The purpose of this study was to determine the position, role and function of the DPD-RI in the Indonesian constitutional system before and after the Constitutional Court Decision No. 92 / PUU-X / 2012. The research method used is juridical normative and type of research is statutory approach, comparative approach, and conceptual approach. The results showed that a number of laws and regulations governing the DPD-RI were still less than the initial purpose of the formation of the DPD-RI. Certain articles relating to the position, function and role of the DPD-RI actually limit the authority of the DPD-RI so that it cannot function as a state institution that should have the same position as the DPR-RI. The decision of the Constitutional Court No. 92 / PUU-X / 2012 brings a new chapter in the implementation of democracy in Indonesia. The ruling of the Constitutional Court firmly provides a strategic role for the Regional Representative Council in Indonesian constitution.

Perubahan UUD 1945 yang telah dilakukan MPR membuktikan, bahwa ada benturan kepentingan sehingga menjadikan perubahan konstitusi yang ‘tambal sulam’ dan tidak berorientasi kepentingan jangka panjang, serta jauh dari kata memuaskan karena ‘elitis’ dan kurang partisipatif, maka perubahan konstitusi seharusnya tidak dilakukan oleh satu lembaga saja yang dalam hal ini adalah MPR. Oleh karna itu, penting kirannya melibatkan Mahkamah Konstitusi agar tercipta hasil perubahan UUD NRI 1945 yang partisipatif. Penelitian ini bertujuan untuk mengetahui tentang apa urgensi pelibatan mahkamah konstitusi dalam perubahan Undang Undang Dasar Negara Republik Indonesia  Tahun 1945, dan bagaimana prospektif pelibatan mahkamah konstitusi dalam perubahan undang undang dasar  Negara Republik Indonesia  Tahun 1945. Penelitian ini mengunakan Jenis penelitian normatif. Hasil penelitian ini menunjukan bahwa Urgensi pelibatan MK dalam perubahan Undang Undang Dasar di dasarkan pada beberapa hal, antara lain: Pertama, terdapat banyak kelemahan dalam amandemen pertama sampai dengan amandemen ke-empat; Kedua, Eksistensi MPR sebagai lembaga politik; ketiga, Pelakasanaan prinsip Checks and Balance System; Keempat, Perwujudan MK sebagai The Guardian Of Consitution. Bahwa Prospektif pelibatan MK dalam perubahan UUD NRI 1945 adalah dengan menekankan pada political good will dari MPR untuk menyusun Mekanisme perubahan UUD NRI 1945 dengan melibatkan MK sebagai lembaga negara yang memberikan Sertfikasi Konstitusi dari hasil kajian perubahan yang dilakukan oleh Komisi konstitusi sebelum mendapatkan persetujuan dari MPR untuk ditetapkan sebagai hasil perubahan UUD 1945 yang baru. hasil dari mekanisme perubahan konstitusi dengan melibatkan MK ini ditujukan untuk menghasilkan perubahan konstitusi yang bersifat the people of the constitution.The amendments of the 1945 Constitution that the MPR has done proves that there is a conflict of interest that makes constitutional changes ‘patchy' and not oriented to a long term interest and far from satisfying because of 'elitist' and less participatory. Thus, the changes to the constitution should not be carried out by one institution only which in this case is the MPR. Therefore, it is important to involve the Constitutional Court in order to create a participatory change in the 1945 Constitution of the Republic of Indonesia. This study aims to find out about the urgency of involving the Constitutional Court in the amendment of the 1945 Constitution of the Republic of Indonesia, and how prospective the Constitutional Court to involve in the amendment to the 1945 Constitution of the Republic of Indonesia. This study uses a type of normative research and several approaches, namely; law approach (statue approach), comparative approach, and conceptual approach. The results of this study indicate that the urgency of involving the Constitutional Court in amending the Constitution is based on several things, including: First, the weaknesses in the first amendment to the fourth amendment; Second, the existence of the MPR as a political institution; third, the implementation of the Checks and Balance System principle; Fourth, the realization of the Constitutional Court as the Guardian of Constitution. The prospective involvement of the Constitutional Court in the amendment to the 1945 Constitution of the Republic of Indonesia is to emphasize the political goodwill of the MPR to develop a mechanism for amending the 1945 Constitution of the Republic of Indonesia by involving the Constitutional Court as a state institution which provides a review of changes made by the constitution before obtaining approval from the MPR to be determined as a result of the amendment to the new 1945 Constitution. The result of the constitutional change mechanism by involving the Constitutional Court was intended to produce constitutional changes that have the character the people of the constitution.

Investigators from the Ministry of Environment and Forestry (Kementerian Lingkungan Hidup dan Kehutanan/ KLHK) are not authorized to investigate the crime of money laundering in the elucidation of Article 74 of Law No. 8 of 2010, although they are authorized to investigate the crime of origin. However, the controversy over the interpretation of Article 74 of the Money Laundering Law was resolved by the Decision of the Constitutional Court Number 15/PUU-XIX/2021, which expands the meaning of 'predicate criminal investigator' in the provisions of Article 74 of the Money Laundering Law to become 'an official or agency authorized by legislation to carry out an investigation.' This paper attempts to describe the dynamics of the authority of KLHK investigators in investigating money laundering offences before and after the pronouncement of the Constitutional Court Decision Number 15/PUU-XIX/2021, including the matter of legal harmonization in the Money Laundering Law relating to the authority to investigate money laundering. This research is normative research with a conceptual approach, a statute approach, and a historical approach. Through this paper, this research can convey that before the Constitutional Court's Decision Number 15/PUU-XIX/2021, KLHK investigators were not authorized to investigate the crime of money laundering, and several legal disharmonies arose regarding the regulation of the authority to investigate money laundering. Meanwhile, after the Decision of the Constitutional Court Number 15/PUU-XIX/2021, all investigators authorized to investigate predicate crimes of money laundering offences, among other things, investigators of the Ministry of Environment and Forestry, are ex officio authorized to investigate money laundering offences. Furthermore, KLHK investigators are authorized to investigate money laundering offences against environmental and forestry crimes whose tempus delicti is before the pronouncement of the Constitutional Court Decision Number 15/PUU-XIX/2021.

Advocate is a free and independent profession. According to the Constitutional Court Decision number 112/PUU–XII/2014 & 36/PUU–XIII/2015. It is interesting that the decision has decided the issue of oath in Article 4 Paragraph (1) Advocate Law, but affects Article 28 Paragraph (1) concerning Advocates Organization. This research is a normative research that uses conceptual approach and legislative approach, which hopefully can dig up and find out the position of Advo- cates Organizations after the Constitutional Court Decision number 112/PUU–XII/2014 & 36/PUU– XIII/2015. It is known from the research that the Constitutional Court is unauthorized to decide which organization is legitimate, although Advocates Organization can also be named as state institution.

The purpose of this research is to determine the constitutional complaint mechanism based on comparisons in other countries, practices, and adaptation of constitutional complaints under the authority of the Constitutional Court of the Republic of Indonesia. Many cases with constitutional complaint substance have been submitted to the Constitutional Court of the Republic of Indonesia even though they don’t have this authority. This research uses a normative legal research method using a statutory approach, a conceptual approach, a comparative approach, and a case approach. This research indicates that the constitutional complaint mechanism in Germany, South Korea, and South Africa has been well implemented. In practice, cases with constitutional complaint substance are filed to the Constitutional Court of the Republic of Indonesia by changing the form by using the legal means of a judicial review, such as case number 16/PUU-VI/ 2008, case number 140/PUU-XIII/2015 and case number 102/PUU-VII/2009. Due to the consideration of the structure, substance, and culture of law, adaptation of constitutional complaint within the authority of the Constitutional Court of the Republic of Indonesia needs to be carried out by amending Law Number 24 of 2003 jo. Law Number 7 of 2020 concerning the Constitutional Court.

Augustine’s Spirituality, setting in its context the figure of the postconstatinian saint, and discussing the topic of the degrees of sanctity in Saint Augustine. Later, it deals with the various spiritual phases in the writings of Saint Augustine, dividing the life of the doctor of Hippo in two moments, before and after his priestly ordination, pointing out in the second stage the role and function of the Holy Spirit as love and principle of holiness. The importance of spiritual man in the period of the anti-Pelagian struggle is also revealed. It also explains what is for Saint Augustine the spirituality of the heart.

Paper that had the title: "Juridical implications of the Constitutional Court Decision Number 011-017/PUU-I/2003 on the Legal Protection for the Rights to be Eelected." This explores two issues: 1) how the legal protection of the settings selected in the state system of Indonesia ; 2) what are juridical implications of the Constitutional Court Decision Number 011-017/PUU-I/2003 on the legal protection for the rights to be elected. To solve both problems, this paper uses normative legal research methods. Approach being used is the statute approach, case approach, and a conceptual approach. Further legal materials collected were identified and analyzed using descriptive analysis techniques. Legal protection for the right to be elected in the state system of Indonesia can be traced from the 1945 opening, the articles in the body of the 1945 Constitution, Article 27 paragraph (1), Article 28D (1) and paragraph (3) and Article 28 paragraph (3) 1945 Second Amendment, MPR Decree Number XVII/MPR/1998, Article 43 of Law Number 39 of 1999, Article 21 of the Universal Declaration of Human Rights, and Article 25 of the International Covenant  on Civil and Political Rights. Discussion of the juridical implications of the Constitutional Court Decision Number 011-017/PUU-I/2003 on the legal protection for the rights to be elected have been included: a) only on the juridical implications of representative institutions no longer marked with specified requirements as stipulated in Article 60 letter g of Law Number 12 Year 2003 in Law Number 10 Year 2008; b) juridical implications of the political field for the right to be elected is the absence of any discriminatory treatment in legislative product formed by the House of Representatives and the President as well as products of other legislation forward.

This research aims to analyze about the significance of the Constitutional Court Decision No.46/PUU-VIII/2010 the position of anak astra in Bali customary law. The research method used is a normative study by selecting the type of statue approach and the conceptual approach. Sources of legal materials that were examined in this study consisted of primary legal materials and secondary legal materials and techniques were analyzed with the description, systematic, evaluation and argumentation. Based on the perspective ( review ) Constitutional Court Decision No. 46/PUU-VIII/2010, anak astra have a civil relationship with her biological father and his family along can be proved by science and technology and / or other evidence according to the law. The juridical consequences of the Constitutional Court Decision No. 46/PUU-VIII/2010 to the norms of Bali customary law about anak astra Bali is must conform to the directions of law in the Decision of the Constitutional Court.

AbstractThis Article revisits the role and function of constitutional identity and common constitutional traditions and claims that the latter have had an increasingly stronger influence on the process of European integration—more than may appear at first sight. In addition, the relevance of common constitutional traditions has not been undermined but, on the contrary, strengthened by the emergence of fundamental rights in EU law and the subsequent conferral of binding force on the Charter of Fundamental Rights. Constitutional identity and common constitutional traditions are part of two discourses—security and fundamental rights—which are an expression of the security of the European project as an overarching frame characterizing the EU as a polity and legal system. After an overview of some of the most important rulings of the Court of Justice of the European Union, this Article concludes by emphasizing the importance of the recent conciliatory attitude recently adopted by the Court of Justice, although the more ambivalent attitude of the Italian Constitutional Court indicates how conflictual features are becoming increasingly important and can no longer be concealed as the EU reaches a more advanced stage of integration.

<p>Undang-Undang Nomor 17 Tahun 2014 tentang Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, Dan Dewan Perwakilan Rakyat Daerah (UU MD3) pasca putusan Mahkamah Konstitusi (MK) dinilai memiliki problem substantif/materil akibat materi muatannya bertentangan dengan Undang-Undang Negara Republik Indonesia Tahun 1945 (UUD NRI 1945), yang mengakibatkan kerugian konstitusional terhadap Dewan Perwakilan Daerah (DPD), meliputi dikuranginya kewenangan DPD untuk dapat mengajukan (Rancangan Undang-Undang) RUU, dikuranginya kewenangan DPD untuk membahas RUU dan dikuranginya kewenangan DPD dalam kedudukannya sebagai lembaga perwakilan daerah. Hal ini menunjukan bahwa pembentukan UU MD3 nyata-nyata tidak menghormati putusan MK yang diberi mandat UUD NRI 1945 sebagai lembaga penafsir dan penjaga konstitusi, dengan tidak menghormati, mematuhi, dan melaksanakan putusan MK ini menunjukkan ketidakpatuhan terhadap putusan lembaga negara yang telah ditunjuk konstitusi untuk mengawal kemurnian pelaksanaan konstitusi. Penelitian ini menggunakan metode normatif menggunakan pendekatan perundang-undangan ( statute approach ), pendekatan konsep ( conceptual approach ), dan pendekatan historis ( historical approach ). Ketidaktaatan penyusunan UU MD3 pada putusan MK merupakan pengingkaran UUD NRI 1945 dan perkembangan ini merupakan langkah mundur reformasi. Pembentuk Undang-Undang, dalam hal ini, Dewan Perwakilan Rakyat (DPR) dan Presiden harus segera melakukan perubahan UU Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan dengan berpijak pada rambu-rambu konstitusional Putusan MK Nomor 92/PUU-X/2012.</p><p>Law Number 17 Year 2014 on the People’s Consultative Assembly, House of Representatives, Regional Representatives Council, and the Regional House of Representatives (MD3 Law) after the decision of the Constitutional Court (MK) is considered to have a substantive problem due to the substance that is contrary to the 1945 Constitution of the Republic of Indonesia (the 1945 Constitution), which resulted in the constitutional loss of Regional Representatives Council (DPD), including the reduction of DPD authority to propose draft bills, to discuss draft bills and the reduction in its authority as the regional representative institution. This shows that the drafting of MD3 Law is obviously not respecting the decision of the Court that is mandated by the 1945 Constitution as the interpreter and guardian institution of the constitutional, by not respecting, obeying and implementing MK’s decision which indicates non-compliance with the decision of the state institution that has been designated to guard the purity of the constitution implementation of the constitution. This study uses normative method with statute approach, conceptual approach and a historical approach. The noncompliance of the drafting of MD3 Law towards the MK’s decision is a denial of MK and this development is a step back of Reformation. The legislators, in this case, the House of Representatives (DPR) and the President should immediately amend the Law Number 12 Year 2011 on the Establishment of Laws and Regulations based on the MK’s Decision No. 92/PUU-X/2012. </p>

Permasalahan dalam penelitian ini, pertama: makna Pasal 2 ayat (1) dan Pasal 3 UU No. 31 Tahun 1999 pra dan pasca dikeluarkannya Putusan Mahkamah Konstitusi No. 25/PUU-XIV/2016. Kedua, penerapan Pasal 2 ayat (1) dan Pasal 3 UU No. 31 Tahun 1999 pra Putusan Mahkamah Konstitusi No. 25/PUU-XIV/2016. Ketiga, efek dikeluarkannya putusan Mahkamah Konstitusi tersebut dalam meminimalisir kriminalisasi perbuatan pegawai negeri sipil atau pejabat publik. Penelitian ini merupakan penelitian hukum dengan pendekatan yuridis normatif. Sebagai penelitian kualitatif maka data yang dipergunakan merupakan data sekunder yang terdiri dari data hukum primer, sekunder dan tertier yang diperoleh dari studi kepustakaan. Hasil penelitian menunjukkan bahwa putusan mahkamah konstitusi tersebut telah mengubah rumusan delik dari formil menjadi materiil yang menjadikan makna pasal tersebut semakin menjauh dari makna awalnya. Pada akhirnya, keluarnya putusan mahkamah konstitusi tersebut tidak dapat memecahkan permasalahan hukum yang telah ada sebelumnya bahkan putusan tersebut berpotensi menimbulkan permasalahan baru yang dapat menghambat proses penegakan hukum dalam pemberantasan tindak pidana korupsi di Indonesia.The problems on this research are, first: the meaning of Article 2 paragraph (1) and Article 3 UU No. 31 Year 1999 before and after Constitutional Court Decision Number 25/PUU-XIV/2016. Second, the application of Article 2 paragraph (1) and Article 3 UU No. 31 Year 1999 before Constitutional Court Decision Number 25/ PUU-XIV/2016. Third, the effects of Constitutional Court Decision in minimizing criminal actions conducted by civil servants and public officials. This research is a legal research using normative legal approach. As qualitative research, this research uses secondary data consist of primary, secondary, tertiary legal data collected from literature study. The results show that the constitutional court decision has changed the formulation of the offense from formal to material which makes the meaning of the article different from its original meaning. At last, the constitutional court deciasion could not solve the existing legal problem, but contrary it potentially creates a new problem which obstructs law enforcement process in combating corruption in Indonesia.
