Land acquisition is done by way of release or transfer of land rights of the holders of rights over land to government agencies that require ground. As a form of respect for the rights of holders of land rights, which require land-party in this case is the government agency, provide appropriate compensation on the basis of agreement between both parties through consultation. Form of legal protection given to holders of land rights is the determination of compensation based on the deliberations, the proper compensation that can provide a better survival than the level of socio-economic life before the affected land acquisition, and submission of objections to the amount of indemnification. Custody compensation cannot be the basis for taking land holders of land rights by Government agencies that require ground.Key Words : land acquisition, legal protection, custody compensation.

Abstract The presence of land controlled and / or owned by either existing rights above the ground and based on the new land acquisition in some places there are still many in limbo. Seeing the reality of the field on the wastelands, he made government regulation and government last issued Government Regulation No. 11 Year 2010 on Land Reform and Control of Neglected. Based on this background, the problem is formulated, what basic criteria for establishing a right to the top of the ground as the object of regulating the wastelands, who preferred to get right to the land above the ground of the former wastelands, this research was normative approach legislation conceptual and legal materials. The results showed that the controlling authority is the authority wastelands legacy which the Government (President) delegate to the National Land Agency of the Republic of Indonesia. The mechanism through penertibannya stages: (1) an inventory of land rights or land tenure policies that indicated displaced (2) identification and study of land indicated displaced (3) warning against the rights holder (4) Determination of wastelands. ABSTRAKArtikel ini membahas Putusan Nomor 95/B/2017/PT.TUN.JKT yang melanggengkan tindakan negara berdasarkan kekuasaan (machtstaat). Objek sengketa dalam perkara a quo adalah Surat Peringatan Ketiga (SP 3) yang diterbitkan oleh Kasatpol PP Jakarta Selatan, yang isinya meminta para penggugat untuk membongkar bangunan rumah miliknya. Dari data tersebut, penulis menemukan rumusan masalah, yaitu: apakah pertimbangan majelis hakim banding dalam merumuskan SP 3 "tidak bertentangan dengan asas-asas umum pemerintahan yang baik dan Undang-Undang Administrasi Pemerintahan" sudah tepat?; dan apakah pertimbangan hukum dalam putusan a quo dapat memberikan jaminan perlindungan akan hak atas tanah berdasarkan Undang-Undang Pokok Agraria dan Undang-Undang Pengadaan Tanah? Dalam menganalisis putusan a quo, penulis menggunakan metode socio legal science. Hasil analisis penulis, putusan a quo yang mengatakan bahwa "penerbitan SP 3 tidak bertentangan dengan peraturan perundang-undangan dan asas-asas umum pemerintahan yang baik" merupakan sebuah pertimbangan yang tidak tepat. Karena penertiban itu bertentangan dengan asas kepastian hukum, dan bertentangan dengan Undang-Undang Administrasi Pemerintahan, Undang-Undang Pokok Agraria dan Undang-Undang Pengadaan Tanah. Putusan a quo tidak dapat memberikan perlindungan hukum pada para pemilik tanah, karena Undang-Undang Pokok Agraria dan Undang-Undang Pengadaan Tanah memberikan perlindungan hukum kepada masyarakat untuk memiliki tanah.Kata kunci: pengadaan tanah untuk pembangunan, hak atas tanah, tindakan melawan kewajiban hukum. ABSTRACT This article discusses the Decision of Number 95/B/2017/PT.TUN.JKT which perpetuates the state actions based on power (machtstaat). The object of the dispute in the a quo case was the Third Warning Letter (SP 3) that issued by Head of the Civil Service Police Unit of South Jakarta (Kasatpol PP Jakarta Selatan), which asked the plaintiffs to demolish their house. From these data, the authors found the formulation of the problem, namely: are the considerations of the appeals panel of judges in formulating SP 3 "not contrary to the general principles of good governance and the Government Administration Law" are appropriate?; and whether legal considerations in a quo decision can provide guarantees of protection of land rights based on the Basic Agrarian Law and the Land Procurement Law? In analyzing the a quo verdict, the author uses the socio legal science method. The results of the author's analysis, a quo verdict which states that "SP 3 issuance does not conflict with statutory regulations and the general principles of good governance" is an inaccurate consideration because the regulation is contrary to the principle of legal certainty, and contrary to the Government Administration Law, the Basic Agrarian Law and the Land Procurement Law. A quo verdict cannot provide legal protection to landowners, because, the Basic Agrarian Law and the Land Procurement Law provide legal protection for the community to own land.Keywords: land acquisition for development, land rights, actions against legal obligations.

This study aims to answer the problem of construct and control of the state land by various parties to acquire the property. Structurally scholars of jurisprudence establishof three procedures, such as identification, turn and obtain approval from the government to acquire the property. While the provisions of the National Agrarian Land Legislation of Indonesia set-up of property rights happen in three ways; the determination of the government, the provision of conversion  and based on customary law. These requirements include the identification of former state land and wastelands and conditions, cultivation way, and obtaining permission from the government. While distinctive occur in terms designation and use of land in the Treasury Office into the absolute requirement for bookkeeping administrative enforcement of land rights. While the jurisprudence is not required certain types of plants or buildings in the enforcement of land rights administration books. While in general terms there should be plants and buildings as well as the limits of the fence is needed as a requirement in jurisprudence. While at the acreage requirement in the Treasury Office required two hectares per household, is an important requirement for the Treasury Office, because they want to regulate the distribution and people's livelihood of farmers` equalization.

This study aims to determine the legal protection of the government agency logo according to intellectual property law according to state financial law and to find out the harmonization strategy of legal protection of government agency logos between according to intellectual property law and according to state financial law. Qualitative research is carried out using the applied law research approach. The results showed that the logo of government agencies is the result of intellectual property that can become a trademark or copyright. Repressive intellectual property legal protection can be done if preventive legal protection has been done through trademark registration or copyright. While legal protection for state finances can be done if the logos of government agencies become part of intangible assets. Government agencies are required to safeguard intangible assets through administrative safeguards, in the form of bookkeeping in financial statements, and legal safeguards, in the form of registering and storing proof of trademark certificates or copyrights. If these two safeguards are carried out, harmonization between legal protection according to state financial law and intellectual property law has taken place. Preventive and repressive protection of agency logos as intangible assets can be optimized. Keywords: agency logos, intangible assets, legal

<p>The importance of land certificate as legal protection for land owners invites the attention of policy makers in this country. The policy which is issued by the government is to issue mass certifying program on land based on the Decree of Ministry of internal affair Number 189 year 1981 0n Agrarian National Operation Project (PRONA) implementing by National Defence  Board  as  its  duty.  Basically,  the  program  is  implemented  annually  through some steps and processes, preparation, coordination/determination of Land Rights, right registration, certificate issuance and delivery of certificates. Obstacles which are faced by the District Land Office or City in implementing the program are in particular aspects such as society as the member of the program, the staff and financial aspect of the program itself.</p> Pentingnya  sertifikat  hak  atas  tanah  sebagai  perlindungan  hukum  bagi  pemilik  tanah mengundang perhatian para pemilik kebijakan di negeri ini. Kebijakan yang di keluarkan pemerintah  salah  satunya  dengan  mengeluarkan  program  pensertipikatan  tanah  secara massal berdasarkan Keputusan Menteri Dalam Negeri Nomor 189 Tahun 1981 tentang Proyek  Operasi  Nasional  Agraria  (PRONA)  yang  pelaksananya  Badan  Pertanahan Nasional sebagaimana tugasnya. Pada dasarnya pelaksanaan Program Prona dilakukan secara  rutin  tiap  tahun  melalui  tahapan  atau  proses,  persiapan,  koordinasi/penetapan peserta PRONA, penyuluhan, pengukuran, pengumpulan data, pengumuman, penetapan Hak  Atas  Tanah,  pembukuan  hak,  penerbitan  sertipikat,  dan  penyerahan  sertifikat. Abstract: The relinquishment of rights in the acquisition of land for the development of public interests is influenced by the subject of land rights. In the case of the subject of rights in the form of a legal entity, the relinquishment of rights is not only with the deliberation of the parties to reach an agreement, but approval from the government that often creates problems are required. This study aims to determine the problems and strategies to accelerate the completion of the release of rights from waqf land, village land, and government agency land for New Airport in Special Region of Yogyakarta construction. The research method uses qualitative methods with a descriptive approach. The results of the study are: first the problem of the release is the difficulty of finding a replacement land, the length of time the permit, and there are differences in the meaning of the compensation. Second, the strategy to accelerate the settlement is to provide compensation in the form of money, simplification of licensing for the release from the government on it, and the government agency's land is contributed to the construction of the airport based on the request for guidance. Basically the mechanism for the release of the three types of land status must obtain permission from the government on it.Keywords: waqf land, village land, government agency land, land acquisition. Intisari: Pelepasan hak dalam pengadaan tanah untuk pembangunan kepentingan umum salah satunya dipengaruhi oleh subjek hak atas tanahnya. Dalam hal subjek hak berupa badan hukum, maka pelepasan hak tidak hanya dengan musyawarah para pihak untuk mencapai kesepakatan, namun diperlukan persetujuan dari pemerintah di atasnya. Persetujuan dari pemerintah di atasnya sering menimbulkan permasalahan sebagai persyaratan pelepasannya. Penelitian ini bertujuan untuk mengetahui problematika dan strategi percepatan penyelesaian pelepasan hak yang berasal dari tanah wakaf, tanah desa, dan tanah instansi pemerintah untuk pembangunan Bandara Baru di Daerah Istimewa Yogyakarta. Metode penelitian menggunakan metode kualitatif dengan pendekatan deskriptif. Penelitian ini menemukan bahwa problematika pelepasan tanah adalah kesulitan mencari tanah pengganti, lamanya waktu perizinan pelepasan dari pemerintah di atasnya, dan terdapat perbedaan pemaknaan dalam pemberian ganti kerugian. Berikutnya, strategi percepatan penyelesainnya adalah memberikan ganti kerugian berupa uang, penyederhanaan perizinan pelepasan dari pemerintah di atasnya, dan tanah instansi pemerintah dikontribusikan untuk pembangunan bandara tersebut berdasarkan permohonan petunjuk. Pada dasarnya mekanisme pelepasan dari ketiga jenis status tanah tersebut harus memperoleh izin dari pemerintah di atasnya.  Kata Kunci: tanah wakaf, tanah desa, tanah instansi pemerintah, pengadaan tanah.

The spatial development can be supported by sustainable development, efforts are needed to divert space through the imposition of sanctions on administration in the spatial field. In the context of a legal state, sanctions must be taken while ensuring their legality in order to provide legal protection for citizens. The problem is, the construction of administrative regulations in Law No. 26 of 2007 and PP No. 15 of 2010 contains several weaknesses so that it is not enough to provide clear arrangements for administrative officials who impose sanctions. For this reason, an administration is required which requires administrative officials to request administrative approval in the spatial planning sector. The success of the regulation requires that it is the foundation of the welfare state principle which demands the government to activate people's welfare. 15 of 2010, the main things that need to be regulated therein should include (1) the mechanism of imposing sanctions: (2) determination of the type and burden of sanctions; and (3) legal protection and supervision by the region.

Abstract: In order to give the assurance of legal certainty, certainty of rights and legal protection to holders and owners of land rights, the land registration shall be carried out. However, there is still a land dispute which now become a homework for The Government. This is because the certificate which should be a strong evidentiary can not guaranteed the legal certainty for the owner, so the person who right the land can blocking the certificate of land rights at Land Office. The issuance of Regulation Minister of Agrarian Affairs and Spatial / Head of National Land Office Number 13 Year of 2017 concerning the Procedures of Block and Sita which expected to create uniformity, standardization in recording process and abolition of registration blocked, it turns out not all the rules can be implemented at The Land Office of Sleman and Bantul Regency.The result of this research shows that blocking certificate process at Sleman Land Office and Bantul Land Office have a policy that the applicant is required to pay the blocking recording fee after the blocking received. Makes a potential loss to the (PNBP) which should be owned by Land Office for faced the problem of KKPweb application which have not been able to accomodate the time period of blocking. Keywords : blocking certificate, blocking, registration blocked Intisari: Dalam rangka memberikan jaminan kepastian hukum dan kepastian hak serta perlindungan hukum kepada pemegang dan pemilik hak atas tanah, maka dilaksanakan pendaftaran tanah. Namun demikian, masih saja terjadi sengketa pertanahan yang saat ini menjadi pekerjaan rumah bagi Pemerintah. Hal ini disebabkan karena, sertipikat sebagai alat pembuktian yang kuat ternyata belum menjamin kepastian hukum pemiliknya sehingga pihak yang merasa berhak atas tanah tersebut dapat melakukan blokir sertipikat hak atas tanah di Kantor Pertanahan. Dikeluarkannya Permen ATR/Kepala Nomor 13 Tahun 2017 tentang Tata Cara Blokir dan Sita yang diharapkan bertujuan untuk mewujudkan keseragaman, standarisasi dalam pelaksanaan pencatatan dan penghapusan catatan blokir ternyata tidak semua peraturan tersebut dapat dilaksanakan di Kantor Pertanahan Kabupaten Sleman dan Bantul. Hasil penelitian menunjukan bahwa pelaksanaan pencatatan blokir di kantor pertanahan Kabupaten Sleman dan Kabupaten Bantul terdapat kebijakan yaitu pemohon diwajibkan membayar biaya pencatatan blokir setelah blokirnya diterima membuat potensial loss terhadap (PNBP) yang seharusnya didapat kantor pertanahan untuk kendala yang dihadapi yaitu Aplikasi KKPweb yang belum dapat mengakomodir jangka waktu blokir. ABSTRAKSalah satu instansi pemerintah di Jawa Barat, menggunakan logo yang diciptakan oleh pegawai dari instansi tersebut. Pembuatan logo tidak diperjanjikan khusus, sehingga pencipta tidak mendapatkan royalti (materiil dan ekonomi). Hal tersebut menarik untuk dikaji mengenai Implementasi Prinsip Alter ego yang berkaitan pada hak cipta seseorang yang mengakui pencipta sebagai pemilik hak tertinggi. Pencipta memiliki hak alamiah untuk memanfaatkan ciptaannya dan mempertahankan ciptaannya terhadap gangguan apapun dari pihak lain. Metode penelitian yang digunakan dalam penulisan ini bersifat deskriptif analitis guna memperoleh gambaran peraturan perundang-undangan yang berlaku dikaitkan dengan teori-teori hukum dan praktek pelaksanaan hukum positif. Pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif, dengan cara meneliti bahan pustaka yang disebut data sekunder yang terdiri dari bahan hukum primer, literatur-literatur, artikel-artikel, pendapat dan ajaran para ahli serta implementasinya dalam praktek. Apabila dilihat pada Pasal 35 ayat (1) dan (2) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta tidak terpenuhi. Meskipun instansi pemerintah tidak bertujuan untuk kegiatan komersial. Namun hak moral dan hak ekonomi hakikatnya wajib dilaksanakan sesuai dengan prinsip perlindungan Hak Kekayaan Intelektual. Perlindungan Hukum terhadap pencipta atas logo tetap harus diakui. Kata kunci: alter ego; hak cipta; hak moral; logo; instansi pemerintah. ABSTRACTOne of the government agencies in West Java, using a logo created by employees of the agency. Logo creation is not specifically promised, so creators do not get royalties (material and economic). It is interesting to review the Implementation of Alter ego Principles relating to the copyright of a person who recognizes the creator as the owner of the highest right. The Creator has the natural right to utilize his creation and defend his creation against any interference from the other party.The research methods used in this writing are analytically descriptive to obtain an overview of the prevailing laws and regulations associated with legal theories and the practice of implementing positive laws. The approach used in this study is normative juridical, by examining library materials called secondary data consisting of primary legal materials, literature, articles, opinions, and teachings of experts and their implementation in practice.If viewed in Article 35 paragraph (1) and (2) of Law No. 28 of 2014 on Copyright is not fulfilled. Although government agencies do not aim for commercial activities. But moral rights and economic rights must essentially be implemented in accordance with the principles of intellectual property protection. Land is a form of gift given by God, but human has given brain to think the challenges of live like the land problems, so that the government tries to regulate it properly. The problems in this thesis are: 1) How to regulate ownership of agricultural land rights that exceeds the maximum limit based on Act No. 56 (Prp) of 1960 concerning the Determination of Agricultural Land Areas? 2) How is the action taken by the Land Office towards ownership of agricultural land rights that exceeds the maximum limit? The method used is juridical empirical, with descriptive analytical specifications. The method used in this research is an empirical juridical approach. The results of this study are: (1) The regulation of ownership of agricultural land rights that exceeds the maximum limit is based on Act No. 56 (Prp) of 1960, namely that the provisions regarding land restrictions state that the application for ownership rights as referred to in Article 4 paragraph 1 of Act No. 56 (Prp) 1960 was limited to a maximum land area of 2000 m2. 2) The steps of the Land Office in implementing Act No. 56 (Prp) of 1960, namely the need for a concept of supervision and control over control of land rights, given the various problems that often arise such as in land registration activities.
