AbstractThis chapter presents the process of the formulation of the circular migration approach at the European level. It examines the genesis of the circular migration concept in the EU’s migration policy by discussing the main policy developments and legal acts adopted since the Tampere programme as well as by analysing the interviews concluded with EU and international actors that have had a bearing on the topic. In doing so it outlines the formulation of a two-fold approach towards the facilitation of circular migration at the EU level, incorporating legal migration directives and policy initiatives developed under the auspices of the Global Approach to Migration and Development (GAMM).

This article critically discusses the role and place of migrants’ rights in the EU’s evolving migration and development policy under the Global Approach to Migration and Mobility (GAMM) pursued by the EU.1 The GAMM, which aims to govern migration flows from outside of the EU more effectively, incorporates the field of migration and development as one of four pillars. Only in November of 2011, however, the human rights of migrants were explicitly acknowledged as a cross-cutting theme within the GAMM, which before paid little attention – not to say neglected – the protection of such rights. This contribution analyses how the linkage between migration and development evolved on the international and European level, highlights the EU’s interests in such a policy, and explains the pitfalls of disregarding the protection of migrants’ rights in this context. The article argues that the ‘development burden’ should not be placed on immigrant populations without guaranteeing their secure legal status in the host countries.

Abstract Third countries are actors in EU external migration policy, not merely passive recipients of policy proposals. In order to understand policy outcomes, it is necessary to understand why third countries decide to participate (or not) in EU migration policy initiatives. The conditionality model provides an explanation which focuses on the domestic preferences of and processes in the third countries. In 2007, the EU introduced the Mobility Partnerships. These partnerships are intended to be the framework for migration relations between the EU and third countries in Eastern Europe and Africa. The Cape Verdean government decided to sign a Mobility Partnership because the benefits of this cooperation with the EU outweighed the costs. The Senegalese government refused to sign because the Mobility Partnership would have implied significant, unacceptable costs.

The paper aims to verify the reproduction of ‘modern coloniality’ through externalising the European borders in Tunisia, Morocco and Algeria, focusing particularly on its discursive and practical articulations. Crossing Critical Border Studies’ approaches and an analytical view on the policies and agreements supporting the externalisation politics, we have tried to trace the evolution of the external dimension of E.U. migration policy from the perspective of both the countries of the Francophone Maghreb and of the member states of the European Union. The results show that beyond the rhetoric of the global approach to externalisation of borders adopted by the EU, Maghrebian states have implemented forms of resistance and accomplishment to make their global political agenda prevail over E.U. attempts to manage the Mediterranean governance migration.

Several stages can be distinguished in the EU migration policy. Member States within the European Communities have adopted internal regulations on economic migrants. Since the 1980s, the process of regulating the migration problem by the countries of the European Community has begun. The most important activities are TREVI agreement, Schengen, the TAMPERE Program, the Hague Program, FRONTEX, EURODAC, the Integrated Border Management Fund and the European Return Fund. The European Union has demonstrated a global approach to migration. The migration crisis has influenced the emergence of a new immigrant integration policy in Germany, France and the Netherlands. Contracts have been created for immigrants, which force them to learn a language, take up jobs and adhere to the principles of European values and culture.

AbstractQuite a few recent ECJ judgments touch on various elements of territorial rule. Thereby, they raise the profile of the main question this Article asks: Which territorial claims does the EU make? To provide an answer, the present Article discusses and categorizes the individual elements of territoriality in the EU’s architecture. The influence of EU law on national territorial rule on the one hand and the emergence of territorial governance elements at the European level on the other provide the main pillars of the inquiry. Once combined, these features not only help to improve our understanding of the EU’s distinctly supranational conception of territoriality. What is more, the discussion raises several important legitimacy questions. As a consequence, the Article calls for the development of a theoretical model to evaluate and justify territoriality in a political community beyond the state.

The European Union (EU)–Turkey deal consolidated a shift in the EU’s migration policy. The deal is the culmination of the dominance of the security frame and depicts the continuous externalization of the EU’s responsibility of asylum protection and burden sharing. The strengthening of the security frame has weakened the humanitarian norms that previously dictated EU’s behaviour. This has led to the EU losing some of its comparative advantages in negotiations. Simultaneously, the instrumentalization of the value of asylum, paired with an increased number of asylum seekers, has given negotiation leverage to the neighbouring countries turned service providers. These changes in perception and norms have created a power shift, at the disadvantage of the EU, creating a more leveled playing field for negotiations between the parties. This article tracks the historical shifts in the global refugee regime to explain how today’s situation was created. Hereby, the existence of two competing cognitive frames—humanitarian and security—is assumed, tracked and analysed. While looking at the EU–Turkey deal, the article shows that the EU has started treating refugees as a security problem rather than a humanitarian issue, breaking the normative fabric of the refugee regime in the process. The article also displays how Turkey was able to capitalise on this new reality and engage with negotiations of other neighbouring countries of EU that point towards a change of dynamics in the global refugee regime.

AbstractThis chapter brings together the EU and national instruments conducive to circular migration developed in Bulgaria and Poland and assesses their implementation against the backdrop of the study’s benchmarks concerning entry and re-entry conditions for migrant workers. In order to do that, the chapter first presents the national general admission frameworks and the specific instruments identified as favourable to circular migration; as a second step, it focuses on the implementation of EU instruments in the national laws of Bulgaria and Poland. This analysis is complemented by insights into the implementation dynamics of the EU and national instruments on the basis of data collected through focus groups with migrants from Ukraine and Russia as well as interviews conducted with stakeholders and data on permits retrieved from the national administrations of both countries. The chapter ends with an assessment of whether the instruments developed provide options for facilitated entry for migrants from the Eastern partnership countries and Russia, as well as for circulation-friendly policies – for instance, the possibility to grant priority to seasonal workers who have been employed in the territory of a Member State for a significant period over other workers who seek admission to that State.

The role of museums in society has expanded significantly in the last decades: from temples of knowledge to forums for debate and discussion, from repositories of objects to people-centred institutions with social responsibilities and functions. This shift reflects an ongoing trend to democratise museums and make them more accessible to wider audiences and responsive to the public’s changing needs, in particular the interests of local communities, whose composition has changed in recent years to include migrants and people of different ethnic backgrounds. With annual migration flows to the EU as a whole projected to increase from about 1 043 000 people in 2010 to 1 332 500 by 2020, the question of how cultural institutions can contribute to effective integration and dialogue has become more relevant than ever. Funders and society at large expect museums to play their part in facilitating the integration and peaceful coexistence of newcomers, with financial resources being made available, also at the EU level, to support them in this effort. Many questions can be raised as to whether it is right and appropriate to charge museums with these responsibilities and whether this would push the boundaries of their work too far and give the social function an exceedingly prominent role over the traditional conservation and educational tasks museums already fulfil. But this discussion seems to be already obsolete in the light of the growing body of evidence on good practices available at the European level. This essay aims to illustrate some of them, as well as to discuss some underpinning theoretical issues and methodological approaches.

In the discussion on the EU migration policy, it is impossible to evade the issue of the relation between this policy and the EU foreign policy, including EU common foreign and security policy. The subject of this study are selected links between migration issues and the CFSP of the European Union. The presented considerations aim to determine at what levels and in what ways the EU’s migration policy is taken into account in the space of the CFSP as a diplomatic and political (and subject to specific rules and procedures) substrate of the EU’s external action.
