Law Number 23, 2009 concerning Environmental and Management Protection has been running for eleven years. This law still needs a lot of evaluation, especially at the level of implementation or implementation. One of them is related to the sanction for corporations that do environmental damage. There are three types of sanctions that can be given to corporations, namely: civil, criminal and administrative. However, all this time the three did not provide a deterrent effect. As a result, the rights of affected citizens to get a healthy environment are also ignored. For this reason, this paper focused on how is the Analysis of corporate sanctions of perpetrators of waste dumping without permission viewed from a Human Rights perspective? This study uses a juridical normative research method, by analyzing secondary data in the form of laws and regulations related to sanctions for corporations that carry out waste dumping without permission. The results of the study found that the analysis of corporate sanctions for the perpetrators of waste dumping without permission did not represent the protection of human rights for the community. Legal fissures make the corporation can continue its activities and make it possible to do environmental damage again. It is necessary to maximize the application of the highest alternative sanctions by paying attention to human and community rights around the location of waste dumping where the quality of water, air, and soil has deteriorated.

This article is about the relation between environmental protection and human rights. The right to healthy environment is directly related to the right to life, in its meaning quality of life. The right to the environment has been analyzed in an indirect and reflexive way in regional systems for the protection of human rights. The purpose of this study is to analyze the right to the urban environment in the jurisprudence of the Inter-American and European human Rights Systems. In the methodological context, the analysis will be made of the theory and international legislation of these regional systems on the environment, the jurisprudence analysis of the Inter-American Court of Human Rights, and the European Court of Human Rights on the urban environment. Possible contributions will be made by the European Court to the Inter-American Court of Human Rights for the extension of environmental protection in the urban context.

This article addresses the consequences of economic sanctions for the protection of human rights in Latin America. The literature on sanctions and compliance informs three hypotheses, which investigate the relationship between sanctions and the level of rights protection in two groups of countries: those that were targeted by sanctions and those that were not. Using data from the Political Terror Scale (PTS) and from Freedom House, I find empirical evidence that sanctions do improve the level of protection in countries that were not targeted. This finding can be explained by the deterrent effect attributed to sanctions by the compliance literature, broadly interpreted. The presence of economic sanctions in a given year increases the probability of observing better human rights practices by almost 50%. These results hold for the 12 Latin American countries that were not subject to economic sanctions for the period 1976-2004.

Abstract During the Covid-19 pandemic, the government through the Ministry of Law and Human Rights reviewed the policy through Permenkumham No 10 in 2020 regarding the release of assimilation and the executive order making the child the perpetrator of this crime many were released. This makes bapas must improve the implementation of the development of the freed child. The problem in this study is how to optimize BAPAS in the implementation of child development as the perpetrator of crimes that are released because of Covid-19 and the obstacles faced by bapas in the implementation of the construction. The purpose of this study is to know how to optimize BAPAS in the development of children as perpetrators of crimes that are released because of Covid-19 and know the obstacles faced by bapas in the implementation of the construction of children as perpetrators of the crime struck. The research method used is normative juridical using secondary data obtained through literature studies such as scientific books, journals, laws. Key words : Correctional Center; Child; Covid-19 Abstrak Dimasa pandemi Covid-19, pemerintah melalui Kementerian Hukum dan HAM mengeluarkan kebijakan melalui Permenkumham No. 10 tahun 2020 terkait pembebasan dan asimilasi membuat anak sebagai pelaku tindak pidana ini banyak yang dibebaskan. Hal tersebut membuat pihak Balai Pemasyarakatan harus meningkatkan pelaksanaan pembinaan terhadap anak yang dibebaskan tersebut. Permasalahan dalam penelitian ini adalah bagaimana optimalisasi Balai Pemasyarakatan dalam pelaksanaan pembinaan anak sebagai pelaku tindak pidana yang dibebaskan karena Covid-19 dan kendala yang dihadapi pihak Balai Pemasyarakatan dalam pelaksanaan pembinaan tersebut. Tujuan penelitian ini adalah mengetahui bagaimana optimalisasi Balai Pemasyarakatan dalam pelaksaan pembinaan anak sebagai pelaku tindak pidana yang dibebaskan karena Covid-19 dan mengetahui kendala-kendala yang dihadapi pihak Balai Pemasyarakatan dalam pelaksanaan pembinaan terhadap anak sebagai pelaku tindak pidana yang dibebaskan tersebut. Metode penelitian yang digunakan adalah yuridis normatif dengan menggunakan data sekunder yang diperoleh melalui studi kepustakaan seperti buku-buku ilmiah, jurnal, undang-undang. This study aims to know how political development of legal protection of human rights in Indonesia and political objectives of the legal protection of human rights itself. The research method using normative juridical approach. Specification of the research is descriptive. Provide an overview and critical analysis and conclusions of the research object. Source data using secondary data sources through books and legislation. The data collection method through the study of literature. Analysis of data using qualitative approach. The results showed that the political development of the legal protection of human rights has undergone discourse tight since the formulation of the Constitution and found basic juridical-constitutional is ideal since the reform era with the birth of Chapter XA in the constitution on human rights, born Law of Human Rights, and the formation of the court of HAM. The purpose of a political human rights protection law contains three dimensions, namely the dimensions of philosophical, sociological dimension and juridical dimension.Keywords: Protection Of Human Rights; Political Law; State Law.

The authors analyse the national protection from emissions, in the first place, a property law component of this regime. Domestic regulation of the protection of property rights from harassment was brought in the perspective of the protection that the European Court of Human Rights provides for the right to live in a healthy environment, primarily through the protection of rights under Art. 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (right to respect for private and family life and home). In the context of the latter, the authors have analysed the interpretative methods used by the European Court and explored the following features: the requirement that environmental and environmental impacts and disturbances violate the Convention right, that is, the existence of a specific Convention causal link; the category of minimum level of severity; oscillation of the "quantum" of minimum level of severity within conventional "fluctuations"; and the scope (and type) of protecting the right to live in a healthy environment through the paradigm of the positive / negative obligations of the Contracting States.

Además de un instrumento internacional para la protección de los derechos humanos, el Convenio de Roma de 1950 es también un tratado concebido, en los términos del Tribunal de Estrasburgo, para el mantenimiento y la promoción de los valores e ideales de una sociedad democrática. Esta finalidad se encuentra muy presente en la jurisprudencia del Tribunal, en particular, aunque no solo, en el ámbito de los artículos 8-11 del Convenio y 3 del Primer Protocolo Opcional. Por otro lado, una jurisprudencia bastante reciente utiliza como criterio de identificación del ámbito de aplicación del margen de apreciación la «calidad» del proceso político nacional que ha conducido a la regulación general de la que trae causa una concreta injerencia en el derecho fundamental que el convenio garantiza. En este artículo se analiza tanto el concepto de democracia que resulta de las demandas decididas por el Tribunal como las exigencias que del mismo resultan para definir la extensión del margen de apreciación nacional.The European Convention on Human Rights of 1950 is not only an international treaty of protection of human rights, but also, in Strasbourg Court's terms, an instrument for maintaining and promoting the values and aspirations of a democratic society. This aim permeates all the case law of the Court, particularly in the field of articles 8-11 of the Convention and article 3 of the First Optional Protocol. On the other hand, the “quality” of the national political process has been considered in recent case law as a criterion for the application of the margin of appreciation doctrine. This paper analizes the concept of democracy shaped by the Court and its consequences for defining the extension of the national margin of appreciation.

This study aims to examine both the application and the accuracy of the accounting information system on outpatient and inpatient service at Medan General Hospital of Mitra Sejati. The research method used is a descriptive method using secondary data, in which the obtained data come from existing sources such as the profile of Medan General Hospital of Mitra Sejati, organizational structure, flowchart, and reports of outpatient and inpatient service at Medan General Hospital of Mitra Sejati. Based on the results of this research, it can be concluded that the accounting information system for outpatient service at Medan General Hospital of Mitra Sejati has not been effectively executed. There are a great number of mistakes made by medical staff in inputting patient data. Accordingly, in the future, Medan General Hospital of Mitra Sejati can provide training for employees in using the accounting information system effectively and is expected to improve outpatient and inpatient service to avoid errors that will impact the quality of service in the hospital.

The changes in the broadly conceived criminal procedure which were introduced in recent years refer to the problems which are crucial from the perspective of the protection of human rights, such as the scope of the authority of the services due to operational control which is conducted secretly, the model of the functioning of the public prosecution service or the unlawful acquiring of evidence in a criminal procedure. The evaluation of these changes, conducted by the Ombudsman from the point of view of the constitutional standards of the protection of the rights of the individual is not positive. The new regulations reduce the quality of these standards and they do not contain sufficient guarantees of protection against the arbitrariness of the activities engaged in these terms by the organs of public authority. This phenomenon imposes a particular duty on the courts – which hear criminal cases – to see that the final decision in a criminal case respects the universal standards of the protection of human rights.

Penelitian ini bertujuan untuk mengetahui Pelaksanaan Fungsi Balai Pemasyarakatan (BAPAS) Makassar Dalam Perlindungan Hak Asasi Manusia Pada Sistem Pidana Anak dan Kendala Balai Pemasyarakatan dalam Perlindungan Hak Asasi Manusia Pada Sistem Peradilan Anak. Penelitian merupakan penelitian normatif. Metode Pengumpulan Data melalui wawancara dan dokumentasi. Teknis Analisis data ini merupakan analisis kualitatif. Hasil penelitian menunjukkan bahwa Balai Pemasyarakatan kelas I Makassar sebagai salah satu penegak hukum khususnya dalam pembimbingan terhadap anak nakal menjalankan perannya tersebut melalui tiga tahap, yaitu tahap Pra ajudikasi, tahap ajudikasi dan tahap Post ajudikasi. Faktor kendala yang dihadapi dalam pelaksanaan Fungsi Balai Pemasyarakatan (BAPAS) antara lain kelemahan aturan hukum yang berlaku terhadap tindak pidana anak, kurangnya koordinasi diantara sesama aparat penegak hukum, rendahnya kualitas sumber daya manusia di BAPAS, and kurang Sarana dan Prasarana yang memadai. Mengakibatkan pelaksaan Fungsi Balai Pemasyarakatan (BAPAS) kurang optimal, dan alokasi anggaran dana yang sangat minim. This study aims to determine the implementation of the function of Makassar Correctional Center (BAPAS) in the Protection of Human Rights in the Criminal Justice System of Children and the Obstacles of the Correctional Center in the Protection of Human Rights in the Justice System of Children. This research is normative research. Data collection methods were through interviews and documentation. Technical analysis of the data is a qualitative analysis. The results showed that Correctional Center Class I Makassar as one of the law enforcers, especially in guiding delinquents carried out their roles in three stages, which are the Pre-adjudication stage, the adjudication stage and the Post-adjudication stage. Obstacles faced in the implementation of the function of Correctional Center (BAPAS) are weaknesses in the rule of law that applies to the crimes of children, lack of coordination among law enforcement officials, low quality of human resources at BAPAS, and lack of adequate facilities and infrastructure. As a result, the implementation of the function of Correctional Center (BAPAS) is not optimal, and the budget allocation for funds is very minimal.

The purpose of this study is to analyze and explain the protection of human rights in the economic sector for citizens to be able to enjoy a socially just economic development as well as to analyze and explain the challenges and obstacles in protecting human rights in the economic sector in an effort to realize social justice in the Constitution 1945. important in the constitution which gave birth to the concept of protecting human rights in the economic sector, which was initiated by the founding fathers, regarding Indonesian socialism. Hatta's idea was in line with Soekarno's thinking as "Indonesian-style socialism" which was adapted to Indonesian conditions. Qualitative research with normative juridical research type with secondary data by means of literature study. The conclusions of this study are 1) so far regulations have not provided much protection for human rights in the economic field, because they are against the principles of economic democracy in Article 33 of the Constitution 1945, so that the interests of citizens are marginalized. 2) regulations so far have more accommodated the principles adhered to by developed countries, the emergence of the era of liberalization, world trade without protection and without obstacles, will increase the level of trade competition among economic actors in Indonesia.
