OBJECTIVE: The aim of this study was to review the use of orthodontic records (OTR's) by Brazilian orthodontists and propose a behavioral approach from a legal point of view, drawing on their interpersonal relationship with their patients. METHODS: A statistical cross-analysis was performed to compare five groups. A sixth group was created comprising the intersection of the responses provided by the five aforementioned groups. RESULTS: The results demonstrate that 42.2% of orthodontists require initial and final records and keep orthodontic records throughout their professional career; 13.9% duplicate the initial records and consider patients as the lawful owners of these documents; 19.5% make use of a medical history questionnaire, to be duly signed by all patients; 5.4% acknowledge that the decision to undergo treatment is ultimately the patient's, and, therefore, an alternative response "not perform the treatment" should be included in the questionnaire; 24% recognize the importance of the Consumer Protection Code (CPC), regard the provision of orthodontic services as an obligation of means; and explain to the patient the risks involved in orthodontic practice. Among the 1,469 orthodontists researched, 0% simultaneously took into account all aspects of this study. CONCLUSION: It was concluded that Brazilian orthodontists adopt a mistaken legal, professional and behavioral attitude, neglecting to build patient's orthodontic record with due care and in accordance with the law, which makes them vulnerable to patient disputes, contentious or otherwise.

The article examines the legal and moral and ethical aspects of a misdemeanor that discredits the honor of an employee of the criminal Executive system. The considered reason for dismissal has the main feature associated with the integration of legal and moral norms, which often raises a lot of questions about the attribution of a particular offense to this basis. Using the analysis of normative legal acts, the authors attempt to identify the signs that contribute to the separation of the studied grounds for dismissal from all their diversity. The classification of offenses that discredit the honor of an employee of the criminal Executive system is presented, which allows to systematize and organize the knowledge obtained about the considered grounds for dismissal. The analysis of a misdemeanor that defames the honor of an employee of the penal system from a moral and ethical position gives an understanding, first of all, that it does not have a clear regulation from the point of view of the law, but the consequences of committing such a misdemeanor are clearly legal. The concepts of “honor” and “dignity” are considered as ethical categories and are analyzed as personal qualities that are manifested in an employee of the penal correction system during the period of service. These categories in the behavior of a person or employee are manifested both externally (assessment from the outside) and internally (self-assessment). The article describes the value orientation of an employee of the criminal Executive system to ethical standards in professional activity, which is an integral part of the moral and ethical side of a misdemeanor that discredits the honor of an employee.

Contingent charges for financial services, such as fees for unauthorized overdrafts, are often controversial. We study the economics of contingent charges in a stylized setting with naive and sophisticated consumers. We contrast situations where the naive benefit from the presence of sophisticated consumers with situations where competition works to subsidize the sophisticated at the expense of the naive, arguably unfairly. The case for regulatory intervention in these situations depends in good part, but not only, on the weight placed on distributional concerns. The economic and legal issues at stake are well illustrated by a case on bank charges recently decided by the U.K. Supreme Court. (JEL D14, D18, G21, G28, L51)

<p><strong>Resumen</strong> El presente trabajo versa sobre las últimas medidas legislativas introducidas a fin de garantizar los derechos a la maternidad y a la conciliación de la vida familiar y la actividad profesional de las trabajadoras autónomas, desde las perspectivas del principio de igualdad y de la promoción del autoempleo femenino. A tal fin, se estudian las escasas referencias a la conciliación en materia de jornada contenidas en la LETA. Especial atención merecen las bonificaciones en la cotización relacionadas con el ejercicio de sus derechos en materia de maternidad y conciliación, reguladas en los arts. 30, 38 y 38 <em>bis</em> LETA. Asimismo, se trata sobre la posibilidad de contratación de personas asalariadas por los TRADE, introducida en el art. 11.2.a) ET. Finalmente, se analizan las garantías previstas en el art. 15 LETA frente a la facultad de la empresa cliente de resolver el contrato con el TRADE, aspecto este último en el que se observa un claro paralelismo con el régimen aplicable al trabajo por cuenta ajena, a la vez que ciertas carencias que pueden ser consideradas contrarias a la Constitución Española. Todo ello, a la luz de las novedades introducidas por la Ley 6/2017, de Reformas Urgentes del Trabajo Autónomo.</p><p><strong>Abstract</strong> This paper studies the various mechanisms that the last legislative reforms have introduced in order to guarantee the right to motherhood and the reconciliation of family life and professional activity of self-employed women, both from the point of view of the principle of equality and from the perspective of the promotion of entrepreneurship and female self-employment. To this end, the paper reviews the few references to the conciliation in terms of working hours found in the LETA. Special attention deserve the Social Security contribution bonuses applicable to the hiring of employed persons by self-employed women to enable them to exercise their maternity and reconciliation rights, according to arts. 30, 38 and 38 <em>bis</em> LETA. Likewise, it deals with the possibility of hiring salaried persons by economically dependent workers, provided by. 11.2.a) ET. Finally, the guarantees introduced in art. 15 LETA as to the faculty of the client to resolve the contract with economically dependent workers, are analyzed, concluding the existence of a clear parallelism with the regime applicable to employment contract, while certain shortcomings that could be considered contrary to the Spanish Constitution. The article discusses the issue of the formation of professionally important qualities (PIQ) in future military aviation navigators in the educational environment of a military university. The goal is to substantiate the activity approach as a practice-oriented basis for the formation of professional qualities in cadets-navigators. A review and analysis of scientific research, publications is carried out, allowing to discover the significance of the activity approach as a methodological direction of research. The methodological basis of the research is the provisions of the activity approach, which are used as the basis for the development and formation of the PIQ among cadets-navigators in the process of a practice-oriented educational process. The description of the results is associated with the characteristics of the content and organization of the professional activity of cadets-navigators in the process of implementation of industrial practice in the form of flight training. Using the activity approach, the main components of the activities of flight instructors, teachers and cadets-navigators are considered, from a unified methodological point of view, and thus the nature of their interaction is revealed. Emphasis have been determined that need to be paid attention to in the course of pedagogical activity on the formation of professional qualities among cadets-navigators. A definition is given and pedagogical technologies are proposed for the formation of professional experience and professional qualities in a future specialist in the context of a practice-oriented pedagogical process. The relationship between the experience gained by the trainee in the practice-oriented pedagogical process and the formation of professionally important personality traits of a specialist is considered. The main goals and objectives for the formation of the necessary professional qualities of cadetsnavigators during flight training have been determined. At the entrance of each stage of flight training, technologies are determined aimed at rational and purposeful impact on the student in order to develop competencies and personal qualities. Recommendations are offered to teachers and instructors to improve the efficiency of development and formation among cadets-navigators of the PIQ.

The article presents an analysis of the problem of human resource retention in the coal-mining region. It is emphasized that along with the factors of economic development it is advisable to take into account the socio-cultural needs and preferences of employees to ensure the preservation of human resources and the development of human capital on this basis. The article substantiates the need to rely on the actual socio-cultural needs of the subjects of professional activity when building activities for the development of the socio-cultural space of the coal-mining region. The article analyzes the implementation of strategic measures for the creation of the Siberian Cluster of Arts from the point of view of the development of the socio-cultural space of the region for the retention of human resources. The empirical part of the article is presented by the results of the study of socio-cultural needs, leisure preferences and the assessment of the attractiveness of the factors of living in Kuzbass by employees of the coal industry enterprises of the region. The sample population included 93 respondents living in the following cities: Kemerovo, Berezovskiy, Kiselevsk, Novokuznetsk, Polysaevo, and Prokopyevsk. The main method of collecting information was a survey conducted through GoogleForms. The analysis uses methods of mathematical statistics, quantitative and qualitative analysis of the results, and analysis of the significance of socio-cultural needs for the respondents.

Purpose – The concept of the “resilient organisation” has gained popularity as a concept that might aid organizations survive and thrive in difficult or volatile economic times. Knowing which factors may contribute to building organizational and team resilience is one of the questions that still remain unsolved. The purpose of this paper is to examine and review different conceptualisations of this emergent topic in the management literature, taking into account the common features of resilience capacity in organizations and teams. Design/methodology/approach – To examine the literature on resilience, the authors will focus on team resilience. The authors depart from the psychological-behavioral approach to study resilience and instead take a multilevel perspective (i.e. taking into account organizational and team factors). Findings – From a psychological-behavioral point of view the authors posit that there is a lack of research on which factors build team resilience. This review clarifies and relates independent and isolated studies on resilience taking into account the resources both at team and organizational level (i.e. collective efficacy, transformational leadership, teamwork, organizational practices) that build team resilience capacity. Research limitations/implications – Taking into account this review, future studies should analyze empirically the relationship between these factors that build up team resilience. Practical implications – With this review the authors try to provide guidance as to which aspects of the organization both research and practitioners should focus on. Originality/value – In sum, this literature review examines organizational and team factors that may build team resilience from a psychological-behavioral perspective, taking into account the multilevel view.

This study focuses on the problem of relationships between personality traits and stylistic characteristics of professional interaction between a teacher and student, the consideration of personal determinant of the stylistic peculiarities of their interaction, as well as the styles of professional activity of a teacher. The model of interaction of subjects of educational process, from the point of view of innovative personality-oriented education is considered. And the result of this interaction is the transformation of educational features into personal and the transition to personal meanings. It is the personal importance of the subject of interaction and the interaction itself that contributes to the formation of the subjective position of the student and the teacher. The main emphasis is placed on the subject-subject interaction of participants of the educational process, personal determinants of style features of psychological and pedagogical interaction, which contribute to the development of the success of professional activity of the teacher.
