Introduction: modern society involves the creation of legal mechanisms aimed at the introduction of digital systems in all legally significant public interests. At the same time, modern federal programs and strategy for the development of the information society in Russia are the basic elements of the country’s economic development. The aim of the study is to identify the main legal components of the modern digital economy of the Russian Federation. Using the methods of scientific knowledge, especially the method of system analysis, it is found that the complexity of the problem involves the use of both law-making and law-realization “vision” of the main directions and forms of the legal adaptation of the digital systems of the modern economy support. Results: the noted shortcomings in the rule-making development are identified on the basis of the analysis of the data from the electronic banks, which allowed justifying the need for the legal regulation of digital relations in terms of improving the rules of law and the law enforcement practice in the country and proposing a number of measures to eliminate them. Conclusions: it is necessary 1) to create the normative conditions of the digital rights adaptation for the subjects of entrepreneurial activity; 2) to introduce a uniform approach to the concept of digital relations; 3) to justify the most significant advantages of the introduction of digital relations and information technologies covering the whole society.

The article reveals the content and outlines approaches to the definition of the legal nature of mining. Attention is drawn to the necessity of legal regulation of this activity, which is predetermined by the Federal Program «Digital Economy of the Russian Federation» — a project that provides for normative regulation of the digital environment. In order to support the mission to eliminate digital illiteracy, which is also envisaged in the National Program, the author elucidates the etymology and meaning of the term «mining» and considers various doctrinal interpretations of this concept. The paper presents such analogies of the blochchain technology as the public ledger, DNA, and a layer-cake for a better understanding of the blockchain technology that is associated with mining. Material-technical and organizational foundations of mining are revealed. The author demonstrates advantages and disadvantages of solo mining, pool mining, and cloud mining. The results of comparative monitoring of the attitude to the recognition of cryptocurrency as a means of payment are presented. Attention is drawn to the liberal legal regulation of blockchain technology and mining under the laws of the Republic of Belarus. The paper determines the stages of a law-making process aimed at legal support of mining in Russia. Based on the results of comparison of concepts of entrepreneurial activity and mining, it is concluded that mining represents one of new types of entrepreneurship brought to life due to the needs of digital economy. The author suggests thatmining participants be recognized as self-employed persons. It is noted that the entrepreneurial nature of mining arises questions concerning measures of its state regulation which is difficult within the framework of the existing paradigm, but should be built on the basis of a balance between private and public interests.

This paper focuses on the potential problems of the introduction of digital technologies in transport in the socio-economic and legal dimension based on the assessment of the current state and development trends of the info and communication in the transport infrastructure in Russia, foreign experience. Moreover, it performs specific proposals for legal and financial regulation of issues and minimization of risks of liability for harm in conditions development of information transport systems. The paper analyses the role of the programs “Digital Economy of the Russian Federation” and “Safe and High-Quality Roads” in the development of intelligent transport systems that constitute some promising areas of the use of unmanned vehicles to improve the quality of life of people. Furthermore, we assess the development of entrepreneurial activity, high-tech industries, and the increase the investment attractiveness of Russia and analyse the strengthening of its position in the international arena. When it comes to the methodology, we use legal analytics, legislative technology, comparative law, and expert assessments. The results of this research reveal the features of the legal regulation of new and promising emerging relations in the digital economy. This is a strategic legal planning and legal experiment. Based on this conclusion, a system of prerequisites for the development of intelligent transport systems based on the analysis of national programs is formulated. The article is devoted to the analysis of amendments to the Constitution of the Russian Federation relating to the protection of national security, including in the field of information. Purpose: to analyze the role and impact of the amendments to the Constitution of the Russian Federation in 2020. These amendments are related to the State regulation at the federal level of information security and the tasks of ensuring the support and preservation of scientific and technological potential and the development of Russia. Methods: the work is based on the methods of dialectics and system analysis of the information and legal sphere, which allow to comprehensively, logically and consistently study the processes of implementation of constitutional and legal norms and the prospects for their development in the legal regulation of information security in order to identify existing patterns and development trends, as well as priority tasks. Results: the study leads to the well-founded conclusion that referring in the Basic Law to the federal authorities the security of the person, society and the State in the use of information technologies and digital data circulation is a constitutional and legal innovation that is fundamental to the development of legal and scientific research in the field of information security as an important component of the national security of the State, as well as for the development of the system of legal regulation in this areas in information law.

Problem statement. The accelerated development of the digital economy involves making proactive decisions to minimize the risks and threats of the new business format to the efficiency of the agricultural industry. Purpose of article. Specify key directions of development of digital technologies in the management of material resources and financial flows, to justify the risks and threats when implementing a digital control models, identify key factors in the transition moving to digital. The object of research is the management of material resources in the context of the development of the digital economy. Methods used in research. The theoretical and methodological basis for research was the work of scientists on the development of the digital economy and the management of material resources in agriculture. In the course of re- search, the following methods were used: monographic, abstract-logical, synthesis and system analysis, etc. The hypothesis of the study. The development of electronic and digital systems and models of material re- source management in comparison with traditional ones has a wide range of features, barriers and opportunities. Presentation of the main material. The development of digital technologies in agriculture is fragmented. The implementation of effective digital systems for managing material resources involves responding to and anticipating risks and barriers at the stage of transition from traditional to electronic models. Originality and practical value. The scientific novelty of the research is to systematize and supplement the scientific basis for the development of digital models of material resource management in agriculture, which subsequently contributes to the development of the concept of "Intellectualization of agribusiness in the Republic of Belarus" in terms of material resource management. Conclusions. The implementation of an effective system for managing material resources in agriculture in Belarus in the context of the digital economy is possible by drawing up road maps for parallel digitalization of all sectors of the national economy, which contains opportunities, risks, and barriers to implementing electronic business models.

The article considers the main aspects of the electronic criminal investigation technologies application from the point of view of modern legislation of Russia and foreign countries. In modern society, there is a continuous process of improving the means of transmitting information, developing and implementing new technical devices for its processing and storage. The rapid development of science and technology inevitably leads to the desire to regulate the relations that arise in this area from a legal point of view. Meanwhile, in the Russian legal science, the information space is defined through the unity of its two components: the technical one, which includes the communication and communication infrastructure, and the social one – the community of Internet users. In this regard, the normative regulation of this area justifiably causes objective difficulties. The development of high technologies leads to the most frequent use of a relatively new form of technical and forensic support for the investigation of criminal cases in the process of criminal investigation. In the modern practice of investigation, the traces left by criminals on various media due to the expansion of digitalization processes are becoming more and more important every year. Timely, systematic development of legal regulation of the use of electronic information technologies is recognized as the most important condition for the successful digitalization of criminal proceedings. Understanding the need for the introduction of electronic technologies in the investigation of a criminal case from the point of view of the informational and technological nature is necessary, since the criminal process should not be an exception within the framework of a single international information policy, and its technological effectiveness should be dominant.

The modern society, having entered a way of postindustrial (information) progress, has unlimited access to various information technologies. The modern person can’t imagine his life without Internet network, mobile communication and instant messages, e-mail, electronic payments and credit cards. However, «simplification» of modern human life entails set of infringements in the sphere of constitutional and civil human rights. The basic feature of legal regulation of the right of a citizen of the Russian Federation on the storage and distribution of personal data in terms of social development and world globalization is conformity of laws to basic issues of the Constitution of the Russian Federation and practical applicability.

The objective of the research is to provide a scientific analysis of the development of the digital economy in the context of sustainable competitive advantage. The methodological basis of the study was the theoretical provisions of fundamental and practical developments in the digital economy, lying at the intersection of various technologies. Under the influence of digital forms of economic activity and the scientific and educational sphere, knowledge and education are turning from a luxury article into a productive force of society. Meanwhile, a global reach of digital technologies in the context of sustainable competitive advantage leads to a change in culture, traditional approaches to education, and serves the interests of the accelerated deployment of the digital economy. Managing the development of human capital as a basic engine for the development of the economic system is an absolute must for the integration of information technologies into modern society. Individuals and effective institutions are becoming a fundamental factor in the productivity, effective development, and formation of the digital economy.


The article analyzes the current state and prospects for improving the legal regulation of public administration in the sphere of stimulating the development of information technologies, including formation of a digital economy in the Russian Federation. Based on the analysis of the Russian legislation, key elements of the legal mechanism of public administration in the sphere of stimulating the development and introduction of technologies in various fields that can be used to stimulate the development of information technologies are identified. The analysis of the documents of strategic planning and information legislation made it possible to substantiate a number of proposals for improving the legal regulation in the sphere under consideration, including legislative provisions for stimulating IT development, identifying and eliminating legal and organizational barriers to their development, and measures to stimulate it.

Modern society is characterized by rapid increasing the information volume and increasing its role in various fields of activity: economic, political, social and public ones. The rapid spread and introduction of information technologies, the growth of information data flow pose new challenges to the modern society. Global informatization dictates the need to form an infrastructure for processing and managing Big Data - an array of data, the processing of which requires special skills, knowledge and applications. The formation of the digital economy through the penetration of ICT and the digitalization of production processes contributes to the modernization of traditional industries, trade and procurement procedures, related financial and logistics operations, as well as markets with other sources of added value. Big Data as a new tool for analytics, forecasting and management decision making is becoming a leading asset and resource of the state, business and society as a whole. At the same time, the absence of physical boundaries in the digital space opens up access to big data for all participants in the global space. The national program “Digital Economy of the Russian Federation” is aimed at creating the necessary institutional and infrastructural conditions for the development of high-tech businesses, increasing the competitiveness of the national economy, the quality of life of citizens, and ensuring economic growth. One of the federal projects “Human Resources for the Digital Economy” is aimed at ensuring the training of highly qualified personnel for a modern society with high professional qualifications, skills and abilities to develop and introduce competitive products. Therefore, a Data Science specialist is a profession shaped by the needs of the Russian economy. In this regard, new challenges and methodologies for training IT specialists with the necessary knowledge and skills that meet the requirements of high-tech business are being formed.

The article discusses the canon of the Marxist critique of capitalism, its methods and means for analyzing economic institutions and the information technologies that affect them. The authors postulate that the Anglo-American academics who remain faithful to this canon are quite leftist in a way that derives from concerns about corporate culture and leads to oversimplifications and distortions of the phenomena in question. For example, economics has turned into an empty concept of capitalism studied through secondary texts and their interpretations in a presentation mode. As the latest failure to link Marxist and managerial discourses in the digital era, the authors cite Platform Capitalism by Nick Srnicek, one of the founders of the accelerationist movement and author of essays on the future of capitalism. The most controversial ideas in Srnicek’s book include the rhizomaticity of the platform model of economics, which he did not himself elaborate but proposed as the typology and genealogy of platforms in recent economic cycles (from the 1970s until the mortgage crisis of 2007 in the USA) when the foundations of the infrastructure and business strategy of the modern digital economy were shaped. The article focuses in particular on the enduring topics of leftist discourse under the new conditions of the digital economy: falling profit margins, deficit, crises of overproduction, exploitation, control, profit-seeking and market competition as explicit motives that supposedly guide the capitalists and managers in addressing new technologies together with the specter of an inevitable apocalypse. The authors question the most popular leftist approaches to critique of digital technologies and of the business models of platform companies and propose a more constructive appreciation of their role in modern society and economic liberalization by taking into account their public benefit and their cultural significance for users.
