Policy regulations are not a new phenomenon in governance in Indonesia. Policy regulations arise as a result of the growing needs of the community, which requires the government to take quick legal action, even overriding the principle of legality or what is also known as wetmatigheid van bestuur. Because the authorities have extraordinary powers, administrative law functions to provide legal protection for the people against the actions of the authorities by bringing a lawsuit to the court. Legal protection for the people from government legal action is a juridical means in a rule of law to prevent or restore losses suffered by the people as a result of government legal actions that cause losses to the people.

The reforms that have occurred in Indonesia have changed the joints of the life of the nation and state. One of them is changing the centralistic system of government. The demand for reforms related to the broadest possible implementation of regional autonomy is the beginning of the implementation of the decentralization principle in Indonesia. This principle can be reflected in the presence of the Special Autonomy policy, one of which is in Papua Province. This research uses a normative legal research method with a statutory approach. The results of this research show that the stipulation of special autonomy status for Papua Province is legally based on Law Number 21 of 2001 concerning Special Autonomy for Papua Province. This law is an attempt by the central government to develop Papua to be the same as other regions. There are many specializations and special rights that the Papuan people have obtained through the determination of this status, but they are still not being implemented in real terms in the field. This is due to government inconsistencies, especially when viewed from a good governance perspective. Good governance in the principle of participation in Papua has not been implemented properly because of the existence of considerable power as a cultural representation which has not fully represented the Papuan people so that many rights and opinions and voices of the Papuan people have not been implemented.

The relationship between fishermen and fisheries (sea) is very close, the dependence of fishermen on fish as a source of livelihood makes fish the main sector in coastal areas. Fish resources can be utilized for the greatest prosperity and welfare of the people, however the utilization of these fish resources must be carried out in a sustainable and responsible manner. This means that the utilization of fish resources must be carried out in a balanced manner and taking into account their carrying capacity and the ability of the resources to recover. During the current Covid 19 pandemic, fishermen's “fishing” activities in the Serang District of Banten Province have been disrupted, due to limited supply of fuel due to the PSBB (Large-Scale Social Restrictions), the catch is not selling well in the market or the reduced end (consumers) to the fish market . Indonesia since 2016 has had Law Number 7 of 2016 concerning the Protection and Empowerment of Fishermen, Fish Farmers and Salt Farmers, however the implementing regulations have not yet existed, so it is difficult to implement, moreover this regulation is urgently needed during a pandemic civid 19 this time. This writing is the result of an independent internal research that has been completed using legal (juridical) normative and empirical research methods (as supporting data and research arguments) carried out in the coastal area of Serang Regency.
