AbstractFor almost fourteen centuries, Muslim men and women believed, or have been led to believe, that beating wives is a permitted act in Islam and the Quran has been used to support this physical violence against women. Permissible violence against women has mainly been justified on the basis of the Quranic verse 4:34. Since its revelation, there has been a long time challenge to explore the real meaning of the verse. The translations and interpretations of this verse have caused much consternation among scholars, including this author. However, important attempts have recently been made to define or interpret the verse. In this study, two different strands of interpretation are explored: patriarchal and egalitarian. While there are many interpretations of the verse, this study focuses only on the works of some of the most renowned scholars and theologians. A critical analysis of different approaches to the interpretation of this verse shows that the contradictions and complexities related to the verse are not inherent in the Quran itself but are rooted in the intentional or unintentional neglect and misuse of the text by authoritative Muslim scholars. This study argues for a more progressive approach to interpreting the verse which is compatible with a holistic comprehension of the text and teaching of Islam.

This paper uses data from a community cross-sectional survey to examine the factors that are associated with justification of physical violence against women. Results indicate that respondents who were married at the time of the survey were less likely (OR = 0.29; CI = 0.17–0.52) to agree that it is justified for a man to physically assault his partner that their counterparts who were single. The likelihood to justify physical violence was less likely to happen among respondents with primary education (OR = 0.49; CI = 0.39–0.62), secondary education (OR = 0.40; CI = 0.31–0.53) and vocation or tertiary education (OR = 0.28; CI = 0.19–0.41) than among respondents with no education. Protestants were less likely (OR = 0.77; CI = 0.64–0.94) to justify physical violence than the Catholics. Respondents who were not formally employed were more likely (OR = 1.66; CI = 1.32–2.08) to justify physical violence than their counterparts who were in formal employment in the last three months preceding the survey. Respondents who agreed that it is okay for a man to control his partner’s movements (OR = 1.27; CI = 1.04–1.55), it is okay for a man to have sex with his wife anytime (OR = 2.28; CI = 1.87–2.78), alcohol is the main reason for violence against women (OR = 1.67; CI = 1.33–2.10), men need sex more than women (OR = 1.57; CI = 1.23–1.99) and women know where to obtain support in case of violence (OR = 1.42; CI = 1.00–2.02) were more likely to justify physical violence than respondents who disagreed. The likelihood to justify physical violence was less among respondents who agreed that: violence is not the only way to deal with disagreements (OR = 0.54; CI = 0.33–0.86), it is possible for men to stop violence (OR = 0.62; CI = 0.47–0.82) and it is acceptable for a woman to ask her partner to use a condom (OR = 0.61; CI = 0.51–0.73) than their counterparts who disagreed. There is need to increase investment in social norms change programmes in order to strengthen contestation of tolerance of physical violence among men and women in Uganda.

The ongoing raise of violence against women shows that the issue refers to the problem of gender in its various dimensions. This is due to beliefs that the differences between men and women are laws of nature- have long been socially propagated. Aside from that, a strong culture of patriarchy has also been put women on powerless positions, as reflected in the handling of violence's cases through legal processes. This article is intended to analyse the problem through three major aspects. pirst, the law has a strong bias towards women as victims, in particular men as perpetrators of detrimental acts towards women. Second, bias in legal procedures which should be administered in the whole processes of litigation which occurs in a lot of violence's cases. Third, the attitude of law enforcements which stand opposed women both as the real victims and culturally as the subordinated classes.The article has showed that the performance of law-enforcement officials in dealing with violence against women has remained remarkably low.The main cause of such violence, may be due to the classic gender bias in the perspective of our legal system which has been reflected in the forms of the patriarchal order of society.

Honor is an important concept that has a vital value in Turkey and affects many women’s lives and even causes death. It is of utmost importance to know and scientifically demonstrate the value judgments of the academics that lead and pioneer the society in our country where honor culture is adopted. Therefore, in Turkey, where thousands of women are exposed to violence every year, 877 academics participated in this descriptive study to determine the attitudes of academics toward violence against women in the name of honor. The data were collected using “The Scale for Attitudes Towards Violence Against Women in the Name of Honor (SAVWNH)” in the form of electronic questionnaires through email addresses of the academics working at different faculties of the university in the official website of the university in September 1 to October 1, 2015. In our study, academics’ “attitudes towards violence against women in the name of honor” were found low. That is, academics had negative attitudes toward the verbal or physical violence against women in the name of honor and opposed to the punishment of women for this reason. Nevertheless, the attitudes of those who were males; those who were not professors, associate professors, and assistant professors; those who were single; those who had lived in the district/village for a long time; those who had arranged marriages; those who used any kind of violence; and those who considered violence as a solution were found somewhat more conventional. These results showed that, for some academics, the traditional beliefs of the Turkish patriarchal society continued to be valid although they were included in university academic cultures. In fact, it is revealed here that social values, traditions, and customs are very effective and important on the formation of personality in socialization process.

Women are exposed to many types of violence such as physical, economic and psychological violence all over the world. The women in Turkey also take their shares from this exposure and this problem is extremely painful, threatening and unpreventable. The topic of violence against women is included in literature as the research subject of many disciplines recent years however it is considered as violation of fundamental human rights that manintains its importance but cannot be prevented easily. It is tried to focus on, explain and evaluate the violence against women and femicides, unequal power relations between men and women, status of women in society and the interaction with patriarchal structure in Turkey in this study. This explanation and evaluation is made according to the statistics of gender mainstreaming, violence against women and femicides in Turkey and the reasons of violence against women and femicides. According to this evaluation, the women in Turkey generally exposed to violence by familiar people, especially by their partners and/or other men in the parent. In addition to physical violence, sexual violence is the most common type of violence and the impact of the general perspective of society and public organizations on women and the hierarchical relationship between men and women on violence should be considered in the evaluation of violence fact. The case of femicide is also underwhelming. There is a significant increase in femicides since 2008 until today in Turkey. ‘Taking decision by woman for her own life’ and ‘claiming divorcement’ are the most common reasons given by offenders to kill women and these reasons prove that the patriarchal system in Turkey does not consider woman as an individual and subordinates women. The idea of taking decision by woman for her their own lives and claiming for divorcement is perceived as a rebellion to power of men, a disengagement from dominance field of men and a failure of power of men. Men are strong and brave who bring home the bacon, save the honor of family, establish dominance on partner and children and commit violence when required to ensure this dominance and femicide is also included in this violence.

After a long time was not heard to the public area, lately death penalty toward the criminal cases that classified as extraordinary crime are appear. The author discovers electronic article about the execution of the death penalty which is the prosecutor prepares to execute death penalty toward the drugs dealer. The president of Republic of Indonesia stated that it is necessary to give a deterrent effect to the convicted  criminal and keep the morality of Indonesian teenagers. According to my opinion, the author argues that it will be better and wiser if we discuss about renovating all of the Penitentiary in Indonesia than debating whether death penalty could be done in Indonesia or not, because it will be displeasure many parties, death penalty infringed the human rights of the convicted criminals and cause psychological burden to them, families, the executor of the death penalty, and other parties. Because if we have to improve the quality of the Penitentiary, if the function of Penitentiary for fostering moralily has been optimal or properly enough to the convicted criminals, Indonesia will be no longer need the death penalty option as sanction to the convicted crimanals including for the extraordinary crime (especially for drugs trafficking in our country). Penitentiary is one of the public services which aims for fostering the people that initially have bad habits (commited to the crime), so that they will have the awareness to change their bad attitude into the be better ones, will not harm others, and positively contributed to the society. Already Penitentiary’s conditions should be designed in such a way and as good as possible, so that the inmates feels like at their own home (like having a second home after his own home), and feel humaner to spend their days in the Penitentiary. The author believes that if the Penitentiary has been improved and optimized its function well, then the real purpose of Penitentiary will definitely achieved. As stated in Law Number 12 Year 1995 regarding to Penitentiary Article 2 which states "sanction system are organized in order to fostering the convicted criminals in order to be the real man, aware of their fault, improve themselves, and not to repeat the criminal act so that they can be friendly received by the community, can actively participated in the development of our country, and can socialize themselves as good citizen."Article 3 on this regulation also intensifies the function of Penitentiary "the function of Penitentiary is to prepare convicted criminals to be able to properly integrated to the society, so they can be accepted again as members of the public who are free and responsible ones."

The trend of violence against women in Nigeria has increased more than ever recently, with many women having been deprived of their fundamental rights. Violence against women in Nigeria includes sexual harassment, physical violence, harmful traditional practices, emotional and psychological violence, and socio-economic violence. This article investigates cases of domestic violence against women in South West Nigeria by assessing the role of family courts in the adjudication of such cases. Both primary and secondary sources of data were employed to examine incidents of violence against women and the role of the family courts in ensuring justice. The author employed both primary and secondary sources of data; the data gathered were analysed by frequency and simple percentages, while qualitative data were descriptively analysed. The article reveals the causes of domestic violence against women to include a cultural belief in male superiority, women’s lack of awareness of their rights, women’s poverty owing to joblessness, men seeking sexual satisfaction by force, women having only male children, the social acceptance of discipline, the failure to punish the perpetrators of violence, the influence of alcohol, and in-laws’ interference in marital relationships. It also reveals the nature of domestic violence against women. The research revealed that the family courts have played prominent roles in protecting and defending the rights of women. The author therefore recommends that the law should strengthen the family courts by extending their power to penalise the perpetrators of violence against women.

Abstract In modern times, the word Modernity has spread widely and has become widely understood, and we see it as a natural extension of European concern and confusion. The Modernist Movement strived to present the ideas that rely completely on Western methodologies and approaches in their study and dealing with Qur’an and Sunnah. The most important scholars that have presented these ideas are; Mohammad Arkoun, ‘Abd Al-Majid Sharafi al-Tunisi, Mohammed ‘Abed al-Jabri, Hassan Hanafi, Nasr Hamid Abu Zayd, Tayyeb Tizini, Muhammad Shahrour, Jamal Al-Banna, and others, they called for a re-reading and reinterpret the Qur’an in the light of Western critical approaches. Then, conveyed and brought the European experience and practice with all its chaotic effects to Islamic thought. The slogan of “Renewal of Religion” from these people has no relation to religion (Islam) or its sources, but instead saturated their ideas with secular methods. They tried to instill modernity rather than religion, and misinterpreted the Islamic sources by distorting it and evacuating it from the true context and setting it with their own understanding. They claim their ideas and opinions as the effort to understand religion and carried the slogan of “Modernization and Modernization of Islam”; they want us to leave the consensus of the Muslim scholars on religious issues (Ijmaa’ al-Ummah) especially relating to the meaning of the Qur’an and Sunnah and bring us to a new views and understanding on religious issues which are contradictory to the views of the past Muslim scholars (al-salaf al-soleh) to fulfill their opinions. There is increasing concern about the impact of the COVID-19 pandemic and the lockdown’s social and economic consequences on gender-based violence. This study aimed to assess the impact of the COVID-19 pandemic on gender-based violence by comparing the prevalence of spousal violence against women before and during the COVID-19 related lockdown periods. This study was conducted in the Kurdistan Region of Iraq using a self-administered online questionnaire survey after the COVID-19 lockdown period in June 2020. Data were collected from a sample of 346 married women about the occurrence, frequency, and forms of spousal violence before and during the lockdown period. Significant increases in violence were observed from the pre-lockdown period to the lockdown period for any violence (32.1% to 38.7%, p = .001), emotional abuse (29.5% to 35.0%, p = .005), and physical violence (12.7% to 17.6%, p = .002). Regarding emotional abuse, humiliation (24.6% to 28.3%, p = .041) and scaring or intimidation (14.2% to 21.4%, p < .001) significantly increased during the lockdown. For physical violence, twisting the arm or pulling hair (9.0% to 13.0%, p = .004) and hitting (5.2% to 9.2%, p = .003) significantly increased during the lockdown. Forcing to have sexual intercourse also significantly increased during lockdown (6.6% to 9.5%., p = .021). The concerned authorities and women’s rights organizations should collaborate to enhance the prevention of violence against women. An effective prevention strategy should emphasize recognizing and acknowledging the extent of the problem, raising awareness about the problem and the available resources to address it, and ensuring social and economic stability. Lessons learned about the increased prevalence of spousal violence against women during the COVID-19 pandemic and the need to adopt appropriate strategies to prevent and address it will be valuable for similar future crises.
