The subject of the study is a series of advertisements – requests from the Siepomaga.pl website in terms of the method of acquisition of recipients (using Cicero’s captatio benevolentiae principles), convincing and persuading to act through proper selection of rhetorical arguments. The main procedure is to create statements taking into account the common auditorium, bearing the hallmarks of ordinariness. Language structures, toposes, arguments explicitly referring to pathos; the most typical strategies are modesty and raising the value of recipients as a last resort; and toposes: unequal fight against disease, time passing relentlessly as well as causative reasons (support is only a means to obtain priceless values: health and life). A characteristic feature of the requests posted on the Siepomaga.pl website is the presence of various semiotic codes typical for the Internet space, a kind of multimodality of communication in which verbal communication and image coexist. In addition, interaction is an important persuasive element, giving the recipients – the donors – an immediate effect of reward for taking action in the form of satisfaction with the real contribution visible in the account balance bar.

The increasing complexity of supply chains, whose structure is changing from a linear to network form creates the need to track a growing amount of information allowing the evaluation of the functioning of the entire supply chain. Developing a system for measuring the performance of the supply chain requires the proper selection of indicators. Performance measurement should be done in a particular context, the analysed dimensions of indicators resulting from the purpose and focus of the survey should be determined. The article reviews Polish and foreign literature in terms of the proposed framework and methods for measuring the performance of the supply chain and the indicated categories (dimensions) of indicators. The authors approach the subject of evaluation of the performance of the supply chain in very different ways. Indicators are divided according to the level of the decision-making process: strategic, tactical, and operational. They are also divided into cost and non-cost or financial and non-financial ones. There are also approaches using the already well established methods and models. An example of this is the selection of perspectives according to the Balanced Scorecard (BSC) and the SCOR model.

The assumption that each road participant adheres to the rules, ideally adapts his behavior to the prevailing road conditions, is unrealistic, and as the basis for taking action can lead to collisions and accidents. The article presents the theoretical models allowing to understand the behavior of drivers who deliberately enforce the priority of passing, and their only motivation is the shortest travel time through the intersection. Two types of situations at crossroads are considered: with guided and non-guided traffic with the STOP sign. The presented mathematical models are illustrated by the real-life recordings of drivers available on the Internet.

Aim:The article has been selected due to the need to determine the legal basis for the consolidation of entrepreneurs on the pharmaceutical market and to identify the difference from the common pattern established by the regulations set forth in the Competition and Consumer Protection Act dated 16 February 2007. The selection of an enactment (the Competition and Consumer Protection Act or the Pharmaceutical Law Act) as the appropriate basis for ruling shapes the legal status of an entrepreneur on the pharmaceutical market, in particular with respect to selecting specific remedies. Design / Research methods:The text of enactments was analyzed using mainly the linguistic method. The aim of the analyzed regulations and the system of values protected by law were also investigated. Conclusions / findings:The regulations concerning anti-competition consolidation on the pharmaceutical market set forth in the Pharmaceutical Law Acta are lex specialis with respect to solutions adopted in the Competition and Consumer Protection Act (this applies only to issuing a permit for running a retail pharmacy and a limited service pharmacy). These regulations are related with respect to content but, simultaneously, they differ with respect to the adopted consolidation criteria (qualitative criterion: the Competition and Consumer Protection Act, and quantitative criterion: the Pharmaceutical Law Act). The regulations set forth in the Competition and Consumer Protection Act apply also to consolidation on the pharmaceutical market since the obligation to report a consolidation intent is not specific to the industry in which the consolidation takes place. It means that President of the Office of Competition and Consumer Protection is competent to study the consolidation status and issue decisions related to consolidation on the pharmaceutical market, and entrepreneurs can appeal from the President’s decisions to the Regional Court in Warsaw. Originality / value of the article:The approach presented is not present in the current literature which is the main value of the article. The subject matter of the article can be interesting for entrepreneurs present on the pharmaceutical market and law practitioners.

Agricultural parcels are often the subject of land valuation studies. This approach implicitly assumes that the real estate value of the land belonging to a farm is the sum of the values of the individual parcels that make up the farm. Nonetheless, the value of a whole can be very different from the sum of its parts. This study proposes a methodology for calculating the real estate value of the land belonging to a farm, by including parameters relating to the fragmentation of the land. Fragmentation increases production costs and reduces farmers’ incomes and by extension the real estate value of the farm. In our study area, the province of Jaen in Spain, figures for its most emblematic crop, the olive, show that fragmentation of the land reduces its value by between 51% for a 10 ha farm and 12% for a 30 ha farm as compared to the values set out in the bibliography. The reorganization of the ownership system or the promotion of systems for the common management of land could increase the profitability and therefore the value of land according to the ‘income capitalization’ approach.

<p>The purpose of this thesis is to challenge the common notion that the internet has had a detrimental impact on the music industry, and on musicians’ ability to generate a viable income while still producing good music. Note, that the following arguments do not automatically extend to the effect that the web has had on books, patents, films, journalism or any other medium. The reason for this is because these different disciplines have individual characteristics that make them respond differently to the same socio-economic pressures. However, on the same token, it does not necessarily follow that the conclusions reached here are inapplicable to other activities: perhaps what is true for music in the following pages is also true for e.g. photography. Furthermore, I am not advocating for a free-for-all internet where behemoths like Google, Amazon and Facebook get to do whatever they wish. Although I am intrigued by such matters, the constraints of both time and space allow me only the possibility to focus on the subject that I am most familiar and passionate about. Furthermore, because I am painting a broad picture which encompasses many intellectual disciplines, many of which I am not an expert in, this work is to be considered more on the consistency of the overall argument rather than the minutia of its individual parts.</p>

The Casebook series provides a comprehensive selection of case law that addresses all aspects of the subject encountered on undergraduate courses. This chapter examines privity of contract, its relationship with consideration, and the ability of third parties to enforce contractual provisions for their benefit. The doctrine of privity of contract provides that the benefits of a contract can be enjoyed only by the parties to that contract and only parties can suffer the burdens of the contract. At common law, third party beneficiaries could not enforce a contractual provision in their favour so various devices were employed seeking to avoid privity. Statute now allows for direct third party enforcement but in limited circumstances. This chapter examines the background to privity and the attempted statutory reform in the Contracts (Rights of Third Parties) Act 1999 as it has been interpreted in the case law. The chapter also discusses the common law means of avoiding privity as illustrated by the case law, e.g. agency, collateral contracts, and trusts of contractual obligations. Finally it assesses the remedies available to the contracting party to recover on behalf of the third party beneficiary of the promise, including the narrow and broad grounds in Linden Gardens Trust. It concludes by briefly considering privity and burdens—and the exceptional situations where a burden can be imposed on a person who is not a party to the contract.

In this article, the developed matrix of criminologically significant information is proposed. This matrix reflects the content, structure, and methodology of the study of juvenile delinquency. The described criminological heptagonal matrix is a fairly complete structure of in formation significant for criminological science, which is implemented for the purpose of gaining the most in-depth knowledge of the modern features of juvenile delinquency. The interrelated elements of this matrix are also proposed in this work. Special attention is paid to the area of conducting, on a planned basis, criminological monitoring of juvenile delinquency. It is noted that criminological monitoring has previously been the subject of research by other authors. It is emphasized that conducting criminological monitoring of juvenile delinquency will allow for a “cross-cutting” study of this type of crime, and develop adequate, modern approaches to its prevention. The author provides the results of research on the attitude of citizens to the Internet space. A separate role is assigned to the theory of intersectionality (the theory of intersections of social spheres). The conclusion is substantiated that, based on the fact that the world of modern juveniles is structured, the application of this theory becomes an important element of cognition, study, and identification of the mutual influence of such social spheres as the real (offline) social sphere, virtual (online) social sphere with the identity of a juvenile.

Since competitions in karate take place within bouts and katas, the subject matter of this study are the psychological characteristics which contribute to this differentiation. The goal of the research is to determine the predictive values of psychological characteristics in the competitive selection of karatekas. In relation to the subject matter and goals of the research, as well as studies carried out so far, a hypothesis has been formulated: significant differences exist in goal orientation between karatekas of various competitive orientation. The study included 79 karatekas, 12 to 14 years old, 37 of whom are competitors in bouts, 23 of whom practice katas, and 19 respondents who take part in both disciplines. In order to evaluate the motivational orientation, we used the Task and Ego Orientation in Sport Questionnaire (TEOSQ), designed by Duda & Nicholls. Even though the overall results did not confirm the initial hypothesis that the respondents of various competitive orientation should differ in their motivational climate of goal orientation, they to a large extent can be of significant help in the proper selection of young competitors in karate.

This study aims to describe the analysis of analysis of errors in the language description of students class XI smk ypm 2 park.Residered from the aspect of the contents of the essay, has not seen pouring ideas and ideas of students about the nature, images, and the real phenomenon of an object. In this case, the essay of the student can not be used as a means to represent lan gsung object so that the reader can not interpret and feel directly the object in the description. The phenomenon that occurs in learning writing essay writing description of students of class XI SMK YPM 2 Taman Sepanjang that the learning atmosphere of writing essay description less significant changes. Less effective learning atmosphere and fun for students, especially at the time of application of writing the text of the description text. This is stated based on the percentage of the value of writing ability description of the students of class XI SMK YPM 2 Taman Sepanjang. After conducting this research, the use of sentences is not effective in the description of students class XI SMK YPM 2 Park include: (1) the use of ineffective sentences consisting of the subject relationship with predicate, predicate with the object, and also the selection of words that are not appropriate (2) the use of sentences is not efficient, not sparing due to the use of words that have the same purpose, and also the use of unnecessary words, (3) the use of incoherent sentences, said to be unified if the subject and predicate, as well as description of aspects and elements the sentence is not in accordance with the Indonesian sentence pattern, other than that the sentence is not coherent also due to inappropriate relationship between sentences in paragraphs, (4) the use of the sentence is not careful, if the selection of words in the sentence is not in accordance with the intention to be conveyed.

A method of low cost strapdown inertial Attitude and Heading Reference System based on MEMS is implemented in this paper. Based on the analysis of the modules, the proper selection of the core processor and the inertial devices, the hardware components of the system is presented; Using the gradient-descent algorithm which is based on quaternion, it can finish the calculation of the attitude; This AHRS can realize the real-time extraction, calculation and the output of the information.
