The phenomenon of prostitution in Indonesia has become a negative specter that refers to its dilapidated moral society. This polemic is one of several different dimensions. Stewardship is also felt because law enforcement is not entirely. Prostitution is a name given to indicate the act in which a woman sends herself to relate to the opposite sex in need of money or other forms of payment. Inspired by the rampant sexual gratification cases among state officials. Ratification process and goods but sadness gratification in expanding sexual section. Added the sexy offender (female) underage. Previously gratification is already in Law Number 20 the Year 2001 on Corruption Eradication in article 12 B, but not yet directly in the scope of sex gratification. Thus there needs to be a legal reform synchronized with the rules and protection of human rights for working women. Until now the sexy gratification case is still taboo because it is considered apathetically State has not been possible to do and provide a deterrent effect for service providers, separation and distribution for the perpetrators of sexual. This is the polemic that must be emphasized from the rising.

This article addresses the consequences of economic sanctions for the protection of human rights in Latin America. The literature on sanctions and compliance informs three hypotheses, which investigate the relationship between sanctions and the level of rights protection in two groups of countries: those that were targeted by sanctions and those that were not. Using data from the Political Terror Scale (PTS) and from Freedom House, I find empirical evidence that sanctions do improve the level of protection in countries that were not targeted. This finding can be explained by the deterrent effect attributed to sanctions by the compliance literature, broadly interpreted. The presence of economic sanctions in a given year increases the probability of observing better human rights practices by almost 50%. These results hold for the 12 Latin American countries that were not subject to economic sanctions for the period 1976-2004.

The practice of prostitution involving women as the main perpetrator creates a negative stigma that sees women as guilty persons. Even though there are also women who are involved in the practice of prostitution due tocoercion. This condition creates a bias towards the position of the victim in the practice of prostitution. This paper is to examine the involvement of women in the practice of prostitution while also recognizing the position of women that are involved in the practice of prostitution. This research uses the normative juridical research method. Women in the prostitution network can be identified as victims due to both internal and external pressure.Women are perpetrators if involved without any pressure from other parties. Women are victims if they act as service providers, suffered, because of force by power from others, besides the relative requirements of women as victims of prostitution when involved in the practice of prostitution because they have been victims of sexual violence and make prostitution as livelihoods. Thus, it is hoped that legislators will soon be able to formulate limits on victims in the context of legal reform and just law enforcement. AbstrakPraktik prostitusi yang melibatkan perempuan sebagai aktor utama menimbulkan stigma negatif yang memandang perempuan sebagai insan yang bersalah. Padahal adapula perempuan yang terlibat dalam praktik prostitusi diakibatkan keterpaksaaan. Kondisi ini menimbulkan bias terhadap kedudukan korban dalam praktik prostitusi. Tulisan ini untuk mengkaji keterlibatan perempuan dalam praktik prostitusi sekaligus mengetahui kedudukan perempuan yang terlibat dalam praktik prostitusi. Penelitian ini menggunakan metode penelitian yuridis normatif. Perempuan dalam jaringan prostitusi dapat teridentifikasi sebagai korban akibat tekanan internal maupun eksternalnya. Perempuan sebagai pelaku apabila terlibat tanpa tekanan dari pihak di luar dirinya. Perempuan sebagai korban apabila bertindak sebagai pemberi jasa, menderita, karena dan daya paksa dari orang lain, selain itu syarat relatif perempuan sebagai korban dalam prostitusi manakala terlibat dalam praktik prostitusi karena pernah menjadi korban kekerasan seksual dan prostitusi sebagai mata pencaharian. Diharapkan pembentuk undang-undang segera mungkin untuk merumuskan mengenai batasan korban dalam rangka pembaharuan hukum dan penegakan hukum yang berkeadilan.

Penelitian ini bertujuan untuk mengetahui Pelaksanaan Fungsi Balai Pemasyarakatan (BAPAS) Makassar Dalam Perlindungan Hak Asasi Manusia Pada Sistem Pidana Anak dan Kendala Balai Pemasyarakatan dalam Perlindungan Hak Asasi Manusia Pada Sistem Peradilan Anak. Penelitian merupakan penelitian normatif. Metode Pengumpulan Data melalui wawancara dan dokumentasi. Teknis Analisis data ini merupakan analisis kualitatif. Hasil penelitian menunjukkan bahwa Balai Pemasyarakatan kelas I Makassar sebagai salah satu penegak hukum khususnya dalam pembimbingan terhadap anak nakal menjalankan perannya tersebut melalui tiga tahap, yaitu tahap Pra ajudikasi, tahap ajudikasi dan tahap Post ajudikasi. Faktor kendala yang dihadapi dalam pelaksanaan Fungsi Balai Pemasyarakatan (BAPAS) antara lain kelemahan aturan hukum yang berlaku terhadap tindak pidana anak, kurangnya koordinasi diantara sesama aparat penegak hukum, rendahnya kualitas sumber daya manusia di BAPAS, and kurang Sarana dan Prasarana yang memadai. Mengakibatkan pelaksaan Fungsi Balai Pemasyarakatan (BAPAS) kurang optimal, dan alokasi anggaran dana yang sangat minim. This study aims to determine the implementation of the function of Makassar Correctional Center (BAPAS) in the Protection of Human Rights in the Criminal Justice System of Children and the Obstacles of the Correctional Center in the Protection of Human Rights in the Justice System of Children. This research is normative research. Data collection methods were through interviews and documentation. Technical analysis of the data is a qualitative analysis. The results showed that Correctional Center Class I Makassar as one of the law enforcers, especially in guiding delinquents carried out their roles in three stages, which are the Pre-adjudication stage, the adjudication stage and the Post-adjudication stage. Obstacles faced in the implementation of the function of Correctional Center (BAPAS) are weaknesses in the rule of law that applies to the crimes of children, lack of coordination among law enforcement officials, low quality of human resources at BAPAS, and lack of adequate facilities and infrastructure. As a result, the implementation of the function of Correctional Center (BAPAS) is not optimal, and the budget allocation for funds is very minimal.

Globalisation involves both promising potentials and risks. It has the potential – through the spread of human rights, the migration of people and ideas, and the integration of diverse economies – to improve human wellbeing and enhance the protection of human rights worldwide. But globalisation also incurs risks: global environmental risks (such as global warming), the creation of new centres of power with limited legitimacy, a ‘race to the bottom’ regarding workers’ safety and rights, risky journeys of thousands of migrants and not least growing global inequalities. Globalisation, therefore, is a key factor for today’s discussions of justice. As globalisation connects people, it also raises associated responsibilities between them. Until recently, the interest in justice among political philosophers and social ethicists was mainly focused on the nation state. However, this is no longer feasible. Since economic globalisation affects how wealth and power are distributed globally it has become indispensable to discuss social ethics in a global context and to develop principles of global justice. Global justice, therefore, entails an assessment of the benefits and burdens of the structural relations and institutional arrangements that constitute and govern globalisation. The academic discussion of global justice is vibrant and expanding. In my introduction I provide an overview of the discussions on global poverty, justice, cosmopolitanism and statism, migration, the capability approach and different dimensions of global justice.

The object of this research is the relations on protection of human rights in criminal procedure justice in under the conditions of pandemic. The subject of this research is analysis of the activity of law enforcement and judicial systems in the country’s current situation. The proliferation of coronavirus infection in the Russian Federation generated pervasive problems in this area. Recommendations contained in the Decisions of the Presidium of the Supreme Court and the Presidium of the Council of Judges of the Russian Federation of March 18, 2020 and April 8, 2020 did not clarify the law enforcement practice, which led to ambiguity in the interpretation of certain provisions of these documents. The situation that formed in the country as a result of COVID-19 pandemic requires rationalization of a number of issues on the protection of human rights in nonstandard conditions of the work of judicial and law enforcement systems. Information from the open sources published on the Internet served as the foundation for this research. The conducted analysis is valuable for understanding the current situation, as well as for making appropriate decisions that are instrumental for the future. Based on the acquired results, the makes recommendations aimed at improvement of separate institutions of criminal law and criminal procedure law, namely Institution of the statute of limitations, institution of the suspension of proceedings in a criminal case. The scientific novelty consists in the exact wording of indicated recommendations on amending the current criminal procedure legislation.

This research was conducted to find out the form of the implementation of the rights of suspects at the level of investigation at the Wajo Regional Police Station, as well as what factors influence the implementation of the rights of the suspect at the investigation level of investigations at the Wajo Regional Police Station. This type of research was conducted in the Wajo district police jurisdiction, and data were obtained from in-depth observations, through interviews and then analyzing existing data. The results of the study were analyzed quantitatively by describing data and also using quantitative analysis with descriptive. Protection of Human Rights in the Judicial Act concerning the principles of quick and low-cost justice, the principle of non-discrimination, the principle of presumption of innocence, and guarantees of Human Rights for all Indonesian citizens under the 1945 Constitution. The results obtained by this article are: shows that the implementation of the rights of the suspect at the investigation level investigation at the Wajo Resort Police, in particular the right to obtain legal assistance, the right to be examined immediately, the right to provide information freely, and the right to be informed of his arrest and detention based on the principle of presumption of innocence, based on the results of the study, have been carried out although not optimal due to several factors, namely (1) the quality of investigative Human Resources is still low, the number of personnel is still lacking and is not balanced with the number of cases, investigators who are not professional and (2) the mental attitude of the investigator which is not good, and the level of awareness the law of society which is paternalism so that it causes resignation to law enforcement officers while supporting factors in the form of the increased budget allocated for the settlement of cases. Abstrak:Penelitian ini dilakukan dengan bertujuan untuk mengetahui wujud implementasi hak-hak tersangka pada tingkat penyidikan di Polres Wajo, serta  faktor-faktor apa yang mempengaruhi implementasi hak-hak tersangka pada pemeriksaan tingkat penyidikan di Polres Wajo. Tipe penelitian  ini dilakukan di wilayah hukum Polres Wajo, dan data diperoleh dari pengamatan yang mendalam, melalui wawancara  kemudian menganalisis data yang ada. Hasil penelitian dianalisi secara kuantitatif dengan mendeskripsikan data dan juga menggunakan analisis kuantitatif dengan deskriptif. Perlindungan Hak Azasi Manusia dalam Undang-Undang kehakiman mengenai azas peradilan cepat dan biaya ringan, azas non diskriminasi, azas praduga tidak bersalah, dan jaminan Hak Azasi Manusia bagi seluruh warga Negara Indonesia berdasarkan Undang- undang Dasar 1945. Hasil yang diperoleh oleh artikel ini adalah: menunjukkan bahwa wujud implementasi hak-hak tersangka pada pemeriksaan tingkat penyidikan di Kepolisian Resort Wajo, khususnya hak memperoleh bantuan hukum, hak untuk segera diperiksa, hak untuk memberikan keterangan secara bebas, dan hak untuk diberitahukan penagkapan dan penahanannya berdasarkan azas praduga tak bersalah, berdasarkan hasil penelitian,  sudah dilaksanakan meskipun belum optimal yang disebabkan karena beberapa faktor, yaitu (1) kualitas Sumber Daya Manusia  penyidik yang masih rendah, jumlah personil yang masih kurang dan tidak seimbang dengan banyaknya perkara, penyidik yang tidak profesional dan (2) sikap mental penyidik yang kurang baik, serta tingkat kesadaran hukum masyarakat yang paternalisme, sehingga menyebabkan sikap pasrah kepada aparat penegak hukum, sedangkan faktor pendukung berupa meningkatnya anggaran yang dialokasikan untuk penyelesaian perkara.

AbstrakSistem peradilan pidana merupakan unsur yang signifikan dalam upaya pemberantasan tindak pidana narkotika. Pengguna narkotika seyogyanya mendapatkan sanksi pidana yang berat, mengingat korban penyalahgunaan narkotika di Indonesia semakin bertambah dari tahun ke tahun. Namun, dari segi penegakan hukum Mahkamah Agung melalui Putusan Pengadilan Negeri Yogyakarta Nomor 389/Pid.Sus/2015/PN Yyk hanya memuat formulasi yang tidak didukung dengan teori-teori keilmuan, bahkan putusan tersebut tidak mencantumkan keterangan masa penahanan atau ketentuan Pasal 197 ayat (1) huruf h Undang-Undang Nomor 8 Tahun 1981. Jenis penelitian ini adalah penelitian hukum normatif. Penelitian hukum normatif lebih mengutamakan studi pustaka. Hasil penelitian menunjukkan bahwa kekuatan mengikat Pasal 197 ayat (1) Undang-Undang Nomor 8 Tahun 1981 adalah  mandatory, imperatif dan limitatif dalam putusan hakim, yang bertujuan untuk memberikan nilai-nilai keadilan dan perlindungan terhadap hak-hak asasi manusia bagi para pihak. Adapun konsekuensi ketentuan tersebut apabila tidak dipenuhi dalam putusan hakim adalah putusan batal demi hukum.AbstractThe criminal justice system is a significant element in efforts to eradicate narcotics crime. Drug users should get severe criminal sanctions, considering that victims of narcotics abuse in Indonesia are increasing from year to year. However, in terms of law enforcement the Supreme Court through the Decision of the Yogyakarta District Court Number 389 / Pid.Sus / 2015 / PN Yyk only contains formulations that are not supported by scientific theories, even the decision does not include informatio on the period of detention or the provisions of Article 197 paragraph ( 1) letter h of Law Number 8 of 1981. This type of research is normative legal research. Normative legal research prioritizes literature. The results of the study indicate that the binding force of Article 197 paragraph (1) of Law Number 8 of 1981 is mandatory, imperative and limited in the judge's decision, which aims to provide values of justice and protection of human rights for the parties. The consequences of these  provisions if not fulfilled in the judge's decision are the verdict null and void.

The presented article offers an analysis of some of the problems of criminal proceedings caused by the current situation in the country caused by the COVID-19 coronavirus infection pandemic. Based on what was stated in Art. 6 of the Code of Criminal Procedure of the Russian Federation, the priority direction on the protection of human rights in the field of criminal proceedings, imposing the corresponding obligations on the state, follows the need for a reliable mechanism to ensure these rights. Meanwhile, in the conditions of the spread of coronavirus infection on the territory of the Russian Federation, a number of questions have arisen regarding the protection of human rights in the non-standard conditions of the judicial and law enforcement systems. Documents at the level of state regulation containing relevant recommendations do not fully cover the range of emerging issues. The decisions of the Presidium of the Supreme Court and the Presidium of the Council of Judges of March 18, 2020 and April 8, 2020, as noted by lawyers, did not clarify the practice of law enforcement.

Law Number 23, 2009 concerning Environmental and Management Protection has been running for eleven years. This law still needs a lot of evaluation, especially at the level of implementation or implementation. One of them is related to the sanction for corporations that do environmental damage. There are three types of sanctions that can be given to corporations, namely: civil, criminal and administrative. However, all this time the three did not provide a deterrent effect. As a result, the rights of affected citizens to get a healthy environment are also ignored. For this reason, this paper focused on how is the Analysis of corporate sanctions of perpetrators of waste dumping without permission viewed from a Human Rights perspective? This study uses a juridical normative research method, by analyzing secondary data in the form of laws and regulations related to sanctions for corporations that carry out waste dumping without permission. The results of the study found that the analysis of corporate sanctions for the perpetrators of waste dumping without permission did not represent the protection of human rights for the community. Legal fissures make the corporation can continue its activities and make it possible to do environmental damage again. It is necessary to maximize the application of the highest alternative sanctions by paying attention to human and community rights around the location of waste dumping where the quality of water, air, and soil has deteriorated.
