Professional Society Codes of Conduct: Their Use & Misuse – An Ethical Problem Upon Which the Integrity of Science Rests

<p>The scientific community has a long history of self-regulation, with accepted public standards regarding the ethical conduct of research, treatment of human subjects and plagiarism. Violations of these widely accepted standards have been investigated and enforced via universities, funding agencies and publishers using their employment, financial and copyright relationships with members of the scientific community. Some modicum of fairness protecting both sides of the relationship arises from an open process, the ability of either party to seek other partners for their work and public shaming of miscarriages of justice committed by either side. By focusing directly on scientific work and the evidence used to support it where scientific expertise is relevant; these standards have worked reasonably well in keeping science honest without silencing scholars whose work is not currently accepted by the mainstream. Such science is by definition self-correcting and warrants public faith in the integrity of its findings.</p><p>Recently, these standards have been expanded into broad Codes of Conduct including regulation of behavior normally reserved for national legal systems built on clearly defined constitutional due process rights, which professional societies lack the jurisdiction, expertise, resources and will to protect. While lacking legal authority, the shadow tribunals these codes create have significant ability to impact the careers of those accused of transgressing their dictates. Such extra-legal bodies, often staffed by non-scientists serving as investigator, prosecutor, judge and jury, undermine academic freedom and the expression of diverse ideas required for a healthy, inclusive scientific community. Instead of being judged on their research, scientists now risk being bullied out of the field on the basis of social considerations reflecting the opinion of unelected code compliance officers acting to fulfill the agenda of professional society leaders rather than those officials elected to enforce national laws. These behavioral tribunals are the anti-thesis of scientific practice and threaten to undermine public faith in the integrity of science.</p><p>This presentation examines several cases from the recent scientific literature. The merits of each case are evaluated using the professional society code of conduct applied to the scientists in question, with outcomes for the parties involved and wider implications of the case discussed. The results suggest that professional society codes of conduct remain capable of assessing the merits of scientific research though social pressure to favor particular demographic groups is undermining the process. The same analysis indicates that professional societies are not competent in assessing behavior via their codes of conduct due to fundamentally flawed investigatory mechanisms and lack of due process protections. Strong biases in society leadership allows misuse of codes of conduct to unlawfully impose a policy agenda on the community, despite evidence that such policy is at odds with, and harmful to, scientific practice. Public belief in the integrity of science will erode if the scientific community fails to disavow and halt the misuse of professional society codes of conduct to regulate behavior in a fashion that no national legal system would condone.</p>

Abstract Background Professional communities such as the medical community are acutely concerned with negligence: the category of misconduct where a professional does not live up to the standards expected of a professional of similar qualifications. Since science is currently strengthening its structures of self-regulation in parallel to the professions, this raises the question to what extent the scientific community is concerned with negligence, and if not, whether it should be. By means of comparative analysis of medical and scientific codes of conduct, we aim to highlight the role (or lack thereof) of negligence provisions in codes of conduct for scientists, and to discuss the normative consequences for future codes of conduct. Methods We collected scientific and medical codes of conduct in a selection of OECD countries, and submitted each code of conduct to comparative textual analysis. Results Negligence is invariably listed as an infraction of the norms of integrity in medical codes of conduct, but only rarely so in the scientific codes. When the latter list negligence, they typically do not provide any detail on the meaning of ‘negligence’. Discussion Unlike codes of conduct for professionals, current codes of conduct for scientists are largely silent on the issue of negligence, or explicitly exclude negligence as a type of misconduct. In the few cases where negligence is stipulated to constitute misconduct, no responsibilities are identified that would help prevent negligence. While we caution against unreasonable negligence provisions as well as disproportionate sanctioning systems, we do argue that negligence provisions are crucial for justified trust in the scientific community, and hence that there is a very strong rationale for including negligence provisions in codes of conduct.

AbstractMicroplastics are contaminants of emerging concern but there is currently a lack of evidence on actual risks relating to them, despite claims in media and scientific articles. Research on people’s perceptions on microplastics is in its infancy. Here we present part of a larger survey about people’s perceptions of issues with microplastics. Our analysis of 1681 responses across the globe to an online questionnaire demonstrates a certain level of uncertainty, not only in lay people but also respondents who study/work on the topic of plastics and microplastics as a pollutant. This uncertainty ranges from level of concern about microplastics as an environmental issue to existing evidence for effects. Further, there is some discrepancy between risk perception and state of the research. Some of this may be driven by scientific work with some serious limitations in reporting and methods. This highlights the need for fact-checking of circulating information about microplastics, but also for addressing the discordance between ecotoxicological risk and how risk is framed within the scientific community.

AbstractThe data produced by the scientific community impacts on academia, clinicians, and the general public; therefore, the scientific community and other regulatory bodies have been focussing on ethical codes of conduct. Despite the measures taken by several research councils, unethical research, publishing and/or reviewing behaviours still take place. This exploratory study considers some of the current unethical practices and the reasons behind them and explores the ways to discourage these within research and other professional disciplinary bodies. These interviews/discussions with PhD students, technicians, and academics/principal investigators (PIs) (N=110) were conducted mostly in European higher education institutions including UK, Italy, Ireland, Portugal, Czech Republic and Netherlands.Through collegiate discussions, sharing experiences and by examining previously published/reported information, authors have identified several less reported behaviours. Some of these practices are mainly influenced either by the undue institutional expectations of research esteem or by changes in the journal review process. These malpractices can be divided in two categories relating to (a) methodological malpractices including data management, and (b) those that contravene publishing ethics. The former is mostly related to “committed bias”, by which the author selectively uses the data to suit their own hypothesis, methodological malpractice relates to selection of out-dated protocols that are not suited to the intended work. Although these are usually unintentional, incidences of intentional manipulations have been reported to authors of this study. For example, carrying out investigations without positive (or negative) controls; but including these from a previous study. Other methodological malpractices include unfair repetitions to gain statistical significance, or retrospective ethical approvals. In contrast, the publication related malpractices such as authorship malpractices, ethical clearance irregularities have also been reported. The findings also suggest a globalised approach with clear punitive measures for offenders is needed to tackle this problem.

The existence of codes of conduct in communication field is still interesting to be discussed. Not many practioners and people consider to this conduct while they were doing their jobs. They have major problems in dealing with ethics issues, especially when communicationg in the publics arena. Communications freedom and communications technology are accussed as caustive prima of communications ethics problems. To solve the problem, this article proposes self regulations to control our communication behaviour .

В статье излагается содержание двух базовых концепций неклассической философии и методологии науки: конвенционалистской и консенсуалистской теории природы научного знания и научной истины. Каждая из них является альтернативой двум основным парадигмам классической философии и методологии науки: эмпиризму (позитивизму) и рационализму. С точки зрения конвенционализма научное знание не есть ни описание чистого опыта, ни его обобщение. Но оно не является также и результатом некой априорной интуиции и чистого разума. Согласно конвенционализму научное знание - это система доказательной информации, исходные принципы которой имеют характер условных, конвенциональных истин. Отсюда следует, что любая истина в науке не категорична, а условна и имеет форму «если, то». Консенсуалистская концепция природы научного знания возникла в философии науки второй половины XX в. Она была, с одной стороны, обобщением конвенционализма, а с другой - его отрицанием. Если в конвенционализме основным субъектом научного познания является отдельный ученый, то в консенсуалистской эпистемологии таким субъектом является социальный субъект - научное сообщество. Научное познание имеет принципиально коллективный характер как в плане его получения в силу разделения научного труда, так и в плане его легитимации и оценки. Последние операции всегда являются результатом консенсуса научного сообщества. The article examines the content of two basic conceptions of non-classical philosophy and methodology of science: the conventionalist and consensual theory of the nature of scientific knowledge. Each of them is an alternative to the two main paradigms of classical philosophy and the methodology of science: empiricism (positivism) and rationalism. From the point of view of conventionalism, scientific knowledge is neither a description of pure experience nor a generalization of it. But it is also not the result of some a priori intuition and pure reason. According to conventionalism, scientific knowledge is a system of evidence-based information, the initial principles of which have the character of conditional, conventional truths. It follows that any truth in science is not categorical, but conditional and has the form «if, then». The consensual concept of the nature of scientific knowledge emerged in the philosophy of science of the second half of the twentieth century. It was, on the one hand, a generalization of conventionalism; on the other, a negation of it. If in conventionalism the main subject of scientific knowledge is an individual scientist, then in consensual epistemology such a subject is a social subject - the scientific community. Scientific knowledge has a fundamentally collective character, both in terms of its acquisition by virtue of the division of scientific work, and in terms of its legitimization and evaluation. The latest operations are always the result of a consensus of the scientific community.

The notion of professionalism within journalism is widespread and has been thoroughly explored. “Professionalism” refers to a normative value system utilized by professionals in relation to their clients, work practices, and occupational socialization. The perspective implies a number of characteristics distinguishing professions from occupations: autonomy, exclusive knowledge, ethical codes of conduct, occupational ideals/culture, and altruistic features (i.e., to act in the public interest). Jointly, these values function as a framework for journalists in everyday practice, guiding and controlling them. In a Western context, this framework legitimizes the social contract that allows journalism the privilege of autonomy and self-regulation on a structural level. The professionalism of journalists has been empirically studied since the 1950s, and the field is constantly expanding. Similar popular conceptualizations when interrogating the norms, practice, and ideals of journalists include, for instance, “role,” “habitus,” “interpretive community,” “ideology,” and “culture.” However, the major body of journalism studies has tried to capture those aspects from a perspective of professional theory. Today, the professional status of journalists is challenged and questioned. Exclusivity is broken, autonomy declines, and other actors are increasingly redefining the field. In this context, new methods and ideals arise. The professional discourse of journalists evolves and adapts in new ways, as does the research in this area.

This article analyses how and with what consequences body–mind relations (the sphere of the psychosomatic) are being modelled in the 21st century through considering the interdiscipline of neuropsychoanalysis. The promise of the term psychosomatic lies in its efforts to rework standard, bifurcated models of mind and body: somatic acts are simultaneously psychic acts. But neuropsychoanalysis, as it brings the neurosciences and psychoanalysis together to model an embodied ‘MindBrain’, ends up evacuating another potent characteristic found in much of the psychosomatic tradition—its refusal to adjudicate, a priori, what counts as the adaptive or well-regulated subject. The psychosomatic problem in psychoanalysis profoundly disturbs everyday models of functionality, adaptation and agency, by positing the psyche as an ‘other’ of the physiological within the physiological. By contrast, neuropsychoanalysis ends up parsing too easily the healthy from the pathological body, such that it is only the latter that is subject to forces that work against self-preservation and self-regulation. In so doing, neuropsychoanalysis recasts the radical problematic that the psychosomatic installed for psychoanalysis in the direction of a corrective biology. This corrective biology is given form in two ways: (1) through translating the Freudian drive—that unruly and foundational concept which addresses the difficult articulation of soma and psyche—into a series of Basic Emotion Systems modelled by the affective neuroscientist Jaak Panksepp and (2) through resituating and quarantining the troubling, non-adaptive aspects of the Freudian psyche within the domain of addiction. That easy separation between the healthy and the pathological is all too often found in current descriptions of healthcare and patient encounters. The article refuses it and calls for the revivification of other ways of thinking about how human subjects—psychosomatic organisms—find ways to live, and to die.

Environmental practices are often considered external to the business, and the impacts of self-regulation and other CSR company practices on environmental practices are important but not fully understood—especially in transitional and developing countries. The aim of this paper is to explore factors that influence the environmental practices of companies operating in Serbia. We observed four types of self-regulations (core values, codes of conduct, ISO 9001, and ISO 14001); the level of CSR practices in relationships with employees, customers, the local community, and society, and related to business transparency; as well as company features related to types of operations (manufacturing vs. service), size, and internationalization (multinational ownership and export activities). Based on the SEM analysis of data collected from 178 companies operating in Serbia, the findings showed that smaller, manufacturing companies that applied the observed types of self-regulations, which have a higher level of employee relations and are more social and community involved, are more likely to have higher levels of environmental practice. Among the observed self-regulation types, only ISO 14001 certification proved to have an individual effect on company environmental practices. However, our results also showed that the influence of core values, applied codes of conduct, and ISO 9001 certification cannot be neglected.
