduction at the legislative and political levels of new governance systems and structures, which would involve mandatory involvement of the most active representatives of civil society in governance. Note that the period of transition to public management is complex, full of various management problems, requires time and competence of politicians, government, NGOs and more. It is evolutionary in nature, when publicity in governance must develop, and representatives of the branches of government will try to solve the problem of governing the state and society competently, transparently, responsibly, flexibly, openly, socially justly, effectively for the benefit of man as the main social capital.

Currently, the special importance of social partnership is acknowledged as an effective mechanism for involving the general public in participation in the socio-political, socio-economic and cultural life of the country in Uzbekistan. In this regard, the President of the Republic of Uzbekistan Sh.Mirziyoyev pointed out the need for consistent implementation: “the principle of mutual responsibility of citizens, the state and society, the connection of their rights and obligations. This principle serves as the basis for effective interaction between the state and the individual, the state and civil society in solving the important tasks facing our country. This article is devoted to the analysis of reforms aimed at the development of social partnership in Uzbekistan.

The authors investigated the features of the legal regulation of the functioning and organizational aspects of the activities of the authorities, the competence of which includes ensuring the security of the court, judges, and other participants of legal proceedings.Particular attention is paid to the intergovernmental body of the Council of Europe - The European Committee on Legal Co-operation (CDCJ), one of the activities of which is to ensure the proper functioning of the judiciary. The features of the general project between the CDCJ and Ukraine “Support for judicial reform in Ukraine (voluntary contribution)” are identified. The features of the activities of sheriffs in Canada and the USA, the regulatory documents of these countries, which determine the status and competence of the sheriffs in the field of judicial protection, are highlighted. The chronology of the establishment in Ukraine of the state system for protecting the court, judges, and other participants of legal proceedings, from 1997 to the present, is investigated. In the course of the study, the authors have been determined the individual stages of the establishment in Ukraine of the state system for protecting the court, judges, and other participants of legal proceedings; the competence of state bodies to ensure judicial protection and the legal basis for their activities, depending on the period of operation. The content of the norms of some regulatory legal acts of Ukrainian legislation, which regulates the activities of the bodies responsible for ensuring the security of the court, judges, and other participants of legal proceedings, is disclosed. The scheme of “gap” while elemental situational analysis of safety of participants in legal proceedings is examined. A matrix for ranking the factors of complex security of participants of judicial system and recommendations on development of public management in the area of legal and judicial security.

Once universal adult citizenship rights have been secured in a society, democratization is mostly a matter of the more authentic political inclusion of different groups and categories, for which formal political equality can hide continued exclusion or oppression. It is important, however, to distinguish between inclusion in the state and inclusion in the polity more generally. Democratic theorists who advocate a strategy of progressive inclusion of as many groups as possible in the state fail to recognize that the conditions for authentic as opposed to symbolic inclusion are quite demanding. History shows that benign inclusion in the state is possible only when (a) a group's defining concern can be assimilated to an established or emerging state imperative, and (b) civil society is not unduly depleted by the group's entry into the state. Absent such conditions, oppositional civil society may be a better focus for democratization than is the state. A flourishing oppositional sphere, and therefore the conditions for democratization itself, may actually be facilitated by a passively exclusive state, the main contemporary form of which is corporatism. Benign inclusion in the state can sometimes occur, but any such move should also produce exclusions that both facilitate future democratization and guard against any reversal of democratic commitment in state and society. These considerations have substantial implications for the strategic choices of social movements.

ResumoDiscute-se como vem sendo elaborada uma nova estratégia de planejamento no Estado da Paraíba, envolvendo a participação da sociedade civil. Aponta-se como objetivo: verificar qual a estratégia de gestão que se desenvolve na Paraíba e quais os princípios que norteiam o Orçamento Democrático Estadual? Desenvolve-se como aporte teórico as teorias sobre a democracia defendida por Avritzer, sobre participação, descentralização e sociedade civil em Dagnino e Jacobi, bem como as teorias da administração de Trigueiro, Costin, e Kanaane. O estudo realizado permitiu compreender que o Planejamento Estratégico elaborado pelo Governo do Estado da Paraíba, modifica a visão tradicional da administração pública, ao incentivar e criar um instrumento de participação da sociedade na discussão das leis orçamentárias. Por fim, através do caso referenciado, vislumbra-se como a democracia participativa enquanto instituição política pode interferir na vida do Estado, mudando sua organização e seu modo de agir em relação aos cidadãos e cidadãs. Palavras-chave:Orçamento Democrático Estadual–PB. The objective is to verify what has been the management strategy developed in Paraiba and the principles that rule democratic provincial budget. As a theoretical contribution, Avritzer’s theory of democracy, Dagnino’s and Jacobi’s theory of participation, decentralization and civil society, and Tariq’s, Costin’s and Kanaane’s theory of administration are developed.The study allowed us to understand that the strategic plan prepared by the Government of State of Pariba changes the traditional point of view of public administration, to foment and create a participation tool society in the discussion of budget law. Se desarrolla como aporte teórico las teorías  de Avritzer sobre la democracia,  de Dagnino y Jacobi sobre la participación, descentralización y sociedad civil y de Tariq, Costin y Kanaane, sobre la administración.El estudio permitió entender que el plan estratégico elaborado por el Gobierno del Estado de Paraiba, cambia el punto de vista tradicional de la administración pública, para fomentar y crear una sociedad con la herramienta de la participación en la discusión de la ley de presupuestos. Пандемия подстегнула развитие рынка розничной электронной коммерции в Казахстане. По данным исследования PwC Kazakhstan, за год этот сегмент вырос на 93%. Целью исследования является оценка государственного управления развития электронной коммерции в Республике Казахстан. Развитие электронной коммерции вызывает неизбежные структурные изменения в экономике. Сложность регулирования цифровой среды заключается, главным образом, в ее нестатичности, постоянном развитии и изменении. Впервые объектом регулирования становятся правоотношения, связанные с реализацией прав в цифровом пространстве, использованием цифровых данных и технологий. По мнению многих юристов, изучающих эту сферу, должны, соответственно, обновляться и методы правового регулирования. Научная значимость исследования обоснована анализом развития рынка электронной коммерции в РК. Практическая значимость исследования обоснована возможностью использования материалов исследования оценке государственного управления электронной коммерцией в РК. Исследование осуществлялось в рамках доступной информации международных, государственных и общественных организаций, а также научно-практических публикаций в ведущих изданиях периодической печати и интернете. Исследование проводилось с использованием аналитических, сравнительных и оценочных методов, на основе статистических данных, по которым были сделаны следующиевыводы и предложены рекомендации: развитие логистических центров и сортировочных центров; назначение налоговых преференций и введение моратория на налоги для интернет-компаний; интеграция процессов БВУ в межбанковскую систему платежных карт; снижение комиссий по имуществу, подлежащему использованию физическими лицами. The aim of the study is to assess the state administration of e-commerce development in the Republic of Kazakhstan. The development of e-commerce is causing inevitable structural changes in the economy. The complexity of regulating the digital environment lies mainly in its instability, constant development and change. For the first time, legal relations related to the exercise of rights in the digital space, the use of digital data and technologies are becoming the subject of regulation. In the opinion of many lawyers studying this area, the methods of legal regulation should be updated accordingly. The scientific significance of the study is substantiated by an analysis of the development of the e-commerce market in the Republic of Kazakhstan. The practical significance of the research is substantiated by the possibility of using research materials to assess the state management of e-commerce in the Republic of Kazakhstan. The study was carried out within the framework of available information from international, state and public organizations, as well as scientific and practical publications in leading periodicals and the Internet. The research was carried out using analytical, comparative and evaluative methods, based on statistical data, on which appropriate conclusions were made and recommendations were made.

"Electronic government" is a system for organizing and developing a system of effective interaction between the state and civil society, openness of the activities of state bodies, increasing their responsibility in the information space. The article analyzes the experience of creation and stages of development of the "Electronic government" system in Uzbekistan and the Republic of Korea. It was found that the implementation of the concept of "electronic government" is closely related to the reform of public administration and includes a number of integral aspects.

The article presents the historical development of arbitration law and international commercial arbitration. Arbitration, as one of the oldest institutes of alternative litigation, has repeatedly undergone fundamental changes regarding the procedure for its appointment, forms of exercise and the very subjects of litigation. The study of the periods of historical and legal formation of arbitration and arbitration courts in the territory of modern Ukraine made it possible to identify the basic prerequisites for the creation of such institutions, to determine the role of the state and the degree of participation of civil society in this long process. The peculiarities of expert support at each of the periods of historical and legal formation of arbitration and arbitration courts in the territory of modern Ukraine are indicated. The formation of arbitral tribunals, as a form of resolution of legal conflicts, to some extent prevented the strengthening of centralized power, in particular the judiciary, the state could not coexist with a strong private jurisdiction that competed with the state judicial system. The establishment of arbitral tribunals in the territory of modern Ukraine, as a modern toolkit for the implementation of alternative forms of justice, is a consequence of the long historical and legal development of the state and society, which was in some way influenced by a set of factors such as: the over-formalization of the judiciary (which often prevented the imposition of ); Western democracy (which accelerated the government's desire to reform and legislate democratic foundations); and certainly the ongoing development of civil society. With the adoption of the Law of Ukraine “On Arbitration Courts” by the Verkhovna Rada of Ukraine on May 11, 2004, for the purpose of the correct resolution of the dispute, the procedure for conducting expert examination was clarified for the first time to clarify issues requiring the use of special knowledge by an arbitral tribunal as an institution, as an appropriate non-state independent body. . The use of alternative ways of resolving disputes is increasingly controversial in modern legal science. However, Ukraine's legal field allows alternative institutions to operate in accordance with international standards. The approaches to proving and assigning expertise in international arbitration practice vary, depending on the legal culture.
