Abstract. The role of the industrial sector in meeting the livelihoods of the people of Banten should be accompanied by efforts to develop an industrial system that prioritizes the halal value on its production. The development of the halal industry can be realized with a system of planning, implementation and supervision in accordance with the principle of halal thayyibah. The method that will be used in this research is descriptive qualitative. Information gathered from the initial research is expected to provide an overview and prescription of the relationship between the planning, implementation, and supervision of the implementation of the Halal Industry in Banten Province. The results of this study explain that aspects of industrial planning should pay attention to aspects of Maqashid Syariah and aspects of trust as an effort to provide certainty that industrial products are in accordance with halal provisions. In practice, industrial management should not only issue technical rules but must also be accompanied by qualifications of basic sharia knowledge in production activities. While in the aspect of supervision, the person in charge must have a deep understanding of the aspects of li dzatihi, li ghairihi, and li aqibatihi as the main components of the halal system. Constraints on halal industry development are experienced by micro and small businesses due to certification costs, inadequate halal industry governance, and fears of leakage of company product secrets.Abstrak: Peran sektor industri dalam memenuhi hajat hidup masyarakat Banten hendak­nya harus dibarengi upaya pengembangan sistem Industri yang mengedepankan nilai halal pada produksinya. Pengembangan Industri halal dapat diwujudkan dengan sistem perencanaan, pelaksanaan dan pengawasan yang sesuai dengan prinsip halâlan thayyibah. Metode yang akan digunakan dalam penelitian ini ialah deskriptif kualitatif, Infor­masi yang tergali dari penelitian awal diharapkan dapat memberikan gambaran dan preskripsi hubungan antara sistem perencanaan, pelaksanaan, dan pengawasan ter­ha­dap penyelenggaraan Industri Halal di Provinsi Banten. Hasil penelitian ini men­jelas­kan bahwa aspek perencanaan industri hendaknya memperhatikan aspek maqashid Syariah dan aspek amanah sebagai upaya memberikan kepastian bahwa produk industri telah sesuai dengan ketentuan halal. Dalam pelaksanaannya, manajemen industri hendaknya tidak hanya mengeluarkan aturan-aturan tekhnis semata namun juga harus dibarengi dengan kualifikasi pengetahuan kesyariahan mendasar pada kegiatan pro­duksi. Sedang­kan dalam aspek pengawasan, penanggungjawab harus memiliki pema­haman men­dalam pada aspek li dzatihi, li ghairihi, dan li aqibatihi sebagai komponen utama sistem halal. Kendala pengembangan Industri halal dialami oleh usaha mikro dan kecil dikarena­kan biaya sertifikasi, tata kelola industri halal belum memadai, serta ketakutan akan bocornya rahasia produk perusahaan.

As the final chapter of the book, Chapter 10 confronts the limits of an imagination that is constitutional and constituent, as well as (e)utopian—oriented towards concrete visions of a better life. In doing so, the chapter confronts the role of Square, Triangle, and Circle—which subtly affect the way we think about legal hierarchy, popular sovereignty, and collective self-government. Building on that discussion, the chapter confronts the relationship between circularity, transparency, and iconography of ‘paradoxical’ origins of democratic constitutions. These representations are part of a broader morphology of imaginative obstacles that stand in the way of a more expansive constituent imagination. The second part of the chapter focuses on the most important five—Anathema, Nebula, Utopia, Aporia, and Tabula—and closes with the discussion of Ernst Bloch’s ‘wishful images’ and the ways in which manifold ‘diagrams of hope and purpose’ beyond the people may help make them attractive again.

The mid-nineteenth century critical discourse compartmentalized art and industry by crediting each with specific powers. Manufacturing was identified with the development of technologically advanced processes, materials and products, while fine artists were given authority over the aesthetic aspects of industrial design. The idea that the two sectors had separate areas of responsibility has proved extremely enduring, and continues to influence our perceptions of Victorian manufacturing. This article contributes to the wider task of re-evaluating the relationship between art and industry in nineteenth-century Britain by examining the role of design in potteries and art metalworking firms from the manufacturer’s perspective. It shows that contrary to the picture painted by Victorian critics, design was central to the ambitions and commercial operations of manufacturing businesses. Crucially, decisions about the recruitment of design staff were shaped by the close connection between the creation of new products at the drawing board, and their fabrication in the workshop. Since each branch of manufacturing had its distinctive characteristics, there were significant practical, aesthetic and commercial advantages for manufacturers in employing experienced designers who knew the trade, and were fully conversant with production practices. Unless a professional sculptor joined a firm, they were unlikely to have this inside knowledge, which made commissioning one-off designs from artists a riskier proposition. Manufacturers found that one of the best ways to get around this was to make reductions of sculptures, and initial demand for statuettes in Parian suggested they would be profitable for all concerned. In the end, the market did not live up to its early promise, but the publicity given to Parian statuettes compensated manufacturers and sculptors. Overall, it was this increased public exposure for art manufactures that was the prime benefit of the mid-nineteenth century critical discourse for the industrial sector.

The article revolves around the doctrine of precedent within the so-called European legal space, wondering whether and to what extent we can speak of a convergence towards a stare decisis model boosted by the harmonizing role of the Court of Justice of the European Union. The article argues that although there are still some differences between civil law and common law legal systems they regard more the style of reasoning and the deep understanding of the relationship between the present decision of a court and past judicial decisions than the very existence of the constraints of the latter upon the former. The article concludes that a sort of mechanism of stare decisis has in fact been created, even though, on the one hand, uncertainty remains as to the way in which the binding force of a precedent concretely operates in the system, and on the other hand, this mechanism relates exclusively to the relationships between past and future decisions of higher courts (horizontal effect). This change, far from being a shift towards a truly judge-made law system or a consequence of the final abandonment of the dictates of the rule of law, enhances legal certainty contributing to the fundamental requirement of stability of law as a feature of the ideal of the rule of law.

PurposeArtificial intelligence (AI)-based chatbots have brought unprecedented business potential. This study aims to explore consumers' trust and response to a text-based chatbot in e-commerce, involving the moderating effects of task complexity and chatbot identity disclosure.Design/methodology/approachA survey method with 299 useable responses was conducted in this research. This study adopted the ordinary least squares regression to test the hypotheses.FindingsFirst, the consumers' perception of both the empathy and friendliness of the chatbot positively impacts their trust in it. Second, task complexity negatively moderates the relationship between friendliness and consumers' trust. Third, disclosure of the text-based chatbot negatively moderates the relationship between empathy and consumers' trust, while it positively moderates the relationship between friendliness and consumers' trust. Fourth, consumers' trust in the chatbot increases their reliance on the chatbot and decreases their resistance to the chatbot in future interactions.Research limitations/implicationsAdopting the stimulus–organism–response (SOR) framework, this study provides important insights on consumers' perception and response to the text-based chatbot. The findings of this research also make suggestions that can increase consumers' positive responses to text-based chatbots.Originality/valueExtant studies have investigated the effects of automated bots' attributes on consumers' perceptions. However, the boundary conditions of these effects are largely ignored. This research is one of the first attempts to provide a deep understanding of consumers' responses to a chatbot.

Abstract:This article aims to provide an alternative account of political constitutionalism by situating it in a broader process of constitutional politics than the traditional court vs parliament debate has suggested. Drawing upon Robert Cover’s distinction between the jurispathic and the jurisgenerative constitution, I argue that parliamentary decision-making is not necessarily more congenial to a jurisgenerative constitutional order than judicial review as political constitutionalists contend. I trace the jurispathic character of current scholarship on political constitutionalism to the presupposition of institutional sovereignty in a narrow understanding of constitutional politics, which its defenders share in common with the supporters of judicial supremacy. To move towards a robust version of non-court-centred jurisgenerative constitutionalism, which I call constitutional jurisgenesis, we need to rethink the place of politics in a constitutional order. From Cover’s idea of constitutionalnomosI take two further lessons for this new understanding of constitutional politics. First, constitutional theory should reconsider the role of institutional sovereignty in the relationship between law and politics in constitutional orders. Second, to engage the people in constitutional politics, we need to shift attention from the popular sovereignty-centred debate to constitutional narratives, which are oriented towardsnomos-building.

Relevance. The increase of children interest in entertainment TV programs, mobile applications and video games available on the internet causes a significant decrease in their physical activity: children get used to a sedentary or lying down lifestyle. The research problem lies in the contradiction that arises due to understanding of the positive effect of physical activity on the development of the regulatory functions of a preschooler, and a significant decrease in this activity in the digital conditions of the modern educational environment. The relevance and prospects of the study of the relationship between regulatory functions and physical activity of preschool children in new digital environment are not yet fully realized. The objective of the paper is to review the studies by foreign scientists in order to identify and describe relevant indicators of physical activity in preschool children interrelated with the main components of regulatory functions (inhibitory control, working memory, cognitive flexibility). Method. A theoretical review of research papers published over the past ten years (2010–2020) on the subject of relationship of various physical activity indicators and regulatory functions in preschool children. Results. The paper provides a comparative analysis of studies conducted by foreign authors. It allows to reveal basic indicators of physical activity in children which are essential for the development of regulatory functions (sufficiency of physical activity; age-related appropriateness; the nature of physical activity; the form of physical activity arrangement), and particular indicators (the relationship of physical activity and regulatory functions in various sports, duration and intensity of physical activity, the availability of software for the development of physical activity in preschool children) as well. Conclusions. The review showed that the majority of the authors emphasized the significant role of basic physical activity indicators and their influence on regulatory functions. Aerobic exercises are the most effective in the development of regulatory functions in preschool children. Particular indicators are selected from the studies of the development of regulatory functions in specific sports (football, karate, yoga, mini-trampoline), and additional research on the duration and intensity of physical activity is needed.

Chiuri trees and beekeeping are the major sources of livelihood among the Chepang community. The study was performed to assess the role of Chiuri on livelihood improvement of the Chepang community through beekeeping and to analyze the efforts of CFUGs to conserve the Chiuri in Silinge Community Forest User Group, Raksirang-6, Makawanpur district, Nepal. Focus Group Discussion, Key Informant Survey and Individual interview in households were carried out for the study from January to March 2019. With the increasing demand for organic honey made from Chiuri, the locals of the Chepang village in Makawanpur have started generating a good income from beekeeping. The majority (63%) of the respondents reported that the trends of the status of beekeeping were increasing in households. The selling of honey was the main source of income for the people of Silinge CFUGs. 1/3 of households earned the money in the range of NRs 200,000 (US$ 1,720.83) - NRs 300,000 (US$ 2,581.24). Physical capital and financial capital have significantly increased, whereas human, social and natural capitals were in increasing trends. The relationship between Chiuri and honey bees was very positive for both. The marketing system of Chiuri is not well developed in the study area. The Chepang community will get more prices after certifying their products as organic. Organic Certification of Nepal (OCN) should conduct studies about organic honey.

This research is a case study to help identify the driving factors of e-commerce acceptance by small businesses in Keranggan Village in Indonesia. This study argues that factors such as technology-organization-environment need to be strengthened by network capability from business actors so that e-commerce adoption intention emerges.  From the total samples of 100 business actors in Keranggan Village. The study utilized Structural Equation Modeling (SEM) with SmartPLS 3.0 for data examination. Consequently, the relationship of technological context with e-commerce acceptance is mediated by significant network capability.

ABSTRACTThe general election is held directly to execute the mandate of the Constitution which stipulates that sovereignty belongs to the people. Therefore, a country that calls itself as a democratic state, the elections should be held at a certain time. Election Commission is an institution established by legislation to hold elections which is national, permanent and independent. Indonesia is a unitary state is a republic whose government delivery system is framed within a policy of decentralization and regional autonomy. One of the most important steps in ensuring good governance at central and local is the process of forming a good government anyway, so also in the Bengkulu Province. Therefore, researchers are interested in taking the title essay “The Role of the Bengkulu Provincial Election Commission in Simultaneously Local Elections in 2015 in Bengkulu Province”. This research aims to determine the role of Bengkulu Provincial Election Commission in conducting simultaneously local elections in 2015 in the Bengkulu Province, the obstacles encountered and efforts made to overcome these obstacles. In analyzing the problems and the facts, the researchers used the theory of the role according to Soekanto. Furthermore, this research will yield some suggestions for the various parties to the improvement of the election system with simultaneous concepts, especially in the Bengkulu Province for the next elections. Through a kind of qualitative research with descriptive and inductive approach, researchers find and process the data and facts onthe ground and then explained in detail and deep understanding of the role of Bengkulu Provincial Election Commission in conducting simultaneously local elections in 2015 in Bengkulu Province. Researchers conducted ethnographic data collection techniques, participant observation, and in-depth interviews. Conducted semi structured interviews with several informants were selected according to the criteria of an ideal informant. Data, facts, and information obtained from the interviews will be through reduction techniques, featuring in a table or chart display, and conclusion drawing. Based on the results of research conducted, proving that Bengkulu Provincial Election Commission perform the role well in the simultaneously local elections in 2015 in Bengkulu Province. The role has not been well executed in terms of facilitating the campaign and increase the number of voter, unfortunately the number of abstention is increase. There are four obstacles faced by the Bengkulu Provincial Election Commission, but followed up with a four attempts have been made in overcoming these obstacles.
