The enactment of Law Number 30 of 2014 on Government Administration had given the changes to the authority of the State Administrative Court. There are two mechanism of the case investigation in the State Administrative Court in providing legal protection against a lawsuit or petition filed by the public. The first mechanism is to file a lawsuit directly to the State Administrative Court. The second mechanism is to resolve internal disputes within the government before filing a lawsuit to the Administrative Courts. There are two mechanisms of the case investigation prove that the existence of discrimination for people who seek justice in the case investigation system in the State Administrative Court. This research focus on an issues first the nature of public legal action by the government in government administration and second Ratio legis non-judicial legal protection against public legal acts  by the government. The results which have to be achieved are to provide the prescription of essential truth. There are several problems approach used in this study, such as statute approach, conceptual approach, and case approach.

In one of the many definitions of public administration it was stated that it is the fulfillment of individual and collective needs of citizens, resulting from the co-existence of people in society, realized by the state and its dependent organs. One of the needs of an individual is the need for safety. Ensuring the safety of citizens is realized by the public administration, due to its service to the society as an executive apparatus possessing a democratic mandate of political power, in service of the law created by said organs. A particular role in the area of defense belongs to authoritative administration, which performs tasks including reversing risks and removing dangers, including the realization of tasks and undertakings aimed at military preparation in case of war. The aim of the following article is to present the tasks and competences in the area of protecting the President, the government, government administration officials on duty and local self-administration of the Slovak Republic. Various methods have been used to reach the pre-determined goal, primarily the method of document investigation, which made it possible to gather, sort, describe and scientifically interpret the legal acts of the Slovak Republic regarding defensive matters.

The Administrative Court and Law No. 5 of 1986 on State Administrative Justice have been provided facilities for the public to sue the government and ask to cancel the decision made by the government. Law No. 30 of 2014 on Government Administration has been stipulated that Government Administration Act more or less supersedes the provisions contained in the Law of the State administrative justice. Especially in this Law which attracts attention is the expansion of object disputes state Administration. The object of the state Administration dispute in this Act is different from its elements to the Law of the State administrative justice. One of these is a written stipulation that includes factual action. There is no explanation for the meaning of factual acts in this Administrative Administration Act. Therefore, further research is needed in this regard. This study aims to find out and understand the meaning of factual actions in Article 87 letter (a) of Law Number 30 of 2014. This study uses a qualitative approach to the type of research Normative Juridical. Data collection techniques are Library study is to collect data conducted by reading, quoting, recording and understanding various literature that have to do with research material. The object of the state Administration disputed in Law Number 5 of 1986 and its amendment has expanded on Law Number 30 Year 2014 on Government Administration. When the object of the dispute expands, it will affect the decision taken by the legal practitioner in this case is the state Administration judge.

Land procurement is the act of the government to realize the availability of land to be used in various interests for development as the public interest. Limitations of land owned by the government takes the land derived from the community to facilitate the course of development for the public interest. The existence of the land needs to be used by the government in carrying out development activities, but in its implementation should not be detrimental to the rights of the landowners. Therefore, for the government which needs the land can not arbitrarily to take the land belonging to the community/the holder of the right to the land which area is affected by development for the public interest. Therefore, the state should provide guarantee and legal protection to the holder of the land in land procurement activity for public interest. So that the implementation of land procurement will be able to provide a sense of justice for the community affected by the development and provide security to the life of the community.

AbstractLand is a natural wealth that is very important for humans and has an important function in development. In carrying out activities carried out by the government, namely land acquisition for the public interest, which has the aim of building public facilities for the benefit of the community. In carrying out land acquisition, ulayat land is often the target for alleged land acquisition. However, using ulayat land for land acquisition often creates problems. The purpose of this paper is to determine the control of indigenous peoples' rights in land acquisition and to determine the role of the state in providing compensation for land acquisition for development in the public interest. The research method used is juridical normative using a statutory approach and a conceptual approach. The result of this research is that the rights of customary law communities have been regulated constitutionally by the State, and the role of indigenous peoples is regulated in Law no. 71/2012. However, the fact is that during the land acquisition process, customary law communities are often not involved, the government should provide legal certainty and protection to the customary law community so that these problems do not harm the customary law community.Keyword: Land Procurement, Customary Law Communities, Customary Land. AbstrakTanah merupakan kekayaan alam yang sangat penting bagi manusia dan memiliki fungsi yang penting dalam pembangunan. Dalam melakukan kegiatan yang dilakukan oleh pemerintah yaitu pengadaan tanah bagi kepentingan umum, yang mana memiliki tujuan untuk membangun fasilittas umum agar bermanfaat bagi masyarakat. Dalam melakukan pengadaan tanah, seringkali tanah ulayat dijadikan sasaran untuk diduganakan pengadaan tanah. Namun, dalam menggunakan tanah ulayat untuk pengadaan tanah tersebut seringkali menimbulkan masalah. Tujuan dari penulisan ini untuk mengetahui pengantutan mengenai hak-hak masyarakat adat dalam pengadaan tanah dan untuk mengetahui peran negara dalam pemberian ganti kerugian pada pengadaan tanah bagi pembangunan untuk kepentingan umum. Metode penelitian yang digunakan adalah yuridis normative dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini adalah bahwa hak masyarakat hukum adat telah diatur secara konstitutional oleh Negara, serta peran masyarakat hukum adat diatur didalam UU No. 71/2012. Namun pada faktanya saat proses pengadaan tanah, masyarakat hukum adat seringkali tidak dilibatkan, seharusnya pemerintah dalam pengadaan tanah memberikan kepastian serta perlindnungan hukum kepada masyarakat hukum adat agar permasalahan-permasalahan tersebut tidak merugikan masyarakat hukum adat.Kata Kunci: Pengadaan Tanah, Masyarakat adat, Tanah Ulayat

Current technological developments have digital money or cryptocurrency which is currently being used as an investment by the world community. Seeing this, the government has now issued CoFTRA Regulation Number 5 of 2019 concerning Technical Provisions for the Implementation of the Physical Asset Market in the Futures Exchange to ensure legal protection for investors and legal certainty in the event of a dispute. This study aims to analyze protection The law against Cryptocurrency Investors is reviewed based on Bappebti Regulation Number 5 of 2019 and analyzes the legal efforts made in the event of a dispute in cryptocurrency investment. The research method in this study uses normative legal research methods with a statutory approach and a conceptual approach. The results of this study show that the Indonesian Government has accommodated the interests of crypto asset trading as well as a guideline and clarity for the public regarding the government's recognition of the presence of bitcoin and virtual currancy, namely through Bappebti Number 5 of 2019 and dispute disputes that occur between cryptocurrency investors and cryptocurrency marketplaces by way of non-litigation and arbitration through the Commodity Futures Trading Arbitration Board (BAKTI). Perkembangan teknologi saat ini telah terdapat uang digital atau cryptocurrency yang saat ini dijadikan sebagai investasi oleh masyrakat dunia. Melihat hal tersebut kini pemerintah telah mengeluarkan Peraturan Bappebti Nomor 5 Tahun 2019 Tentang tentang Ketentuan Tekhnis Penyelenggaraan Pasar Fisik Asset Kripto (Crypto Asset) di Bursa Berjangka untuk memastikan adanya perlindungan hukum bagi para investor dan kepastian hukum apabila terdapat sengketa. Studi ini bertujuan untuk menganalisa perlindungan Hukum terhadap Para Investor Cryptocurrency dikaji berdasarkan Peraturan Bappebti Nomor 5 Tahun 2019 serta menganalisa upaya Hukum yang dilakukan apabila terjadi sengketa dalam investasi cryptocurrency. Metode penelitian dalam studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil studi ini menunjukkan bahwa Pemerintah Indonesia telah mengakomodir kepentingan perdagangan kripto aset serta sebagai suatu pedoman dan kejelasan bagi masyarakat terkait pengakuan pemerintah terhadap kehadiran bitcoin dan virtual currancy yaitu melalui Bappebti Nomor 5 Tahun 2019 dan perselisihan sengketa yang terjadi antara investor cryptocurrency dengan marketplace cryptocurrency dapat diselesaikan dengan jalan non-litigasi dan abitrase melalui Badan Arbitrase Perdagangan Berjangka Komoditi (BAKTI).

The existence of a lawsuit for unlawful acts by the authorities (onrechtmatige overheidsdaad) is one of the means of providing legal protection for the citizens from actions (handling) carried out by the government. Over time, the concept of onrechtmatige overheidsdaad has develops dynamically. The change in the concept of the State Administrative Decree in Article 87 of Law Number 30 of 2014 concerning Government Administration has caused an onrechtmatige overheidsdaad lawsuit which was once the absolute competence of the District Court, and now became the absolute competence of the State Administrative Court. This research attempts to explain the changes in the regulation and changes in the concept of onrechtmatige overheidsdaad after the enactment of Law Number 30 of 2014. The transfer of authority to examine onrechtmatige overheidsdaad lawsuit from the general court to the state administrative court has various juridical consequences, ranging from changes in procedural law, petitum and posita. One of the important consequences is a change related to the implementation or execution of the judicial decision, where in the past, when an onrechtmatige overheidsdaad lawsuit was an absolute competence of a district court, the implementation of the decision depended on the good will of the government. However, after becoming absolute competence of the Administrative Court, there is a mechanism of forced efforts so that the decision can be carried out by the relevant government agencies (defendants).AbstrakKeberadaan gugatan perbuatan melanggar hukum oleh penguasa (onrechtmatige overheidsdaad) merupakan salah satu sarana pelindungan hukum masyarakat atas tindakan (handeling) yang dilakukan oleh pemerintah. Adapun konsep mengenai onrechtmatige overheidsdaad berkembang secara dinamis dari waktu ke waktu. Perubahan konsep Keputusan Tata Usaha Negara (KTUN) di dalam Pasal 87 Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan, menyebabkan gugatan onrechtmatige overheidsdaad yang dahulu merupakan kompetensi absolut Pengadilan Negeri, berubah menjadi kompetensi absolut Pengadilan Tata Usaha Negara. Penelitian ini berusaha memaparkan mengenai perubahan pengaturan dan perubahan konsep onrechtmatige overheidsdaad pasca berlakunya Undang-Undang Nomor 30 Tahun 2014. Beralihnya kewenangan untuk memeriksa gugatan onrechtmatige overheidsdaad dari lingkungan peradilan umum ke peradilan tata usaha negara memiliki berbagai konsekuensi yuridis, mulai dari perubahan hukum acara, petitum, dan posita. Salah satu konsekuensi yang cukup penting adalah perubahan terkait dengan pelaksanaan putusan atau eksekusi. Dahulu, gugatan onrechtmatige overheidsdaad merupakan kompetensi absolut pengadilan negeri, sehingga pelaksanaan putusan tergantung dari itikad baik (good will) dari pemerintah. Pasca-beralih ke kompetensi absolut PTUN, terdapat mekanisme upaya paksa agar putusan tersebut dapat dijalankan oleh instransi pemerintah terkait (tergugat).

This research aims to see and analyze legal protection for land rights holders who lost their land rights due to public interest clause, whether for the benefit of the state or the private sector. Based on the 1945 Constitution, it can be seen that the use of the earth (land), water, and natural resources contained therein by the state is required to be used for the greatest prosperity of the people, and not for certain elites from government agencies who need land. Limitations must be applied to this clause so that the use is not arbitrary because even though the land rights are ownership rights, it can lose since the Government carries it out. The public interest clause is always the way and the Government answer for those who refuse their land to be acquired. Research results are that public interests, which are the needs of many people or broad goals, must pay attention to social, political, psychological, vindication and security aspects based on the National development principle.Keywords: Land, Public Interest, Acquisition

The rise of fraud cases and investment offers that are suspected to be illegal have resulted in losses for consumers and the public, so in this case legal protection is needed to minimize illegal investment cases. The purpose of this research is to analyze the role of the financial services authority in anticipating illegal investment activities carried out by investors and a legal protection for consumers by the financial services authorities against illegal investment activities carried out by investors. This research is a normative juridical research with a statutory approach and a conceptual approach. The technique of collecting legal materials used is the recording technique. The legal materials used are primary and secondary legal materials. After the data is collected then the data is analyzed systematically. The results of the research reveal that in the context of legal protection, the Financial Services Authority is given the authority by the State to take steps to prevent consumer and public losses. Efforts are made based on Article 28 of Law No. 21 of 2011 concerning the Financial Services Authority by conducting outreach and education to the public regarding the characteristics of fundraising activities and managing illegal investments and asking the Financial Services Institutions to stop their activities if these activities have the potential to harm the community. The handling carried out by the Financial Services Authority cannot be separated from the support of the public who have submitted reports or complaints.

In providing services to the community there are two important things, namely the making of authentic deeds including the PPJB deed relating to the trade of state land, and providing legal counseling to the public. Legal consouling by Notary must be did for and for legal actions did by notaries at the request of their clients. In the case of taking legal action for his client, the notary may also not side with his client, Notary must be neutral, because the task of the notary is to prevent the occurrence of problems. This normative juridical research uses a statute approach and conceptual approach. This research is limited to the discussion forms of legal protection the object buyers of State land through the Deed Agreement of Trade Binding (PPJB) which is not given legal counseling by Notaries, and Notary responsibilities in connection with the PPJB Deed with the object of state land before a Notary are not preceded by legal counseling of parties in relation to land status. The results from this study explain that in the PPJB deed there is a legal relationship between the legal subject and objects which creates the rights and obligations that also need to get legal protection. Forms of legal protection against buyers of State land object through the Deed Agreement of Trade Binding (PPJB) made by a  Notary that trade object is state land and cannot be traded with the status of property rights is by Submit a claim for cancellation of the deed and Submit a claim for compensation to both the seller and the Notary. The notary is responsible in connection with the Deed Agreement of Trade Binding (PPJB) with the object of state land made before a Notary whose services are not preceded by legal counseling because there is a legal relationship between the Notary with the respondent, but not contractual relations.

Secreted as an action or decision that can be used by the state civil service (ASN) under certain conditions, in carrying out the law enforcement duties of civil servants especially the police the authority to use discretion can be applied according to the conditions needed in the context of law enforcement, but after the enactment of Law Number 30 of 2014 concerning Government Administration requires clarity regarding the position of discretion in law enforcement. The method used is a normative approach using secondary and primary data that is analyzed qualitatively. The results showed (1) That the enactment of the Law on Government Administration is an effort to provide a legal position for discretion within the State Civil Apparatus. Discretion is regulated more clearly, from the definition, the limit according to the law, the limit is issued by the authorized official, the purpose, scope, conditions, use of discretion and approval procedures, and the consequences of discretionary law. (2) POLRI in its position as a law enforcement apparatus has the function of enforcing law in the judicial field both preventive and repressive. So with the discretionary authority in the judicial field as stipulated in Law No. 2 of 2002 in Article 18 paragraph (1) that "In the public interest of the Republic of Indonesia National Police officials in carrying out their duties and authorities can act according to their own judgment". (3) that in the relationship between the implementation of discretion according to the Government Administrative Law and the Police Law of the Republic of Indonesia there is an expansion of the purpose of police discretion in law enforcement, which is not only to create and maintain security and order, but also to launch and overcome obstacles in the process of law enforcement.Keywords : Discretion, State Civil Apparatus, Law Enforcement.
