AbstractThe large number of prisoners who are elderly and experiencing illness in Indonesia, making the legislators through the Clemency Law add a special reason for granting Clemency. The reasons for Humanity and Justice are added reasons for filing a pardon by the Minister of Justice and Human Rights if the prisoner is in the condition of: 1) children; 2) >70 years old; 3) prolonged illness. Of the several conditions that have been regulated, the condition of "prolonged illness" is a condition that is often abused due to the broad and open concept. So far, there is no clear and definite regulation related to any disease that can be categorized as prolonged illness. Not a few parties who make this condition as a gap to be able to buy their freedom. It is feared that this will overcome the sense of justice that is expected to be realized in granting clemency. Through the normative juridical research method, the author is able to answer the issue of this problem by answering any criteria that can be categorized as prolonged illness. Keywords: Clemency; Humanity and Justice; Prolonged Illness.AbstrakBanyaknya jumlah narapidana yang lanjut usia dan mengalami sakit di Indonesia, membuat para pembentuk undang-undang melalui UU Grasi menambah alasan khusus dalam memberikan Grasi. Alasan Kemanusiaan dan Keadilan merupakan alasan yang ditambahkan untuk mengajukan Grasi oleh Menteri Hukum dan HAM apabila narapidana dalam kondisi : 1) anak dibawah umur; 2) berusia diatas 70 tahun; dan 3) Sakit berkepanjangan. Dari beberapa kondisi yang telah diatur, kondisi “sakit berkepanjangan” merupakan kondisi yang sering disalahgunakan akibat konsepnya yang luas dan terbuka. Sejauh ini, belum ada pengaturan yang jelas dan pasti terkait dengan penyakit apa saja yang dapat dikategoroikan sebagai sakit berkepanjangan. Tidak sedikit pihak yang menjadikanan kondisi ini sebagai celah untuk dapat membeli kebebasannya. Hal ini dikhawatirkan akan mencedaerai rasa keadilan yang diharapkan akan terwujud dalam pemberian grasi. Melalui metode penelitian yuridis normatif, penulis mampu menjawab isu permasalahan ini dengan menjawab kriteria apa saja yang dapat di kategorikan sebagai sakit berkepanjangan.Kata Kunci: Grasi; Kemanusiaan dan Keadilan; Sakit Berkepanjangan.

Penelitian ini bertujuan untuk mengkaji perlindungan hukum terhadap korban pencemaran nama baik melalui media online dan menjelaskan pemenuhan restitusi yang seharusnya diterima korban pencemaran nama baik melalui media online. Pencemaran nama baik merupakan perbuatan melawan hukum, dikarenakan telah menyerang kehormatan atau nama baik seseorang. Rumusan tindak pidana pencemaran nama baik melalui media online diatur dalam Pasal 27 ayat (3) Undang-Undang Infomasi dan Transaksi Elektronik. Sanksi pidananya diatur dalam Pasal 45 ayat (3) Undang-Undang ini. Dalam Undang-Undang ini belum diatur sanksi pidana yang berbentuk restitusi, sehingga kurang melindungi korban pencemaran nama baik melalui media online. Metode penelitian ini adalah yuridis normatif dengan menggunakan bahan hukum primer, sekunder, dan tersier, Berdasarkan hasil penelitian ditemukan bahwa ancaman pidana pada Pasal 45 ayat (3) Undang-Undang Infomasi dan Transaksi Elektronik belum memenuhi rasa keadilan dan memberi manfaat kepada korban. Karena pada pasal ini belum mengatur sanksi pidana yang bersifat ganti rugi terhadap korban. Reformulation of  Criminal Sanctions on Defamation Through Online Media This study aims to examine the legal protection of victims of defamation through online media and explain the fulfillment of restitution that should be received by victims. Defamation is an act against the law, because it has attacked someone's honor or reputation. The formulation of criminal defamation through online media is regulated in Article 27 paragraph (3) of the Information and Electronic Transactions Law. The criminal sanctions are regulated in Article 45 paragraph (3). This law has not yet regulated criminal sanctions in the form of restitution, so it does not protect victims of defamation through online media. The research method is a normative juridical by using primary, secondary, and tertiary legal materials. The results found that the criminal threat in Article 45 paragraph (3) of the Law on Information and Electronic Transaction had not fulfilled a sense of justice and benefited for victims. It is because this article does not yet regulate criminal sanctions that are compensation for the victim.

Smoking belongs to the right of all people, but smoking can interfere with Human Rights because the distribution of cigarette smoke produced by smokers can interfere with the health of people around. In Bali, tourist attractions are one of the non-smoking areas. This is stated in the Regional Regulation of Badung No. 10 of 2017 concerning Non-Smoking Areas. Related to this, the study examines two things, that is, the regulation of No-Smoking Areas in the tourist attractions in Badung Regency and the implementation of the Regional Regulation of Badung No. 10 of 2017 on the tourist attractions. The research method used is empirical legal research that is conducting a direct research followed by analyzing data and presented in qualitative manner. In its regulation, Civil Service Police Unit (Satpol PP) as the enforcer of the regional regulation has conducted supervision on tourist attractions and sanctions given in accordance with the Article 21 Number (10) of 2017 of the Badung Regency Regional Regulation. Its application has been done through socialization to the manager of tourist attractions, but the lack of public knowledge about the non-smoking areas in tourist attractions has been appearing as an inhibiting factor.

The principle of legal certainty applied to the principle of extra ordinary crime is contrary to the respect for humanity as the most fundamental human rights principle and the principle of legality is associated with positive law and international conventions. The results of this study are intended to seek or find arguments for the certainty of the execution of the death penalty for the community, family, convicts and the state, so that the research on death penalty decisions in narcotics cases that occurred from 2014 to 2018. This research method is included in normative juridical law research. The conclusion is, sentencing with the threat of the death penalty can still be applied in Indonesia in narcotics crime cases is appropriate. Therefore, the death penalty, of course, state law does not conflict with religious law/teachings, in other words, the death penalty does not conflict with the first precepts because the first principle of Pancasila is Belief in One God, which means based on the beliefs/religions of each person who in carrying out/believes His religion is also guaranteed in the 1945 Constitution of the Republic of Indonesia, which is contained in Article 28 E paragraph (1) and paragraph (2) and Article 29 paragraph (2).

Penelitian ini bertujuan untuk menganalisis yurisdiksi Pengadilan Pidana Internasional dengan Pengadilan HAM Indonesia. Masalah penelitian Bagaimana yurisdiksi dibandingkan dengan pengadilan kriminal internasional dan pengadilan HAM di Indonesia? dan Apa Peluang untuk Pengenaan Yurisdiksi Pengadilan Pidana Internasional di Indonesia? Metode penelitian menggunakan penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa perbandingan yurisdiksi Pengadilan Pidana Internasional dan Pengadilan Hak Asasi Manusia dapat dilihat dari yurisdiksi pidana, pribadi, temporal dan teritorial. Indonesia bukan negara pihak dan bukan negara yang menerima yurisdiksi Mahkamah Pidana Internasional. Meski begitu, Yurisdiksi Mahkamah Pidana Internasional dapat diterapkan di Indonesia mengingat perbedaan yurisdiksi pidana kedua pengadilan tersebut, karena ada 2 (dua) kejahatan yaitu kejahatan perang dan kejahatan agresi yang tidak diatur dalam Pengadilan HAM Indonesia. , jika ada situasi di Indonesia yang dirujuk oleh Dewan PBB dan keamanan Indonesia dianggap tidak mau dan tidak dapat membawa para pelaku kejahatan untuk diadili di pengadilan. This study aims to analyze the protection of labor rights in this case Indonesian migrant workers abroad within the framework of the ASEAN Economic Community and Law no. 18 of 2017 concerning Protection of Indonesian Migrant Workers' labor rights within the framework of the ASEAN Economic Community. Research problems, First, What is the Form of Protection for Indonesian Migrant Workers, Second, What is the Form of Legal Efforts for Indonesian Migrant Workers who are disadvantaged? The research method uses socio-legal research by observing the ASEAN Declaration of Human Rights and Law No. 18 of 2017, as well as other Indonesian Laws and Regulations. The results showed that the Protection of Indonesian Migrant Workers (PMI) is all efforts to protect the interests of prospective PMI and their families in realizing guaranteed fulfillment of rights in all their activities. The author will analyze the issue of the extent to which the state protects labor rights in this case Indonesian migrant workers abroad within the framework of the ASEAN Economic Community and Law No. 18 of 2017 concerning Protection of Indonesian Migrant Workers.

Abstract During the Covid-19 pandemic, the government through the Ministry of Law and Human Rights reviewed the policy through Permenkumham No 10 in 2020 regarding the release of assimilation and the executive order making the child the perpetrator of this crime many were released. This makes bapas must improve the implementation of the development of the freed child. The problem in this study is how to optimize BAPAS in the implementation of child development as the perpetrator of crimes that are released because of Covid-19 and the obstacles faced by bapas in the implementation of the construction. The purpose of this study is to know how to optimize BAPAS in the development of children as perpetrators of crimes that are released because of Covid-19 and know the obstacles faced by bapas in the implementation of the construction of children as perpetrators of the crime struck. The research method used is normative juridical using secondary data obtained through literature studies such as scientific books, journals, laws. Key words : Correctional Center; Child; Covid-19 Abstrak Dimasa pandemi Covid-19, pemerintah melalui Kementerian Hukum dan HAM mengeluarkan kebijakan melalui Permenkumham No. 10 tahun 2020 terkait pembebasan dan asimilasi membuat anak sebagai pelaku tindak pidana ini banyak yang dibebaskan. Hal tersebut membuat pihak Balai Pemasyarakatan harus meningkatkan pelaksanaan pembinaan terhadap anak yang dibebaskan tersebut. Permasalahan dalam penelitian ini adalah bagaimana optimalisasi Balai Pemasyarakatan dalam pelaksanaan pembinaan anak sebagai pelaku tindak pidana yang dibebaskan karena Covid-19 dan kendala yang dihadapi pihak Balai Pemasyarakatan dalam pelaksanaan pembinaan tersebut. Tujuan penelitian ini adalah mengetahui bagaimana optimalisasi Balai Pemasyarakatan dalam pelaksaan pembinaan anak sebagai pelaku tindak pidana yang dibebaskan karena Covid-19 dan mengetahui kendala-kendala yang dihadapi pihak Balai Pemasyarakatan dalam pelaksanaan pembinaan terhadap anak sebagai pelaku tindak pidana yang dibebaskan tersebut. Metode penelitian yang digunakan adalah yuridis normatif dengan menggunakan data sekunder yang diperoleh melalui studi kepustakaan seperti buku-buku ilmiah, jurnal, undang-undang. This research tried to elaborate implementation of human rights and principles of suitability types, hierarchy, and material of regional regulation making. The main problem was whether in the making regional regulation of Nias Barat Regency, No. 8 / 2014 on Provisions of shift appeal of Civil Servants in Nias Barat Local Government neighbourhood, have paid attention to human rights and the principles of suitability types, hierarchy, and material of regional regulation making. It aimed to find out the implementation of human rights principles, especially right to develop their potency and its implementation. Hopefully, it also could contribute and have the benefit of knowledge of legislation and understanding for lawmakers related to the implementation of human rights and the principles of suitability types, hierarchy, and material of regional regulation making. It was a normative legal research method with analytical descriptive type. Tulisan ini juga diharapkan dapat memberikan kontribusi dan berguna bagi pengembangan ilmu pengetahuan perundang-undangan serta dapat memberikan pemahaman bagi organ pembentuk peraturan daerah terkait penerapan prinsip HAM maupun asas kesesuaian antara jenis, hirarki dan materi muatan peraturan perundang-undangan. Metode penelitian yang dipergunakan adalah penelitian hukum normatif dengan sifat deksriptif analitis. This paper looks at the Acehnese women's movement in helping to respect women's work in the grassroots community. This effort was carried out to give recognition and appreciation for women who have dedicated themselves to upholding women's human rights in Aceh, because there are still many people who do not yet know the humanitarian work they have done. The women who were nominated were those who worked since the time of the conflict until now. This voluntary work they do without financial support on a regular basis from the government, although some of them are listed as volunteers in their respective city P2TP2A. The types of cases they handle vary, from domestic violence cases to women's empowerment and society. This research was conducted in the Banda Aceh, Bener Meriah and Central Aceh regions. The research method for this study was in-depth interviews of winners, nominees and implementers of activities shaded by the Ureung Inong Aceh Shura Hall. The results of this study indicate that there are ups and downs in the implementation of this activity. Some of the obstacles that hindered him were the unavailability of funds, weak government commitment and lack of coordination of women's institutions in Aceh in the success of this activity.Keywords: Aceh Women Award, Aceh Women's Movement, Empowerment

AbstractThe AEC is good news for Indonesian migrant workers wanting to work overseas. Unfortunately, many Indonesian migrant workers have been deported from ASEAN countries because of having problems. This study adopts the normative legal research method. It argues that AICHR may be slow in resolving the problems of human rights. It is also argued that the ASEAN Committee on Migrant Workers works in the absence of the political commitment of ASEAN leaders to implement the Cebu Declaration. Therefore, the best solution is public participation in the ASEAN countries to protect migrant workers.IntisariKomunitas Masyarakat Ekonomi ASEAN adalah berita baik untuk Tenaga Kerja Indonesia (TKI) untuk bekerja di luar negeri. Namun, banyak TKI yang kembali dari negara-negara ASEAN dikarenakan mendapatkan berbagai permasalahan. Penelitian ini mengadopsi jenis penelitian hukum normatif. Penelitian ini menyimpulkan bahwa AICHR lamban dalam menyelesaikan permaslahan tentang hak asasi manusia. Penelitian ini juga menyimpulkan bahwa komunitas ASEAN tentang Pekerja Migran bekerja dengan tidak adanya komitmen politik dari para pemimpim ASEAN dalam menerapkan Deklarasi Cebu. Oleh sebab itu, dibutuhkan partisipasi ASEAN dalam melindungi TKI.

This study aims to analyze the problem of legal protection for children in the perspective of human rights. The type of this research is socio-juridical or including descriptive research with a non-doctrinal approach, which views law as a socio-empirical symptom observed in experience. The research method used is descriptive research with the type of incorporation of normative legal research with sociological legal research related to the implementation of legal protection for children in the perspective of human rights. The results of the study show that the results of this study are the legal protection of children in the perspective of human rights in essence is an effort made by parents, government and society to fulfill and guarantee all children's rights that have been guaranteed in the convention of children's rights and laws Number 35 of 2014 concerning Child Protection. Legal protection for children in the perspective of human rights is less implemented because the government has not implemented its obligations in fulfilling children's rights so that there are still legal violations of children. The recommendation of this research is to implement legal protection for children in the perspective of human rights, parents should be fully responsible for the behavior of children and the government establishes policies that are in line with the wishes of the community, so that the common perception between parents, government and society is realized in fulfilling the rights child.

Xinjiang reeducation camps are dedicated to cleanse the practice and existence of religion, and majorly subjects the Uighur moslems. China has constantly denied the conduct of gross human rights violations of Uighur moslems within Xinjiang political reeducation camps. This article will elaborate on the actions done by Xinjiang officials to unveil the gross violations of human rights towards the Uighurs within Xinjiang reeducation camps. The article will also examine the available possibility to criminally hold the perpetrators liable and provide effective relief to the victims. This article is constructed using normative legal research method with statutory, case, and fact approaches, along with conceptual/analytical approach. The result shows that there exist gross violations of human rights towards the Uighurs within Xinjiang reeducation camps in a form of arbitrary detention and torture. Moreover, there are some available possibilities to criminally hold the perpetrators liable and provide effective relief to the victims, namely through a municipal court proceeding and through the Committee against Torture.
