The practice of prostitution involving women as the main perpetrator creates a negative stigma that sees women as guilty persons. Even though there are also women who are involved in the practice of prostitution due tocoercion. This condition creates a bias towards the position of the victim in the practice of prostitution. This paper is to examine the involvement of women in the practice of prostitution while also recognizing the position of women that are involved in the practice of prostitution. This research uses the normative juridical research method. Women in the prostitution network can be identified as victims due to both internal and external pressure.Women are perpetrators if involved without any pressure from other parties. Women are victims if they act as service providers, suffered, because of force by power from others, besides the relative requirements of women as victims of prostitution when involved in the practice of prostitution because they have been victims of sexual violence and make prostitution as livelihoods. Thus, it is hoped that legislators will soon be able to formulate limits on victims in the context of legal reform and just law enforcement. AbstrakPraktik prostitusi yang melibatkan perempuan sebagai aktor utama menimbulkan stigma negatif yang memandang perempuan sebagai insan yang bersalah. Padahal adapula perempuan yang terlibat dalam praktik prostitusi diakibatkan keterpaksaaan. Kondisi ini menimbulkan bias terhadap kedudukan korban dalam praktik prostitusi. Tulisan ini untuk mengkaji keterlibatan perempuan dalam praktik prostitusi sekaligus mengetahui kedudukan perempuan yang terlibat dalam praktik prostitusi. Penelitian ini menggunakan metode penelitian yuridis normatif. Perempuan dalam jaringan prostitusi dapat teridentifikasi sebagai korban akibat tekanan internal maupun eksternalnya. Perempuan sebagai pelaku apabila terlibat tanpa tekanan dari pihak di luar dirinya. Perempuan sebagai korban apabila bertindak sebagai pemberi jasa, menderita, karena dan daya paksa dari orang lain, selain itu syarat relatif perempuan sebagai korban dalam prostitusi manakala terlibat dalam praktik prostitusi karena pernah menjadi korban kekerasan seksual dan prostitusi sebagai mata pencaharian. Diharapkan pembentuk undang-undang segera mungkin untuk merumuskan mengenai batasan korban dalam rangka pembaharuan hukum dan penegakan hukum yang berkeadilan.

Penelitian bertujuan untuk menganalisis perlindungan hukum terhadap anak korban kekerasan seksual, dan menganalisis faktor yang mempengaruhi perlindungan hukum terhadap anak korban kekerasan seksual. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian bahwa; Perlindungan hukum terhadap anak yang menjadi korban kekerasan seksual dalam praktik penegakan hukum pidana oleh Kepolisian di Polewali Mandar adalah perlindungan dalam proses penyelidikan serta melalui upaya preventif/pencegahan dengan bekerja sama dengan Lembaga Swadaya Masyarakat (LSM) di Kabupaten Polewali. Sedangkan perlindungan hukum oleh Pengadilan Negeri Polewali adalah perlindungan dalam proses persidangan yang berupa korban anak tidak disumpah, hakim dalam memberikan pertanyaan sangat hati-hati dan tidak formal, serta adanya pendamping yang dipercaya oleh korban anak. Perlindungan hukum terhadap anak korban kekerasan seksual tidak berjalan secara efektif dikarenakan masih terdapat tindak kekerasan seksual anak yang pada kenyataannya saat ini masih banyak yang menimpa anak di Kabupaten Polewali Mandar. ABSTRAKSetiap anak yang menjadi korban tindak pidana berhak mendapatkan restitusi seperti yang tertuang di dalam peraturan pelaksana dari Pasal 71 D Undang-Undang Perlindungan Anak No. 35 Tahun 2014 yakni Peraturan Pemerintah Nomor 43 Tahun 2017 tentang Pelaksanaan Restitusi Bagi Anak Yang Menjadi Korban Tindak Pidana. Pelaksanaan restitusi kepada korban hanya ditujukan kepada beberapa tindak pidana tertentu saja termasuk tindak pidana kekerasan seksual. Diterbitkannya Peraturan Pemerintah tersebut bertujuan untuk memberikan perlindungan hukum terhadap korban khususnya anak-anak atas penerapan hak restitusi. Penelitian ini termasuk tipologi penelitian hukum empiris. Hasil penelitian menunjukkan bahwa pelaksanaan restitusi bagi anak yang menjadi korban tindak pidana kekerasan seksual di Provinsi Riau berdasarkan Peraturan Pemerintah Nomor 43 tahun 2017 belum berjalan dengan baik. Hal ini disebabkan oleh beberapa kendala yakni kurangnya kesadaran dari aparat penegak hukum untuk mendorong terlaksananya restitusi bagi anak yang menjadi korban tindak pidana, administirasi pengajuan permohonan restitusi yang rumit, dan kendala restitusi yang tidak dibayarkan dan ketentuan dalam Peraturan Pemerintah Nomor 43 Tahun 2017 yang kurang jelas. Fokus penelitian ini adalah penerapan restitusi pada anak korban tindak pidana berdasarkan Peraturan Pemerintah Nomor 43 Tahun 2017.Kata kunci: restitusi; anak korban tindak pidana; kekerasan seksualABSTRAKEvery child who is a victim of a crime is entitled to get restitution as stipulated in the implementing regulations of Article 71 D of the Child Protection Act No. 35 of 2014 namely Government Regulation Number 43 of 2017 concerning Implementation of Restitution for Children Who Become Victims of Criminal Acts. The implementation of restitution to victims is only aimed at a number of specific criminal acts including sexual violence. The issuance of this Government Regulation aims to provide legal protection for victims, especially children, on the application of restitution rights so that they can run well. This research is a typology of empirical legal research. The results showed that the implementation of restitution for children who were victims of sexual violence in Riau Province based on Government Regulation No. 43 of 2017 has not gone well. This is caused by several constraints namely lack of awareness from law enforcement officials to encourage the implementation of restitution for children who are victims of criminal acts, administration of submission of complex restitution applications, and restitution constraints that are not paid and the unclear provisions in Government Regulation Number 43 of 2017. The focus of this research is on the provisions stipulated in Government Regulation Number 43 of 2017 concerning the implementation of restitution for children who are victims of criminal acts.Keywords: restitution; child victims of crime; sexual assault

Sexual violence happened to children are often occurred, after the emergence of sexual cases in Jakarta International School (JIS). It began to arise attention to child victims of sexual violence. This paper aims to provide a review of the protection on child victims of sexual violence at this time. With the sociological juridical method, the primary data were obtained from direct interviews with law enforcement officers, while secondary data were obtained from literature references. The result shows that the legal protection does not pay attention on children as victim. The legal protection for children as victim sexual violence is expected to give punishment to the criminals in the form of payment of compensation to the victim whose amount is determined in the court, or fulfillment of the obligation of the Local custom or legal obligations that live in society or social and mental rehabilitation. If the convicted person tries to avoid giving the compensation, the convicted person is not entitled to a reduction in the criminal term and does not get conditional released.

The fenomenon of domestic violence, especially against women, becomes a serious social problem. Law enforcement is required in order to eliminate domestic violence. The purpose of this study is to find out how the form of legal protection against women as victims of violence in households and to know what factors affect the occurrence of violence in the household. This research method using normative law research method. The data used is secondary data from the Baubau city resort police in 2017. Data were analysis using qualitative analysis. The results of the study indicate that the form of legal protection against women as victims of violence in households is the protection of preventive and repressive law. In two forms of legal protection, preventive law protection is more dominant than repressive.

Human rights are the rights attached to every individual and recognized by international law, in practice regarding human rights is regulated to become more specific, namely being the right of the suspect. The KUHAP regulates the rights of suspects precisely in Article 50 until 68. In the case of writing this scientific paper, there are several suspect rights in the stage of investigations that are violated by law enforcement officers, especially article 52, which means there are differences between those stipulated in the law with reality. The research method used is a normative legal research method which is based on primary, secondary, and supported by the results of interviews with related professions, which are then analyzed deductively. The results of this study illustrate that there is legal uncertainty amid law enforcement in Indonesia. Theory of justice, Theory of legal protection and the theory of legal certainty used which essentially becomes a benchmark for conformity of law enforcement in Indonesia.

Transportation is one of the derivative needs in society due to economic, social activities, and so on. In general, there are two transportations, namely based on conventional and online, but the problem is that discrimination often occurs against providers of online-based transportation services, especially in transporting passengers. Thus, the purpose of this study is to find out the legal protection for online transportation service providers in transporting passengers and to find out the legal consequence of discriminating against online transportation service providers in carrying passengers. The method used in this study is normative legal research method. Meanwhile, the legislative and conceptual approach is the approach used in this study. The results of this study showed that the legal protection of online transportation service providers in Indonesia is regulated in legislation including the 1945 Constitution of the Republic of Indonesia which in principle every legal subject must be treated equally before the law, and Law Number 39 Year 1999 which protects that every person is entitled to a job, and legal protection is also contained in Law No. 8 of 1999 which in principle regulates the rights and obligations of business actors. The legal consequence of discrimination is that it can result in criminal and civil law in the form of compensation for imprisonment or fines.

The purpose of this study is to find out 1) whether the legal protection carried out by prison officers for prisoners is in accordance with Law Number 12 of 1999 concerning Corrections; 2) how is the security system at Class II B Penitentiary in Lubuk Pakam; and 3) What are the obstacles faced in law enforcement in Class II B Penitentiary, Lubuk Pakam. The research method used in this study is empirical normative juridical supported by secondary data and interviews with informants. The results of the study show that: 1) Correctional Institutions are a place to carry out the formation of prisoners and correctional students. 2) Community service and security and order maintenance in Lapas are not yet optimal, the quality of human security officers is low, and 3) Development officers and administrative officers must always be consolidated through coaching officers with concurrent and special meetings/briefings.

A wistleblower is someone who is aware of a criminal act and notifies it to law enforcement officials. The role of whistleblowers is very important to help expose acts of narcotics abuse. The purpose of this study is to determine the legal protection arrangements for whistleblowers in narcotics abuse and to find out legal protection for whistleblowers in narcotics crime. The research method used in this research is normative legal research method normative legal research method which is carried out by examining a statutory regulation related to the problem being discussed and through a conceptual approach or conceptual approach which shows a concept, and uses a conceptual approach. doctrine, namely the views or thoughts of experts related to the science of law. A person who is a whistleblower or notifier in narcotics abuse always bears a reply from those who feel aggrieved or aggrieved as a result of a notification or report from a whistleblower, legal security for a person who is a pioneer or whistleblower in investigating criminal acts of narcotics abuse is important given to the authorities so that all people are willing to become reporters in order to support legal institutions to reveal and arrest narcotics abuse. Security for whistleblowers must be made strictly in law so that security for whistleblowers can be upheld.

The problem of net neutrality has become a debate in many countries where the regulation on the net neutrality policy confirms that internet providers or Internet Service Providers (ISPs) are not allowed to make distinctions or be discriminatory in the selection of internet applications or content to be used by consumers or users. The purpose of this research is to analyze the application of network neutrality from the perspective of Indonesian law which specifically examines critically the applicable Information and Electronic Transactions Law. This research method is descriptive qualitative. The results show that the implementation of Net Neutrality in terms of the Information and Electronic Transactions Law is still not optimal because there are still network restrictions that are applied to certain Internet Network Providers. The results also show that there is a need for amendments to the ITE Law related to the enforcement of legal protection with the principle of forming a prohibition against the actions of Internet Service Provider (ISP) business actors that can disrupt the business climate.

This article aims to examine the use of exoneration clauses in a Notary deeds, as a new form of legal protection for Notaries in Indonesia. The research method used is juridical normative, with data collection techniques in the form of literature study of primary and secondary legal materials, and supported by interviews in support of the two legal materials. The results showed that it is possible to include an exoneration clause in a Notary deed, even though the Notary is not a party to the deed, the Notary can include the exoneration clause for his/ her own benefit. The exoneration clause as a self-protection effort carried out by a Notary, is a form of legal protection. In addition to functioning as an initial warning to the parties in the agreement, with this clause if there is an individual who states/ gives something that is untrue, then law enforcement officials can immediately take action against these parties without involving the Notary any further.
