The Unmet Promise of Alternatives to Incarceration

A careful review of the research literature on alternatives to incarcera tion suggests that their promise of reducing the prison population has remained largely unmet. For each of the reform strategies reviewed, the nonincarcerative options were transformed, serving criminal jus tice system values and goals other than reducing imprisonment. Sen tencing alternatives, such as restitution and community service, were found to enhance the sanctions of probation and fines instead of re placing incarceration. Similarly, postincarceration release programs, such as work release and work furlough, often escalated the level of control over clients and served primarily to control populations within prison systems. Increasing the availability of community correctional facilities has not reduced populations in secure confinement. Com munity correction legislation appears less likely to reduce incarcera tion than to change the location of imprisonment from the state in stitutions to county jails. Moreover, initial declines in state prison commitments can be neutralized by modifying over time other sen tencing or release policies that increase prison populations. Although community correction legislation may have redistributed correctional costs and shifted decision making from state to local levels, it is ques tionable whether it has made a long-term contribution to reduced im prisonment. Progress in alternatives will remain frustrated until re forms are more carefully implemented and until proponents of alter natives are willing to test their ideologies through rigorous research. Furthermore, a new political consensus must emerge outside the crim inal justice system in which the values of punishment and public safe ty are rationally balanced with fiscal constraints and competing claims for public revenue.

This article reviews the impact that the punitive, “get tough” policies of the 1980s have had on corrections. With record breaking increases in prison populations, legislators and policy makers have had to confront the realities of fiscal constraints while responding to the conservative agenda on crime. The consequence has been to develop and expand alternatives to incarceration which can be both tough on criminals but cheaper than traditional prison punishment. However, intermediate punishments such as intensive probation, electronic monitoring, and shock incarceration may be widening the correctional net. In reviewing these developments, the authors examine ideologies and consequences, and observe that economic considerations will influence corrections policies in the 1990s.

Nationwide, prison populations have declined nearly 5% from their peak, and 16 states have seen double-digit declines. It is unclear, though, how decarceration has affected racial disparities. Using national data, we find substantial variation in state prison populations from 2005–2018, with increases in some states and declines in others. However, although declines in the overall state prison population were associated with declines for all groups, states with rising prison populations experienced slight upticks in prison rates among the white population, while rates among Black and Latinx populations declined. As a result, greater progress in overall decarceration within states did not translate to larger reductions in racial disparities. At the same time, we do not find evidence that a decline in prison populations is associated with a rise in jail incarceration for any racial/ethnic group. In additional exploratory analyses, we suggest that recent incarceration trends may be driven by changes in returns to prison for probation and parole violations, rather than commitments for new crimes. Our results make clear that while efforts to reverse mass incarceration have reduced the size of prison populations in some states, they have not yet made substantial progress in resolving the crisis of race in American criminal justice.

Introduction: being a structural and functional element of the state mechanism (a kind of “state within the state”), the prison system is transforming along with it. Accordingly, the image status of the prison itself and representatives of “prison authorities” and “prison population” is also changing. We bring to the fore the problem of understanding the term “system” in the context of the image status of the social system in general and the penal system in particular. We highlight the formation of semantic images and image statuses on the example of three social institutions (school, army, prison), which are similar in terms of parametric characteristics and functioning and qualitatively different in image status. The article comprehensively examines the bipolar image of the penal system: on the one hand, prison is inextricably linked with human misfortune, an evil that cannot be treated positively; on the other hand, as an instrument of state law enforcement policy, the prison guarantees the inevitability of punishment for a crime, ensuring the execution of punishment, protecting law-abiding citizens, which is a good thing for society and the state. Research materials and methods: the features of formation and functioning of the image status of the Russian penal (“prison”) system are considered in the context of the concept of cyclic political genesis. In accordance with this concept, in relation to the history of the unified Russian state, three cycles should be distinguished (imperial, Soviet, post-Soviet). Within the framework of each, Russia was represented by qualitatively different forms of state government, economic order, social structure, etc. At the same time, in such “different” Russian states, there were different models of prison systems, the formation and functioning of which, as well as the transformation of the image status, was carried out under the influence of state prison policy and under the influence of public consciousness (national mentality). Results: the current state of the Russian penal system can be described as transitional. Along with the legacy of the “Soviet past”, we observe serious changes proceeding from democratization and humanization of the political and legal system of the Russian Federation. Transformation of the image of the penal system is aimed at increasing the level of openness and forming a positive opinion about the functioning of the penitentiary system (the Concept for development until 2030). It is important that in the public consciousness the image of the penal system as a predominantly punitive prison system gradually be replaced by the idea of it as a penitentiary system, which is concerned primarily with “revival of the essence of humanity” in a person through awareness and repentance. As for the image status of employees of the penal system, the state can optimize it first of all by equalizing their official status with that of military personnel and special services employees, who, like representatives of the prison system, serve the Russian state, but are in a privileged position in relation to them. Increasing the prestige of the service in the penal system in the eyes of actual or potential employees implies the rejection of such differentiation.

AimsTo investigate whether racial groups are proportionally represented in referrals for trauma, hearing voices, emotional regulation and psychological therapy.To understand the psychological needs across racial groups in HMP Wormwood Scrubs, the UK's 4th-most diverse prison.To see if the long-established under-representation of Asian males and over-representation of Mixed males in psychological services in the community is also occuring in the prison system.MethodPsychological referrals were recieved via the medical notes system (SystmOne), whereby a prisoner's name, age, location, racial group and reason for referral are trasnferred into the psychology referrals database.773 referrals were made between October 2018 and May 2020. As the prison's population throughout this time period was fluid, the month of December 2019 was used as a reference for the general prison poipulation.Racial groups were specified using the Office of National Statistics' 5-category classification system (White, Black, Asian, Mixed and Other).ResultThere is a consistent under-representation of Asian males in psychological referrals in relation to their general prison population. Whilst this group makes up 17% of the population of the prison, only 10% of prisoners referred to psychological services identified as Asian.Those identifying as Mixed are over-represented in trauma referrals and psychological therapy referrals. The prison's mixed population is 7%, whereas 16% of those being referred for these two reasons were from the same racial category.The proportion of patients who identified as Black, White or Other and were referred for psychology input were found to be representitive of the wider prison population, suggesting no clear over or under-representation.ConclusionTrends seen in the community in regards to Asian males being under-represented in psychological services are also evident in one of the UK's most diverse prison populations.Public health campaigning to reduce stigma and promote help seeking in BAME communities is of vital importance to provide the needed support for those silently dealing with psychological problems.The two largest racial groups in the prison, White and Black individuals, where found to be proportionally represented in their respective referrals to psychological services.One key finding was in regards to Mixed race individuals, who comprise 7% of the total prison population but 16% of psychology referrals. As this racial group is one of the fastest-growing in addition to be over-represented in referrals, it is vital to understand how provisions can be put in place to appropriately address the needs of this group.

Investments in criminal justice have been expanding over the decades especially as specific outcomes have been sought to address the issues surrounding crime and public safety. Reducing crime and the rate of imprisonment can both significantly impact public safety and cost savings, as well as address outcomes for the justice-involved population in reducing the rate of return to imprisonment, or recidivism. Lessening sentences for non-violent crimes and expanding drug courts as an alternative to incarceration, along with other major criminal justice reform, have led some states to experience a reduction in crime and prison population. New Jersey, Hawaii, and California have made significant strides to reduce its crime and prison populations and are leaders in achieving major criminal justice reform. This chapter seeks to examine corrections spending for these three leading states that have implemented evidence-based policies and adapted information technology to improve criminal justice outcomes. It will also outline states spending on corrections over the past five years.

Background: The prevalence of traumatic brain injury (TBI) in prison populations has been found to vary considerably. This study aimed to determine the prevalence of TBI in a prison population in New Zealand and to identify whether age, ethnicity, offence type, security classification and sentence length were linked to TBI prevalence. Methods: All offenders admitted to a new Corrections Facility over a 6-month period (May-November 2015) were screened to understand their history of TBI. Data was merged with demographic information, details of the offence type, sentence length and security classification from the prison database. Binary logistic regression was used to identify the contribution of predictors on TBI history. Results: Of the 1,061 eligible male prisoners, 1,054 (99.3%) completed a TBI history screen. Out of the 672 (63.7%) who had sustained at least one TBI in their lifetime, 343 (32.5%) had experienced multiple injuries. One in 5 participants experienced their first TBI injury before the age of 15 years. A regression model was able to correctly classify 66.9% of cases and revealed that belonging to Māori ethnicity or being imprisoned for violent, sexual or burglary offences were independently predictive of TBI (χ2 = 9.86, p = 0.28). Conclusions: The high prevalence of TBI within male prisoners and a high proportion of injuries sustained in childhood suggest the need for routine screening for TBI to identify prisoners at risk of persistent difficulties. Interventions to support those experiencing persistent difficulties post-TBI are needed to optimise functioning and prevent reoffending.

We provide an analysis of COVID-19 mortality data to assess the potential magnitude of COVID-19 among prison residents. Data were pooled from Covid Prison Project and multiple publicly available national and state level sources. Data analyses consisted of standard epidemiologic and demographic estimates. A single case study was included to generate a more in-depth and multi-faceted understanding of COVID-19 mortality in prisons. The increase in crude COVID-19 mortality rates for the prison population has outpaced the rates for the general population. People in prison experienced a significantly higher mortality burden compared to the general population (standardized mortality ratio (SMR) = 2.75; 95% confidence interval = 2.54, 2.96). For a handful of states (n = 5), these disparities were more extreme, with SMRs ranging from 5.55 to 10.56. Four states reported COVID-19 related death counts that are more than 50% of expected deaths from all-causes in a calendar year. The case study suggested there was also variation in mortality among units within prison systems, with geriatric facilities potentially at highest risk. Understanding the dynamic trends in COVID-19 mortality in prisons as they move in and out of hotspot status is critical.

Simultaneity between prison populations and crime rates makes it difficult to isolate the causal effect of changes in prison populations on crime.  This paper uses marijuana and cocaine mandatory minimum sentencing to break that simultaneity.  Using panel data for 50 states over 40 years, this paper finds that the marginal addition of a prisoner results in a higher, not lower crime rate. Specifically, a 1 percent increase in the prison population results in a 0.28 percent increase in the violent crime rate and a 0.17 percent increase in the property crime rate. This counter-intuitive result suggests that incarceration, already high in the U.S, may have now begun to achieve negative returns in reducing crime.  As such it supports the work of a number of scholars who have suggested that incarceration may have begun to have a positive effect on crime because of a host of factors.

Purpose The purpose of this paper is to explore the policy Implications of aging prison populations. Design/methodology/approach An examination of the worldwide aging trend in prison and its implications for correctional policy, including an examination of population aging in California prisons as a case example of needed reform. Findings Prison populations worldwide are aging at an unprecedented rate, and age-related medical costs have had serious consequences for jurisdictions struggling to respond to the changes. These trends are accompanied by a growing body of evidence that old age is strongly correlated with desistance from criminal behavior, suggesting an opportunity to at least partially address the challenges of an aging prison population through early release from prison for appropriate persons. Originality/value Some policies do exist that aim to reduce the number of older, chronically ill or disabled and dying people in prison, but they have not achieved that goal on a sufficient scale. An examination of the situation in California shows that recognizing how the healthcare needs of incarcerated people change as they age – and how aging and aging-related health changes often decrease an older person’s likelihood of repeat offense – is critical to achieving effective and efficient policies and practices aimed at adequately caring for this population and reducing their numbers in prisons when appropriate.

After three decades of passing laws and implementing policies designed to dramatically increase the nation's prison population and harden the conditions of confinement, there is a newfound interest among policy makers and criminologists in prisoner release. Using national data and a survey of eight states, this article examines the current “state of the art” of prisoner reentry. Not surprisingly, most state prison systems are ill equipped to ease the transition of inmates from prison to the community. A significant portion of released inmates pose minimal risk to public safety. Parole supervision increasingly results in ex-convicts' being reincarcerated for noncriminal behavior or misdemeanor crimes. For most inmates, reentry should be curtailed by either eliminating supervision or greatly shortening the period of supervision.
